I don't have any idea what the additional delay could be either, but it would be a good idea for you to write an e-mail to the Embassy in Moscow. In my experience they have always been prompt at responding (usually within two business days.) Also do you have the tracking number from the DHL prepaid envelope that she had to give them at the interview? It's good to check that online to see if the shipment (with visa) has left the Embassy.

Translate the one you have if it's not in English and send it. To the government if you are married once in the world that's it you are married and a foreign marriage certificate is as good as one that was issued here.

 

The certificate we have is translated to English, and we used it for Direct Consular Filing at a U.S. Embassy overseas. What I understand is this will suffice and we do not need to get it notarized/certified/attested.

We will file N400 in November under the 3-year rule as I am married to a USC.

 

One of the documents needed is our "current marriage certificate". We have a non-US marriage certificate that was translated overseas and used for direct consular filing. We don't have a US marriage certificate.

 

I'm not sure what we need to do at this stage. Do we need to notarize/certify/attest our existing certificate? Do we need to get a US certificate? I did a search and couldn't find an exact answer to our question.

Does submitting as soon as eligible (90 days before anniversary) mean that some people get approved 1-2 months after the anniversary date?

Hi everyone,

 

I'm a permanent resident and I got my GC through marriage to a USC. I removed conditions earlier this year. My 3rd anniversary is February 2014, so I am eligible to send my N400 in November.

 

However, my wife & I have to travel for 3 weeks in July 2014, which is 7+ months after I submit N400 and 4+ months after my 3rd anniversary. Looking at the timelines I should be able to do my interview & oath ceremony before July, but nobody knows what happens. There's still a chance that I get the interview letter during my absence, and usually the interview is 3-4 weeks after receiving the letter, but if it's any shorter duration then there's a chance that I would miss the interview date. We do not have anyone we trust to pick my mail and check for a USCIS letter.

 

The other option would be to submit N400 in August 2014 but I'd rather not postpone the whole process 9 months!

 

What do you all think? Thanks!

I've spent so much outside the U.S. since obtaining my GC. I did my calc and it apparently I have not accumulated 18 months of presence in the U.S. since obtaining my GC. So I have to move to my next option, which is also related to Question #3.

 Your travel reporting requirement is since you got your green card or 5 years which ever is less.   So if you aplly because of the 3 year rule it is   since you got GC to date of filing.  If you have had green card for 20 years it is the last 5 that count . 

 

so for Question #2, if I file in November (90 days before 3 years), I have to report travel since obtaining GC (Feb 2011) till filing date (Nov 2013)?

I will file based on the 3 year eligibility (married to a USC). My anniversary is February 2014, so I should be eligible to apply in November 2013. I have 3 questions:

 

1. When I count the number of days spent outside the US (Part 7A), I believe that I should consider only the last 3 years (not 5 as it says), right?

 

2. If I apply in November 2013, should I count the number of days spent outside the US from November 2010 till November 2013 (based on submission date), or from February 2011 till February 2014 (based on anniversary date)?

 

3. I am planning to travel during next year, so I might decide to file N400 after I return from my trip, say August 2014. In this case should I count the number of days spent outside the US during the 3 years prior to my application date, i.e. from August 2011 till August 2014? Or from February 2011 till August 2014?

I am a LPR since Feb 2011 married to a USC and filing under the 3-year rule. I am planning to file in Aug 2014, i.e. after 3.5 years from becoming a LPR.

 

Q1)

I have read in an IRS source that to file based on the 3-year rule one should not spend more than 18 months outside the US. I have read in another IRS source that one should spend at least 18 months in the US. If you file exactly at 3 years, this makes sense, but in my case I'm filing after 3.5 years. Which one would apply?

 

Q2)

When counting the trips and no. of days outside the US, should I count those during the last 3 years or those during the last 3.5 years (i.e. since becoming a LPR)?

The same happened to me when I filed for removal of conditions. The letter was lost in the mail. I'm not saying yours is lost as well, but this is always a possibility.

 

I called the 800 number multiple times and was never told that my letter was lost. I scheduled an Infosys appointment and only then I was told that I did not show up to my bio appointment. A few days later I received another appointment with language stating that I missed my first appointment.

