Hello! I'm filling out the 130 and the guides and example awesomely explain most things but - question 21 which asks the last address my husband and I lived together is a problem...we've never lived together! I visted him for about a month in the UK but it's just been visits between us, and no "living together". should I just write none?


I put the address that I was at when I spent time with my husband in Pakistan. I had no RFE's and it worked well for us!

here we are now,, interview date April 07 2010.
But what with this all..( this is part of email what we receive from NVC,, confusing part of email,,)

Reminders
* Any original documents that were requested by the NVC but were not submitted
to the NVC must be brought to the visa interview.

So far i know NVC will not send document to embassy if we did not send all requested document to NVC.
This is confusing.


* The applicant must bring his/her medical examination results to the visa interview
in an envelope sealed by the medical office.

OK this will be done next week,,

* The applicant must bring the correct size and number of photographs to the visa
interview. They must measure 2 inches by 2 inches (5 cm by 5 cm) on a white
background.

Yes we will get two picture,,,

* IF a sponsor filed an I-864 (Affidavit of Support) AND provided the NVC with
proof of an IRS Federal Income Tax Extension in lieu of a Federal Income Tax
Return, the applicant must bring the sponsor's most recent Federal Income Tax
Return to the visa interview.

Sponsor did not file tax extension, so this is ok,,we don't need to bring anything else, NVC will send our document to embassy.

* Failure to present all necessary documents to the Consular Officer will result in
the applicant's immigrant visa being refused at the initial interview.

Visa Interview Requirements
FIRST NAME - LAST NAME must bring the following to the visa interview:
* Any original documents that were requested by the NVC but were not submitted
to the NVC
* The medical examination results if not submitted to the Embassy/Consulate by
the physician
* The correct size and number of photographs
* Valid passport for all traveling applicants
The following table lists the documents requested by the NVC and whether or not the
NVC received them. Please note that even though the applicant may have provided
the NVC with a copy of a document, the applicant is still required to bring the
original document to the visa interview.


We send original document to NVC, did this mean we need to get all that document again and bring it to interview?

This is for IR1 visa.



Hopefully you kept copies of everything you sent to the NVC in triplicate. Make sure your beneficiary has a copy of every single bit of paper sent to the NVC.

With the NVC you sent copies of your birth certificate...they will want the originals potentially in the interview. Anything that you sent that was a copy of an original (such as the BC. police certificate, etc.) make sure your beneficiary has the originals in hand before the interview. Depending on the country, if the police certificate is older than six months you may be required to obtain a new one for the interview.

Keep two copies for yourself in case there is any sort of emergency AND make sure you send your package DHS, FED EX or USPS in trackable form and request a signature for the package.

We sent them, basically letters from friends stating they know our marriage is real. The guides tell you what need to be in them.



Please can you tell me of any other documentation I may need to go ahead and send with the I-130 to prove we have a ligimitate relationship and and our marriage is real..... I hear that sometime we need to submit emails and things prior to the marriage and so forth might help.....Not sure what to do.......I have pictures of our wedding and my trip there also should I submit those?

I am getting ready to file the I-130 for my husband who is in Ghana........ and a G-325A.... for me and my husband. I believe that is what was instructed.... the question is...I have a marriage certificate from Ghana to send as evidence but they also require other evidence can anyone tell me what you may have sent as evidence for your paper work.... I have pictures.....but the instructions says something about affidavids.....Did anyone have to send those?.....

Need all the information I can get on the process from here unitl the end......

Hi I'm Rae and I'm new here as of today.

My husband is in Ghana........and we are getting ready to start all our paper work ......My biggest fear is the I 864. I'm disabled and only receive SSI income......My Dad lives with me and has pension and Social Security. Does anyone know how that will affect our chances of bringing my husband to the States......

And If I don't use my Dad's income can I use another family member who does not live with me as a sponsor to get my husband to the states.

Looks like interview dates have been suspended until they can clear the backlog in U.S. Embassy in Ghana I'm hearing it will take a year just to get an interview date which I pray is not true. Cause I haven't made it that far along myself yet.....and don't want to have to wait so long. There is no legal action that can be taken as far as we know of here at least I haven't heard of anything people are writing letters to officials and senators and all and it has been recognized but still no changes have been made. I have a friend who has been waiting since December 2009 for an interview date for her husband and still hasn't recieved one..... So there are many people waiting and no new so far has come through. All I can tell you is hang in there like the rest of us. and Keep praying.........

If you case as actually been sent to the U.S. Embassy you can email them and I believe you can email NVC but what the response will be I have no idea really. I hope I have helped as much as I can.......

