I have got my letter from the US Embassy London informing me that they have received my approved petition ....

What im not sure about is this line .....

 

"please request your fiance(e) to make a notarized statement of intent to marry within ninety days of your arrival in the US" .............

 

I just thought he had to do another letter with a more recent date on it ? where and how does he get it notarized ? Would it be with a Lawyer ?

 

Also ...."All fiance(e) and K3/4 visa applicants must each pay $240 prior to their interview" ................ im sure i read some where that this is a payment for me and not my 2 children (both under 16) ?

 

so is it $240 once or $240 x3 ?

Hi VJ ..... I am at the point of being able to send my form 2001 so i can get my interview date . The only thing stopping me is a police report from Spain . I sent off for it over a month ago and still nothing ! by law it should only take 10 days plus a few more days for postage, ive called and they are very unhelpful  ... Has anyone else sent for this report and what sort of timeline did it take ? Im getting so down about this as its one thing after another and patience is running very thin lately ........

Hi Vj Friends ,

I got here Oct 25 in usa ... But i have some questions regarding some paperworks that i got recently which is i dont know what those papers for..

1st of all.. my poe was GUAM .. when i was in Guam Airport (Immigration) my experienced there was good ... Immigration Officer was good and nice to me.. They asked for my Sealed yellow PACKET which i gave to them ... So after like 5 mins they gave me back a Yellow Envelope , called M-708 that has a printed name of Dep of Homeland Security..o my inlaws
Now i dont know whats this for or where i will use this ???

Then after like my 4 or 5 days here ... we got a package fr US Embassy .. But we will see that package on Fri when we get back to my inlaws house since thats still our address ...

I just want to know what are those paperworks and what will i do with them..'

thank you! I basically had the same question as I am finally getting ready to send in my K1 Visa application for my fiance who is also in Romania. We started thinking about applying for a K1 back in June when he was denied a visitors visa. I have visited him in Romania twice and we met in Mexico for a week just recently. I have hundreds of pages of messages and I was only going to include a few since i have pictures and boarding passes from all 3 visits. I also have a paid receipt from a ticket I purchased for an upcoming trip to see him in bucharest in december, so i was hoping that copies of all the skype and fb messages would not be necessary. I hope to send my packet in on Friday :) Good luck - Keep me posted - will you be going thru the embassy in Bucharest?

Hi, I'm putting together my K1 Visa application and I'm pondering whether I should print all of the facebooks messages me and my fiancee exchanged? It's in another language so would it have to be a notarized translation of the facebook messages? There are about close to 1000 messages and I would literally be sending in a novel. Also how many pictures would suffice as proof of having met? I have fifty pictures that I could send from various parts of the foreign country where we met. Thanks in advance for any help! :)

There is no need to be arrogant. I was physically separated with my ex-wife by the time I started my relationship with my current fiancée. Both my ex-wife and my fiancée knew for each other. I explained everthing to my fiancee - of course she was a litte disturbed but she knows everything.

so true! People should not judge not knowing the circumstances. I will tell you that you are not the only one who started a relationship with your fiance before your divorce was final. I met my fiancee while i was still married. I was in an abusive relationship that was not so easy to get out of - especially since my ex is an attorney. My fiancee gave me the strength and courage to get out from under the abuse and live a healthier life. You need to be able to prove that your relationship is legitimate and you are free to marry at the time you apply for the petition. If you are then no need to wait! Good luck! I've already posted there, and this is technically about a tourist visa, but I need to hear from people who have experience within the context of the K1 process. We have decided that it is absolutely not worth trying to hide the previous K1 petition. She's just going to go in and lay it all out on the table.

There have to be some people on this site who've done this. Just to sum up, we canceled a K1 petition last year because she was unprepared to take that step after such a short time. Now she wants to visit New York to see how she feels here. She will absolutely go back to Uzbekistan, whatever she decides. She has a lot of beloved family and needs to deliberate. She's an open person and would not be able to pull off a lie anyway, and I think any interviewer with half a brain will see that.

Still, has anyone done this? Have you gone in for the tourist visa and said, "Yes, I'm thinking of emigrating, but not yet. I have a love interest in the U.S. and we even started a K1 petition before, but really, I'm not going to overstay. I want to check it out first, but I will be back to say goodbye to my family and begin the K1 process and wait my turn." What are the chances of getting a tourist visa this way? Someone in the other thread mentioned that it may work in her favor that she didn't want to rush things last time. Thanks!


If her country has a high refusal rate for tourist visa what will be most important is that she show strong ties to her home country and intent to return on a specific date. My fiance is from Romania which also has a high refusal rate and he was denied a visitor visa twice-they told him it was because he was not a property owner so couldn't show strong enough ties to his home country.The first time he said he was going to visit a friend and showed them a specific itinerary of what he planned to do while here. Second time he said he was going to see me. This was before we applied for K1 - it would have been nice if he could have spent some time here but since that wasn't possible we met up in another country for a week where neither of us would need a visa. There is thread posted on here about yes you can visit while applying for K1 -i know it isn't exactly what you are asking but the posts have good information on what they had to show to enter the US - also,keep in mind, most of those post came from people visiting from a country that participates in the visa waiver program - i didn't see any from someone in a country that is not in the VWP.

