our petition was approved aug 20 and i got the notice a few days later but i cant figure out where our stuff is now. its been over a month now, and nvc has not received it, uscis said to call the embassy, and ive tried 2 embassies (because our notice didnt tell which one its going to) and evidently chennai doesnt do k-1 visas anymore, and i cant get ahold of anyone at the delhi office. can someone please clarify what really is happening right now?! does it really take weeks for a packet of paper to travel from one side of the states to the other? am i overreacting that there is no communication as to where my stuff is right now? is it possible that its been lost?

Unfortunately, when cases are in administrative processing there is nothing that can be done to waive or expedite the process and they are unable to give us a timeline of when it will be completed. If you do not hear anything from NVC within the next 4-6 weeks, please feel free to let me know and I will follow up with them. If you have any questions, please do not hesitate to contact me.

i feel you. ive been waiting since august too for our stuff to reach the nvc. im baffled at how it could take so long and frustrated that theres not a thing to do but wait wait wait. i hope it happens next week for you!

congrats! the first part is done!

 

if you dont receive anything wiithin a couple weeks from nvc, id call them just to check. it took 7 weeks for us to get the letter that said it was moving on to the embassy. they wont do anything until 8 weeks has passed, so hopefully they aren't as behind as they were a month ago. the number is (603) 334-0700 between 7-12am eastern time.

 

once you get your new case number, you can check the status here https://ceac.state.g...er/Status.aspx? 

 

they just changed the visa paperwork requirements, making it so much simpler. the new packet instructions are here http://photos.state....kt 4 Oct 13.pdf  

you will need to fill out ds-160 online and then bring it with you to the appointment. 

 

get everything you need for your i134 asap and mail it or email it to your fiance. there are various instructions online, i just sent one of everything. the i134 instructions are here http://www.uscis.gov.../i-134instr.pdf

 

make sure you are getting a pcc from a regional passport office, not a police office. this has caused many people problems in getting their visas right away. this website is here http://passportindia...ect/welcomeLink

register, upload application, pay and then you can walk in to the office when you are ready. 

 

medical has to be done at least a week before your interview, so be prepared to get that done once you find out.

 

i hope this all helps! they sure dont make it very easy to understand everything, looking at loads of different websites to get all the information you need. good luck on getting an interview quickly!

our petition was approved late august but it took 7 weeks for the nvc to process it. they will send you a letter stating that they will mail your case to the embassy within a week and itll have your new case number. ours took 3 days to make it to the embassy. (someone a while ago posted a way to track your file using dhl website, which is why i know when it got there, but i dont remember the details now...) 

 

that was the most frustrating 7 weeks as they dont tell you a dang thing and theres nothing you can do! hopefully they arent as behind as they were then and you wont have to wait as long as we did. try to be as patient as possible!

Hi  Erinmuskan88 congratulations to you and your fiancé and best wishes for your future. I read few of your post and find them very helpful and again need some information/help from you my fiancé also going to attend interview at New Delhi embassy I wanted to know :

 

1. You received your package # 3 and 4 via mail/post or they sent you via email

 

2. how long it took from getting case number from NVC to receiving you interview package

 

3. Did you schedule your interview or you were assigned date and time already when you received your package??

 

4.How long it took you to get your PCC from passport seva kender

 

5. if it was difficult to get appointment for your medical exam ??

 

6.do you know if they allow your fiancé with you at interview at New Delhi embassy or not  ?? as I want to be there with my fiancé on the time of interview so need to make travel plans and prepare all needed documents also

 

7.what exact form needs to be filled out.. for interview.

 

will wait for your answer anxiously our case status as of 13th Nov. approved case info mailed to NVC

1. both. we had emailed the embassy with a question and they told us to wait a week and then ask again. we got the confirmation letter in email and then packet 4 2 or 3 days later via mail. there is no packet 3.

2. i think it was about 1-2 weeks. we emailed the embassy because they just changed things and wanted clarification on the new process, told us to email back the next week, and then by the end of the week my fiance had the hard copy of the letter and packet. once nvc gives a case number, it only takes days to get to india, but the embassy isnt immediate to process your case either. i think that is why they said to wait a few more days.

