From my personal experience, please ensure that the State of South Carolina  allows one to marry soon after the divorce. In my case, Texas has a 30 day waiting period after divorce before person is declared legally free to remarry.  I filed my I129F twelve days after my divorce, and after some discussion and advice from fellow VJers, I elected to cancel that petition and resubmit a new petition after the 30 days had passed.  I Lost $340 and close to six weeks of processing, so just be cautious.  The important thing is, At the time you file the I129F "You must be legally free to marry by the sate laws of South Carolina".   Please check the State Divorce Laws for your state before you file :)

I dated the I-134 with the date of Sept 18th and sent to fiance.  His interview date is Nov 19th. On the day of interview, that form will be two months old.  Does anyone think I should redo it and send him a new form with a date like maybe today's date or should it be dated closer to interview date or is it OK the way it is?

The I-134 can be a couple months old and it should still be ok.  You should send in the documents as close to the time of interview as possible though.

I want to send items needed from me, the Petitioner, to fiancee in advance (i.e. I-134, Copy of original I-129 Petition, proof on on-going relationship, taxes, bank statements, travel tickets, hotel receipts, phone logs, photos etc). Because DHL is so expensive, I want to send only one packet.

 

Our case is still and NVC, and he has not yet received an interview date. 

 

Do I have to wait until he receives his interview date before sending these items to him?  If it is NOT necessary to wait for interview date, what date do I put on the I-134? 

 

Due to medical reasons, I will not be able to attend interview if it will be before the end of the year, which I believe it possibly could be.

:idea: No need to ask an attorney.  Go to site IM2US.net.  There are very knowledgeable people on that site that deal will denials under Sec 221.  I would ask the question there first, before consulting an attorney.

Was your case received by the embassy the 25th?

Mine was also this day, and i checked the nvc status today because i read somewhere that they update it, and there was another update with todays date. I tried calling the nvc abt it and they did not give me any info, they just told me to contcag the embassy, and when i called a visa specialist told me to contact nvc.. This is so confusing. Idk if i should pay 8 dollars to call them, i would if i knew for sure that they had the interview day, but i am not sure!!



My case was received by embassy on the 15th of Sep. the status date changed on the 25th. I called them and emailed them and got the same info " case pending waiting for interview date to be assigned. When I asked about status of expedite, I was told that they would forward a request for info to that department.

My original case status date was 15 Sep 2014. The status date changed to 25 Sep 2014. I called embassy Today to see if an appointment had been scheduled and was told that my case is pending for an appointment date to be set ASAP. ??

By the way, I requested a Medical expedite on 18 Sep 2014 and there is still no decision on that as of yet.

So we are still waiting.....................,,ugh!??

and how do you know if you have an inpedimento de salida ? 

As I understand it,, sometimes the lawyers inform you or you might not know anything until you are leaving the country and they can stop you b4 you pass through the airport checks. If you think that there is a possibility that you have something out there that needs to be taken care of, and you are planning to leave, best to contact that office to find a solution and clear it up in advance. My fiancée met with the attorneys yesterday, made a deposit and entered into a contract of repayment. I have to say that his experience with them was very bad. He said he was threatened constantly and was shown a list of about 27 or more people's name on the list preventing them from leaving the country. This list had been authorized by a judge.

I don't really understand the legal system in the DR, but I do believe that when it comes to having someone detained, MONEY talks with the Judge. Corruption maybe, can't confirm. Not my place to talk down on a country, but from my limited experience dealing with my fiancées case, I have found that the police and the legal system is a far cry from Justice. As I said before, we have entered into a payment plan which should be cleared up by end of this month.

NOTE; IMHO ........

What power does an attorney has to stop the visa process? I do not know, but the attorney can stop him from traveling.
 
Even if the loan problem does not become an issue and the visa gets approved, I know that some lawyers can get an "impedimento de salida" ...it is like a restriction to travel outside the DR,  as a "medida de coercion" (don't know how to say that in English) very easy..a friend of mine was actually moving to Spain and the day she was leaving, she was stopped at the airport by the security, she couldn't travel that day. She found out that the restriction was related to a fender bender several months before, and it was even paid off. But the lawyers of the owner of the other car got the restriction during the process, and she didn't even know she had one...it took her two weeks to resolve the issue, and a new plane ticket.
 
