Actually, my advice won't help. You're from the Philippines and from what I've read they don't accept joint sponsors. If you can, postpone the interview.

I was extra overcautious and sent in all my itineraries, boarding passes, and passport stamps.  I front loaded my file and was approved without any RFE and no hiccups at the interview.  Send as much as you can if it makes you feel comfortable.

My fiancé was denied entry to the US using his previous visa. He is currently in the US on the K1. They did ask some questions about it (I went to the interview with him) but it got approved. Its easy to worry after hearing of denials but as long as you have everything in order, follow the rules with what they require, and can prove your relationship then you'll be fine. It's hard because it feels like the process never ends but soon enough you'll be together and all the worry and stress you experienced feels silly. :-)

 

 

This x10.  We worried a lot during our K1 visa process.  In the end, the medical was a piece of cake, the interview was a piece of cake, and we got our visa in hand 6 days later.  We front loaded our application the best we could, and either it paid off and proved the relationship, or they didn't need that much in the first place.  Just pace yourself. You'll be fine! :)

 You're still working at the same location but your titled changed? You don't have to worry. Nothing from here will matter enough. At the interview, you need to supply your paystubs and such, but they probably don't care of your title change.

Yes, as everyone has said, it's not the doctor that makes the final decision.  I know hearing denial is scary, but stay positive.  When is your interview?  

 

Again, you might be okay, especially if you tested clean at the doctors.  Just keep your fingers crossed the CO sees it that way too..

At the time that my fiance and I filed the K-1 in Oklahoma City (moved to Kansas City after approval), I thought this was a big thing, something I was so unsure about if I could do.  But I constantly read the guides, checked, double checked, triple checked everything, front loaded our petition with so much stuff, and sent it in. That was July 2013. 

 

As of February 2014, we had our interview and was approved and she received her visa!  Just study this process, learn as much as you can, ask as many questions as you need, we'll help you.  Looking back, this was fairly simple to accomplish, as long as you do it right the first time. :)

 

Your previous entry denials will not affect the K-1 visa, just make sure you mention them when they ask for that information.

You've already been told to wait it out. I'm not going to be the one to tell you again.

 

However, almost everyone gets placed in AP for some period of time. Could be a few days, a few weeks, a few months, a year. By getting married, you've actually sacrificed all the time you've put in to get to this point just to start over.

 

Yes, waiting sucks. None of us like it. But be smart and don't get married, you'll be waiting LESS time by waiting for your result now. I know it isn't the greatest method, but you have no clue how long you'll be in AP for. Could be a few weeks and you'll get an approval. 

 

Be smart about your decision, but in the end, you do what you feel is best!

She's going to bring her most recent paystubs, a statement from her college showing her college and semester, and a recent credit card bill with her home address (she lives with her parents again and doesn't have any lease agreement).  Do you think this is sufficient to cross into the states? She's coming from Canada.

you do not need to send the items on the checklist with packet 3, just the completed checklist itself. that is merely a checklist so you are prepared for what to bring to the interview.

 

i do know that it states on the DS156-K that it is required, but you can just bring them with you to the interview as outlined on the checklist.

Hello Everyone,

 

 

I am currently in the middle of doing my Packet 3 and I've read the list of what must be sent.

Going through the forms.

I read that I must also send the following things as well.   Birth Certificate, Police Certificate, Marriage Certification (If any), Birth Certificate(s) of children (If any) etc.

 

 

Now this doesn't specify on the checklist or the letter I had received from the US Embassy but it does state it on Form DS-156-K.

So I am rather confused as to what needs to be sent with Packet 3 and what does not.

Hello fellow VJ-ers! Hope all is well! My fiance finished his medical exam today in London. It went swimmingly! Next is the interview! (woot!) I've been reading and it looks like various people are bringing various documentations along with their I-134 (financial support documentation) I mailed him my tax return from last year, along with 3 paystubs from my two current jobs each (they're not on last years tax return, but maybe two months) I'm also having my uncle co-sponsor as I'm a student who only works 25hrs a week, with his seperate I-134, I sent a scanned copy of his passport and his tax return from last year. Are we okay? Some people said they just have tax return, others all this employer verification? I guess I need to know if there's something else I need to send my fiance asap!?

you have to put both so that it help to boost your income and able to meet the poverty guidelines.

 

if your both part time job meet the income requirement you don't need a co-sponsor.

 

if your answer is no, co-sponsor should use form -864 and you fill up form I-134 goodluck

 

what???? My co-sponsor doesn't use the I-134 form? Are you sure they use a different form? Im a full time student, I do work two part time jobs but it only totals to less than 10k a year, so I definitely need a co-sponsor.

I'm starting to fill out the I-134 form with myself and my uncle who is our co-sponsor, but what technically counts as supporting documents? I go to school full-time and work two part time jobs, so I have no idea what to put as my employer. Should I put my main part-time job or put full-time student/part-time after school program instructor? HELP!

The main cultural issue I think we have is that he loves to meddle in everyone's business, always has a clear and loud suggestion for what people should do, and loves to be involved with everyone's business (family/friends); and I was raised more like give people information that they might ask for, let them make their own decisions, and otherwise mostly mind your own business.  We really don't see eye to eye in that area... but, hey, I gave him my information and he can make up his own mind about handling that, none of my business!  rofl.gif

Possibly, you mean "should he submit them?" He should submit all of them for the affidavit of support (if that's needed for K-1).  Otherwise, not sure what you mean.  W-2 is a tax document generated by any employer who paid wages during a tax year.  Form 1040 is a form filed, by someone with income, to the IRS to report earnings throughout the tax year.

