K-1 Fiance(e) Visa Process & Proceduresestimating time of K1 process to set wedding date

Wow that sounds so beautiful! I would definitely not be adverse to the idea as I think the stress of planning it may well ruin the experience for me on the day, plus im a private kind of person and dont like the thought of there being hundreds of people there. What state did you get married in?

We live in Missouri but we got married in Wisconsin. It was beautiful and private and so stress-free. We had so much fun - we have great pictures of us in the stream and on a little bridge in the woods - There was nothing to go wrong or be disappointed about because I had planned so little.
Kind of a long story made short - I choose Wisconsin because my sister lived there and she could be there with us.
It was so easy to plan - i called the shawano county courthouse, they gave me a phone number to a judge, we agreed on a location ( i had made a trip up to see my sister a few months prior and found what I thought was the perfect park) and about a week before the wedding I called a florist in shawano and asked them to make me a wedding bouquet I told them i didn't care about the colors just make it pretty - and also ordered a cake from a bakery - with the same instructions.
Total wedding cost:
dress - 170.00
suite - 300.00
judge - 100.00
flowers - 15.00
cake - 20.00
champagne -30.00

I wasn't trying to go for a budget wedding - I honestly thought we would do this and then have the real ceremony that we would plan later - NOt going to do that anymore - nothing could be better than it was - the day was perfect - I would rather use the money we saved to go back to Romania and celebrate with his family

K-1 Fiance(e) Visa Process & Proceduresestimating time of K1 process to set wedding date

yeah we are having the same issue with the bloody wedding date people want to know asap when to book it off and when to buy flights. Im so tempted by a court wedding but my mum would be devestated. With the ceremony etc. do you still have the vows and everything as u would of anyway?

You can have it how ever you want. When my fiance ( now hubby) had his visa in hand, and was on his way here, I called the county courthouse who put me in touch with a justice of the peace and we made arrangements to have a small ceremony in a park. We got married on a rock under the trees overlooking a beautiful stream. He asked me if I wanted to use my own vows, any music, etc and gave me lots of choices for the ceremony. It turned out to be the best day ever - with so little planning and no stress over it. WE have the best outdoor pictures. Most of all we had a blessed stress free wedding. you can have a "courthouse" wedding without it being in the courthouse.

K-1 Fiance(e) Visa Process & Proceduresa few questions about the process

I think anything "officiall-ish" in your name, from mexico will be ok, also maybe card statements if you made atm withdrawals or card payments.

Remember that to file the petition you only meed to prove you met once in last 2 years. For interview you might need to prove ongoing relationship.

You need both - proof of having met in the last 2 years and proof of on going relationship. Look through the RFE master list - people have received RFE for proof of ongoing relationship.

K-1 Fiance(e) Visa Process & Proceduresa few questions about the process

I figure I just bump this up instead of making a new thread.

I'm done with our packet and soon be sending it as soon as I can have her sign it and date it where she needs to. I got a few questions, I don't want no problems and have to get a RFE. So with the packet I'm sending:

6 pictures of us together during various stages of our relationship and 1 with family. Also 1 current.
3 pages of her phone bill which is an American cell phone that I pay for and shows her international calling to my cell. So will show a payment and calling to my cell within' past 3 months.
1 page of toll tickets that I saved when me and her went with my mom and her husband to Nyarit Mexico for a week to show that we traveled together. No photos because all were lost.

Just wondering if this will be enough evidence of a real relationship?

you need proof of two separate things.

1). That you met in person within the last 2 years, so, copies of passport stamps, copies of boarding passes or plane tickets, and pictures. Pictures are not considered primary evidence.
2). show proof of on-going relationship, so, phone bill, chat logs, e-mails, cards/letters that you have exchanged, also any plane tickets, pictures, etc from any other trips together.

Congratulations and Good luck on your visa journey!

K-1 Fiance(e) Visa Process & ProceduresWill it help?

