K-1 Fiance(e) Visa Process & ProceduresNeed some advice
Perfect advice/info from Nich-Nick there.

I had my shots done on the NHS after the Knightsbridge medical. Just make sure you get a printout to prove what shots you had done at your doctor, whether that is in the UK or US. I also had them stamp and sign it, to be sure! Then, when in the States I called around and found a cheap Civil Surgeon who would transcribe the vaccines. This took a lot of calls because most will not just transcribe, they only offer the full medical. When I went to get the transcribe done, as Nich-Nick said, they really pushed me hard to get a full medical. Stand your ground and don't give in!! You are not required to do it again, no matter what they tell you!! After much arguing I got my way and they signed off the transcribe for $50.

K-1 Fiance(e) Visa Process & ProceduresWould a Cruise Wedding violate our Visa?

Don't even think about leaving the US not even Hawaii or puerto Rico! That was the first thing the immigration officer told me and my husband when I got here to the US. he said you can wait until you have your residency or your AP it won't be as long as it would be to be denied entry and start all over again. I got my green card in 3 months. The wait is not that long and is not worth the risk.

Good luck!

Hawaii is a US state! It is fine to go there without AP.

K-1 Fiance(e) Visa Process & ProceduresWould a Cruise Wedding violate our Visa?

Hi! Don't leave the US! He will not be allowed back in. Even Hawaii is risky. Just DONT do it! There are plenty of places you can get married in the US that are beautiful and romantic.

What's risky about going to Hawaii without AP??

K-1 Fiance(e) Visa Process & ProceduresAnother physical once stateside?

Yup, the County offers the best deal. I'll get the list of what shots are needed, get them from the County, and find a CS to do the documentation. Anyone done that?

Wherever you get the shots done, just make sure you get evidence to show the CS. I had a couple of shots done by the NHS for free and just got a printout from them. I also got them to stamp it and sign it.
Nigel&MeggieMaleEngland2011-09-01 16:14:00
K-1 Fiance(e) Visa Process & ProceduresAnother physical once stateside?

They said I can get the shots anywhere, and they are indeed cheaper elsewhere so once I have all the shots, and the UK physical is less than a year old, I should be golden then. Yes?

If you do not get all the required shots done at the London medical then you will need to have a CS transcribe the vaccinations onto the I-693 in the US.

K-1 Fiance(e) Visa Process & ProceduresAnother physical once stateside?

My fiancee had a physical in the UK, not cheap! She got the paperwork and is on the way through the process.

I checked and found she will need another shot that is not available in the UK. I called a civil surgeon here who wants almost $500 for the physical. I thought we did not need another physical if AOS was within the time frame of the physical from the UK. So, do we need another one while in the US too? They did say we can get our shots anywhere though.

You do not need another medical. It took me a LOT of calling around to finally find a Civil Surgeon who would actually give me a missing shot and transcribe my vaccinations without doing another full physical. Found one in the end and it cost me $50 for the transcribe and $20 for the shot if I remember correctly.

K-1 Fiance(e) Visa Process & ProceduresGot RFE for "divorce decree" but I already included it

New update... I am still screwed! I just spent 10 minutes on the phone with the court, called the divorce department first and then forwarded to the copy department. They insist in no uncertain terms that the "certificate of divorce absolute" is the correct document, and that there is no other document. They said the only other thing they can give me is the Divorce Nisi, which I already have anyway and isn't what they want. So, there is no reason for me to make the trip in today, since I'll just end up talking to the same lady in person that I was talking to on the phone.

What am I supposed to do? I am greatly distressed here!

Thanks for the effort, but that nice lady gave me conflicting information from what you found out. See above post.

That is the complete opposite to what they told me yesterday. They specifically said (and I asked her twice to make sure I heard it right) that they were 2 different documents. The problem USCIS have with what you sent them is that nowhere on the document does it say it is a divorce decree. It's the magic word 'decree' they are looking for. It refers to a decree that is filed at the court, which suggests what the lady told me yesterday was correct - and that would be the document USCIS want.

Anyway, if they are refusing/unable to provide a decree then I guess all you can do is get the certificate of divorce absolute signed by a judge. Maybe if possible accompanied by a letter/statement from them stating that it is the decree absolute as provided by the State of Massachusettes. I'm sure they will do that for a fee of course.

You did?? Thanks very much! Although, I wonder how I am supposed to get this now. I specifically asked them for "divorce decree" in my letter.

I would suggest calling the nice lady who I spoke to on (617) 768-5850. I'm sure she will point you in the right direction.

K-1 Fiance(e) Visa Process & ProceduresGot RFE for "divorce decree" but I already included it

That's a good idea although I have no idea if such a distinction happens in Massachusetts. The "final" decree happens automatically, so I doubt a judge would need to sign that. It happens automatically just by doing nothing except the passage of time.

Ok, well I just called the court for you and asked them and they said the certificate of divorce absolute and the divorce decree are in fact 2 different documents. Again, I would suggest getting a copy of the divorce decree.

