I checked the USCIS website and it said this: "On August 26, 2011, your document I129F, PETITION FOR FIANCE(E) was processed and mailed to the address on record. If you have not received it within 30 days of August 26, 2011, contact customer service at 1-800-375-5283. If you move while your case is pending, please call our customer service center at 1-800-375-5283." We are thinking this means we got an RFE or our entire case was returned? We got our NOA1, though. We did have an address mixup. I went on the site previously and it had the same message only with a date of August 10. I called on the 12th and changed my address so... Hmm. I also just sent in a change of address form, too, just to be sure.

You're misinterpreting the law. It doesn't say that they will be banned. It says they are inadmissible. The US government doesn't want aliens with a history of certain crimes coming to the US. Most countries have similar laws. Some inadmissibilities can be be waived if it poses a hardship to a US citizen or LPR. Some automatically expire. Some cannot be waived and never expire.

There's a list of most inadmissibilities in INA section 212(a). Waivers are described in section 212(h).

I know they do look at health/mental health issues and whether you would have to support someone based on health issues or have more expenses because of health issues. If he needed meds or, God forbid,hospitalization, he would not have access to health insurance initially here. Was he able to work while classed as disabled? I can't imagine it would look good that he is classified "disabled" by his diagnosis. I don't know the answer to your question but maybe this is something that will impact the answer? If it is a problem, perhaps a doctor would help you document he is stable, able to work, etc. and that might possibly help? I don't know but I hope some of the more knowledgeable folks weigh in on this.

I noticed the processing from NOA1 to NOA2 increased from 70 to 88 over last month or so.

How would the file dates being processed go backward. I think I must not understand the data being reported. Can someone explain this?

I would at least check with the closest US Consulate (or look on their website) about DCF. If you are living there in Brazil, that may be an option for you. You could also ask on the country-specific forum here on Visajourney for feedback from other VJ members who have gone that route in Brazil.

We tried DCF a million years ago in Kathmandu, Nepal and were told at the Consulate that we couldn't because I (the USC) hadn't lived there long enough, but it didn't hurt to ask. I had the impression at the time that different Consulates had different rules under which one could file for DCF. And I don't remember anything at any time about a USCIS field office being an issue. DCF is done through a Consulate (hence the name, Direct Consular Filing), and all the Consulates AFAIK are all run by a completely different agency, the Dept. of State. You wouldn't deal with USCIS until your spouse was here in the US. I'm sure if I'm wrong, someone will be along soon to correct me!

I believe in order to do the DCF you have to be living in the area for a period of time to qualify. I noticed how quick those go through and thought about that as an option so looked into that for the UK. I don't know if a different consulate would be different or not?

So we were waiting and waiting on our NOA1 and it turned out that what I feared was happened is what did happen: they didn't send it to my post office box but rather to my physical address. So, I called USCIS to get the NOA1 and they changed my address over the phone. They sent me a change of address form but USC's can change their address without submitting a form. I didn't worry about it. Then I checked USCIS case status and it said something about a form being sent to me. I waited and didn't get it so I sent in a change of address form. GOOD THING I DID!!! I got the "form" today. It was a confirmation of my called-in change of address which was still completely wrong!

Moral of the story: Always mail a form in with any change of address. One VJ'er advised to follow up with a call to double-check. I think that is a good idea, too. So just a heads up to the new folks who actually bother to read other people's posts instead of just posting questions. Hehehehe

To all those waiting for USCIS approval, has anyone have any ideas as to why this whole process seems to have ground to a halt lately. I watched Igor'd stats seemingly fly by for April, but then i noticed a lot of RFE's for May applicants, and now almost no June applicants have been done (so far). Igor says that they are processing for the 14th of June. I just don't see it. I know that all of this info is based on what us members provide, but looking at the statistics on the different pages there is a lot of conflicting info. I know i am impatient that is just me. I just want to know why it all slowed down so much


If you notice on the stats, there typically is a slow down beginning this time of year. We have alot of holidays coming up. I doubt it is going to get any better soon.

She "may" not be eligible for VAWA if not married. I could swear when I was working at a DV shelter we helped a not-yet-married woman on a K visa use VAWA. I doubt if her goal is to stay here that the U visa is anything to worry about. I think in order to pursue that one the crime would have to be fairly big and then once prosecution is over she would be sent back home.

I am no lawyer but I watch cops on TV :D . In most states you can't change the locks or not let her back in. Once she brings her belongings in and stays one night (check your local laws)... she is there. This is why I said you have to move out. Leave her with the house. If you plan on staying there, I wouldn't. I think you can get her out in 3 days if you have no lease... but you need to start proceedings immediately with a real estate lawyer... which is way cheaper than a criminal lawyer.