My fiancee is also from Romania and was also denied a tourist visa - twice. It is my understanding that this is not uncommon and a tourist visa from Romania is difficult to get. I was concerned as well about the impact that would have on our K1 visa, but was told by an immigration attorney that it should not be a factor. I have been to Romania a couple of times since our initial meeting - it did get difficult for me to always go there so we met in Mexico where neither of us needed a visa, and it saved me some travel time ( only a couple hour flight for me instead of 18 hours) and we were able to spend more time together. His visit satisfies the requirement of having met in person one time, but it will help if you can meet again as you will need proof of an on-going relationship. Visa Journey has been very helpful! As others have suggested read the feedback on the Romanian embassy.

DeeDee, another VJ member that I chat with had her interview at the Romanian embassy a month ago and she said they asked her questions about her engagement ring and made an issue about the fact she was wearing it on the wrong hand. (Needed to be sized- i have been doing the same thing ). Apparently the ring is a bigger deal at the Romanian embassy, so I think I will get mine sized so I can wear it on the correct finger when I go with my fiance for his interview.

Neither the K1 nor the CR1 is going to seem fast and easy. Which ever one you choose is going to take time and patience and $$. You should pick the one that is going to give you the best outcome for your specific situation. My fiance and I agonized over which one would be best. I read the forum guides on k1/Cr1 so many times i think i have them memorized. I really wanted to do the CR1 but like a previous poster stated, it would have been difficult to marry in my fiance's country due to translations, waiting period, etc. Not to mention he would have had to plan the entire wedding lol :). Which ever process you pick, do your research, prepare for it and follow the rules and guidelines, if you think something is questionable, don't do it - it could come back to haunt you later. They asked me if i wanted to provide an email address for the beneficiary. The told me they received the petition 2 days ago but couldn't tell me when it would be sent out. I'm not sure there is anything you can do to "push it long". While things do move a lot faster once you have your NOA2, it can still take some time. There is a current thread on the amount of time it is taking for petitions to get sent to and processed through NVC. For me it was longer than I had anticipated.

It depends on whether her daughter's biological father is on her birth certificate and what the custody arrangements are. The information whisper gave you is correct. In Colombia it can take four to six months (or more) for a mother to get sole custody, and to do that she may have to prove abandonment or abuse by the father. The permission to leave can be indefinite, but as long as they have joint custody, the father will have to grant permission over again each time your fiancee visits Colombia with the kids and wants to return to the States.

If the father is like some Colombian (or American!) men, he'll sign the first time the mother threatens to leave the kids with him! Kids would hamper his good times!! wink.gif

I suggest you check out the Colombia Club forum as well. I just posted a sample letter that has worked well for my wife and her boys.

Lets wait and see the result of your actions before you go recomending them to others..... It is very easy to prove you are married but it is very hard to prove you are not.... lets hope your interviewing officer understand what you have done and that you have some form of proof to show them that you are not married....

You would be making a huge mistake to marry after you have waited this long. Patience is a life journey, not just for a K-1 or anything else. My darling 18-year-old daughter died in my arms 5 years ago from an asthma attack (on Easter Sunday). I have to wait for my eternal trip to see her----i HAVE to be patient for this, so you can be patient for your K-1

My USC wife was pregnant when we went through the process (she was in the UK with me). We made inquires if this would help speed up the process, we were told it wouldn't make a difference. Since my son was born near the time we moved the only hassle was getting him a US passport. we had to register his birth and the US embassy in London put a rush on his passport (which we got 1 week before we were due to leave).

I did find at the embassy that since we had a child together it prove that we were in a committed relationship.

You are in the same situation as i am. i had the same thing. BUT i was legally divorced when i filed the I-129F. Foreign affiars manual says that we need to be able to legally marry. I guess we are good. But depending on the consulate they might think the morality of the issue. Lets hope nothing goes wrong.


Yeah, we filed the I-129F in August so I was legally divorced too. I was just worried how it looked to an officer dealing with the case, because I was still married until July (obviously he/she wouldn't know that my wife and I had separated almost 2 years before). Thought it might raise a red flag and make it look like the relationship with my fiance wasn't genuine.

Hi, was hoping for some advice and possibly hear from anyone with similar circumstances. Here is a description of our situation.

I am the beneficiary in the UK and I met my fiance in the US in Dec 09. She visited me in the UK for New Year and then I made trips to see her in Feb, March and April. She then visited me in June and July and I recently visited her in September, so there is plenty of evidence to prove this is a genuine relationship. My issue is as follows. I was married to an English girl in May 2008, but we broke up in September 2008. We didn't actually get the divorce completed until July 2010 even though we weren't living together or in a relationship since Sept 2008. I got engaged to my fiance one week after the divorce papers came through, but we were obviously having a relationship while I was technically still married. When we sent in the I-129f, we included a copy of the divorce certificate dated July 2010. Having done some research I discovered that this might be a red flag issue on our case, because we were having a relationship whilst I was still married, and because we got engaged so soon after the divorce.