But will be happy to answer any questions or any concerns and keep communications open.

The I-130 petition was received in their office on 12/13/07. They are presently processing petitions in this category dated 7/30/07.



The office also advised that in order for any petition to be expedited the beneficiary must have a severe medical condition that has to be treated in the U.S. The illness of the beneficiary must be documented with certified letters from doctors and hospitals. Than upon review by the USCIS, a determination would be made.



If you do not hear any response as to the status of your wife’s current petition within 90 business days contact our office.

HAHA not 3 months, 3 months worth of business days, what a ###### spit in the face.


It is totally crazy! All we want is some really good information about our cases and not the run around!

Hi,

It's very difficult to get track of every procedure they take, I believe your process is now at USCIS and as soon as you get NOA 2 which is the approval of your I130, your process will be sent to NVC. Are you applying for K1, K3 or CR1 visa? Mine is CR1, so we submited I130 and don't need to submit I129, so after approval of our petition on I130 our process was sent to NVC and my husband use to call them to get a status. I send an email every week to get a status from them and they usually take 5 working days to reply, but it's ok. If you search for timelines similar to yours in here, you may understand the step by step for your case.
I'm not awared about military records but I believe you will get everything you need from the links below. I've also sent you a flowchart with the step by step for CR1 visas, if that is your kind of visa so that you'll be able to know where you are in the process.

Thanks so much... we are fairly new here (it took us forever to get our paperwork together for the I-130... we are so busy, and frankly, the whole process is overwhelming- I don't see how there are so many immigrants here if it takes all this!)

We are trying to stay on top of things so when the next step is ready to be taken we will have what we need.

I was under the same impression after reading many posts concerning this subject .... however, I've actually checked out the next set of paperwork for the NVC section and that's when your flights are taken into consideration ..... you have to list every flight you've every made to the US on one the forms ..... I'm actually having a nightmare with it as I've been travelling there for 30 years!!! wacko.gif

Plus, there is no where on any of the forms for you to list 'refused entry at POE' ..... it only tells you to list flight dates for where you have actually entered the U.S. .... and which visa you came in on.

But, at least it shows that up until the NVC stage, you're quite safe as far as FBI checks and flights are concerned ..... too much scaremongering going on, and not enough factual evidence.
My goodness how this process has us all wetting our pants for the slightest thing at times eb0dfafc.gif





Can anyone direct me to where I can get this information of what you will have to list on subsequent paperwork? Listing all flights to US? Geez... that might be tough getting that info together... maybe all our old credit card statements... or stamps on his passport?


It's on the DS-230 part1 form ..... question 25. "List dates of all previous visits or residence in the United States (if never, write never) Give type of visa status, if known ....."
They give you 3 spaces for your visits wacko.gif ..... it's a nightmare if you've been travelling there for many years.

Can anyone tell me when they would suggest that we go to get police records and military records? I have read that they are only good for so long, so I don't want to get them too early, but some will be in France and some in Canada. I'm thinking the Canadian records will be quicker to get, but I'm not sure about France... does anyone have any recommendations?

Since you have received your NOA-1, you already have a receipt number. So you can USCIS Online Change of Address feature from USCIS's website. Go here: https://egov.uscis.g...i/go?action=coa

Read the Introduction section and you will see what information you need to do this change of address online. You can file AR-11 if you don't want to change address online. However, I would do it online because we all know how efficient they are dealing with papers.

I know this must be so upsetting, but please try to stay as positive as possible, after all there is no cancer now so far, right? I'm not sure what a "cancer marker" is, but it sounds like its just questionable, right?

That being said, I will say that I do have my husband on my medical insurance at work right now even though he is not living here now... I thought it would make sense since he does spend time here visiting until he gets his green card, and he doesn't have dental insurance in Canada so we are getting some work done for him now. There was nothing on any forms about pre-existing conditions that I filled out for him. Basically, he is my husband so he is going to be covered... Plus, you don't have cancer now if I'm understanding correctly (hopefully) and so it's not a pre-existing condition anyway I would think.

I wish you the best... In my opinion, I would get your husband to cover you in the US since it will give you more options.

My husband is coming for visits (otherwise I would go nuts- he is a free lancer and I have a straight job with limited vacation) so it will effect him, I'm sure. I just hope they don't turn him away since we are in the NOA1 stage!

If I'm understanding correctly, the visa waiver is going away? Non citizens of countries formerly requiring a visa waiver will now have to register biological information 3 days before travel to the US, but then they won't have to register again for two years when they travel.

What do you guys think about this? Have you heard about it? Looks like August it will be required!