I would check the laws on this. I have been told by police in CO that this law is kind of an urban myth. There are alot of components to it. In another state, my ex broke into my house and I could not press charges because a few months ago I let him crash there for a few days. I don't think I would move out unless there is reason to move out. She is in another state. Consult a lawyer. Perhaps the eviction is a good "cya" move. I have read in other posts outside this thread that once her I94 exp you can call immigration and she will be deported if found.

our visa process was a difficult one because of the wrong and at times unnecessary information users share from time to time.case in point,the other day i was going through k-1 form,trying to catch up with the new information and possible changes that i thought uscis might have made.i came accross a post from a member asking about information regarding AOS and how long the time frame to file aos in was.some member mentioned that AOS has to be filed before the visa expires which is wrong,because its true that if you dont file for AOS before your visa or other cards and information expire,the time you spent in the US is considered over staying,but its forgiven base on the marriage when you do file for AOS.
needless to say when i saw that i started doubting and wondering whether or not that was true.
to sum it up,i spent 4 sleepless nights looking for that information,so from an old member to the new ones, double check each and every piece of information you see on this website

Thank you!!! I was trying to say that in a post I made about AOS and the 90 day time frame issue. I had read on here you don't have to but then read other people say it does have to be and even found some misleading wording in the guides on here. There is so much to learn about the process that it is hard to keep it all straight let alone adding in people who think they know. I wish USCIS would have more info on their site but I suppose if America is known for anything it is now known for not being easy to immigrate to-why would USCIS want to ruin that reputation!

Some numbers never show up. Some numbers do show up but the status NEVER changes.

Do not worry about it try again at a later date or call USCIS for a case update.


So this is why our status has said the same thing since we first filed? We do not even have acceptance, initial review, or anything! We did however have a debacle with mailing address and that shows on there! :)

But the translating job is an awesome idea!

My thoughts, too! If your job is your job no matter where you live, you might be able to use your income as well.

Your friend will need to provide a letter of employment from his employer - stating how much he makes - and provide recent paystubs.

I know how hard the whole co-sponsor thing is; we've all been there at one point or another. :-/


If for some reason your friend cannot sponsor, have Brandon go back to the US and seek a better-paying job? Assuming that he doesn't have any other dependents, the income requirement isn't very high. A near-minimum wage job (full time) would almost be enough to suffice.



I suppose I'm also a bit confused at whether you're applying for a K1 (as with the talk of the I-134 and your profile), but you mention that you have a wedding planned in Brazil, which would mean you're going the CR-1 route? Apologies if I've missed something.. it's (again) early in the morning here and I'm not full force yet ;-)



In all honesty, I think it is very rare that you'll find someone on here to act as your co-sponsor. It is a big committment for someone who doesn't know you... and besides that, everyone on here already probably has a sponsorship of their other half.

i've sent package 3 and done my medical examination, and the embassy was meant to receive my package 3 by today, and i have just tracked my package at postoffice.co.uk and it gave the following message: An attempt to deliver your item was made on 05/09/11 but we were unable to deliver as there was no access to the delivery address. The Item will be returned to WEST LONDON to await instructions from the addressee or will be returned to sender. You can arrange a redelivery online, call the WEST LONDON office to arrange a re-delivery, or collect the item from WEST LONDON by bringing proof of identification and address.

It is supposedly based off what members enter in regards to their own timelines. It is not very accurate since I have been watching it which has been since June. It constantly jumps all over the place. Yesterday it said they were working on July 9. Don't pay much attention to it. There are still a ton of unprocessed June petitions according to Igor's list. Some people will get processed ahead of others. I don't know if these are the expedited petitions or just petitions that have been put together very well or with faster processors or what.

This website has a variety of statistics that people follow to try and figure out what their timelines are going to be. We can argue ad nauseam about the accuracy of said tools, but they are here because computers are good at collecting data and doing math. If you find those statistics troubling, you can ignore them. If your friend finds them troubling, she can ignore them. Indeed, I usually ignore them, but once in a while I get bored and start poking around. Are you also whining to the site administrators for publishing their processing time estimates?

Just because you had no such statistics available to you when you went through this process is no reason to get on the case of those who are using what is available today. Sounds like sour grapes; but life is like that - progress gets made on a variety of fronts.

And as for my two months, you're wrong, it's closing in on 5 - some got approved before me, some will undoubtedly wait longer than me - I remember some poor woman who was waiting almost 11 months recently, it was miserable for her and I was very happy when she finally got it. So get your facts straight before you spout anymore of your bitter nonsense.

