I actually got an email around 1:30 in the morning. I work until 12:00 pm, so that is why I was up late. I checked my email at 1:00 am and no email. At 1:30 am I got an email saying my application was approved on August 01. The good news for you is that I have an RFE date the same as yours. It appears CSC is going by order of the RFE date and not the NOA1 date. Your NOA2 should be coming shortly.
I originally filed on April 07. My wait has been pretty long except for the March people, so I know how hard it is on us all. Good luck with the rest of you!

From my personal experience, when my fiancee moved, I was told that I had to contact the consulate handling our approved petition. From my timeline, you can see that our petition was approved on August 01. I called the National Visa Center this past Monday, where the approved petition was still sitting and waiting to be shipped to the Embassy in Moscow.
The person answering my call asked me a couple of questions like the date of birth of the benficiary and my phone number. He then proceeded to change the address for my beneficiary. I will also follow up on this with the Moscow Embassy once I get the letter that the petition has been sent to them.
I did not fill out any AR-11. The change of address does not affect the petition, just where the packet 3 is sent. The Department of State needs to know the beneficiary's new address, not the USCIS.

I am not sure if your birth certificate was issued by the hospital or the state you were born in. If it was issued by the hospital, the birth certificate is unacceptable. If it was issued by the state, it should have a file number and raised seal. If you need a state issued birth certificate, go to www.vitalcheck.com. This may have been the problem.

This whole process sucks for me. It has really tried my patience. USCIS knew about IMBRA for months, yet did nothing about it. There is also a big disparity between the processing times between the service centers and now at the CSC itself. I thought they would go by first in- first out. Now you see that they could care less about the lives they affect. I am just glad that I am now dealing with the State Department. They have proved to be easier to deal with.

My father is deceased, so that is what I put for City and State of residence. With the address, my fiancee lives in an apartment, which is very common in Russia. Your fiancee may live in a small village, but if she lives in an apartment as most Russians do, just put the street, house and flat number. The next line you write down the city, republic and 6 digit postal code. The last line is the country. If you want an example, look at the US Embassy in Moscow address. It can be found by going to their website.

Absolutely I read that, but that is based on what has been in the past and makes no concession for a change in the process. Also, remember it is an opinion only, just like mine.

What we do know at this moment is that the Biometrics notice has not shown up on the K-1 NOA1 receipt before and the odds are this is not by accident.

With the IMBRA just coming into play we are going to see some changes for K-1 processing and that will all be determined by how USCIS decides to do things.

Collecting Biometrics from the USC does provide them with an easier method to validate the information concerning criminal history since they have that system in place now and I expect them to take the easy way out on meeting what they interpret as their responsiblity.

The only thing we can do is wait to see how it all plays out, but this sure does look like a change is coming quickly.

I called them and they said that I can file an I-826 form to receive a duplicate but they would not tell me how long it might take to receive the duplicate. They only said that it might take up to six months or even longer. This did not really help. Does anybody know how long the processing time of an I-826 form is?

They also told me that we can substitute the document if we provide prove that the document does not exist and why it does not exist. How can we do that?

We would also have to demonstrate evidence that proves the same thing as the approval notice. This seems easier to me. We could provide a copy of the original petition, some action notice letters, and a copy of my visa.

Does anybody have expperience with such a situation? Any suggestions are appreciated. Thank you.

My fiance lost the approval notice and I read that the it is possible to request a duplicate with the I-824 form. However, a copy of the original approval notice or a copy of the notice of action (I-797) is required to be submitted with the I-824 form. Can the duplicate be requested without any of these original forms? How long does it take to get the duplicate? :help:

When we went for the interview they called us up to the first window where we turned in our documents, then my husband went to another window where he got fingerprinted.  After the fingerprints he was given a paper to take to another window to pay for the visa.  The CO asked for the paid receipt at the start of the interview.    Sorry about giving the wrong fee - I looked it up and that is what we paid but I remember seeing that the fees  went down sometime after we did ours.

