K-1 Fiance(e) Visa Process & ProceduresI sent my K1 app the same day my divorce was finalized... now stuck!
Well, my fiance is 11 years younger than me (I am the female). I got engaged while I was still legally married. Sent the papers the day of the divorce. We only had two visits (5 and 4 weeks respectively). It just seems like we have a few red flags, and this couldn't hurt. I was reading other threads on the boards here that suggest you do write such a letter in this case (although it wasn't specifically aimed at USA/Canada). I figure anything I can do to help, is a good thing? Maybe I'm wrong... I just don't know.

K-1 Fiance(e) Visa Process & ProceduresI sent my K1 app the same day my divorce was finalized... now stuck!
Okay so my ex husband moved out a couple years before I met my fiance. He refused to help fund the divorce despite making a great deal more than I do, so it took me a LONG time to have the funds. When I did, I filed immediately.

During our separation, it was agreed that we could date, that our marriage was absolutely unsalvageable, and it was just on paper at that point.

I sent my K1 application later in the day that my divorce was finalized.

We just had our NOA2 approved. I finished up writing an evolution of relationship letter, and am now trying to write a letter explaining that I wasn't "cheating" on my husband behind his back, that he had moved out, and we were not together in any way except on paper. I'm having a terrible time with this. How personal do I get? Do I mention violence? Do I mention that he lives with his girlfriend and her children? Do I say that we had separate bedrooms for years before he finally moved out (due to finances)? I know it looks bad that I sent it the same day. It's too late to change it now. So I want to explain myself. Can anyone offer some help with this letter? >.<

Thank you...

K-1 Fiance(e) Visa Process & ProceduresWould changing jobs be a bad idea right now?
Wow, what a wonderful answer lol. The search is on! I've worked for this employer on and off since 1997, and it is time to move on. Thank you!

K-1 Fiance(e) Visa Process & ProceduresWould changing jobs be a bad idea right now?
My fiance and I (I am the USC) had our NOA-2 approved March 4th. I've sent off my last everything that needed to be mailed to him. That is the spot we are in, in the process.

Anyway, I am really quite miserable in my job. 3 year wage freeze. It is very difficult manual labor, and honestly it's just too much for me. My boss has become nearly cruel (HR not helping), and has lost a lot of employees under her direction.

I am seeing a ton of help wanted signs up around my area lately. I want to get out there and find something else. But would it be a poor idea to do this after filling out the affidavit of support (I had to use a co-sponsor, I don't make enough to buy a box of tic tacs), and prior to my fiance's interview? Do I need to just wait?

Thanks for any insight.

Thanks for the replies. Good news.

On a similar note, on posts I've read on the boards, it's saying my fiance needs my marriage certificate (I'm the USC)? I don't see this on the packet 3 checklist Vancouver sent in an email. He has my divorce decree... do I need to send my marriage certificate too? All I see on the list is divorce decree. But all over the boards... marriage certificate. Maybe I am misunderstanding. We are doing a K1...

And does he need MY original birth certificate too, for the interview? They already have copies of course. I thought I had an official copy made but now I can't find it. I have the genuine original, but hesitate to mail that. >.<
I thought they just needed his long form birth certificate... but?

Net paystubs are fine, and you have tax transcripts and employee letter. W2s would seal the deal. You should just make sure everything else is in order and stop worrying about this one....

Photo copies of W2s okay? I know they want all originals. But everything else is the original, and I just don't know how my mom (co-sponsor) would feel about me sending her actual W-2s out there. Also, I was thinking about just sending her W2s? My sponsorship is just for show as I don't make enough... and the W2s are just my ex husbands name... I don't know if I should send those or not. I do have everything else for both of us, employer letters, tax transcripts, paystubs. I never even thought to do W2s. ><

Oh yes, there are two options on the website... a simple, or extended. I got the "extended" version of the checks, which has every last detail that would be on a paper mailed stub. You can tell it's a print out of course... but all of the information is absolutely there.

Thanks so much for your reply.

I swear, I have spent the past hour searching. I cannot find the answer. -_- I am sure it has been asked before, I just can't find it.

Is it okay to print these off of the internet? I don't even get a paper copy... just direct deposit, and access to them online. I'm unsure if I can "order" them through work.

The other things I have for proof are (for both myself and my co-sponsor) the completed I-134s, 5 printed from the internet detailed paycheck stub records, 3 years of tax transcripts from the IRS, and a signed letter from our employers with all the necessary information.

I've already mailed all of this off to my fiance. The NVC should be getting out packet any day now, so if I have to figure something else out, I am in trouble.

