IR-1 / CR-1 Spouse Visa Process & ProceduresIR-1 VISA APPROVED!

Hello VJ friends!

I want to stop by to announce that my visa has been approved this morning! If you recall from my previous post, my first interview was on December 23rd, 2010. While it went very well as posted previously, I didn't have tax transcripts for 2008-2009 and I was asked to return with those documents on January 12, 2011. I went this morning and nothing was asked again. I just submitted the tax transcripts and the consular officer lifted the approval stamp and stamped "APPROVED" on my documents and handed me a blue visa collection slip to pick up visa on January 21. Praise God!

In all, it was not as stressful as I read on several forums and both consular officers were very nice and professional! I can't wait before I meet with my 23 months son and wife and it's going to be wonderful as well as fantastic! I'm going to get ticket this afternoon!

Thank you all once again for your wonderful contributions to this forum! I pray that y'all have smooth interviews and be approved without any stress! God bless us all!

Congrats....I know you are so excited and I'm so happy for you and getting to meet your child for the first time is going to be so awesome....Enjoy and again congrats...

My opinion is they telling you that the K-1 expired and you said you were denied so you can't file to reopen your K-1 cause it has expired but you don't qualify for k-1 any more since you are now married... you have to file cr-1 but it would be good to know why your K-1 was denied so you can make sure you won't have the same problem during this process of a cr-1....

IR-1 / CR-1 Spouse Visa Process & ProceduresAny New Spousal Interviews in Ghana?

Has anyone heard of any new CR1 interviews in Ghana beyond the few listed on VJ for March? Just trying to keep up with the progress and like knowing that the line is moving even if it is moving slowly. I know vj only represents a small percentage of people going through the visa process - but, please, please, please - anyone going through the process in Ghana create and keep your time-line up to date. Information provided on his website has helped out so many people going through the visa process - the least we can all do is to create and keep our time-line up to date. Based on vj time-lines looks like we are still behind by a year waiting for our cr1 interviews. The last interviews listed seem to be filers whose process called at the NVC around January, 2010.

Happy Valentine's Day to everyone. (F)

I know there are others you haven't updated or have a timeline who recently had interview and or have an upcoming one this month... I really wish everyone would do the time line and keep the rest of us updated as well.. Hope people pay attention to this post and start letting us know... I'm in this waiting line with you.... and a year from now seems ridiculous to wait.... but I guess that is all we can do....

Happy Valentine's Day to Everyone also.... I know you all are missing your loved one as much as I am mine.....

K-1 Fiance(e) Visa Process & ProceduresRussian Police Certificate for non Russian Citizens
Okay, everything has gone pretty much according to plan up until now. But now we've run into a snag.
We finally have our interview date for March 21 but we are missing one important document. That document is the police certificate that is required if you have lived any where else for 6 months or more. Alma lived in Moscow while attending the University from 1987-1992 when Kazakhstan was part of the USSR.
My fiancee applied for the police certificate from the Russian Consulate in Almaty Kazakhstan in October. On December 2 she was called back to pay a fee and the consulate, as I understand it, forwards the request for the police certificate from the proper authorities, Ministry of Foreign Affairs and Ministry of Interior (MVD) in Moscow. Not sure if I've got the Ministries correct???
It's been almost 4 months now and still no Police certificate. Alma has been to the consulate several times to check on the status of the certificate but they can't seem to tell her any thing and treat her with indifference  . We've tried everything that we can think of and it's getting us absolutely nowhere. It's so frustrating! No one seems to have any answers or seems to even care. I've tried the US consulate even but they can't do anything either.
We are exploring the option of sending her to Moscow. That's going to cost alot of money and then there is no guarantee she can get the police certificate. I can scrap together the money if need be but I thought I would see if anyone here on VJ has had any experience with this type of situation.
Any Advise out there? Should we wait longer for the Police Certificate and take the chance of receiving a 221g or should we go to Moscow now? Any other ideas?

K-1 Fiance(e) Visa Process & ProceduresI-134, Affidavit of Support

It depends on the consulate. I e-mailed the consulate in Rio and they spelled out everything very clearly that I need with the Aff. of Supp.

