I sent in our I-129F 2 weeks after my divorce was final. I had been separated for 2 years - I was divorcing a divorce attorney so my divorce took a while to be final. I was very worried we would be denied since I only waited 2 weeks. It was not a problem. We were never asked about it - not even at our interview.
I know it is different for each country.

He wasn't asked about the denied visas. It did come up in the interview but only because the CO asked if he had met my family and he said no - I wasn't able to because i couldn't get a tourist visa. The CO then said " oh I see. Well, they probably did the right thing by denying the tourist visa" and then said Congratulations and approved our K1.

Like a previous poster suggested - I would read the reviews for your particular consulate. I was with my fiance for his interview and they did ask to see my engagement ring. I had read reviews of the romanian consulate so I knew they probably would ask about a ring. It doesn't mean you need to have one - you just need to be prepared to answer their questions. Same with your wedding plans. The process is stressful enough - enjoy your journey! Congratulations!

You should be fine. It will likely still show up in the police report you will submit, but it was so long ago, I don;t think it wil be a major issue.


I know the beneficiary has to submit a police report, but as the petitioner, I don't remember submitting one for me.

do not send flash drive - print photos with date and time stamp. Send a few pics from each trip. We sent 3 from each of ours and labeled them. Send itineraries and copies of your passport stamps from the trips. Dont send the hair. With the evidence you need to show proof of 2 different things. You need to prove that you met in person in the last 2 years and that you have an on-going relationship. Sounds like you have plenty of evidence. :thumbs:

This information is incorrect!


While Romania is part of the EU it is not part of the Visa Waiver Program. Both her and her parents would need a tourist visa to visit here. Obtaining a tourist visa is not always easy. My fiance was denied twice - there are many threads on this forum discussing this issue. You must be able to show strong ties to your country and prove that you will be returning home to Romania.

As others have said, meeting on line is not a problem. just keep plenty of proof of the times you have met in person. Save your boarding passes, ticket stubs, etc.

If you are looking at getting married in August I would start the paper work now. My husband and I got married this past August and We sent our petition in Nov.2011. You should take a look at my time line- we did not get any RFE- and the process went smooth for us.

You can print your messanger and skype logs that show time and dates of your phone calls. You may want to make an effort to email or send of few snail mail cards to have for evidence.

As far as the engagement ring goes, you do not have to have one, but Bucharest is one of the consulates that tends to ask about it in the interview.
I flew to bucharest to be with my now hubby for his interview and they asked to see my ring (others going thru the process from Romania had warned me they would ask) If you read the reviews for the romania consulate it is very helpful in knowing what they will be looking for.

Her parents can apply for a tourist visa - but they will need to show very strong ties to their country. Make sure they show plenty of proof that they intend to return to Romania. My husband was denied a tourist visa twice. We had not found the vj site at that time and didn't know when he applied for one that it would be that difficult.

You could get married in Guatemala, then file the I-130 for the spousal visa, then have a ceremony in the USA for all of your family and friends (vow renewal, of sorts). The plus side of the CR-1 visa is that he gets his green card when he gets to the USA and doesn't have to adjust status. If I had to go back and redo my husband's visa, I would have filed for the CR-1 instead of the K-1.

If you go the K1 route do not pick a date or make plans until you have the visa in hand! We filed in November and had our wedding in August and that was with no RFE or big delays.
If we had it to do all over again we would also go the CR-1 route instead of K1 only because your spouse will get their green card when they enter - which allows them to work and get a driver's license, travel out of the country etc... Waiting on the AOS and not being able to work or get a driver's license until EAD was issued was tough on my hubby.

A silly question but is it necessary to get an MO drivers licence ? My fiance worked in a bank he told me most banks accept passports to open an account


well, you need a driver's license if you plan on driving.

per MO DMV your passport is not a diver's license - you can drive with an international license and passport as long as your i94 is valid
which brings us back to the original dilemma - i94 expires 90 days after entering the country

Hi! I'm also living in MO (Springfield) and I was just about to go next week to DMW to apply driving license. So it's not gonna happen and I need to drive with my European license, is that correct? How about opening a bank account etc? Cause I know many banks only accept American ID to open account. So am I now pushed to keep using my Finnish bank card etc until I will get my GC? :( is this only for MO DMW? Cause I now I have friends living for example in Virginia and they got temporary driving license for 6 months with no problems...

I can tell you our experience

We had checked the MO DMV website and it states that K1 visas are eligible to get their drivers license. We called Jefferson city to verify what he needed to bring - passport and I94 - they said he would have to take both written and driving test - he did that - paid the fee and passed both - gave him the paper with his scores to take to DMV - they issued a temporary paper license that would expire same day as 1-94 (we had applied for AOS but he had about 6 weeks left before i94 expired)
They said his regular license would come in the mail in a couple of weeks after verifying his immigration documents. Instead a few weeks later we got a letter in the mail revoking his license because i94 was expired and stating he could reapply when he had new documentation.
to make a long story short - i called the dmv - who really didn't understand k1 visa and then jefferson city again - the person I talked to first was very snotty and tried to tell me that it was immigration that didn't approve it and that he is here illegally and I should be grateful she wasn't reporting him as an illegal. I finally got through to a supervisor who explained that they will only issue id or driver license for the duration of i94 and that since it was going to expire it was denied. She said he would need to come back when he got his EAD - (they won't accept noa from aos) and he could reapply. Also, since the temporary permit they game him expired he would have to take the drivers test all over again and repay the fees.

