K-1 Fiance(e) Visa Process & ProceduresLondon Embassy Interviewers
I was wondering if I could put a shout out to the London interviewers... What time line are we looking at from NOA2 to interview? Anyone who got their visa: how long before you got the visa after interview?

I looked at the timelines and such on here and it looks to me like, now that we have our NOA2, we should expect 3-4 months? 4-5 months?

K-1 Fiance(e) Visa Process & ProceduresMedical: What constitutes a fail?

From previous posts people won't be drug tested. You admit drug use and you will need to see a psychiatrist or someone like that to determine whether your drug use is bad enough that you should be denied.

I know someone who had this issue come up and they did not even get asked about it. The situation was that the beneficiary had to turn in medical records that mentioned he used ecstacy when he was a kid. This is the difficult part of the forum. People fail to mention whether their post is opinion, speculation, or experience. I have seen all kinds of conflicting information on this site. I tend to look for certain people's answers because they seem to be more reliable, well-thought-out, most people who also seem to know alot about the process seem to agree with them, etc. I really wish this site would organize posts according to what stage you are working on in the various visas so all the past posts about the topic could be easily accessed. I sometimes have to try numerous different combinations of keywords to get what I am looking for. And, of course, policies change constantly. Sorry, Widsy, I know this kind of got hijacked from the actual topic to a side topic.

K-1 Fiance(e) Visa Process & ProceduresMedical: What constitutes a fail?

Sometimes people who admit to past drug use will be drug tested and then made to come back in six months or more for another drug test before the medical is approved

I read that in a previous post, too, but people argued against it, as well. Wish there was a way to tell if someone is expressing opinion or experience.

K-1 Fiance(e) Visa Process & ProceduresMedical: What constitutes a fail?

That seems stupid!

If my doctor on Tuesday decides to slap a 'denied due to high bp' on my papers, there will be serious words!

High bp is in my family, mother, grandfather, cousins etc.

My own gp told me that one day in the future, I will need treatment for it. But currently I'm 26 years old, of average weight, and don't think I need it yet...

You don't currently have a high bp, just genetics for it? If it was high I would think they would be treating it. Perhaps it is borderline. You might be able to get by with breathing slowly, deeply, thinking calm, relaxing thoughts. Either way, I don't think it would hold you back? I think the disease issue is more of a problem or finding yourself needing expensive medical treatment very soon that might make it likely you need assistance. This is just me speculating, though... Not real knowledge for sure.

K-1 Fiance(e) Visa Process & ProceduresMedical: What constitutes a fail?

They also ask about past drug use......which is a fail.

It is my understanding, perhaps I am wrong, that it depends on the drug use. If it was long ago history, under age, proof of treatment, etc. Those things make a huge difference. It used to be automatic fail but I thought I had read if it was over 3 years ago you should be ok or if it was an underage use-as long as no conviction of something, you should be ok. You will be asked about it but you would not necessarily fail.

K-1 Fiance(e) Visa Process & ProceduresProof of Income Question
I work for the state I live in for the agency who pays for that service here. The payments we issue are not intended to serve as income for the foster parent at all. They are meant to ease the burden if caring for such children. Of course, we do not monitor where the money goes and some people take some or all for themselves as payment for their services. I don't know your state or how much you are paid so hopefully no one takes this to mean I am implying you are stealing from the kids. Each state is diffferent. I just know in our state the payments are akin to child support and therefore probably not taxable. Not taxable because it is intended to support a child not the foster parent. Our parents do not get much but it is alot more than I get for child support for my child. My GUESS is either they will look at counting your foster kids as dependants or not counting the maintenance as income. I agree some investigation is in order but rather with your company as to whether this is actually your income or considered a maintenance payment which means it is more meant to offset your cost of caring for these children.

K-1 Fiance(e) Visa Process & ProceduresI found this post.. and thought it would be helpful

Sometimes we get so caught up in our own little world, we sort of need reminding of what the service centers go through. I found this post by HuskyKeive that states (as of 2007) what the process was for processing an application, and thought I would share it. Of course, I was seeking something to understand what happens when we send petitions to this blackhole called a service center and waith for 6-8 months for a reply..

Seems to me that perhaps (given how some people have waited nearly 8 months) the adjudicator actually need an aging report so that they can work on RFE's first thing, and clear those off. *shrugs* just a thought..

Anyway, here's the post, and to HuskyKiev.. if you're still around, thank you for your frank and honest answers!

Thanks for posting this!!! :). I think this is very helpful. Have a great new year and good luck!