I went to Ghana to give my fiancee moral support during her interview last year. As far as I am concerned, it helped that I was there. I was asked all the questions and the CO didn't ask my fiancee any question. I was surprise. At the end of the interview, the CO said that she is convinced that our relationship is genuine and she does not need any further document but unfortunately we were put under AP.

Same thing happened to me. I was with my fiancé for his interview in Romania. The CO ended up asking me most of the questions! If it is possible for you to be there then I would go. It will help for your fiancé to have the moral support.

K-1 Fiance(e) Visa Process & ProceduresTourist Visa denied while K1 Visa pending

Hi..Me and my fiancee ha just thought about it now and i was just trying to read online about it till i found this post..really made me sad. We thought we finally thought on how to get rid of the waiting for awhile but sigh...guess has to wait till our K1 visa is approved. Thanks for your post. Wishing us goodluck!

It might be different for your country. Wouldn't hurt to try. I was only giving my experience with the embassy in Bucharest.

K-1 Fiance(e) Visa Process & ProceduresTourist Visa denied while K1 Visa pending

It's a little late now, but not being in a VWP country, it would have been best to get the tourist visa THEN apply for the K-1 after the tourist one was approved. I'm guessing that the expense is too much for a family visit the other direction, so all I can do is wish you the best of luck and a speedy process.

Most likely would not have made a difference. My husband (boyfriend at the time) was denied a tourist visa twice - and that was before we had applied for K1 visa. He owned property - had a good job, no family in US, an invitation letter from the medical mission group that we both volunteered with and plenty of ties to his home country, but was still denied tourist visa - we were told it was because as an unmarried male he was considered an immigration risk. Later after our K1 interview at the consulate in Bucharest, we were talking with the CO and brought up the topic of the denied tourist visa and he said it wouldn't have mattered what proof he had, as long as he had a girlfriend in the US - he would have been denied. I made lots of trips to Romania and then we met up in Cancun, Mexico - because it was a short flight for me and no one needed a visa.

K-1 Fiance(e) Visa Process & ProceduresMarriage in a different state?

We live in Missouri - got married in Wisconsin.  Like everyone else has stated - check the requirements and - Make sure you get the official copy of your marriage certificate or know what you need to do to get it.  Some places will get it to you right away  - others can take a couple of weeks.  You will want it as soon as possible for AOS.

K-1 Fiance(e) Visa Process & ProceduresJust Wondering?

Yeah I didn't think it mattered. Just last minute worries- the interview is just 3 days away... unsure.png

Good luck on your interview!   I know its different for each embassy, but my husband (then fiance) had quit his job before his interview and his employment never came up.  The only work related question he was asked was what type of job he intended to pursue in the united states and what made him qualified for that type of work.   Read the reviews for your embassy so you will know what type of questions to expect.  If you are prepared, I'm sure the interview will go just fine!

K-1 Fiance(e) Visa Process & ProceduresJust Wondering?

It is the USC (petitioner)  that has to meet the income requirements and provide the affidavit of support.  Your income will not be included in that so it should  not make a difference.

I've read a few other threads about the wait time approaching one year for CSC? This is California Service Center, correct? Will my application go there if I'm from Oklahoma, or does it get somewhere else? Thank you for answering a basic question for me.

That's really good news. I let her know all of what was talking about in this thread and she's feeling pretty great about things as well.

Plus we've been meaning to travel over to Vancouver. This just gives us more of a reason. :)

K-1 Fiance(e) Visa Process & ProceduresQuestions and concerns regarding k1 visa

It depends on the country they're from, sadly. Some countries have high numbers of visa fraud, so genuine relationships are scrutinized and sometimes not believed.

Canada is one of the easiest countries to come from going through this process, so don't worry. It will not be a problem for you.

You've given me so much more confidence in this process. Thank you from the both of us. :-)

I think this is my last question for now. I've read conflicting information online that you find out after the interview if you are approved or denied. Is that true?
johnnyvMaleCanada2013-02-11 13:16:00
K-1 Fiance(e) Visa Process & ProceduresQuestions and concerns regarding k1 visa
It sounds like I got very lucky with her living closer to Vancouver.