Thanks

K-1 Fiance(e) Visa Process & ProceduresCan we slow the process down? >.<
Thank you all for your answers. To my absolute amazement, we no longer need to slow it down. I got a jaw dropping offer from my one and only uncle... half gift, half loan, and it is enough to cover the visa and it's expenses, and the AOS. My fiance and I have enough saved up for his flight to move here, and for things wedding like the marriage license, minister fee, etc. I'm just in shock, and so grateful. There was just no way in a million years I saw this coming, I truly thought we were at the end of our road and would have to end the Visa process.
Thanks again everyone.

Lol I would trade you the NOA2! It was such a bittersweet surprise. >.<

Yes, we are worried about the fees before the visa, not after, those we can figure out then. We don't want our interview as soon as possible... so thats what I'm asking, can we delay sending in packet 3 things a little? Do THEY pick your interview date, or do you get input?
Our wedding date is just a date. We have spent no money (wouldn't do so before approval), its just going to be the two of us anyway, not a traditional fancy wedding. It's our goal, but if we miss it, thats okay.

As I posted in a previous thread today, search is not working for me today. All day. I search, and it takes me to the list of forums. So please forgive me asking.

Okay so we had our NOA2 approved in 52 days, instead of the five months we expected. Money is tight. We are both working, and selling personal belongings as quickly as possible.

The NVC has already sent our case to the embassy in Vancouver, Canada.

So is there a way to grab a little more time?

I know there is a 4 month expiration date, and I mean, our goal wedding date is July 22nd.

Could anyone tell me, at this stage, what is the normal wait time to the medical and interview?

Is there anything we can do... can we be a little slow in returning the items in packet 3? I don't want to tamper with our chances O_O but like a May interview would be nice... late may...

I think this may well be the last thing I have to freak out over this week. I hope. Everything is going very well for us, we just need a little more time to have travel money and all the other fees.
As I understand it we need:
Travel to vancouver fees
$330 medical exam
$131 interview fee (unless it goes up... and man we are so close, I hope we make it under the wire)

He has already purchased the mailer, has the photos, is ordering the birth certificate, getting the police check, etc. All the little things are being taken care of. I just wonder if there are any other fees at the medical or interview. I read on some attorney site I found on google that you need $100US at the time of the interview?? I hadn't seen that before...

Thank you...

K-1 Fiance(e) Visa Process & ProceduresAffidavit of support, I wonder if I messed up
I could write something like:

The income shown on the tax transcripts from years 2007, 2008, and 2009 was that of my ex husband, xxx xxxx, and his alone. I was unemployed during those years. xxxx continued to support me until I started my current job at xxxx, summer of 2009, despite his having moved out early 2008.
I provided the tax transcripts simply to show that I always filed taxes, and because it's required of the consulate.

Does that work? Can anyone tell me how to improve it, or what needs changing? Thanks...
garnet80FemaleCanada2010-03-20 14:02:00
K-1 Fiance(e) Visa Process & ProceduresAffidavit of support, I wonder if I messed up
None of it applied to me. So I guess I could simply add a letter to my tax transcripts explaining that the income was not mine, but my ex husbands. We are using the Vancouver Canada consulate which I think is one of the slightly more mellow ones. It's easy enough when it's all his income to use the transcripts and just add a letter. Does this sound acceptable?
garnet80FemaleCanada2010-03-20 13:46:00
K-1 Fiance(e) Visa Process & ProceduresAffidavit of support, I wonder if I messed up

Sending your mother's W2 forms won't hurt anything but they are not needed. Yours would be pointless, as they document only your former husband's income, not your own. Frankly your transcripts do the same so you'll want to make a note of what portions, if any are YOUR income. Normally in such a situation, I would recommend copies of returns instead of transcript for you and if none of the income on them is your own, a short letter indicating that would be better than sending any tax information that's just for somebody else's income, IMO.

I thought that too, but was given the advice on this board that sending my tax transcripts showed that I at filed taxes (we filed joint despite my lack of income, every year). Do you think it's okay to just go with the transcripts for both of us? Or is this a big enough deal that I should change what my fiance takes for my portion?
Or can I do tax transcript for me, plus a letter that I did not work in those 3 years? Just don't want to mess up at this stage of the game. -_-
garnet80FemaleCanada2010-03-20 08:54:00
K-1 Fiance(e) Visa Process & ProceduresAffidavit of support, I wonder if I messed up
Thank you, that is a relief. I guess I was just worried that it "looked bad" for our us in one way or another. People do look down on us for this arrangement, although it works wonderfully for us. If I may add a question that I have gotten two answers to...
For the affidavit, I am sending my own I-134. My own employer letter. My own 3 years of tax transcripts. My own 3-5 paycheck stubs (I don't remember what I sent). My mother and co-sponsor is sending her own I-134, her own employer letter, her own 3 years of tax transcripts, and her own 3-5 paycheck stubs.