The problem is, that not always the restriction is lifted after the legal issue is done. There was a news report in the DR last year about the huge amount of still active "impedimentos" and that so many of the persons affected with it don't even know they have one  until they try to leave the county either for vacation or work...and you know what? the "impedimento de salida" cost only $330 pesos,  yes I think a judge has to approve it, but I know its a rather fast process....And it does not have to be a big criminal case, my friend got one because a traffic bender,  and people can get it for not paying child support.
 
What I am trying to say, your fiancé should find out if he has one, and if it he does, be sure it is legally lifted before traveling when his legal issue is resolved....I know all this because there are so many lawyers in my family.

So my fiancée informed me today that he had an unpaid bank loan in the DR from year 2008 that has turned over to an attorney. The attorney advised him that they can stop him from receiving a visa and detain him from leaving the DR because of this. Can they do that? The original amount owed was $500 dollars but now it has been turned over to an attorney and the amount has accumulated to an outrageous amount. What are our options? Any and all help is greatly appreciated!

We received the copies back from the consulate; however these copies were obtained in April 2014. It appears that we will need a "new" copy when it is time to renew his passport.

Ok thanks so much for the info. So after six months have passed, one needs to supply another copy, correct?

My husband's Dominican passport expires in October 2015. His US 1-130 Visa is printed in it.

According to the Chicago DR Consulate website this can be done via mail.

However, must we wait until the passport expires to renew it?
AND
Must we provide a birth certificate printed within 6 months of renewing the passport? I really do not want to visit the DR again any time soon, especially just for a birth certificate!

Sorry I can not answer you question, but I am curious about the birth certificate not being in his possession right now. When you provided the birth certificate to the consulate, did they keep it? I just want to ensure that if that is the case, when my fiancé provides his copy for the consulate, that he requests another to bring with him here to the U.S.
Or or this just a situation for those filing the I-130?

Well you can count me in. And what's more frustrating to me is the Expedite. When I emailed them about it, they told me that they would send a request for update to the appropriate section, BUT in the same email response they stated that I should also be aware that it usually takes 3-4 months for an interview! So I'm like DUH, THAT'S THE REASON FOR THE EXPEDITE REQUEST!!!

I am so done. Because of my medical condition and this back and forth with the embassy, I have scheduled an appointment with my physician.

This process is not for the faint of heart or the impatient or in my case those with medical conditions that are aggravated by STRESS??

So you didn't receive the letter that says the docs you need to gather and that you have to complete the DS160?
 
Your fiance has to get the medical done, pay the fees, gather the docs, etc. Here is a link with the instructions. They are the same instructions you would receive in the mail. It's possible that your fiance may receive it, but the mail is not to be trusted in DR.

There was only the blue sheet paper stating that he had been scheduled for an interview with the date and time and location. The letter alluded to attached documents with instructions for medical, but there were no other documents. Only the one sheet of paper.

I'm the OP and today I received a letter here at my address in the U.S., from the Consulate in Santo Domingo . One page, typed on blue paper. It stated that my fiancée was scheduled for interview date time and location. Also stated that there were instructions about medical exam and other instructions.......but nothing was attached. Just one sheet of paper. I contacted my fiancé and asked if he had received anything there in the DR and he told me that he had not. I scanned the paper to him. What does this mean and why did he not receive anthing yet? His interview is on the 19th of November. Please respond anyone. Thanks

The Total Cost of the Visa is now $265. 
 
The cost of Visa Delivery was $11us. But it may or may not be changing in November. We'll have to wait and see since they are changing courier services.

I don't have an exact date on when this started, but they're a number of changes in the Visa Interview Process.

 

1) The Embassy is no longer using Banco Popular. The entire $265us must be paid at the Embassy on the day of your Cita/interview. 

 

2) The Embassy is no longer using DomEx for their visa courier service. They will be using a New "un-named" courier service starting in November

 

3) The Visa Medical Facility is now requiring (although it's not on their website) 5 passport pictures (2x2 size) for your medical exam instead of 3. 

 

4) I know recently people have been having a difficult time getting visa information from DOS/NVC for their upcoming interviews. On November 12, there will be a new number to call and website to check your visa status.

Thanks Mr. Tee for previous help but I have another question.  We are trying to get all of the funds together for medical and visa fee and anything else we need to pay.

 

So the medical fee will vary depending on vaccines and flu shot correct?  The Consular Website states for his age group, the Flu shot is $99.00. and the Medical Exam with the Vaccines is a separate $289.00.  And in addition to this amount the Visa Fee is $265.00.  Am I correct or am I missing something?  Thanks so much.