3. when you get your packet, it gives step by step instructions on what to do. scheduling your interview is the last step, but YOU get to choose the dates. you actually have 2 appointments to set up, ofc to take fingerprints and picture (which there are plenty of spots and you will probably be able to go in next day), and then interview (which we had to wait only 2 weeks). 

4. pcc is confusing. register online, pay, and once the payment clears you can just walk in to the office and pick it up. i think it took my fiance only 2 days.

5. not at all. my fiance called ahead of time and got an appointment for later that week. BUT you can not get your medical done until you have the confirmation letter from embassy stating your case is ready to more forward. as soon as you get that letter, get it done cause itll take a full week to get the results.

6. as far as i know, you can attend the interview with your fiance still. and it looks better when you do cause they can see your interaction together. 

7. the only forms needed now are the ds-160 which is done online, and the i-134. 

 

heres a copy of the letter we got;

if i remember correctly, i think you can start the application without having a case number and fill in the blanks later. you will not be able to schedule your interviews until youve paid the visa fee.

As for  i-134, my fiance is a full time student and will graduate from college this December. Her mom will co-sponsor. Does she and her mom need to fill out separate i-134 ? Seems complicated.

 

yes i-134 is complicated!

 

if she does not meet the poverty guidelines, she must have a co-sponser who does or they will automatically deny your case. they both must fill out a form and have supporting documents to show the money is there to support you. i looked several places to find out what the supporting documents should be and am pretty sure i provided more than actually required. i sent the previous years tax return, 3 months of bank statements, birth certificate (to prove citizenship), my co-sponsers letter from work explaining she does make enough, and a letter from me explaining why i dont have a job/make any money right now. i didnt want any doubts! and like i said earlier (i think) make sure they send you there original signed copies of the form through the post. :)

my helpful hints are these:

-make sure the pcc is from the regional passport office. you can register online, fill the form, pay and then just walk in when your ready to pick it up.

-as soon as you get the confirmation letter or email from the embassy that they are ready to work on your case, get your medical appointment done. it takes a week to get the results and you cant have your interview without it.

-get all your i-134 documents together and mailed asap. remember that the signed form needs to be an original, not a copy so you have to mail it. it takes time for snail mail, so i would try to get this done first.

-check, double check, triple check that you have everything you need to bring to the interview!

 

once the embassy receives your case, it goes relatively fast from there. we got our interview just 2 weeks after they got it. good luck!

I just got my nofa2 on august 20th and I know that I will need to send my alien fiance the affidavit of support in the coming weeks/months but I am concerned because I am pregnant and had to leave my job for health reasons. I currently have no income, but Ive heard I can use a co-sponser. Is this true? Or will our visa be automatically denied because I have no income? 

 

And on another note, how long is average for this phase of the process? I am due in late November and though we tried to expedite the process, they denied it. Is there still a possibility that my fiance can be stateside for his sons birth?

so my fiance had his interview last tuesday and the lady said he was approved, took his passport and told him he'd get contacted when its ready. that day on ceac the case was updated but the status did not change from 'ready'. it still hasnt changed and so my fiance called today to see what was going on. they said to email support with a copy of both confirmation emails because there wasn't anything in their database that he even showed he had an interview. we did that and their reply back was

 

'With regards to your query, a case with the case number "__________" has already been escalated and is still in the process of being reviewed. We will contact you as soon as we receive a response. Alternatively, you may contact us again at a later date.'

 

am i overreacting to think that something weird is up and that we wont get his passport back very soon?

yes i would send everything you have just to be on the safe side. i needed a co-sponser for my fiance because i had to leave my job this year for health reasons, and last year i was travelling abroad so my w-2 showed hardly any money made, but they didnt red flag us. as long as you have proof that you or your co-sponser makes above the poverty line, you will be fine.

 

i sent the w-2 and everything i had because i wanted to be safe rather than sorry. i over did it because i wanted to make sure we didnt get a 221g...and we didnt. over the top, maybe but worth it in my eyes!

just to be on the safe side, write a letter explaining the situation and yes, i would also provide the w-2. i sent that all to my fiance and we had no issues. 

