Really sorry to hear that patiently waiting, but as you have said this is only a "setback". I really hope that it is only a short setback.

Hmm... it seems that what i had posted from the manila virtual embassy chat session was accurate and that many visa have problems because of former marriages. That is really food for thought. I have only been on this site for a little while, but first i have seen jazzy have a former marriage affect his fiancee and now PW.

There is a lesson here for people who have "unusual marriage circumstances". Triple check to make sure that within the eyes of the embassy officials that all previous marriage have been anulled.

Really hoping that judge says that the one annullment is all the is neccesary for you PW.

Alright i went to the virtual consulate chat session for manila. It was alright, but way too many beginner questions and/or uninformored questions (can i file for a k1 if i am still married to another, can a k1 visa be extended for a year, ect) But here are some highlights: (note administrator is a persons question and consulate is the consulate representative)

Administrator - kid - Much of the documentation my fiancee will present during her interview in March is from about 3 months ago because we completed everything early. Is there any problem with our paperwork being that old? Everything is still current, no changes of significance in that time.

Consulate - Some of the documentation necessary for the K-1 visa application does expire, e.g. the local police clearance, the medical. None of the relevant documents expire within a three-month time period

Administrator - enigma - If the beneficiary's address for the delivery of the packet cannot be located by the courier, how do you notify the petitioner/beneficiary?

Consulate - We send packets to the petitioner and the beneficiary. If the address is incorrect please tell us immediately. Applicant may also pick up the appointment packet at St. Lukes Medical Extension Clinic

Administrator - mikaela - IS IT 100 PERCENT POSSIBLE FOR A K1 APPLICANT CAN PASS THE INTERVIEW IF HER FIANCE WILL ACCOMPANY HER ON THE SCHEDULE DATE AT THE EMBASSY?

Consulate - Mikaela – The presence of the petitioner at the fiancé visa interview is optional. About 90% of our fiancé visa interviews take place without the petitioner being present. If there is information that the petitioner can present in the interview that will be useful, they are welcome to attend but again its not mandatory

Administrator - pathdoc78 - i didnt see an answer to my question i posed,,,is age a factor in the visa being granted?... for instance, is there an age cutoff, since i heard it may be more difficult to get a visa if the applicant is under the age of 30...please advise

Consulate - photographs, letters, remittances etc can be helpful indicators of a good relationship.

Consulate - Mikaela – You must have a valid NBI clearance at the time of the interview. In the Philippines the NBI and Police Clearance are the same thing. The NBI clearance is valid for all of the Philippines and local police jurisdiction clearances are not necessary. If the applicant has lived in another country for 6 months or longer, he/she will need a police clearance from that country as well.

Administrator - slimjim - What happens if for some reason you are unable to marry with in the time period. Is it possible to try again later?

Consulate - There are no restrictions on the age of K-1 visa applicants, but all factors will be considered when determining if the relationship is genuine

Administrator - lasprec - is there a limit on the number of visas that are approved in the philippines? Consulate - There is no limit to the number of K-1 visas that may be issued in any country.

Administrator - springdays - What are the most common reason of Administrative Reviews and Denials of K1?

Consulate - Springdays – A common reason for administrative review for K visa applicants is the Marriage Index (MI) check. We generally run an MI check to determine whether or not the K visa applicant has an existing marriage to the petitioner or to someone else. You cannot enter the U.S. as a fiancé of an Amcit if you have an existing marriage that has not been legally terminated

Even if the paperwork has been completed correctly there are some common problems with K1 visas that can prevent the issuance of the visa. These include: prior unterminated marriage, lack of domicile etc. If the consul determines that the applicant is not eligible the consul will either: explain in writing how the applicant can correct the problem by submission of lacking or additional documentation OR they will give the applicant a written explanation of the ineligibility and return the petition to CIS

Administrator - patrick - What form of Financial Documentation is/are required for my fiancee's interview process???

Consulate - the appropriate affidavit of support as well as the last three years of tax returns. You must show that she will not become a public charge.
Consulate - In follow up to the financial question we need to see income and asset information to ensure that the person will not become a public charge

Administrator - enigma - How do you send the packet of instructions? Via postal mail or via courier? Consulate - via postal mail so please tell us if your address has changed

Administrator - dorothy - why is the fiance visa process faster than a spousal visa?
Consulate - Dorothy The K1/K3 process was designed to be faster than the IR process b/c of the delays in the IR process. The IR process is getting faster. There might eventually be a time when the K3 process will not be necessary.