Placed In Line on 09/5/14. Received yellow letter on 09/22/14 to bring passports and traffic citations to interview. As of 10/02/14 it shows online I have been scheduled for interview-no date yet as I am still waiting on the letter.

It is easy to do an early walk in bios @ any ASC, but that does not speed up the processing of N400 applications. Especially in places like atlanta,NY,boston,Houston...
Your priority date is the kye.

I didn't realize that what I saw online after I created an account/was able to see my case number in the USCIS system referred to the initial NOA that I received on 8/15 in the mail.  I assumed that they sent me my biometrics letter on 8/26 and have been waiting for the letter since then...

So I called the USCIS today. They opened a service request and told me to wait for 15-30 days for a response :(. I don't understand how notices can get lost in the mail whereas I receive so much junk my mailbox on a daily basis...or that notices stating that you've missed your appointment get delivered, but not the actual biometrics letters! (sorry I'm ranting).

 

thebighash: how long did it take you to get a new biometrics appointment and were you able to do a walk-in for it? Also, how soon after your scheduled appointment that you didn't know about and missed did they send you a letter notifying that you didn't show up for it?

I can't remember off the top of my head but it must be at least 3 weeks after I missed my initial appointment that I received the new letter. The new appointment was like 2 weeks away and I did not do a walk in. On a side note, I don't think this issue affected my application or the time it took to get approved.

 

I'm not saying your letter got lost in the mail, but it is possible. I called like 4-5 times and none of the agents told me that my bio letter was already sent. They all said that it hasn't been long enough to start being concerned. I sent emails to no use as well. It's one of those things :( Now I hope my N400 bio letter comes within 1-2 days otherwise I'll start getting nervous again :(

Gogo.  FYI, if you go to pay the visa fee and they have a nine digit A number they are having issues with being able to process payments with a complete nine digit number.  Supposed to be fixed by Friday, but we'll see.

Gogo, in order to track via email...send email to: passportstatus@ustraveldocs.com, in the subject line and/or the message put in the passport number. You cannot have anything else but the passport number or you will not get any result. I believe that I read that it did not work for everyone so, good luck.

Speaking their websites working I called them today to get an explanation of the four conflicting pieces of information they have for us, and the guy on the phone said not to bother with any of the information you get online because they cannot ensure that it correct. I had to laugh.

So kind of frustrating over the past few days. I had called the travel docs and after inquiring they sent me an email saying that visa and passport had been delivered to the CITIC bank (yippee, right????). My wife has called the bank and they have nothing. So here is where we are at now:

- CEAC still only shows issued
- US Travel docs passport tracking shows; Passport has been received from the consular section, and is currently being processed for delivery
- Tracking the passport via email shows; origination scan

I know I am being a bit overzealous in trying to follow up on this, but why can't things be more consistent? Is it too much to ask to have them all read the same thing, and have it in plain english so we actually understand what they are talking about????? I wonder if they teach a class on vagueness and inconsistency to everyone before they start working. I was talking to a coworker of mine the other week who had immigrated here an few years back, his idea was to have everyone reapply for their citizenship at least once in their life. Let's see what everyone says about reform at that point, right????

So I have a question that I am a bit confused about.  As I see it, when you are at the point where the visa has been issued you can call one of three numbers to talk to a human being.  You can call the consulate number in one of several places in China as listed on US Travel Docs, you can call a number listed in the US from the same place, or you can call the DoS.  Can anyone say which is the better place to go?  

 

It seems that if I call a number that is listed from the Travel Docs, they are not native English speakers, which leads me to believe that they are not employees of the DoS.  I have called, but I don't think that anyone really know what they are talking about, and all I wanted to know is what the status of my wife's visa is.  At one point in time the woman I spoke with said it was printed and waiting for delivery, then the next moment she says it needs additional processing.  

 

The other thing, is that it seems like the average time to delivery once it has been listed as "Issued", is about a week.  Can anyone confirm that?

I filed my petition with a request for an IMBRA waiver (2nd K1 in two years, but for the same beneficiary.) As my timeline shows, we got the NOA2 in the same time as most CSC filers, and it has passed through the NVC quickly and smoothly.
