I just received notification from the government that between March 2010 and April 2014, I have been overpaid in retirement benefits in the amount of $35,000 dollars :girlwerewolf2xn:  which they intend to start recouping immediately beginning July 2014.  That will be a lose of income monthly in the amount of over $1,000.  Is this a reason for a request for expedite.  In addition to this the IRS also wants their cut. :girlwerewolf2xn:  What do you guys think?  Thanks in advance for your input.

WAIT it out, not much longer..,.,.,. an I-130.,.,.,.is a very, very long process, and after your "night" after the marriage.,.,you will be asking yourself..,.,.."WHAT HAVE WE DONE".,.,.,.,. now re-submit.,.,and wait 12-16 months?

Yes, but according to them when I last checked, it was still open but closed based on non-activity. They're useless. Hubby came over on the Visa Waiver Program (VWP) and we got married, plain and simple. He went back to the UK after our honeymoon and I filed the I-130 once I received our Marriage Certificate in the mail, which took a MONTH. He visited every few months after we applied, but remained residing in the UK. I'll also say that they ask if you've filed for a visa for anyone before on the I-130, and I put yes, and included the NOA2 from our I-129F since I was applying for the same person.

Also the Marriage Visa I believe is cheaper and they come over with a Green Card and permission to work where as K-1's have to pay an additional 1070 to adjust status and wait about 3-4 more months to get work permit and travel permit... and longer for GC.

I have nothing against people wanting to practice their religion but I am not particularly religious myself. 
That said, here is some thought on your situation...don't know if it can work for you guys. 
 
1. Do the official religious wedding ceremony so that you two can be fully intimate. 
2. But do not file them into government record in either countries. 
3. Continue the I-129F processing so that you are not resetting the visa clock by almost 1 year. 
4. Once you are joined in US, simply go to the local county office and get married by peace of justice.
 
If you can separate the religious ceremony with the official marriage filing with the court, 
then, you can be both emotionally and religiously proper for having sex, 
but you also keep the current K1 visa processing going.

She didnt want to have sex with his fiance before marrige
And the k1 was taking long, so they decided get marry.
They didnt cancel the k1 , they just got marry and when the appoinment for the k1 arrived she didnt go to the interview. She didnt call to cansulate either. Her appoinment latter arrived 2 months after she got marry.
She just waited her interview for spouse visa 8 months.
Then she went to her interview and was approved without problem, she is in usa now 7 years now.
So you can get marry without problem. You know that you are going to start over, but I think that can be wuicker that wait for tsc.
Tsc is taking for ever to approved and then you need to wait 3 or 4 months for interview.
There are a lot of informations about what documents you need at Junta central electoral wedsite.
I hope you can read spanish, and if you dont read spanish tell to your fiance that go to a junta central electoral and get the information or he can read on internet and tell you.

You will effectively be starting over with a CR-1 petition (the time for the K-1 will not "transfer" to the new petition). CR-1s generally take longer than K-1 VISAs. Here's a comparison chart so that you can decide what option is best for your relationship:

You can do it but you have to start over at the beginning with a spousal visa.  New petition, new waiting, new everything.  Good luck.
 
Why did you have to withdraw your first petition?

I didn't wait the required 30 days after divorce by Texas Law before I filed. By Texas law one is not legally free to remarry after divorce until after 30 days have passed. I filed 12 days after my divorce was final. We had the option to wait for a possible RFE or a dreaded disapproval, so we opted to withdraw and refile after the Texas Law 30 day requirement

We are current April Filers. Since TSC is just now processing requests from December 2013, my fiancée and I are considering the option of canceling the I-129f and proceeding with marriage and then filing the I-130.

Because of our religious beliefs and Bible trained conscious, we have not had any sexual contact since we met over a year ago. Each time I visit it gets even harder to abstain from sexual intercourse, so we decided to think about the marriage now. Please don't judge us, we just want our marriage bed undefiled by fornication.

Questions:

What are the pros and cons.

If we decide to go ahead with the marriage we have to do it in the DR, so what paperwork do I need to accomplish this?I am the Petitioner and US Citizen.

How long does it take after marriage to file for I-130? Should the waiting time be comparable to K-1 or sooner?

