I hope so too. I guess it could be considered infedelity because we were not divorced, only living apart. I wonder if it depends on the country your petitioning through whether or not it is brought up.

I read that some members had issues because they were engaged before the divorce is finalized, but they DID file AFTER their divorce.In some cases they were denied or put under AP because the CO considered it was an infidelity issue. In my very personal opinion, I think is nobody bussiness what you do with your life, the USCIS specific require is "BE FREE to marry" legally and personally. How you get to that point is your life, so I dont agree with the CO making a desicion base in his/her moral statements. In my case I was a lil concern cause my husband and I got engaged 6 month after his divorce was ready. He got marry on 2003 and they agreed to separate on 2006, no kids. They were lazy about filling the divorce for 5 years even when they already had new partners and complete separate lifes. When he decided that he wanted to spend his life with me they did the paperwork. But we date for a year while he was still married. But thanked God it was never brought during my interview (k1). Neither his ex wife or his past married life. Nothing. I was approved without issues. I hope you guys make it without problems


I also agree that it shouldn't be there choice on their own morals, just if you meet the requirements.

The petition was filed after the divoce was filed and recorded. so everything was completed by the time we had filed. my fiance is aware of all dates regarding my previous divorce and no children were conceived.

I have a question about my previous marriage that has been itching at me for a while.  We decided to separate in August 2012, same month I met my finacee.  We separated in October and I moved out, same month as I actually met my finacee in her hometown.  Because the divorce was a mutual divorce, we had no problems with each other, we delayed filing until December.  Will this be any red flag for our case? I hope not.  i didn't find anyway to explain this in our petition.

Why is religion, previous marriage and such so much of a bad thing? I can see how different religions, countries, don't mix, but other than that, I don't see any issue.  And as far as prior marriages are concerned, why are those always brought up as long as the petitioner filed after the divorce was finalized?  I'm just really curious because I really feel giving all of these scenarios just worries everyone more.  Maybe it's just me.

this is why I'm concerned. some answers saying need to be certified and some answers say it just needs to be a copy. I just made an actual copy of the divorce decree. I can bring a certified copy to the interview with no problem but I thought it just needs to be a regular copy for now.

I think I read that it needs to be certified, which the version I sent was not.  I never got a certified copy from the lawyer, just a copy.  Anyone ever have an issue with a copy or have had it go through without an issue.  I sort of expect an RFE, but it doesn't sound like the end of the world.

No.  The 5x is if you are using assets.  You need to have 5x the assets if you make under the poverty guidelines.  Just the difference between the two.  If you're over the poverty guidelines, don't worry about it.

This only counts CONVICTIONS, but nothing else? I had the police take me to a center for troubled teens (I was) when I was 13 over an incident with my mother, but I was NEVER convicted, NEVER needed to attend court, and NEVER charged.  Am I okay for saying No on the 1-29F? I thought I would since it mentions only convictions, which I do not have.  I'm probably worrying about nothing, but I want clarification (again).

I used 10-15 pages of skype messages where I copied/pasted the information and I got an approval without any RFE.  It may depend on the country you're petitioning for, but I went a simple route and it didn't seem to be a problem.

I currently make 29,000 a year but am very unhappy with my current job.  I've applied for the K-1 visa, already received NOA2 and received notice that my petition has been forwarded to the NVC.  I applied for a new job and one offers less money, 24k a year, but I'm considering taking it to be happier in my workplace.  Will this income be sufficient for my Canadian fiancee?

Okay. I've read things here on VJ about scar issues and having to go back to the medical a second time. We'd like to prevent that because it's 8 hours away.  

 

How is history with depression bad? She had depression as a teenager, who didn't.  Is that a denial reason? She never attempted suicide or anything of that nature.

My fiancee has keloid on her earlobe.  A keloid is a growth of scar tissue from a previous surgery.  She can have it surgically removed beforehand I think, but do you think we'll have an issue at our medical? Do you think it'll do me much good to call the actual doctor that our exam is at and see if it'll be a problem?

My beneficiary's 21st birthday was March of 2012.  What does this mean?

If you are in the U.S for 365 days illegally, you will have a ban. They are now aware of that stay, and he'll have to waive out the ban. You do not have to be deported to receive this ban. It starts from the moment he left the USA.

Actually, my advice won't help. You're from the Philippines and from what I've read they don't accept joint sponsors. If you can, postpone the interview.