K-1 Fiance(e) Visa Process & ProceduresGot RFE for "divorce decree" but I already included it
Try calling the court and asking for the divorce decree and not the divorce certificate, there may be a difference as suggested by this below which I found online. USCIS specifically asks for the divorce Decree and I think you may have provided the divorce certificate. Just an idea.

Quote:
Divorce Decree is the document prepared by the court, setting forth the terms and conditions of the divorce. It is signed by the judge and filed with the County Clerk of the County where the decree was issued.

Divorce Certificate is the document issued by State Department of Health confirming the fact of divorce granted on or after a certain date. The Divorce Certificate contains basic information about the husband and wife, and the date and place the marriage ended.

K-1 Fiance(e) Visa Process & ProceduresGot RFE for "divorce decree" but I already included it

I got the RFE letter in the mail today. They want the "divorce decree". But, I already included that in the original request; I paid $20 to the court's copy office to get the document, and included it with the I-129F and also listed it in the table of contents. There is nothing else that Massachusetts courts issue when you request proof of divorce. What am I supposed to do???

We got an RFE for the same thing. We sent another copy, this time highlighting in bright yellow where it said Decree Absolute on the certificate. They accepted it. Just double check what you are sending them is definitely the decree absolute certificate and if you can't think of anything else they might be asking for then I suggest trying what we did.

K-1 Fiance(e) Visa Process & ProceduresWhat interview dates are being given?

Is there a way to tell what interview dates are being issued for a certain embassy? Maybe something like Igor's list or something?

We are going through London, and I was just curious to know what type of dates they are giving out. I saw one timeline that said Oct 3rd was given a few days ago, but about a week ago I saw Oct 27th handed out. Let me guess - like many other aspects of this process - there is no rhyme or reason!? Lol

Thaaaaanks ;)

The interview date can be affected by when your wedding is planned for (the wedding date given in the cover letter with packet 3), so looking at recently handed out interview dates could be misleading.

K-1 Fiance(e) Visa Process & Proceduresevidence of meeting?

lol thank you :) yeah the last trip sort did it, he came here in feb and i just arrived home from a visit a couple days ago. great i'll probably do next day just because i'd feel more comfortable with it. want to do this as soon as we can. do i have to make a color copy of my passport? i am sending that as I can't get to my birth certificate right now. or would that be okay in black and white? i have found my bank statements from when i was there during one visit and found a hotel bill from when he came here to ny and we met up there for a visit as well. i also have quite a few pics. so we don't have to show evidence of an ongoing relationship right now? i dont wanna get into trouble for it is all. thanks !

USCIS
P.O. Box 660151
Dallas, TX 75266

and even if i'm getting it signed for and doing next day it would go to this address correct???

You don't need to send evidence of ongoing relationship. London is not fussy about all that! They won't ask for it. You'll be surprised how easy it is. Just got to satisfy USCIS about proof of having met and then you're set. I sent colour copies of my passport, it just seemed to come out clearer. Not sure if they insist on that. I'm sure if it is clear enough to read the stamps then it should be fine. We actually sent copies of both our passports showing the stamps.

If you are using USPS then send it to the PO Box address you mentioned. Seems it has been brought up before:

thank you :) I think I actually spoke to you before but we weren't ready then to fill out the application and you helped me out a lot :) thanks !!!! if I'm sending it like next day and want a signature, can i use the USPS? is that what one would recommend??? I'd like to be able to track it and know when it gets there. also I was planning on writing a check to make sure i know when it was cashed. is that alright??

Yeah I remember we spoke. I'm glad everything is obviously going well and you have decided to start the 'journey'! :)

We sent ours USPS and it got there, although I don't think we paid for next day. You can choose to have it signed for if you like and also you can track it on the internet. We also sent a check, which is fine.

K-1 Fiance(e) Visa Process & Proceduresevidence of meeting?

so I'm looking at this as I'm wanting to send this out tomorrow after getting my passport photo, and I have my boarding passes going into London, will those be alright if i make copies of them? do i have to show my return ticket as well? and well I'm not sure if you can find your itinerary for your past trips because he cannot find his boarding pass for his last visit here in february. bit bummed about that and I'm wondering if it's going to cause a problem or not? i have emailed to see if they can send me them in an email and i can just print them out but haven't heard anything from the airline yet. I also have a lot of pictures, and I want to keep my originals as i only have one so i can make copies, but do they have to be on photo paper??? also, we have a lot of skype phone calls - does anyone know how to print out a log of the phone calls between us??? i dont want to print out all of it cause its got to be a whole lot of paper that I'm sure they don't want to go through. thank you !!!!

Boarding passes are ok as long as they show the date including the year on them. A lot don't. One of the best things to send is copies of your passport stamps. You could also send receipts from hotels, restaurants etc. You don't need to send skype logs if you have this other evidence.

K-1 Fiance(e) Visa Process & ProceduresFiance coming to visit

We've just gotten the NOA2 a couple of weeks ago so we still have a few more months to go. We're waiting on the police cert from Malaysia before he can even get the interview scheduled. He called the US Consulate in London to see if he is allowed to come visit while the visa is being processed and they said yes as long as he can bring evidence that he IS returning to the UK after two weeks. Couple of questions...