Administrator - patrick - Will three years of Income Tax Return be sufficient enough plus the I-134 form??? Consulate - IF your income on your tax returns and the W2’s indicates that you meet the Federal poverty guidelines, it normally is sufficient
Administrator - james - What if a fire took tax returns but you still have W-2's...will they be sufficient enough?
Consulate - You can contact the IRS for copies of your tax returns

Oh an here is my question which was finally answered after waiting an hour

Administrator - kansas_city_usc - if my philippines fiance worked in a foreign country for over 6 months, but cannot get a police certificate from there because it is on the list of places where "a person must be physically present to recieve police certificate" then will the manila embassy still require that police certificate, even thought it is impossible for her to get?
Consulate - Kansas City – Police clearances are not required from countries from which they are not available. Information on individual countries is available from travel.state.gov/visa/reciprocity/index.htm

And it looks like the time in AP can vary quite a bit. UGH...i thought i learned my lesson in patience with the 5 months it took for the noa2... guess i have a bit more to learn!
I think the worse part is I thought we were almost there - I thought this part was supposed to go quick. I had planned my vacation for June so i could be with my fiance for his interview....not looking good for that. But... Zambeste! (smile) we will get there!

Got my NOA2 on Apr12, 2012. NVC still has not sent out case out to the embassy. A week ago NVC told me they had received our case and it would go out the next day. I called today - a week later and they said our case has not been forwarded on and that it was undergoing some additional processing and he could not give me a time frame on when it would be going out. He said I would be receiving more information from them and to call back in another week or so. He would not give me another other information. What does this mean? Will I need to send them something and how long does this typically take?

It took our case 2 weeks to get from CSC and put in the system at NVC and then it took 3 weeks to get from NVC to the consulate in Bucharest. (When I called I was told our petition was in additional processing)
So it was a little over 5 weeks total from NOA2.
Once our petition reached the consulate in Bucharest it went really fast.

For purposes of filing your state taxes, you should contact your state's revenue department, but what I found in Missouri applied to both my federal and state tax returns.

You can file as single and amend your return later - though this merely moves the "complications" from now until later. You can file married, but filing separately - the downside here is that your return will be much smaller. Or, you can file married on a joint return. To do the joint return for a non-resident spouse, you need two things to go with your return: a W-7 form, and a notarized power of attorney form, signed by your spouse, and specific to your state. The power of attorney must specifically say that you (the US citizen spouse) have the authority to prepare and submit all tax related documents for your non-resident spouse. Of course, such a power of attorney can be essential for other financial matters such as purchasing health care and entering into financial agreements (i.e. loans) if you live in a joint property state.

The power of attorney does not have to be notarized by an American embassy. It only needs to meet the requirements of your state law and the law of your spouse's country.

You submit these two documents with your federal return. The IRS will issue a tax number for your non-resident spouse. In all probability, that number will be sent to your spouse's foreign address. You can then use that number on your state tax return, but just remember to include another copy of your power of attorney form with your state taxes. If you anticipate delays caused by foreign mail delivery, it might be wise to request a filing extension from your state.

As pushbrk indicated, your I-130 is being held. The government (for whatever reason) automatically assumes you will want to proceed with the I-129, which does tend to go faster. With the K-3 process (the I-129) your spouse will receive a non-immigrant visa. This means that after your wife gets here you will still have more work to do with the adjustment of status. It's up to you as to how long you want to be apart. In regards to your questions, here's what little I know about it:

1. Does anyone know what to expect next? It depends which route you choose. Read through posts on this site related to your choice. You can expect some waiting, but you should also be prepared to move quickly on some things. Read, read, read.
2 .Do I need to submit more paperwork? At this stage, your wife will be the one preparing paperwork. She'll receive a packet (packet 3) from the embassy there. You should be working on preparing the I-134 paperwork. Most of the rest will be hers. Follow all instructions to the letter. And read information contained on this site.
3. How long does it take for the acutal K3/K4 visas to be issued after these appovals? Most of the time now will be related to mail and preparation time. Her interview won't be scheduled until she returns packet 3, then things can move quickly. Again, read, read, read.
4. What would anyone recommend for me to do while I receive the approval letters? Make yourself aware of what you need to do. Educate yourself. Prepare YOUR paperwork now, so that it is ready when her interview comes up.
5. Is this the end of the long wait? or is there more waiting ahead? All good things come to those who wait. There is more waiting but the time is winding down.
6. How long will it be until I actually can bring my wife/child to the USA after this step of the process? That depends on how quickly she gets packet 3 sent back in, the interview is scheduled, and you and her have everything ready for packet 4 (which she will take to the interview, as I understand it). She should have her visa within a few days or couple of weeks after the interview. Then she is free to join you! Good Luck!!!