Good Luck,

andy

That was an excellent idea. I called the Consulate and they told me exactly what I needed. They were very friendly and I was not placed on hold, I was directed right to the person with the answers. FYI I only needed IRS transcript or certified copy of most recent tax return with W-2 and letter from employer.
No bank information is needed. And yes it looks like every consulate has their own requirements so I would advise anyone that is not sure to email or call the consulate for answers.
Thanks everyone for their input.

K-1 Fiance(e) Visa Process & ProceduresI-134, Affidavit of Support

I would highly recommend getting everything they ask for, only because they could ask for it at your interview and if you dont have it can cause a delay in your case. Presenting too much is better than too little, whatever they dont want, they will just give back to you.

Thanks for your advice. From what everyone has said I think I will play it safe and send everything.

K-1 Fiance(e) Visa Process & ProceduresI-134, Affidavit of Support
Hello I'm a bit confused and want to make sure I don't cause any delays in our K1 by not following instructions properly. I could use some friendly advise.

In the K1 instructions received from the consulate they ask for evidence of financial support by submitting an I-134. After that they ask you for a certified copy of your federal tax returns.

In the instructions for the I-134 it states "Evidence should consist of any or all of the following documentation listed below that are applicable to your situation." It then goes on to mention that I need written statements from my bank and employer.

Is all of that necessary if I'm already giving them a copy or transcript of my tax return?

first of all you're not dumb, it's taking some getting used to the new changes here on VJ. to change your timeline first click on "Immigration Timelines" at the top of the page then click on "Edit / Add my Entry" under the Timeline Function heading.

[size=4] Finally! NOA2 RECEIVED and APPROVED!!! :D I received an email notification today that we were approved yesterday on January 31.

It's been kind of stressful waiting and waiting  . please update your timelines, mine and I'm sure others are getting estimated dates that are really way off.
i.e.
"Based on timeline data, your I129f may be adjudicated as early as February 25, 2006*.
If this date has passed by more than 10 days or your application is past due per USCIS processing times then you should consider calling the USCIS to inquire on your petition. If you have been approved please update your timeline."

K-1 Fiance(e) Visa Process & ProceduresRussian Police Cerificate for non Russian citizen
Hello, has anyone out there ever heard of HOROS http://www.horos.ru/ ? Alma has had a lot of difficulty obtaining this police certificate from the MVD in Moscow through the Russian consulate in Kazakhstan.
This company HOROS said they could get us the police certificate in a week if we pay $350.00. To me the price would be worth it if they are legitimate. Does anyone know of them or has used their services before?

Thanks again! Whew! Lots of information... I'll show my sweetie when he gets here... should come for a visit on Thursday...

One more question.... Is the amount of time he can spend here limited? I read something about 90 days maximum.... is that true? within a calendar year? Jan to Dec? I have to admit I'm pretty clueless on these rules...

Thanks so much for your replies... I'm kind of overwhelmed by the whole process! I have so many questions... I've been to the guides, and there is a lot of information, but there are specific questions I have, too... like what about him having a French passport? Will it hurt us that he has applied for the green card lottery already? What if he gets selected for the lottery? and many more! I will keep coming here and try to let everyone else's experiences sink in... just now it seems like a mountain of information!

Thanks for the tip about the Canadian forum, too... although it throws a possible wrench in the mix that he is French...

Thanks for the warm welcome... I really appreciate it!!

K-1 Fiance(e) Visa Process & ProceduresBrand new to the forum and clueless...
Hello everyone,

I met my fiancee almost a year ago in Canada. He is french but has been living in Canada for the last 17 years. He has been to the states to see me several times and I have gone to Canada to see him and also some vacations abroad. Now... it's serious! LOL We want to get married and for him to live here.... one problem, his job... he is self-employed as an interpreter/translator and the state in which we would live doesn't have much call for french interpreters... The dream is for us to live here, and for him to travel for interpretation gigs and for him to do translations online... We'd like to keep an apartment in Canada... so we would be living in the US but spending some time in Canada as well. Is this possible?

Also, I am understanding that once he comes to the US and we marry, that he will be unable to return to Canada until he is approved for the next step (can't remember the name of it, but I'm sure you know what I'm talking about).