Now I have heard both ways, in answer to my question if we need to attach W2s with the tax transcripts. Some people say it's silly, there is no point, and some have said I'd be golden if I add them. I've also read on other K1 threads where it is suggested the W2 is added to the mix. My mom has been divorced for well over ten years, so all her taxes have been filed as single, if that matters.

I don't really want to send W2s myself, because they were my ex husbands, not mine (I didn't work outside the home in the end, and he still supported me until the divorce. Now I work again and support myself). Since my income is so small that my moms income is what counts, I wouldn't think this a problem.

Can anyone please give a clear answer? I can scan and send them, but if I don't have to, I'd rather not.

K-1 Fiance(e) Visa Process & ProceduresAffidavit of support, I wonder if I messed up
I share a house with my mother. I have the upstairs, and she has the downstairs. It works for both of us to save money. My fiance will be (hopefully) moving in here as well.

My mom does not "support" me. I don't make much, but I buy my own food, pay rent, pay my own bills, etc.
She is my co-sponsor though, and she makes a lot more than me.

Is any of this going to matter? I wonder if I should have done anything special in the paperwork (now that I've sent it off...). :help:

The affidavit of support has me spooked that I did something wrong, now that I'm thinking about it. I don't know what though.

K-1 Fiance(e) Visa Process & ProceduresDo I the Petitioner have to fill out this form?

I guess it would depend on if your fiance speaks English well? My fiance also filled out his own paperwork. I looked it over for mistakes, but he checked everything I filled out for the initial petition (and the I-134) over for me as well. Two sets of eyes are better than one, in my opinion.

Good point about speaking/writing English. That is really the only way it would make sense to me. Whatever works for the couple though!
garnet80FemaleCanada2010-03-23 21:37:00
K-1 Fiance(e) Visa Process & ProceduresDo I the Petitioner have to fill out this form?
My fiance filled out his own DS156 and DS156K... he is the one applying for the visa, it makes no sense to me to fill it out myself and just have him sign it. I don't know all his details, he does. This thread baffles me.

K-1 Fiance(e) Visa Process & ProceduresPlanning the wedding before you get a yes?
Thank you all for the replies. It sounds like I've done the right thing so far. I will check with my minister and photographer and see if I can pay them, but make sure the date is flexible, and refundable.

Right now I'm trying to decide if moving things around in my house to make room for him will jinx it. I'm not superstitious, however, I don't know, it just seems like being overly confident can't be a good thing. >.<
garnet80FemaleCanada2010-04-04 14:25:00
K-1 Fiance(e) Visa Process & ProceduresPlanning the wedding before you get a yes?
I'm having a difficult time trying to not lose out on anything... yet not do anything drastic before we get a yes. >.< I've seen signatures for K1 folks that don't have an interview date yet, with what looks like a firm wedding date planned. How can you do that? My fiance and I have a *hopeful* date...
And for those of you that are finished, how much planning/buying did you do before you got the yes?

What I've done is purchased my dress (it was the only one and I got a killer price), and emptied my fiance's future closet lol.

What I worry about is, losing the minister, losing our location, losing our photographer. I can't just expect they will be free with no notice, but they all need up front payments to hold the date of course.

I want to start getting more ready for him to move in. I don't want to jinx it either. So yeah, I am just curious how you all are handling this part of things.

K-1 Fiance(e) Visa Case Filing and Progress ReportsJanuary Filers
Our last touch was Apr 27 and then my USC fiancee received an RFE... guess one of the legal documents she had was missing a signature. With small town Kansas, she got that done and sent off the next day. It was received at CSC on May 5 at some early hour of the morning.

Since then, nothing... zip... nada... A whole week without anything!!!! Obviously, the trend of following an RFE with a quick NOA2 is not happening for us...

But it seems that there hasn't been a single NOA2 this week at all. Wonder if they were all at training or something like that...

Removing Conditions on Residency General Discussionhow to tell when touched
Hi. The only way that you can tell if your case has been touched is if the date on the USCIS website has changed. You have to look where it says last updated, if this date has changed since you last saw it then it has been touched. Even if you have signed up for email updates, you won't get an email when your case has been touched. As far as it saying case received and pending, it will always say that until it is approved. I hope this helps.

Please keep posting even if you receive a call from embassy and you get visa. Just remember your one final post can help many people who are still in a situation where you been before. For sure we will be out of this sooner or later it just matter of time. If you get mad or be patient and wait time will pass with its own pace but if you will be impatient you will just make it more difficult for yourself. No more lectures smile.gif.
