the petition has been approved, they sent the file at montreal consulate and now it's been a month and 2 weeks without any news, and waiting for packet 3... is there anyone in the same situation than us? or something gets wrong?

Now just how often can they (Canada Post) screw up? not only with incoming but outgoing mail before they see somethig is wrong. I have too many gripes to go through them all so I will deal only with the latest. Since Jan. 4th Montreal has sent 2 correctly addressed Packet 3s to me, the address was confirmed on Jan. 12 over the phone after the second packet was returned to them. On the 12th of Jan. they were given a different address to use and after having it read back and confirming its correctness, the packet was to be posted on the next day, that was 8 days ago for a total of 17 days since the first one was sent.
Even thought having the packet wouldn't in my mind speed up the process as there is still work to be done it would still be nice to have it here to confirm we are going in the right direction through this maze.
One other thing is that just maybe the packet wasn't sent at all and the answers were just to satisfy my inquiries even though there were only two.

It sucks but I'm just bitchin, not yet time to scream, yell and shout and start pulling hair out.

I sure hope everyone else is having a better time getting all their correspondence in due time.

i've been in the same situation, first time they sent packet 3 to me was nov. 29th, i never recieved it... second time, january 5th, never recieved it... both time they sent it it was at the right address.. so as i live just a few blocks from the consulate, i picked it up ...

heh funny... i had to go at the consulate to pick up some documents, i had my steel toe boots, camo coat and black combat pants and i got in fine... except i had to take off my piercings (2) and leave it at the security...

...well for sure i won't wear my metal music shirts for the interview lol

i'm goona cross by greyhound via peace bidge... the bus terminal is close from the border so i'll take a cab it the next bus does'nt have a place for me...

it happened once the officers questioned me more because i brought my guitar and they thought i was going there for a gig ( duh )... once they were finally greet my passage, i had to catch another bus, so i guess it will be the same for entering with a k visa... greyhound won't delay a whole bus for one person, any transportation company won't either

i'll miss my homeland for sure but i doubt it will makes me urge to move back... i already live away from my mom and my brother... my dad passed away close of 6 years ago, i'm not close of the rest of my family and i have no kids...

i know for sure i'll work in the same field than i do here ( woodworking / carpentry ) it's one of my hobbies...

thinking of my precious honeycake helps me a lot, plus what helps me it's at work... i have a co-worker who got into the immigration ( from France to Canada ), she gives me a lot of support since the beginning, my boss and other co-workers encourages me a lot too... plus these days i'm pretty busy at work... on my work table, i displayed 2 pictures of me and Pamela and a US dollar bill and at the edge of my table there's an american flag ( since july 4th ) :P... at home it's another story...

Oh, are you taking the bus to go past the border? If so then please tell me how it goes after... I'd take the bus too but I'm a bit reluctant since I'm afraid it will either slow the whole bus down or go without me due to my K1 visa, LOL so I am saving up money for a flight possibly... or hoping to get a ride somehow (though I'm not sure how yet...)


thay won't hold a whole bus for one person... once they'll done with you , they'll make you catch another bus... ( past experience on bad issue with the customs )as buffalo's terminal is at five minutes from the border, i'll call a taxi

Wait, I just read that you can apply 90 days before completing the permanent residence requirement!
This means we can apply THIS JULY! Right?

So as long as we are able to go out of the country (I'm talking short term like 3-4 months at a time) then we can file July.

I am a US citizen from birth.
My wife and I got married 5/2009
She got her Conditional Permanent Residency 10/2009
She just got approved for removal of condition 1/2012

So we will be able to file for her naturalization process this October. (right? Three years of permanent residency)
We didn't leave US for more than 2.5 months and the past 2 and a half years.

Here's the problem. I accepted a two year employment in Asia (not korea her home country) that starts this August.
We have a baby, and we don't want to spend much time apart.

I can get a 1 month vacation this december till january. Another vacation next May to July

So here's my question.
1. Can we apply for naturalization process in December. (She would have been gone for four months)
2. Can she leave US after filing N400? and for how long?
3. Can we come back when it's approved and for the interview day?


So this would be the time line.

2012 August: Leave U.S.
2012 October: Date qualified to file for n400
2012 December: Come back to US and file.
2013 January: Leave U.S.
2013 ????? Come back for more paper work or interview if approved.

Is this legal and possible?


There's also a section that reads........

Most people must live in the USCIS district or State in which they are applying for at least 3 months before applying. A district is a geographical area defined by USCIS and served by one of the USCIS “District Offices.”

Does this mean that she's supposed to have come back and stayed here in US for 3 months before applying or just that she hasn't moved to a different state under different district in past 3 months?