If you're really unsure how to proceed even after reading the information here then a lawyer would probably be a good option for you.  For some people these crazy rules and procedures are easy to decipher but for others, that's why there are immigration lawyers!  Don't worry what other people say, you need to do what's best for you guys!!

He can request transcripts from the IRS, which might show something useful. If he hasn't filed, but was supposed to, now is the time to own up and file back returns. If he wasn't required to file, probably some statement showing that and signed by him. Letter from CO is really good.

But, in the end, you might want to think about a joint sponsor. Just to be safe.

What do you consider to be the red flags in your case? I don't see any in what you wrote, or any reason why your K1 wouldn't be approved.

I am probably being paranoid, but it is the fact I had an F1 refusal so soon after my return to the UK.

Hello all.

Very new to the forum and firstly wanted to say what an excellent job you all do in providing opinions, help and support to all concerned.

I was just interested in other peoples opinion of mine and my fiancés case.

I am 24 years old, born and raised in England. I arrived in the US (Kansas City) on the 31st May 2013 on a J1 Visa. While out in America I met my fiancée who is 25 years old. We began our relationship on the 27th July until I left on November 8th.
During this period I met all of her family, had many pictures with her family and also visited my brother in New Jersey who is at college there so he could meet her aswell. Again this was all before we got engaged.

I proposed to my fiancée on November 7th 2013

Whilst out in America I had an opportunity to go to college, unfortunately it was too late to change the status of my Visa. This process occurred before I proposed. My advice from the college was to come home and reapply for an F1 visa, I had my interview towards the end of November and unfortunately it was rejected under section 214b.

This was before me and my fiancée even knew about the K1 visa. At the time I had very genuine plans to attend college in the United States and continued with those plans after out engagement until the F1 refusal.

After doing some research and discussing wether we wanted to live in England together or in America we decided to pursue the K1 visa and applied on the 20th December 2013. We have received our NOA1 and currently waiting for our NOA2.

Since then she has just returned from a visit to England where she met all of my family. I was hoping to visit her for the whole of March where I could get time off work but unfortunately my ESTA was denied, obviously because of my F1 visa denial.

A couple of questions...

1. In your opinion is it worth applying for a tourist visa (I have a very respectful job for the English government and can easily show when I am due back at work, the same job I returned from my J1 visa for) Me and my fiancée would never do anything to jeopardize our K1 visa. But I wonder how immigration will view it.

2. What is your opinion of the chance of our k1 success (As honest as our situation is, I totally understand certain red flags in regard to our case) There are no issues in regard to any other aspect of the application.

Any help and advice would be greatly appreciated. As I am sure you are all aware how stressful this situation can be.

Of course it depends what the denial was for.

If it was for lack of ties to home country of something similar (which is denial by section 214b) then you will be fine.

But if it was denied for having a criminal background or other things of a serious nature then it may be best consulting a lawyer,

I need some advice.

When filling out the DS-160 I believe I have made a mistake.

I answered the question 'Has anyone ever filed an immigration petition on your behalf with the United States Citezenship and Imigration Services?' Yes

In which I was asked to explain and I responded 'My Fiancée (I put her name). This is the reason I am completing this form for my K1 Visa application'

Now I completed this form a few hours ago and thought nothing of it, it has been completed and sent. But now I believe I should have answered 'no' as the K1 visa is not an immigrant petition. I wrongly assumed the I29f was.

So firstly, did I fill in the DS-160 incorrectly?

And secondly if I did, what can I do to correct this?

I think I basically have the same question discussed in this thread.

I have moved and changed addresses in between the I-129F approval and AOS stages. I just used my new address for the AOS paperwork. From reading on the USCIS site and on this forum, it would appear that is all I would need to do. My only worry is that on the approved I-I29F we put that she intends to live at my old address. This may be a silly question, but do the USCIS and foreign embassies communicate that change to each other, or do I need to notify the USCIS.

I just wonder if at her interview the consulate will look at the I-129F and see one address, then at the AOS and see another, and may wonder what the issue is. It would appear, though, that, since the petition is no longer pending, it is not required that I notify the USCIS.

I am considering filling out the "change of address" online with the USCIS and just pretending as if I didn't know the difference between pending and approved, just to be safe. :)

Hi All!

 

My Fiancé and I have pretty much everything in order to send off for the K-1 Visa. He's from the UK and has gone about 2 years without filing (not sure if that's what they call it), his taxes over there. Would this be an issue that could possibly delay the visa process or even deny it? If so, we'd like to know in advance so we can remedy the situation sooner than we had initially expected to.

 

And as a side note question...for the medical examination, I read that they will look through your medical records. Is this correct? And if so, is this just to make sure the person doesn?t have a severe illness?

He will have to undergo a medical examination I-693 to make sure he is healthy and he doesn't have diseases like TB. They will take blood samples, etc.  Also make sure he has all the proper vaccinations (Dtap). He can get those vaccinations with the civil surgeon that will do his examination if he doesn't have the vaccines but it will cost more money.

I ask because your profile says you are filing for IR-1 but you mention I-129F which is a form for the fiancé visa, if it's a fiancé visa what you are doing he must be a US citizen, if he was a permanent resident before he can find his A number on his green card or in his naturalization certificate

I sent in our I-129F 2 weeks after my divorce was final. I had been separated for 2 years - I was divorcing a divorce attorney so my divorce took a while to be final. I was very worried we would be denied since I only waited 2 weeks. It was not a problem. We were never asked about it - not even at our interview.
I know it is different for each country.