Just to throw another curve, he applied for the green card lottery... we knew we wanted to be together, but now we're sure that we want to get married, we don't want to be apart any longer.

I'm wondering if it would be best to get a lawyer... we don't have a ton of money to throw around, but this process seems to be difficult to me. We don't want to screw it up for sure.

Thanks for any help you can offer!

IR-1 / CR-1 Spouse Visa Process & Proceduresmarrying family members for green card

I am in a mix of emotions. Last August my boyfriend (perm resident) went down to the country where he's from in the caribbean. His mother and sister live there. His aunt that lives in America sent him down there to marry his own sister (she used a dead person's birth certificate so her name was different) so she can get a green card because she dumped her kids on another family member in America (through adoption I'm sure) and she wants to see them. I understand, but I think it's a really immoral thing that the whole family condones the marriage between sister and brother just for a green card. My boyfriend says he knows a lot of people that did fake marriages and it's no big deal and he wants to help his family. I understand his concern but I don't like the idea of it, and I am afraid something bad might happen. Every day I'm really angry about it, but emotions aside and logistically speaking is there a chance of being caught? I'm not familiar with the process at all, but I have no good feelings about this situation, and I want to know what the risks are. I tried talking him out of it, but he keeps saying it's no big deal. He has nothing that proves their marriage is legit, no shared accounts/lands, he just wired over $100 to her name that's it. I really don't know for sure if he started filling out any immigration paperwork. I'm worried sick over this and I'm not sure if this is no big deal like he says or if there are major roadblocks or possible criminal charges that can happen? PLUS him and I live together and I cosigned a carnote and also have a joint checking account together, will they research that and find out?

Another thought for you if this is real. If you helped him at all, even in the slightest, way then you are an accomplice to fraud. Even having the knowledge and choosing to remain silent may have implications for you. I am amazed if this is real you would need to come here and ask what is right.

IT REALLY WRONG IF WE MARRY WHEN IM NEXT THERE IN AUG AND THEN GO DOWN THE SPOUSAL VISA ROUTE ?If you mean come to the US, get married then return to the UK to await a spousal visa, then no - it's not wrong - happens every day.

I WANT TO LIVE IN US NOT STEVE HERE ......?? WE WERE GONNA APPLY FOR FIANCEE VISA AND WAIT BUT WOULD RATHER BE MAN AND WIFE?? WILL IT GO AGAINST US THAT WE WILL HAVE TO LIVE SEPERATLEY?? Not at all - most of un on VJ either have or are living seperately (some exceptions of course).

AM I ALLOWED TO COME HOME GET MY STUFF AND DAUGHTER AND MOVE BACK TO US AWAITING SPOUSAL APPROVAL??? Not certain what you're meaning is - but I think the answer is going to be No.

You're not alone any more - virtually all of us are/have-been in your position.

Well what they told her was that she was lying to them. They asked her why she was in California in '05. She has never been to the west coast. I have a friend that works for ICE. He looked up travel documentation for her no where did it say that she had ever traveled to Cali.. They wanted to know why she would fly into Cali. and she said she had never been there that her aunt lived in Cali when she died, but the only one that went there was her mom for the funeral. Then they said she was lying about her aunt dying, the immigration officer even said that he had talked to someone in Guatemala and that her friend had just saw that aunt at the market. They canceled it in Houston, the problem is that the reason they gave for the cancellation and the code do not match, I am confused, she is confused and neither of us no what to do.

Lusby, the first thing that came up on my mind now is why don't you call the congressman of your state and talk to him/her, explain situation, and seek for help unsure.gif This is ridiculous how they play with people's lives mad.gif
I'll try to find the link about similar situations in past, and I'll post it here. Wish you both all the best now heart.gif

Before contacting your congressman, get an immigration lawyer to help you sort this out. A public forum is not likely to be able to give you the legal advice necessary to navigate the 5 years ban.

I see no problem here getting both involved. There seems to be some confusion about the code and explanation not matching. Congressional assitance might help. Working around the ban is more of a problem, especially if you were involved with the situation then.

I think that if the instructions say to send the original, you need to do that or risk a delay when the correct document is requested. I will defer to any one who has tried it though.