I'm a bit confused...I saw some people post that if the I-129F petition is transferred from MSC to CSC "in order to speed up processing" [ - as was written on my I-797C], then that may mean a visa approval without the interview abroad???


Thank you, Yodrak. Could you please elaborate? I'm pretty sure that the K3 petition I have mailed to UCSIS was an I-129F. That is the case that just transferred for processing at CSC. What is an I-485? I also understand that USCIS does not approve visas, but they can certainly speed up the processing for turnover to NVC.

You are correct. An I-129F is referred to as a K petition: K1 for a fiance(e) and K3 for a spouse. USCIS is only the initial approval level. They determine, among other things, if the prospective visa recipient is a security threat. The Department of State (at the NVC) receives approved petitions from the USCIS. The DoS can also deny a petition prior to a consular interview if they find something wrong with the petition. DoS is also the agency performing the interview at the individual embassy. This is the next to last step in the process. Assuming the recipient is approved after the interview, the final step is talking to US Customs and Immigration officials at the Point of Entry (POE) in the US. Once that person or persons approve the visa - Welcome to the US!

dont worry about it. she dont have to have the interview By that date. ignore the date because, the petiton is at the embassy. more than likely since you have I-130 approval your k-3 will be cancelled.

Hate to disagree with a member with more experience, but my understanding is that the I-130 (CR-1) process is put on hold when the I-129 is approved at the same time (or before). DOS will assume that you want to proceed with the K-3 unless you tell them otherwise.

We've finally heard some news! Both our I-129F and I-130 were approved on April 9, 2007. Of course, now we must choose which one to follow through on. And we are having some complications from my wife's ex. He is now saying he will not give permission for their two sons to travel out of the country. Anyone have any experience with this?



Oh boy, now that's a tough one. Have you tried talking to him and convince him that the children will be very well taken care of? :huh:

I hate to say it, but the children are not really the "issue" with him. He's just trying to use them as leverage to manipulate their mother (my wife). I'm not sure what the custody laws are like in Colombia - or if the officials would even enforce them. As far as me talking to him, that is what he has claimed he wants, but neither my wife or I believe him. He's abused her in the past and has a less than savory history. He's very full of the stereotypical machismo that is often ascribed to Latin men. I'm sure we'll get around this, but I'm also worried that it will eat up more time, and could put us past the four month window Lorena has to get her visa (using the K3).

I have an update which is really a "non-update". I called the toll-free number today, as suggested by the auto response on the timeline thingy here, because my I-130 is past the average time it takes for processing. Though I did get to talk to a live person, they merely quoted back to me the same dates and processing times available from the USCIS site.

Am I mistaken or is there really no value in calling them until the date on the processing page at USCIS is past?

My problem is that I have everything from the I-129, but I can only locate the cover letter and first page of my I-130. Everything I'm reading says she needs to have the I-130 in hand. Are we screwed? Will I have to start all of that stuff over again? You can't imagine how much of an idiot I feel like. I sure hope someone has some ideas. Any help will be appreciated. :crying:

You should check out the Colombian posts in this section, they have a lot of info that you may need.

The vaccinations needed for Colombians are: TD, Varicela and MMRR. They can get them at the Red Cross about a month before their medical and they can also bring a valid record of them to the US should they need it.

Do most people need all of those? The Colombian embassy only requires varicella, mumps (or is it measles?) and Tetanus and diptheria toxoids. Just those three. :huh:

I think it is varicella (chicken pox), measles (and possibly rubella, which is a form of measles usually covered by most vaccinations), mumps, tetanus and diptheria. In the US, a MMR shot covers measles, mumps and rubella, while a TD shot covers tetanus and diptheria. So, that may be where you're coming up with three shots: MMR, TD, and varicella. :thumbs:

My 130 arrived at NVC on Jan 22 and I don't have a case number yet. I have been told each time that they have not entered the information yet. I have gotten lot of questions answered on my 1 minute calls :) I asked about stapling or paper clipping and two people have told me that Brazil is a paper consulate so none of my documents will be scanned in so stapling is fine. All of the pertinent information will be entered by hand. I have also asked about translating documents and they said that Portuguese is not a problem language for them and that they will just check off that they have the correct documents to be further inspected by the consulate. I am not sure if these guys are just CSRs or are actually working on cases and what their knowledge level of the process is, but so far they seem pretty good on sharing info....not sure what a problem language is haha.

Hey, I'm glad you have a lot of questions answered. Every time they asked me what else, I clammed up since I didn't know what to ask. You can instruct me what questions to ask. I'm gonna do EP.
I think the ladies on phone are just contractor agents, answering phones, not the government employee working on the cases.