Hi. I'm a US citizen. My wife is a green card holder. (almost 3 years, but we're going out of country for about a year so can't apply for citizenship right now. We applied for both continuation of permanent residency and re-entry permit because we would qualify)

So the real question is... We have a 7 month old and she had some hospital work done and ridiculous amount came out.
Since our daughter is a US citizen, the hospital is saying that applying for medicaid for her will not affect my wife's citizenship process.
I just wanted to confirm this.

I think I got the answer to this question.

 

Nonresident aliens are supposed to file a different form 1040NR.

I filed a normal tax form so I don't think IRS has me as a nonresident alien.

 

Missouri will have me as a non-missouri resident, but not as a nonresident alien.

 

Just as if I lived in the State of Kansas and work in Missouri, I'll be viewed as non-missouri resident, but still be a permanent resident of US.

I think I know the answer to this question, but I just wanted to make sure.

The question says...

 

8  "Have you ever called yourself a "non-U.S. Resident" on a Federal, State, or local tax return since you became a permanent resident?"

 

There was one year that we had to live abroad for the whole year because of my husband's work.

I was able to retain my permanent residency status during this time and even got N470 approved to keep my continuous presence.

 

However, when I filed the State taxes... I had to click non-Missouri resident because I didn't live in the State of Missouri.  

 

This means... I was just not a resident of Missouri, but a permanent resident of US correct?

So my answer to question #8 would be  "no."

 

Is that right?

It seems like IRS.gov has online transcript service.

Can I use the transcript printed from IRS.gov or do I have to go to an IRS office and get it certified?

I think that answer would be fine.  At our interview  they asked us about our wedding plans - but they didn't ask why the K1

Its not unsual from all the reviews I read on the Bucharest consulate to ask about wedding plans, but I didn't see too many that said they had to explain why they chose the K1 visa, or why get married in another country.   I know one of the previous posters said she was asked that, so I definitely would be prepared with that answer but hopefully  you won't have to worry about it.

We didn't send anything other than my wife's pictures and copy of Permanent Resident Card.

Back in 2001 when I got naturalized (Btw, I got my permanent resident from AA-1 Visa Lottery in 1990), I didn't send any other evidence besides what's listed in the N-400 form. When they sent me the interview letter, they listed what I needed to bring to the interview. Not sure how it works now, but I would think it's still the same. Posted Image

Not only the N-400 instructions but the M-476 manual as well is required reading.

Our county courthouse charges 8 bucks for the first copy of our marriage certificate and five bucks for each additional copy. In no way am I going to risk a 10,000 buck fine to save five bucks.

After I plowed through the N-400, instructions, and M-476 manual, realized this is a combination form of both the AOS and I-751, matter of fact, copied and pasted practically all the answers to the question off her I-751, I-485, and G-325a. Would actually like to go in there and ask them, how in the hell do you think my wife got her green card in the first place? But not wise to do that.


We just sent my wife's N-400 application a couple of weeks ago and we didn't send anything other than what's listed in the N-400 instructions. I would think they will ask what documents they need us to bring to the interview. Posted Image

It's time to get going on this Naturalization thing (have been eligible for almost 2 years now, but other things took priority...), and I have a question for you seasoned folks.

When sending in your marriage certificate, should you send an original, or a photo copy?

The N-400 instructions indicates that a copy is acceptable, but the certificate itsels states that it is a fellony to create copies of the document...

Just want to give a quick update....

My wife had the interview yesterday in Kansas City, MO. The interview was scheduled at 11:30 am, we arrived there around 11:15 am, but they were running late and my wife was called around 12:15 pm. The whole interview took about 15 minutes. Questions asked:

Q#7 - How many amendments does the Constitution have?
Q#16 - Who makes federal laws?
Q#17 - What are the two parts of the U.S. Congress?
Q#29 - What is the name of the Vice President of the United States now?
Q#38 - What is the highest court in the United States?
Q#60 - What group of people was taken to America and sold as slaves?
Q#61 - Why the colonists fight the British?
Q#70 - Who was the first President?

Reading Test: "Who can vote?"
Writing Test: "Citizens can vote."

Other than that, my wife told me that they just went thru the application form. She gave the interviewer the copies that we brought to the interview (Note that we didn't send any documents when we originally sent our N-400 application):
- Copies of my US Passport and my Naturalization Certificate
- The last 3 years of our Tax Transcripts
- Copy of our marriage certificate
- Copies of our children's birth certificates
- Bank Statements showing both of our names (last 3 months, and one month each from 2009 and 2008)
- Electric Bills showing both of our names (last 3 months, and one month each from 2009 and 2008)
- Copies of Medical Insurance and Prescription Cards

She gave my wife the N-652 paper (Naturalization Interview Results) w/ the followings checked:
- You passed the tests of English and U.S history and government.
- Congratulations! Your application has been recommended for approval......

She said my wife should get the Oath letter in 2 - 6 weeks.
