K-1 Fiance(e) Visa Process & ProceduresJoint Sponsor / Co Spondor - 1-134 / I-864

Hi

I am so confused.

My NOA 2 is passed and waiting for the case number so i can book my medical.

I am now getting all the required documents ready for the interview.

My Fiancee has cancer and does not work, she is on government welfare.

She will have to be my first main sponsor. her benefits are $9000.

i know i need another joint sponsor, he has to be 125% poverty level $19,387.

what do they mean by a family size? on the poverty level ? hes single with no kids, and lives with his parents.

Also my fiancee did not file any tax returns last year, what do i do there?

i will also take my own money, would this help in the interview?

I hope someone can shed some light

Many Thanks in Advance

K-1 Fiance(e) Visa Process & Procedurescan i request a second drug test?

Hi thanks for all your replies and support.

an update....

so the Dr rang finally stating the lab tests have come back positive, and is very high, not passive smoking. She mentioned sorry etc and will be sending the medical report to the embassy. I stopped her right there and questioned everything about the test etc, also I still stayed firm confirming my innocence  of not smoking and baffled to why the results have come back positive. I could not take NO for answer, and a sorry from the Dr ?? not having it. I wanted to speak to the superiors. She mentioned she will speak to rhe panel of Drs and come back to me.

A few days later she rang stating they have spoken and with all the research they have done it is positive and they cant do anything. Not going to take NO for an answer again. Id like to present my own case to the panel. Id like to battle my own fights rather than leave it in someone elses hands.

That afrernoon A senior head Dr from Knighsbridge rings and advises me of the above, I presented my case, my points and now they have  referred me to a drug specialist in Chelsea who will decide, The cost of this doctor I will be absorbing, not including all the travel costs coming back down to London etc (on train this time). This Dr is £300 a hour. I will for sure looking to be refunded every penny once proven im in the clear.

My question is, has anybody been to this drug specialist ? what am I expecting? The appointment is tomorrow. I cannot wait to finalise this as this medical is still pending for two weeks.

Thanks in advance

K-1 Fiance(e) Visa Process & Procedurescan i request a second drug test?

Thanks for all your replies.

Firstly the doctor was being an ####### with me, when it came to drugs and alcohol she kept asking me the question, again and again. I SAID NO. I may have come across a lil rude when I answered it for the 3rd time.

Why would a Dr. patronise you?, I was paying them for a service.

Im Asian, 29 and a muslim. (only saying)

Passive smoking - well  I drove down to London with my mates the night before, and they were smoking all the way, in a car for 5 hours. Which now im certain it has to be that. Like I said all my life I have been around smokers. To me it is the norm. I am 100% confident I will pass another drug test now. In either case I have spoken to my GP and have scheduled a drug test this week. The results I will take to the interview. From what people are saying these tests have no weight or meaning but I will try -  Knightsbridge have not rang me back yet with the results of the further tests. From the research i have done, no test is 100%, they accurate but not 100%. some say passive smoking can be a positive and some say they don't. Im no Dr but i aint going to take one test as a concrete result. I will fight my corner.

Why would I do research on a drug test if I've never taken them ? If i had known there was going to be a drug test, there still would be nothing different that i would have done.

What exactly happens on the interview with the medical results? Will I get a chance to explain or will it be a simple No?! Is it up to the interviewer on the day to make a call on this? or the dicition is already made ?

The Mrs cannot travel, she has her chemo ongoing. I cant bear the thought of a year not being with her?

can I travel to the USA now with my ESTA before the interview so atleast I could see her before this one year ban happens ?

Ha at my medical being lost, i aint that lucky.  - ps what courier do they use?

Thanks

K-1 Fiance(e) Visa Process & Procedurescan i request a second drug test?

thanks for all your replies.

I have never smoked marijuana in my life. im not lying about this. I can understand peoples objection about this as drug test has come positive but I haven't and I would know If I have. I cannot understand how passive smoking can make my drug test be positive. I am 100% certain if I do a second drug test it will be fine -  It has to be due to my birthday being so recent and all the smoking which went on -  I did not take a single puff ! Can I request a hair drug test ?

My fiancé is absolutely livid, she is fuming mad and upset. I have been with her for 5 years. She has breast cancer and I cant believe what im putting her through. she does not deserve this. This year I wanted to make our dreams come true.

The doctor did say she will call me next week as sent for further tests. Ive not been able to eat or sleep, I cant stop thinking about it. I cant wait for a year, a ban for a year means I cant even travel to the country ?

Only God knows what the next year holds and not be able to see eachother will affect her so much, I can bear to just think about it.

K-1 Fiance(e) Visa Process & Procedurescan i request a second drug test?