Waivers (I-601 and I-212) and Administrative Processes (221g)221g in Juarez for K-1

Your right, it doesn't sound like they sent it back to the states. If so it would have stated it on the 221g letter. Have you tried your local congressman as well? Just keep pushing until you get their help, make sure you have your evidence all in a row to show any representative that will help you.

Also, have you thought about contacting a lawyer? Just a thought.

Good luck to ya!

I did consult with an attorney and paid him $100 for 30 minutes of advice, but did not hire him he wanted to $3000.00 to take my case.
I sent a letter with all particulars to my senator and I recieved a call yesterday that they were going to look into the case, the lady said hopefully they should have some information about my case next week. All this is just an emotional rollercoaster, down, down, then up fast, sharp curve, then down again.

Boiler: I called the State Department and asked them if they were done doing checks, they said they weren't doing any checks on that case. That the petition is at the CDJ consulate that they were waiting for evidence to prove our relationship. I don't understand why the 6 month wait, if it is just sitting there. I sent in 50 pages of additional evidence in February photocopies of pictures together, wedding dress reciept, engagement ring reciepts, hotel reciepts, passport stamps, picture taken of me with his family, airline tickets, cell phone bills, letters. I have not even had a reply. When we took all this in January the consulate officer did not even want to take it, he said bring it in July.

Samuel: I'm sorry to hear about your case, it makes me angry that they cannot give a justification why it is held up. I hope you hear something soon. Contact your senator, I just wrote to mine today and include an authorization form signed by you authorizing the office to inquire about your case. Their is a number that you can call I will try to find it. That is where they can tell you if they are doing checks and if they have been completed.

Waivers (I-601 and I-212) and Administrative Processes (221g)221g in Juarez for K-1
We had our first interview in early January and we were given a 221g requesting additional evidence of our relationship and the CO also requested my fiance's last 3 employers. The CO was quite rude and presumptious. My fiance took a bus back to SLP and I came back home by myself. I was not sure how we could turn this evidence in so I email CDJ to ask, since the sheet was not clear CDJ said to come in any weekday M-F between 8-10 am.
We went again in late January with additional evidence. The CO would not take additional evidence and said we were both ignorant and couldn't read and he told my fiance to not come back until July 2006. I was angry, I did go to the citizen services section and the person behind the glass window at that building told me they really did not have anything to do with the visa section. I told him I would contact the senator and he told me that was probably the best thing I could do. Well anyways I did write several letters and make several phone calls but none of the State reps have responded yet.
I will keep trying and I also sent in the additional evidence that the CO who insulted us would not take, and a letter to the supervisor. I also emailed the supervisor of Visa Section and still have not received a response in February.
I called the State Department and asked them if they were done with there extra security checks. They told me they weren't doing any checks on this case. That the consulate was just waiting for the additional evidence.
Since then I've gone to Mexico to visit my fiance with my youngest child and spend some time with his family. He is depressed and so am I we had plans to marry this month and now we are uncertain of the future. I know that I will go marry him over there and live over there if I have to but I don't want to. My children and I have our lives and family here. There are times that I feel hopeless and other times I am just angry. This process they make us go through is crazy and some of those COs don't know what they are doing. You would think they would give them better training. My question is why is the CO making us wait 6 months to turn in the evidence, is he just being a jerk?
Well anyways I have not been able to post for months, I decided once and for all to let it all out.

http://www.dcmobilen.../apostille.html

For cinco de Mayo I will probably stay home but tomorrow I'm going to the fiesta with the kids and tommorow night I'm watching the paid per view fight featuring Goldenboy Oscar de la Joya

I sent my bc in with a check for $10 to Texas Secretary of State and about 2 weeks later I got the Apostille. I printed and filled out the form requesting it and that was it. They sent the bc with Apostille attached and a reciept for the payment. I was surprised it was so easy especially since a lawyer was charging me $50.00 to get it for me and she said it would take about a month.

I found the following to explain better at:

http://www.missnotar.../apostille.html

What is an Apostille?

In 1961, the Hague Convention Abolishing the Requirement of
Legalization for Foreign Documents resulted in many nations
adopting a simplified method of legalizing documents for
universal recognition. These nations are referred to as
member nations of the Hague Legalization Convention.

An Apostille is a seal which, when affixed to a document,
certifies it has undergone specific procedures established by
the Hague Legalization Convention to prove the document¹s
legality and authenticity for use in a foreign country.

An Apostille is internationally recognized by all member
nations and documents sent between Hague Convention
countries may be submitted to the member nation without
further action.