I agree with lecourville. I requested an expedite by calling USCIS. I told them verbally the reason and they gave me about 7 options or categories for which the request would fall under. I believe I chose category "7" which was medical. The officer told me that either I would be approved without any additional evidence needed or they would send me an email requesting further proof of my claim.

About 5 days after my request, I received an email requesting evidence to support my request. I sent in the evidence which they requested be scanned and attached to the email. After about one week,I kept calling everyday and spoke to Tier 2 officer. After about 14 days, the officer told me that my request had been approved. I received a text and email the same day verifying the approval. So yea, I think you should request the expedite by calling them, not through letter, because when you call them they give you a type of confirmation control number. With a letter, you don't even know if they received the letter or not. Good luck.

I couldn't find any info on this subject so I decided to ask it here.  If it has been addressed before, please guide me to the appropriate section.  Ok, so here is my situation.  I receive taxable income from my federal govt retirement.  I also receive social security which only a portion is taxable and I also receive Disability Compensation from the Veterans Administration based on service connected disability.

 

My problem is that on my tax returns, the only income is retirement and about $4,000 of the social security which equals about $17,000 per year according to tax returns, but in actuality I make about $70,000 per year when you factor in my disability from the VA and the non taxable portion of my Social Security.

 

If I send only my tax returns, they will not accurately reflect my current income.  I have 1099's for each year from SS, and Letters for each year of income from VA.

 

I want to include these with my tax returns but don't know how to go about putting it together so that the CO can ascertain that this is additional income although not reflected on taxes because it is non-taxable.  Please any suggestions on how to do this will be greatly appreciated.

The ex-spouse is not listed in #8 as a dependent, just your child and whoever else you claim as a dependent on your taxes. They are listed in #9 as someone you previously submitted an I-864 for. They would also be listed in #10 along with the current fiance(e), since a petition was filed for the ex-spouse in the past.
 
The total for your household count size will be you, your child, the ex and your fiance(e). So, you need enough income to meet the requirements for a household of 4.

Petitioner applied for I-130 and subsequent I-864 for ex-spouse in 2006 and ex received green card in 2010. I believe when I asked this question before, I was told that ex-spouse had to be included in I-134 that I am submitting for my fiancee.

I just need help understanding what portion of income do I check? Would it be partial support?  Ex-spouse has 10 year green card, he is only 4 years into that card and I know I am still financially responsible for him until I DON'T KNOW WHEN , but HE MAKES ALMOST AS MUCH AS I DO AND SUPPORTS HIS NEW FAMILY :ranting:  (His girlfriend and their two children). 

Another question? I also have one other person who is dependent on my income and she is on my taxes. So I guess what I'm asking is, for the I-134, will I have to put my daughter, my fiancee, and my EX-SPOUSE on the form, and what percentage of support for the EX?. :bonk:  :bonk:

and how do you know if you have an inpedimento de salida ? 

As I understand it,, sometimes the lawyers inform you or you might not know anything until you are leaving the country and they can stop you b4 you pass through the airport checks. If you think that there is a possibility that you have something out there that needs to be taken care of, and you are planning to leave, best to contact that office to find a solution and clear it up in advance. My fiancée met with the attorneys yesterday, made a deposit and entered into a contract of repayment. I have to say that his experience with them was very bad. He said he was threatened constantly and was shown a list of about 27 or more people's name on the list preventing them from leaving the country. This list had been authorized by a judge.

I don't really understand the legal system in the DR, but I do believe that when it comes to having someone detained, MONEY talks with the Judge. Corruption maybe, can't confirm. Not my place to talk down on a country, but from my limited experience dealing with my fiancées case, I have found that the police and the legal system is a far cry from Justice. As I said before, we have entered into a payment plan which should be cleared up by end of this month.

What power does an attorney has to stop the visa process? I do not know, but the attorney can stop him from traveling.
 
Even if the loan problem does not become an issue and the visa gets approved, I know that some lawyers can get an "impedimento de salida" ...it is like a restriction to travel outside the DR,  as a "medida de coercion" (don't know how to say that in English) very easy..a friend of mine was actually moving to Spain and the day she was leaving, she was stopped at the airport by the security, she couldn't travel that day. She found out that the restriction was related to a fender bender several months before, and it was even paid off. But the lawyers of the owner of the other car got the restriction during the process, and she didn't even know she had one...it took her two weeks to resolve the issue, and a new plane ticket.
 