Yes, you will pay fees at the consulate when you have your interview.  I don't remember exactly how much but I think it was around $350.00.

If you can still get your money back I would.  It looks like TSC is still working on petitions filed in Jan.  Even if you get approved in the next couple of weeks, you then  have to wait for the petition to go to NVC and be processed which can take a month.  Look at the time lines from reviews of recent approvals through the same embassy.  It looks like it takes a good 6 weeks after NVC to get an interview scheduled.   I would get my money back and wait to plan.

I know it's possible to submit the I-130 while living overseas, but I have a question or two. I'm living with my wife in Medellin, Colombia, and want to start the IR-1 process in December. The I-130 wants a permanent address in the US in question 18, but obviously we don't have one. So, what do I put in that space? Do I need to secure an apartment in order to apply?

 

I currently receive my personal mail at my son's house, and his house is listed as my US address, but we have no intention of living there when we get to the States. Is it possible to use his address and then change addresses when we arrive?

 

Any guidance (or thread links) would be appreciated.

I have most of my documents prepared, proofs of relationship, photos, etc. for submitting the I-130. Can I submit all as one packet, or separate packets for each of them? In other words, do I need separate photos of me with each child only with that child's I-130, and separate photos of me and my wife with her I-130, etc.? One cover letter for all or separate one for each I-130?

 

It makes sense to me to minimize the pile of paper as much as possible, but I want to be as thorough as is necessary.

 

Our situation is slightly complicated by the fact I am living with my wife and kids in Colombia, therefore, requests for more evidence during any part of the process will be a major hassle (and cost), so I want things to go as smoothly as possible. :-)

Can you tell me what letter that NVC asked for? Did they ask for the paper signed by the two parents? Because we do not yet have this paper signed by the father. He is giving us a hard time about this. We hope to have it by the time of the interview. He insists that it is only needed at the airport and refuses to sign anything until then. We tried to explain to him that it will be needed by the NVC and the embassy! Can you confirm?

Did you make up the documnet yourselves and what did it have to say besides to remove the child permantly from Colombia? How long was it valid for? Did the embassy ask to see the document? Were you required to give your physical address personal info ect? I ask cause we don't really want the him to know too much. He has been abusive towards my wife in the past and we are just trying to get him to sign this and want nothing more to do with him.

PS- Did the embassy ask the child any questions?

I don't mean to butt in here, but we went through the same thing with needing a letter from the father. The embassy and NVC are unlikely to ask about or even care about such a letter. The only ones that will care are DAS at the Bogota airport. Permission is required from both parents for a child to leave Colombia, unless there is proof that one parent has given up legal rights to the child or is deceased. The letters, no matter how they are written, are good for one departure only. So, the next time the child visits Colombia, he/she will need another permission letter from the father to leave for the United States again.

As for the letter, our letter states basically the following (all in Spanish, of course):

I, (father's name), of legal age, with citizenship number XXXX issued in (city, state, country), by this document give permission for my minor child(ren) (child's name) identified by civil registry number XXXX and passport number XXXX to leave the country and enter the United States in the company of his/her mother (mother's name), identified by citzenship number XXXX issued in (city, state, country). This trip is anticipated in or before (month and year) and this permission and authorization is in effect from now until the date of travel.

Signature and Notary stamp

The only other option, with the father still living and wanting rights over the child(ren), is for the mother to seek sole custody through Colombian courts. This will require not only proof of abandonement or abuse, but will also take several months to obtain. I'm guessing this is not an option you want to pursue.

This is, I believe, a requirement of the Colombian government and not the US. DAS in Colombia will want to see this letter when your wife and her child leave the country. It should be a recent letter, if possible, and should be notarized. Also, keep in mind that if your wife and child return to Colombia for a visit in the future, they will need another notarized letter from the father for the child to leave. This will likely be true until the child reaches legal age. The only way around this requirement that I know of is for the father to grant (or the mother to legally take) all parental rights to the child. This process, from what I hear, can take several months, and only that fast if both parties agree.