1) Is that true?
2) Would the return ticket, a letter from his boss stating his date of return to work and a letter from his landlords (in his case, his parents) stating that he is paying rent through X date so he will be returning be sufficient? Would they need to be notarized?

I know3 I've asked a lot of questions on here but after what we went through with USCIS (almost everything they told us was incorrect), we want to be absolutely sure!

Yes it is true. Take the evidence you mentioned along with anything else you can think of that suggests he is returning home. Just remember, there is never a 100% guarantee they will let him in, but he will very likely be fine. I visited many times and they let me in each time, although on one visit they did harass me a LOT!! If this happens, just tell him to stay calm and don't lie about anything!!

K-1 Fiance(e) Visa Process & Proceduresabsolute divorce decree
Thomas70 clearly has not been divorced in the UK. I have. None of the documents - decree nisi, decree absolute, or otherwise - carry a judge's signature. The decree absolute has a red court seal. I received the same RFE as the OP. I returned a copy of the decree absolute with an explanation that these are not signed by a judge in the UK. USCIS accepted this and I got my NOA-2.

I did speak to a solicitor in the UK after receiving the RFE to see what to do. The solicitor told me the same thing- judges don't sign divorce decrees in the UK. The only way to get a signed copy is to write a letter to the court asking for a copy signed by a judge. They charge a fee and you have to wait a week or two. The official divorce decree does not have a judge's signature, but if you want to pay the court, they will sell you a signature. Another option that is cheaper and quicker is to have a solicitor certify that it is a geniune legal document. Again, this is not required by USCIS.

K-1 Fiance(e) Visa Process & ProceduresTraveling when k1 visa is issued to get married in another usa state

Hello guys,

I was wondering if i can travel from Washington to Hawai to get married without problems when my k1 visa is issued.

To be clear, i will leave France to go to Washington where i will be living with my future husband, then go to get married in hawai and then come to Dc after a week.

Did anyone done this before with no troubles please?

Xxso

Yes, you can get married in another state. We live in Missouri and got married in Las Vegas. Our very good friends that live here in Missouri got married in Hawaii. The only problem with Hawaii is that the state takes a long time to process and send your marriage certificate. It took them 5 weeks to get a copy of theirs. If you are in a hurry to do AOS and get a work permit, it will delay you a bit. If you have time to wait, then there is no problem with Hawaii.

Not all states are the same. In Nevada, we applied for a marriage license and got it the same day. When we got home a couple of days later, I put in a request for a copy of the certificate and received it in days.

Hello, my fiancee's petition of 129f got approved last December. We are waiting for National Visa Center to forward the package to Embassy in South Korea. My question is... can my fiancee visit U.S. for 2 months with her B1/2 visa while we wait for the processing by NVC?

I'm sure this is an ongoing discussion, but with the 129f approved already, does it make any difference in the probability of her entering?

Thank you.

Hi,

My fiancee applied for her social security card after 14 days upon her arrival in US.
After a month, we didn't get the card so we checked back with the SSA and they said it might take up to another 2-3 weeks because of their error.
I'm getting worried because her visa is about to expire and we can't get married because we don't have marriage license.
Is there a way for USCIS to extend her K-1 Visa? I mean we're trying to get married but we just can't!

K-1 Fiance(e) Visa Process & ProceduresDealing with my RFE
Its not that you need to have any one specific thing to make this work. You need to simply supply enough stuff that someone who does not know you and whose job it is to be suspicious will believe in your intentions. Simply gather up all those little things with dates on them that you can. The visa copies in color simply show more effort and that can be rewarded also, a letter from a friend signed and dated is help, as is pictures and any receipt. If you truly want this, then spend 1 day to gather all you can, get a letter from a friend, write some info on the back of a few photos, run to CopyMax and make a few 20 cent copies or your passport and anything else with those dates and send it back. Its not rocket science to them, its just about going thru the steps.

K-1 Fiance(e) Visa Process & Proceduresplease help me...lawyer is confusing me
The request by the lawyer is just to make it easy for them. A lot of them and the one I had chosen did the same. They ask for everything you will need the entire process up front, then they create the packets for you at that time. Then they file and wash their hands of it. Only to send the rest back to you at time of approval. They just don't want to have to deal with you very much during the process so they do this instead. Problem is it doesn't always work since you need fresh information and forms at the time of interview. You don't seem to be rolling in money. I would take some time and do it myself if I was you. There is more then enough help here to make it on your own. Don't waste your money with a lazy lawyer.

Thanks everyone for your input. I am planning on submitting my petition in Oct after my return from meeting her Mother and Father, and officially asking her to marry me in front of her family and give her my ring.

We met 3 years ago while I was in Beijing and I though about having her come visit the USA then but it got too complicated. I went back again this spring for 2 months and decided to take the jump.

I feel like I'm falling in a black hole with only our government to save me. Talking to her for an hour everyday on Skype helps.

I'm sure I will have other questions as time goes on.