I expect a formal service inquiry in writing upon my request. My right and what they are required to do when they fall out of guideline. Wouldn't it be nice to tell the bank you do not owe a penalty because I don't have my payment yet and I am changing the due date. That is what they are doing. Do you see what I am getting at? They are not living up to their obligation and giving the runaround as to why.


I work in a government job and if immigration is anything like what I do... I am overloaded beyond all imagination. I constantly get phone calls, emails, letters from clients, their attorneys, supervisors, supervisors of supervisors, other professionals asking when something is going to be done. If I didn't have to respond to all those phone calls, emails, letters from clients, their attorneys, supervisors, supervisors of supervisors, other professionals I could probably get things done twice as fast. My goal is to return phone calls, etc. within 24-48 hours but some days people get more harried and I am even more bombarded by contact and maybe a problem or twenty pops up and suddenly my goal changes to returning contact within 72 or more hours. Goals are flexible sometimes because you never know what might pop up to interfere with your workload.

I think we all get frustrated beyond reason with this process and each have our own peeves. Mine are the people who decide to file on a whim and then drop it midstream. They bog it down for the rest of us. There is nothing I or you or anyone else can do to really hurry things up. There are people on here who have been waiting alot longer than you and are also tax-paying US citizens. You will drive yourself nuts with frustration if you don't chill a bit and let it go. Whoever said to grab a drink and take a seat or whatever is right. Believe me we all agree with you but you can't fight 'the man'.

Hey everybody, this is just a followup from a post that I posted in October. My fiance had tried drugs in the past and the embassy is aware of that after having medical records sent. We were worried that he wouldn't get his visa because of this, BUT he had his interview today and he just called me to tell me that he got approved for the visa and should be in the mail soon! Apparently they didn't even ask him about it. Barely asked him any questions. He said overall it was super fast, easy, and stress free. Just wanted to let you all know!

WE GOT THE VISA!!!!!!!!! :) :) :) :) So happy!

We were thrilled to get our RFE because it was proof we were moving!!! I got the text at work and I jumped up and ran out to call John. We yelled and cheered and sent messages to everyone telling them of it. I find it amusing that other people are being cranky about receiving theirs. WE ARE FINALLY MOVING!!!!!!!!!!!!

Correct me other Vj'ers if I am wrong: I believe the process for people who are married is not that much longer than the K1 process? I have to say I agree with other voicing the frustration we feel when we try to walk a thin line to obey every law and such then other people try to cut corners and not worry about the laws. I understand, though, that desperation of missing your finace but the cost is so not worth following the laws. And they ALWAYS find you sooner or later. Too bad you cannot make arrangements for her folks to visit here to see her marry you according to their traditions, etc. Maybe there is a way to make a compromise that honors her culture but obeys immigration law?

I made a Bone Head mistake last Tuesday when sending in my Responses to the RFE!
Sure! I sent it certified mail, return receipt requested.

But in my haste, mixed with always a bit of anxiety that so many of us experience when sending/responding/communicating with
USCIS,... I meant to, but didn't ALSO tell the postal worker: NEXT DAY DELIVERY!

So,... it's been a week, and I'm still waiting.
That seems a bit long, Louisiana to Vermont.
I'm gonna call uscis and/or go talk to the post office today.

Yes, we got a text notifying us that there was a change. We looked on the USCIS website and saw that they notated that they received the RFE response.

Answer: I just did receive a text message from the USCIS, saying that my case is now UPDATED, Check My Case Status at uscis.gov.

The website simply says they received my response to the RFE on December 19th.

So, for some of you, like me, always wondering about the LAG TIMES at the USCIS, ... they actually RECEIVED the response in the mail, on December 16th (unless, of course, the post guy at the local post office told me wrongly a few days ago, when I went there to check/have him track my Certified Mail ticket no.),.......

...... and just a few moments ago, today being the 22nd, they text me and post on their website that they received the response on the 19th.



(Of course! I nearly pissed in my pants, upon seeing the text message from the USCIS, thinking that possibly ALREADY, they had REVIEWED the response evidence and GRANTED APPROVAL.. :rofl: )

We got notice of our RFE on 12/5/11 and we fixed it immediately. I wondered if anyone else who had a RFE around this time period has heard back, yet? I was wondering if I could put a shout out to the London interviewers... What time line are we looking at from NOA2 to interview? Anyone who got their visa: how long before you got the visa after interview?

I looked at the timelines and such on here and it looks to me like, now that we have our NOA2, we should expect 3-4 months? 4-5 months?