Is this likely to be the case and do you think it will cause us problems? I have got paperwork from the divorce proceedings, stamped by the court, that state I separated from my wife in Sept 2008 - should we have sent this in with the I-129f? Or can/should I send it in as extra evidence now, or is it better just to sit tight and wait? We have already had the NOA1.

Ok, I don't want to put a damper on things here, but there are a lot of people telling their stories of how easy it was to come visit during the K-1 process and that you won't have a problem, which is fine, but I also think you should be aware that it doesn't always go so smoothly! We have filed our K-1 and are waiting on the NOA2. I recently visited my fiance in September for 10 days. I was asked the purpose of my visit and who I was visiting and I was completely honest and forthcoming with my answers, stating that it was vacation and visiting my fiance. Now I don't know if the BPO was just having a bad day but she went a little crazy. I am not exagerating when I say she was extremely rude to me and asking many questions in an aggressive manner (very different to the standard questioning manner I have received in the past). Now she did let me through eventually after much huffing and puffing and hammering into her keyboard (who knows what she was putting into the computer), but she told me I could not return to the States during the K-1 process for longer than 10 days and if I did, in her words, "Your K-1 is finished". Now first off, to my understanding, they can either let me in under the VWP for up to 90 days, or they can turn me away and send me home. I really don't think they can stipulate that the next visit can only be 10 days or less (bearing in mind over the last 12 month period I have only spent 61 days in the States in total, including that 10 day trip). Secondly, I am pretty sure that this has no effect on the K-1 process no matter what decision is made at the border, unless I have overstayed at some point, which I haven't.
Anyway, I guess what I'm trying to say is it's not always as easy as some people make out. I think it all depends on the BPO on the day. I did notice that the BPO I had gave the same treatment to the South African guy ahead of me also, and he was pretty shocked by her reaction too! So just be prepared that you MIGHT get some flack on the day. Bring as much evidence of ties back home as you can. I also brought a copy of the I-129F etc but she refused to look at it!

By the way, not to be put off too easily, I'm heading back over next week for 80 days! Who knows what will happen at immigration this time. Just hope I don't get that same officer! :wacko:

With regards to affecting the K-1 in the event of refusal of entry, if he is refused entry for no other reason than they were not convinced he was planning to return home, and conducts himself in a proper manner (doesn't argue or get angry etc) and accepts that he will have to return to the UK, then I don't think it should affect his K-1. This is just my opinion, based on research I have made.

We are also going through the K-1 process and I visited my fiance in September and again now. In September I came for 10 days and got hell at the border, but after much intense questioning they let me in. This time I am here for 3 months and they just let me straight in without any problem at all - I think they asked me 2 questions and that was it. Both times at Houston.

I think it's just luck of the draw who you get and what kind of mood they are in. But it is perfectly ok to attempt to visit, just bring loads of proof of ties back home. Hope it all goes well.

Here is an old post I found that I have copied. It shows that even if you get turned away on your attempted visit, it does not affect the K-1.



It is a case of hit or miss depending on which POE you have.I came over to visit my then fiance to stay for 88 daysduring the process and was denied entry, I had all the paperwork for strong ties to the UK return flight letter from employer etc etcbut that did not matter i was denied and sent back on the next available flightNow I am a permanent resident with a conditional green cardit made no difference that i had been turned away in the long runIt was mentioned at interview for AOS but the interviewer said it was more common than you would think.Good luck on your journey it is all worth it in the end.

#1. The letter from Customs that said not to go was from an individual giving his advice. Since he can't promise you will get in and he isn't completely sure about how it affects the K-1 (because he works for an info center for USCIS, not on immigration visas specifically) the safest answer is to advise you not to go and therefore, you will have no problem. He's covering his butt, which is more or less what you have to expect from those types of resources. Perfectly respectable, but not very helpful to us. #2. I have visited Meg twice while waiting for my K-1 approval. The first time was a 10 day trip and I got hell at immigration, but I got through. The second trip was for 80 days and I sailed through after 2 questions. I think the most important thing that helped me was that I was honest. If you say that you are visiting friends and they are satisfied and let you in, that is great, but if you say that and they ask you another 67 questions, it might be hard to keep to your story. If you call your fiance a friend and later have to admit that you're engaged, it may make you look shady to the officer. We agonized over the decision of whether to say I was visiting a friend or a fiance. Many people have been successful both ways and you will get advice for either path. In the end it just has to be your call. (But I am strongly in favor of complete transparency)

#3. I am also self-employed. I sold my house and moved in with my mum to get rid of the house while there was still a market for it and save some money. All I had was a copy of the I-129F and NOA1, a return ticket, bank statements to prove I could support my trip, a letter from my mum stating that I live with her, pay her rent, and have left my belongings at her house and am expected back, and also a letter from my accountant stating that my company is trading and he is currently being paid to keep the books. No one looked at any of this on either trip, but it is good to have, just in case.

#4. Visit your fiance! You cannot imagine what you will miss out on if you don't try. Just go with the mindset that it is possible that you may get turned away. Skype kept us going, but to spend that kind of time together is just not substitutable. If you are lucky enough to have the means to do it, you have to try! Plus, it makes the waiting go by so much faster!
