a lawyer is recommended if you have any issues out of the ordinary that would require someone with more knowledge of immigration laws (such as if your fiance(e) had any arrests, overstays in the US, etc).

most run of the mill couples, can do it themselves without incurring the extra expense.

i think if you have considerable financial/residential/business assets you would be a fool not to try and protect them when entering a new marriage.

it is all nice and lovely and hollywood to think that love lasts for ever, but reality says that it doesn't for almost 1/2 of us. you also need to consider how you feel now is NOT going to be how you feel, should you be presented with a spouse who wants to divorce you, especially if you then have children involved ... trust me! :thumbs:

business is business ... i would definitely present this to your fiancee and have a nice, open discussion about it.

when ever an ajudicator performs any type of work on your case ... you are 'touched' and you will a date change with your online status. you can register at the site once you have your NOA1 # (also located on the back of your cancelled check). some people are:

*never touched and approved


*never touched and RFE'd


*touched once and then approved


*touched several times and approved


*touched several times and RFE'd


see the pattern here?? unfortunately, there is no way that anyone here on VJ can tell you if you case will or will not be touched and how many times.

then it is YOUR background that they are looking into. regardless if you called them, they would have written that the required investigation into your fiance's background remains ... but they didn't.

basically at this stage of the game, they won't be checking too heavily into your fiance ... that happens at the embassy level.

i may be off base here, but i don't think i am. it's almost apparent by the delay that either your name or his name generated a 'name hit'.

as pax said earlier, my husband geoff was denied at the philly airport after being delayed and questioned for 2 hours, fingerprinted, and then sent home. he had used the VWP 3 times in a row ... only having returned to the UK for about 4-7days at a time. we were completely clueless to immigration back then!

once he got denied, he went to the embassy for a visitor visa ... you guessed it: denied. he was also told that he could not return to the US without the appropriate visa (K type visa). therein started our visa journey. we received our NOA2 within 41 days without any out of the ordinary delays. after our case was sent to the embassy, geoff received an FBI fingerprint clearance letter and had to go to london to be fingerprinted again.

all of the above is pretty routine for someone being turned away and denied entry. no waiver is needed and i don't see one being needed in your case either.

the letter you received said (per your account): they can not move forward on my case because the "required investigation into your background remains". was this letter addressed to you or your fiance?? if you, then this sounds more like they are looking into YOUR background. do you have a common surname?

simply describe the circumstances in which you met in person ... i stated our's plainly as: met online w/first meeting 4/03 and subsequent meetings 5/03, 8/03, 3/04 & 11/04.

that was it. just provide evidence of your meeting. this is not the time to provide an essay of your love. save that for the interview.

what state do you live in? there aren't any reciprocal child support agreements between the UK & Alabama, Mississippi, South Carolina, or the District of Columbia.

since you seem to have a grasp on it now and realize that it will be a long drawn out process which will be expensive on her end, the only advice i have to offer is:

have him send her a factual, non-emotional certified letter (recorded delivery in the UK) of his circumstances. he should explain that he is legally not able to be employed until he successfully receives employment documentation which can sometimes take up to 4-6 months. i would give a buffer of 4-6 months in case of an RFE and then actually finding a job. once he finds empoyment he will resume his payments of 'x' amount of dollars/pounds ... and for what it's worth he should not send a penny more than he legally has to!!

true, the past is the past ... but the CO may ask questions about your past. he's not going to get approved if he doesn't know the answers - plain as that.

he should know: how many times you were previously married, if you had/have any children, and when/why those marriages broke down.

he doesn't need to get into the nitty gritty but he does need to know those answers at the bare minimum.

If you have a history of a physical or a mental disorder, there must be a harmful behavior that is likely to recur in order for it to make you ineligible. If your condition has no associated harmful behavior, then you can proceed with your application process.

you may want to arm yourself with some sort of information regarding your care once you are in the US. where are you going to live and who is going to provide your care, etc. they may want to know that your disability is not going to lead you into becoming a public charge. <<< all of that is just a guess though!

i would also ask the agency who arranges the care (that she gives to her son) to write a letter explaining the situation.

send a cover letter and be as thorough as possible as you and andrew have an extremely unique situation.

you can fit it in on the application ... some people want to go into a full fledged dissertation of their love story! while the adjudicator LOVES to read it ... it's not necessary at this point. you need to PROVE that you met and show proof that you have met within the last 2 years. save the extraneous proof of your relationship for the interview!!