You are probably right about those stories. Coincidentally I never could find any about the process with Canada. I know that we have a genuine relationship, but it shook me to read others had a "genuine" relationship but were denied.

In the instance if someone was denied and does indeed have a true relationship, what do they do? Sounds like a punch in the stomach.

I haven't read much about the AOS process since I've been so concerned with the k1 approval. I'm glad I started looking into all of this now.

Does the AOS process take a long time to complete so she may begin work, or is it shorter? Estimate how much it costs? (I see that you've had your AOS approved so I figured I'd ask).

I'm glad you pointed out the subforum. I'll definitely do some reading about the Vancouver process.

You suggested that we should apply in advance because the process can be rather slow. Once the visa is approved, how long do we have to move her here? I assume the 90 window to marry will not begin until she enters the US the first time after the approval, correct?

Where in Canada does she live? The interview will either be in Vancouver or Montreal. Those are the only two options. And yes, you are allowed to go with her.

She lives in Cranbrook, BC. It looks to be Vancouver is where we'll have to go.

Of course now that I have this forum to help, other questions I had have escaped my mind. For those who completed this process in Canada, how was your experience? Any particular advice?

Thank you for the responses.

I do have the divorce decree and will make sure to provide that with the petition. I also can provide tax proof regarding my income.

As for the interview, I've gathered that the interview is held in Canada, correct? Am I allowed to go with her?

K-1 Fiance(e) Visa Process & ProceduresQuestions and concerns regarding k1 visa
I am 24 and my girlfriend is 21. She is from Canada. We are wanting to get married and I have discovered the best route for her to marry me and move to the US is the k1 visa. We have decided she is finishing college first and then we will apply. We won't apply until mid 2014 but I like to be prepared and learn about this as much as I can beforehand.

I have been married once before. I got married when I was 21 and divorced in 2012. She was very difficult with me and we couldn't communicate. The girl from Canada is aware of this failed marriage. Will this failed marriage of my past make getting a k1 visa more difficult? I know they'll ask her questions about the marriage and she is prepared to answer them.

I have read online that the minimum requirement of income for two is roughly 15k per year. I currently make just shy of 29k per year. I would assume this isn't a problem. She won't have income once she moves to the states, but we will get her settled and find a job, naturally.

I've read many horror stories online that prompted me to make this post. Lots have been denied without review of relationship evidence. I thought the k1 process is to prove your relationship is genuine. Of course after reading these type of stories, I'm concerned about my own adventure. Does it make a huge difference in approval that she is from Canada than China for example?

I've read interview questions and I've read the process again and again. Because of my prior marriage, should I consult an attorney, or will I be fine doing this all on my own? As you can see from my post, I have lots of little worries. If you can address as many as you can, that would really help me a lot. I will chime in with more info upon request. Thank you all for your time! :)

I would also like to make note that we see each other about every 1.5 months for about 10-14 days. I'll be able to provide all itineraries for our application if it helps.

K-1 Fiance(e) Visa Process & ProceduresDifference in time from proposal to filing k1
I'm sorry, I don't think I made myself completely clear.

Currently she is enrolled in a teachers program for college, which isn't to be finished until June 2014. I know the process will take roughly 10 months and we planned on filing around September of this year, to hopefully be approved about the time she's going to finish school.

I planned on proposing to her in May when she comes down. But I was concerned if that I propose in May, and we file in September, she'll be visiting within that time frame. At that point is it bad to say we're engaged but haven't filed the K-1? Will that make them deny her entry? Does this make sense?
johnnyvMaleCanada2013-04-14 19:14:00
K-1 Fiance(e) Visa Process & ProceduresDifference in time from proposal to filing k1
I plan on proposing to my girlfriend (not saying when because she's on this forum too!) but the time from when we propose to the time we file will be separated by a few months. We're waiting to file, so if 10 months is the time it generally gets approved, she'll just be finishing school. So we'd like to finish school and get the approval around the same time.