The problem is, that not always the restriction is lifted after the legal issue is done. There was a news report in the DR last year about the huge amount of still active "impedimentos" and that so many of the persons affected with it don't even know they have one  until they try to leave the county either for vacation or work...and you know what? the "impedimento de salida" cost only $330 pesos,  yes I think a judge has to approve it, but I know its a rather fast process....And it does not have to be a big criminal case, my friend got one because a traffic bender,  and people can get it for not paying child support.
 
What I am trying to say, your fiancé should find out if he has one, and if it he does, be sure it is legally lifted before traveling when his legal issue is resolved....I know all this because there are so many lawyers in my family.

The attorney advised him that they can stop him from receiving a visa and detain him from leaving the DR because of this. Can they do that? The original amount owed was $500 dollars but now it has been turned over to an attorney and the amount has accumulated to an outrageous amount. What are our options? Don't you know what happened in your life?  The requirements to be a petitioner are pretty objective and straigthforward, and you really don't need to look online to check yourself out.
 

There is something very prevalent in the United States called "Identity Theft". So IMHO just as one should always check their credit periodically, it would seem logical to check if any crimes have been committed under your name. This has happened to one of my family members who was listed a a child predator in the state in Georgia and had never visited the state in his life. The only reason he found out about it was when he went to the school to check his small child out and they told him he could not because he was listed a a child predator out of the state of Georgia. Found out that some had stolen his identity. ??It was hard to clear up but eventually the matter was solved. So yes, a person knows what HE or SHE has done in life, but they don't know what that PERSON who stole their identity HAS DONE,,, just my two cents

Was your case received by the embassy the 25th?

Mine was also this day, and i checked the nvc status today because i read somewhere that they update it, and there was another update with todays date. I tried calling the nvc abt it and they did not give me any info, they just told me to contcag the embassy, and when i called a visa specialist told me to contact nvc.. This is so confusing. Idk if i should pay 8 dollars to call them, i would if i knew for sure that they had the interview day, but i am not sure!!



My case was received by embassy on the 15th of Sep. the status date changed on the 25th. I called them and emailed them and got the same info " case pending waiting for interview date to be assigned. When I asked about status of expedite, I was told that they would forward a request for info to that department.

Well you can count me in. And what's more frustrating to me is the Expedite. When I emailed them about it, they told me that they would send a request for update to the appropriate section, BUT in the same email response they stated that I should also be aware that it usually takes 3-4 months for an interview! So I'm like DUH, THAT'S THE REASON FOR THE EXPEDITE REQUEST!!!

I am so done. Because of my medical condition and this back and forth with the embassy, I have scheduled an appointment with my physician.

This process is not for the faint of heart or the impatient or in my case those with medical conditions that are aggravated by STRESS??

E-mail the consulate asking for interview date, they will send you an e-mail with the beneficiary name and interview date on it, that is the packet 4, with that e-mail he print it and pay at banco popular ,and do medical.
Medical has to be done at least 3 weeks before interview, no before, he cant do medical one month before.
Remember that he need go to the medical and go back to pick up the results.
For that is good go 3 weeks before and go back to pick up the results.
Ds-160 can be fill out any time.
If your fiance wants he can fill out now, and keep the confimation page.
I filled out my ds-160 one month before interview.

Ladies your spouces can take the email you receive to do the medical right now it's costing about 320 due to flu shot. The email is enough do not wait for packet 4 to get to beneficiary. For most that I know and myself it was never sent. Good luck and read the most current interview experiences as you get ready for your big day .

Anyway, we hadn't even received the email yet and the interview is still not showing up on the cita list. Maybe it's because it's not until November.

I know I said a couple of days ago that I wasn't going to call or email for another week, but today I said I'll give them ONE last call, and to my Surprise, I was told that our interview date had been scheduled!!!! Wooohooo!??

As I expected, it's in November, but no problem, at least we have a date.??