My biggest problem with that is they should not have on their website that you are eligible with K1 - since all k1 visa i94 expire in 90 days. So none of them are going to be approved.
its so frustrating because we were trying to do things the right way. After talking to the supervisor - as she explained it to me - basically they have to verify the immigration documents and when they do - its USCIS that says no - this i94 is going to expire.
That is the downside to k1 visa - you are in this limbo once 194 expires until EAD is approved with nothing to show your legal status.

You should be able to get a bank account with your ss and passport.
My hubby drove with his romanian license until he could get his missouri license - i'm just saying that is what he did - not giving that as advice :)
Also I called my insurance company the day he arrived here to make sure he was covered on my car insurance.

So, we are married, and filed the AOS paperwork, got a letter saying they received it- and went to the Biometrics appointment. However we never received anything that extends her K-1 visa which expires in 10 days. Are we supposed to?

The only reason why we are worried is because we tried to get her a (MO) driver's license, but the lady at the DMV said that she can't do it because there is no extension date for the visa.

You will not get anything extending it. She will not be able to get her MO driver's license until she has her EAD.
I just went through this with my husband. That is the bad part of K1 visa- you are in kind of a limbo until you get your EAD. The MO dmv will not accept NOA1 for AOS . I posted lots of about this when we were going through it - very frustrating

If you are not legally divorced at the time you file then you will be denied. If you appeal the denial you couldn't then present your final judgment because it would be dater AFTER you filed... meaning you were rightly denied for not being free to marry when you filed.

So no. You need to wait.


:thumbs: exactly as Vanessa&Tony stated it. Also, you need to check with you state and make sure there is not a waiting period before you can remarry - because if there is - then you will also need to wait until that period is over to file your petition.
There have been cases posted on here where the petitioner filed just 3 days before their waiting period was over and they were denied because of it.

We have decided to move our wedding date back to June 28, 2014 (which I can only hope is enough time!) and having a court wedding in the meantime when we get approval. I submitted our 129F this time last year - you can check my time line on how things played out. The NVC stage to interview took longer than we thought it would. We got married end of August. However, it was a civil ceremony that I did not plan until the visa was in hand. Honestly the process is stressful enough because so much of it is out of your control. There were so many things to take care of just getting my fiance here and settling in that I am glad I didn't have the stress of a big wedding to worry about on top of it.

I am almost 17 years older than my husband and we also have a large education difference. I am a doctor and he didn't finish his college education even though he is one of the smartest people I know. Like you, I had read that both of these things would be a red flag. I attended his interview because I thought if they saw us together they wouldn't be as aware of these red flags. Neither of these things were asked about in our interview.
The only time it has been an issue was with family and friends - and i really don't care what they think - if he was the older, more educated one, no one would think a thing of it.

It can easily take 2 months from NOA2 to the interview. Since you just got your NOA1 - it could be a while so I would tell him to wait.
Keep in mind, when he gets here he won't be able to work for a while. It takes approx 90 days to get your EAD - after filing AOS. I felt like we did things pretty quick - my hubby came here a week after his interview. We got married about 6 weeks later and then filed AOS. He got here July 5, and he got his EAD end of November and got a job this week. My point to all of this is, it has been almost 8 months since he worked. (not because he didn't want to, but because that is just how long it takes)
Once he gets the visa it is going to take time before he works again - so I wouldn't quit too soon. Even when its not about the money, it was hard for my husband to be home all day while I was at work.
I think quitting now would only make the wait for the NOA2 seem even longer.

We have been waiting over 5 months and haven't received an interview letter yet. It seems to be taking more like 6-10 months if you are being processed at the NBC. Some cases (supposedly it is random)are sent from NBC to local field office where you live to be processed. If that is the case then you will have an interview and that seems to be taking around 4-5 months depending on the local office. If your petition stays at the national benefits center to be processed then plan on 6- 10 months

you can not leave the country until you get your AP card. If you do - you will not get back in and you will have to start the process all over and go the CR1 route. It takes about 90 days after you apply for AOS to get the AP card. Postpone the honeymoon or find some place in the US. There are plenty of cool places to honeymoon within the states.

Kind of a long story made short - I choose Wisconsin because my sister lived there and she could be there with us.
It was so easy to plan - i called the shawano county courthouse, they gave me a phone number to a judge, we agreed on a location ( i had made a trip up to see my sister a few months prior and found what I thought was the perfect park) and about a week before the wedding I called a florist in shawano and asked them to make me a wedding bouquet I told them i didn't care about the colors just make it pretty - and also ordered a cake from a bakery - with the same instructions.
Total wedding cost:
dress - 170.00
suite - 300.00
judge - 100.00
flowers - 15.00
cake - 20.00
champagne -30.00

I wasn't trying to go for a budget wedding - I honestly thought we would do this and then have the real ceremony that we would plan later - NOt going to do that anymore - nothing could be better than it was - the day was perfect - I would rather use the money we saved to go back to Romania and celebrate with his family


sorry - it wouldn't let me edit - but i was going to add that we filed in NOV 2011 ( processing times were maybe a little faster then - not sure cos it felt like forever) but we didn't have any RFE's and got our NOa2 in APR and by the time our petition went thru NVC and we had the interview and he got here and we got married about one month later it was about 10 months total, and we really didn't have any delays - other than we took about a month to get married - which we needed... just to get settled in and get SS#, get him fitted for a suit...etc