My question is regarding crossing the border. Because there is a few months lapse, is it wise to say fiancee or continue as boyfriend/girlfriend until we've filed? I don't know if it would cause confusing or denial by saying fiancee but no K-1 filed yet. Any insight?

K-1 Fiance(e) Visa Process & ProceduresCouple questions over G-325a and I-129a
G-325a question:

My family name. My mother remarried when I was younger and is still with the same man, who I consider my father, but he's not my biological father. Do I put him or my biological father in the place for Father?

File Number A This is an Alien #, right? Most likely put None?

Regarding address, if you're not entirely sure where you stayed and for how long, what should you do? I stayed at a few places years back but for only a few months (these places don't even show up on my credit report). I'm also not sure about the dates. Are these REALLY looked into? I want to be safe.

I-129A question:

State/Country: Is MO/USA (Missouri/USA) and BC/CA (British Columbia/Canada) acceptable?

Question 10: There are multiple boxes for Q10 and I'm not exactly sure what applies to me and what doesn't. I was born in the US.

For the Arrival/Departure Number (I-94), I don't know what this is. There are multiple spaces for obvious numbers. Do I leave this blank?

And question 20, I'm just not understanding what I should fill in there. Is this where the interview will be?

I know these are really silly questions, but I'm going to just make sure I'm doing everything right the first time. Thank you. :)

K-1 Fiance(e) Visa Process & ProceduresProposing and cross the border

Well I cannot apply until July anyway because of a previous marriage and the laws here in Oklahoma prevents me from getting married again.  I assumed if I couldn't get married yet I should wait to apply until that time frame is over.

K-1 Fiance(e) Visa Process & ProceduresProposing and cross the border

I know being honest is best, and her last visit she brought proof of schooling and paystubs (she moved back home so she doesn't have a lease agreement), but they didn't even ask for proof.  I guess it's best to have it.  Yes, denied entry is what I don't want. :)

K-1 Fiance(e) Visa Process & ProceduresProposing and cross the border

So I just proposed on May 4th (YAY)!  But I have a question now about her crossing into the states.

We are not going to start applying for the visa until August.  She's finishing school (she's canadian btw) and she'll finish in June of next year.  If we apply in august, this gives us time to complete the k-1 process 6-10 months and allows her to finish school.  We don't want to apply too early, have it get approved early, and run the risk of using all 6 months to cross (at least I heard you have six months to enter the states after visa approved).

Anyway!

She's coming back in June.  Should she tell the CBP that she's my fiancee but we haven't applied for the visa yet, or should she just say I'm her boyfriend?  I don't want it to raise any red flags to say I"m her fiance but we haven't applied for a visa.  Thoughts? Am I worrying over nothing?

K-1 Fiance(e) Visa Process & ProceduresThings to use and not to use for Skype messaging

I'm going to use Skype Historian to collect our skype conversations, however, we're always on a call and generally don't type much when we're both home, aside from sending links.  Should I remove links that we send back and forth, etc? Also, do I need to do every single day, or can I just grab handfuls of days to collect and submit?

I'm just overall curious how others have handled their chat logs because everything wouldn't be appropriate, nor would I want to share everything with them.

K-1 Fiance(e) Visa Process & ProceduresQuestion 12 on I-129F

Question 12 asks if the beneficiary is currently in the U.S. and to complete the information about I-94 or I-95.  She's coming to visit me in 3 days (YAY!) and we're going to fill out this paperwork together.  She'll obviously be in the states during the time this is filled out.  I would put visitor as what she arrived as, but I don't know what the I-94 numbers and such are.  Has anyone ever filled out their I-129F together and handled this question?

Fill this out and add the information to your I-129F.  This is what I had to do recently because she was here visiting when we filled out all the paperwork together.  This made it easy on me, gives you everything you need to complete the question.