 

as for the co-sponser, as long as your current job shows that you make more than the poverty line, you do not need one. but i would also say that if it makes you more comfortable, go ahead and send your parents info. its always better to have more, than not enough.

 

lastly, dont forget to send a copy of your birth certificate with your i-134, to prove your citizenship.

maybe do 50 pages of Skype from different times. Letters, copies of emails, wedding pictures, family pictures. etc.. Fiance did say that a girl was denied because they wanted prof that they could communicate. They told her to come back with Skype logs! Our Skype log was 4 pages long with about 100 conversations. We did get approved!

 

Questions they ask come from forms you have turned in. Anything other than that, and they are shooting in the dark. The questions they asked about if I owned my home and where did I work, and my daughters name  came from I-134.

My wife has her interview September 3 in Kiev and we are trying to get everything together for it now.

She completed her medical examination Thursday!

 

What documents should she take to the interview?

Aside from the documents required, we know she should take some pictures, letters, Skype log, call logs, etc.

Our Skype log is 1300 pages long. Of course we can make the font smaller but it's still really long. Any suggestions?

Is there anything else we should take?

 

What questions might they ask her? Does anyone who has recently (or not so recently) completed their interview remember specific questions they were asked? It would be really useful for us to know the types of questions. Also, we've heard that they can ask her about my family member names. Has this happened in anyone's interview?

She is Ukrainian.

We have been married since November 24, 2012.

I lived in Ukraine from Sep 2010-June 2013 (our relationship started in April 2011).

1. Some people have told me that K3 visas don't exist anymore. Is this true?

2. My wife and I got married last year, here in Ukraine, and are now working on applying for her visa. Which visa should we apply for?

3. We no longer need to submit her documents with the visa packet, right?

4. We don't have much proof of a bonafide marriage, though we have pictures traveling with our parents together, pictures from our wedding, as well as documents from our apartment. Should we submit all of these things? Do pictures mean anything? If so, how many do we send? (just a few I'd assume)

Yes, the choice of agent and address is the DS-3032. Did you put your NVC case number? It can take them a week or more to read and answer your e-mail.

When the NVC first contacted us, the emailed me (the petitioner/sponsor), and according to the immigrant visa processing checklist I established communication and declared an agent (myself). I wrote them with my name and email saying that I would be the agent for my wife. I wrote our names, birth dates, and case number as required.

 

I just got off the phone with NVC (18 minutes on hold) to ask if they had received our payment for AOS. They had! But she told me that before making the payment for the visa application I have to have submitted the DS-3032 form (choice of address and agent) in order for them to send me a bill.

 

Is the establishing of an agent which I did via email before doing the AOS (payment and forms) essentially the DS-3032 or do I need to do that as well?

 

I think what happened is that they just haven't checked the email I sent them on April 23 and once they check it they will email me that bill.

 

Any thoughts are appreciated.

The NVC does want to see her international passport right?

To add detail, I met my wife as a Peace Corps volunteer and so my income from 2012 was not enough to support her (though I have a sufficient salary now). My parents helped fill out the i-864A. The first time I had my dad and mom separately and added their incomes together (2 i-864As). On the phone the NVC told me that I should only file an i-864A for my dad and just put their income combined because they filed taxes jointly. Apparently that wasn't right either.

We submitted our first AOS in May.

They said there were some problems with it and I refiled it in June (following the instructions that I was given by the NVC on the phone).

They said there were some problems with it again (at the very end of July) but they would go ahead and put our case through, we would just have to take the forms to the interview.

I was working with a lawyer (in the last 2 weeks) who said a lot of times they don't approve the i-864 AOS even though there is nothing wrong with them. Today, he has dropped my case because they aren't allow to take on cases unless they are at the beginning. Terrible surprise for my peace of mind.

 

My wife's interview is September 3, she is Ukrainian and I'm back in America so I need to finish the i-864 forms here, sign them, and send them as soon as possible (hopefully tomorrow) so they get there on time.

 

Has this ever happened to someone? I am just worried that the lawyer's advice about the forms being okay but not approved won't hold up at the embassy.

 

Any advice or examples would be great.