Documents sent to non-member nations require a
Certification of the officials signature rather than an Apostille.
This is performed at the state level. The document may then
need to be transmitted to the U.S. Department of State in
Washington D.C., and then on to the specific embassy. This
process is referred to as Legalization of the documents.
Requirements for preparing international documents

Overall, the Apostille is a certification issued by the State
Government, a page attached on top of your original
document, to verify that your document (such as a Birth
Certificate for example), and the signature of the
County Official who signed the certificate, are legitimate, and
therefore it can be accepted internationally by governments
of foreign countries.

Who issues an Apostille?

The Apostille certification is from the office of the Secretary
of State, after reviewing the document's signature. It is an
official state government certificate.

Is an Apostille different for different countries or
different documents?

All Apostille certificates will look the same for all the
countries you send the Apostille to. There is no difference
between an Apostille which will be used for Mexico and an
Apostille for Russia. Similarly, there is no difference between
an Apostille for a Birth Certificate and an Apostille for a
Marriage Certificate, or a Power of Attorney or a Court
Divorce Decree. The Apostille will look the same. However,
a few countries have a different requirement other than an
Apostille, and your document would receive a Legalization
Certificate instead.

What are the steps involved?

For Hague Convention Nations:

The document must be acknowledged before a notary public

The notary¹s signature and seal must be authenticated by the
clerk of the county
in which the notary is commissioned.

The apostille is affixed to the document by the Secretary of
State of the state in which the document is executed.

Non-Hague Nations.
The document must be acknowledged before a notary public.
The notary¹s signature and seal must be
authenticated by the clerk of the county in which the notary is
commissioned. The certification is affixed to the document by
the Secretary of State of the state
in which the document is executed. The U.S. Department of
State may need to authenticate the document. The document
must be legalized by the appropriate embassy.

Melissa- An apostille is a legal document from Secretary of State it is the proof that the bc or whatever other document filed under that state is authentic and it has the state seal on it. In Mexico and some other countries gov't and local agencies accept it along with the original document for their records under the Hague Convention. I think, that's correct??? but, you can get it at the secretary of state for the state you were born in, try searching for the website.

Some of the requirements are same but the time frame and local requirements may vary from state to state in Mexico. It may be shorter where you are trying to marry, they told me it would take about 1.5-2 wks to get everything done.

Melissa, I found this:

Marrying A Mexican National
So far, the above requirements have assumed that a foreigner is marrying a foreigner in Mexico. If you plan to marry a Mexican National in Mexico, you'll need to fulfil some additional requirements:

In addition to all of the above documentation, you will need to obtain permission from the "Secretaria de Gobernacion - Oficina de Migracion" where for a fee of around US$200 you'll need to acquire a permit to marry a Mexican national. The document is known as "Permiso para contraer matrimonio con un nacional".

The office issuing this permit must be the same office that has jurisdiction over the area where the marriage is to take place - so check beforehand!

This process can take from two days to two weeks, depending on the State and the people at the local government office: be prepared to be patient if you have to!

Here is the website:

MissLiss, where is your fiance from? Sorry, I know you told me but I've got ADD, remember? Anyways get your birth certificate Apostille done now. You send it to your State office and I think it is like $10, or $15 dollars and you send your original BC. They will get the apostille done and send it back to you with your bc. I got mine done last month just in case we marry in Mexico. You can look up the information of what is needed as far as the requirements, for what state in Mexico you are getting married in or search under Mexican Embassy, there is some information there.

I haven't talked to my Alberto all week, I've got so much news to tell him! I wish I could call him whenever I feel like hearing his voice but it is impossible. I have to wait till he calls me. Hearing his voice right now would really make my day!

How sad, there are so many people that would benefit from the proposed bill. They are all good hard working people, I told him just keep studying and do your best in school if the Dream Act is included in the bill you may benefit from it.

I was looking at your alls picture. It's nice to see you all and actually have a face to put with the posts.

I hate to get my hopes up, she did not sound like she knew what was going on. But I hope they do schedule an appt. soon and Alberto can just go and pick up his visa, that's what I've been praying for. I'm just going to wait and see if my senator gets a response.

It seems like we are both just left hanging.

That lady was a tripp! She said our next appt was for 01/09/2008, she did not know what she was doing. I told her no, we had our 1st interview 01/09/2006 and then she said it must be a typo from the consulate and she gave me wrong info. then she told me you will be getting appt. soon.
I still don't know what's up???

How does the process of Advisory Opinion go exactly? Why would it take longer than 60 days, does your reciept have any way to check on the status?