K-1 Fiance(e) Visa Process & ProceduresAbout ready to send the I-129F off (need suggestions/input!!)

So we are very excited to say the least.  I'm preparing our K-1 package now and getting ready to send it off in just about a month.  I want to make sure I have everything in order, last minute additions, etc to make sure I'm all set.

We each have our G-325a signed and dated, intent to marry letter signed and dated by both of us, I-129F signed by me (petitioner), a letter from our parents stating our relationship is true and genuine (we're both of age to marry but thought these letters would help), a letter from both of us stating all information was reviewed by both of us (we filled out the paperwork together while she visited), copies of passport stamps from our passports, to and from boarding passes (all that we could gather), itineraries of each trip we made (about 7 trips), 5-10 pictures of us together, including 1 with her and my parents, small portions of skype conversations (no full conversations) since January, and a passport style photo taken at CVS attached to our G-325a.

  • Petitioner I-I29F signed
  • Petitioner G-325A signed with passport photo
  • Beneficiary G-325A signed with passport photo
  • Petitioner divorce decree
  • Petitioner intent letter signed/dated
  • Beneficiary intent letter signed/dated
  • Passport photo copies
  • Itineraries for 7 trips
  • Boarding passes
  • Letter from parents stating true relationship
  • Photos
  • Letter from counselor for pre marital counseling
  • Skype conversations

I think that's about all I have in the package (I'm doing this by memory so hopefully I'm not forgetting anything).  What do you think about this? Enough information to avoid RFE you think? I wanted to overload them with a lot of information up front.

K-1 Fiance(e) Visa Process & ProceduresPassport concerns.

Since you are under the jurisdiction of the American Embassy in London then you would need to follow their procedures. If they state that you need to have a passport with validity for eight months beyond the visa issue date then that is what you will have to do.

Renew it now and solve the problem.

(Edit) Ah you are Portuguese, not British. Either way, it sounds like you have a handle on it. I would certainly renew it now and make it one less thing to worry about.

It's funny, when I have tried to describe Jersey before to Americans the conversation always gets steered towards New Jersey (the American state). They forget that the "New' in the name exists for a reason, the same as with New York and New South Wales.

Haha, yeah, I totally agree.
That's how I met my fianceé was due to that.
She asked where it was and it stirred a convo :D

But I am local here, just my passport is Portuguese however I will need to head to London Embassy for the interviews and such.
futuremrsmonizFemaleGuernsey2012-10-02 17:39:00
K-1 Fiance(e) Visa Process & ProceduresPassport concerns.

It doesn't matter but I would strongly suggest you renew it now and head off the problem down the line.

I believe passports issued to Channel Islanders (Jersey, Guernsey, etc.) count as British, just with a slightly different cover to traditional British passports.

On a side note, I spent a lot of time in the Channel Islands when I was younger (around St. Helier and St. Peter Port) and they are very nice places to live.

Wow that's awesome.
Not many people even know where Channel Islands is, let alone been there.

My only concern is my passport is actually Portuguese which is why I can't renew it here.
Luckily, Jersey seems to have a Portuguese embassy and I can renew it there so it's not that expensive or time consuming.
£30 and a 1 hour boat trip.

But I only wanted to make sure if our forms were at risk - Even if I was to get passport done this month.
futuremrsmonizFemaleGuernsey2012-10-02 17:29:00
K-1 Fiance(e) Visa Process & ProceduresPassport concerns.

For London at least, the requirement is to have a passport valid for travel to the United States and have at least eight months validity beyond the issuance date of the visa. There isn't a stipulation that it be X months/years old, however.

Well you see Guernsey, Channel Islands is part of the U.K.
We are an independent island however we obey majority of UK laws although we have some of our own.

So this process is said to take roughly 7-10 months to process.

Mine expires as I mentioned previously on the 08.04.2013 (DD.MM.YYYY)
If I was to renew it this month.

Would you think that would cause issues for when I travel over?