Hi

I went to my medical yesterday and they asked for a drug test. the doctor has rang me back today saying I have been found positive for THC. I don't smoke, I have been around friends who smoke for all my life, not only that it was my birthday a few weeks ago and we had a mad party, thinking it maybe my last with them - I did not smoke in that party also. passive smoking all my life.

can I request a second drug test? how accurate are the drug tests? I cant believe this could hinder my chances for the visa.

pls help

Thanks in advnce

Hi,

We have recently (March, 20th 2013) been approved (received text message & email), however not received our NOA-2 letter in hardcopy as yet. My husband is a USC and Im beneficiary in Pakistan...I was wondering if we could start working on my Police Cert immediately even though we havent been assigned NVC case number as yet? Since Pakistani Police Certs are valid upto 3 months....what if Im not given an interview date with in 3 months (from the day Police Cert was made)....does it mean I have to make Police Certs again for the interview?

Thanks in advance...

IR-1 / CR-1 Spouse Visa Process & Procedureshow long from email ds3032 accepted to IV bill generated?

IV fee bill has nothing to do with AOS fee or it's status - those two go parallel. Once DS-3032 is accepted (acceptance takes 5 - 7 days from the time it was emailed, provided it is emailed after the case has been physically entered into the system), and it takes 2 - 3 days from such acceptance for the IV fee bill to show up.

Does it take 5-7 working days or just in total? My Ds 3032 got accepted on 23rd April, 2013 and still havent been invoiced for IV ? :(

Should I inquire via email or phone?

"IF the applicant is living in their country of nationality at their current residence for more than 6 months
AND is 16 years old or older
THEN the applicant needs a police certificate from the police authorities of that locality.
IF the applicant lived in a different part of their country of nationality for more than 6 months

IR-1 / CR-1 Spouse Visa Process & ProceduresPutting everything together! Please help
Hello

I will be really appreciated for your help, if you can do so.

I recently got married in Bangkok, Thailand on Feb.16th 2012.

well, the marriage was just to register me and wife at the district office, but me and my wife haven't done official ceremony yet...... (you know i was just a student and not much financial resources to get the ceremony done.....) however, I am planning to do the ceremony in near future.

my wife is living in thailand for now, and I am getting it ready to file I-130 forms and all the other documents.

I just have some question in mind.

What is considered as an evidence of a bonafide marriage?

I do not have any joint account or ownership with her because she is living in thailand and i live in NYC. I didn't realize this thing unitl i came back to the U.S.A

a lease or joint financial disclosures, I also do not have those yet. should I make one up or It will be fine if i don't include these things?

also, what evidences are considered as ongoing marriage relationships? I have some pictures that I took with her when I was in Thailand and other countries nearby. and I saved chatting dialogues with her and e-mail correspodences. these are all the evidences? or should I prepare for more?

I know it is so many questions but, I will be really appreicated for you guys help. It is not really easy to get this done by myself.......

PhilippinesTraveling with Advance Parole

A GC doesn't guarantee entry to the US either.  Furthermore, a K-1 doesn't guarantee entry in the US.  Was he afraid to use that?  If he becomes an international criminal between the time he leaves the US and the time he returns, then he won't be coming back.  But otherwise it will not be a problem.  That is what AP is for.

If my husband goes home to the Philippines using the AP and his K-1 visa on his passport expires February 2014 is it still safe to travel. My husband thinks that I should accompany him on his trip to the Philippines just in case he has trouble re-entering. We have read that he can travel with AP as long as he was never out of status upon filing the AOS.

My condolences to both of you on the passing of your husband's grandmother.  rose.gif

Your husband shouldn't have any problem entering the U.S., but according to the U.S. Customs and Border Protection (CBP):

Please note that Advance Parole does not guarantee admission into the United States.

http://www.cbp.gov/xp/cgov/travel/id_visa/lpr/adv_parole.xml

Thank you. That is what I am worried about since it states AP does not guarantee admission to the U.S. my parents are worried also that if he goes to the Philippines he may not be able to re-enter with just the AP. Not sure what to do as my husband wants to see his grandmother one last time before she gets laid to rest.

Hello everyone. I have a question if anyone can help. My husband's grandmother recently died and my husband wants to go to the Philippines for the funeral. He already has his EAD/AP combo card but other people are advising us that he should not go home as it might be hard for him to re-enter the U.S. Do you think its safe to travel with Advance Parole or should he just stay here? Any help would be great.

PhilippinesPhilippine Travel Tax - Pay every time you leave?

My wife (then fiancee) paid the travel tax when she left the Philippines for the USA the first time in 2009.  She didn't think she paid it when she left after visiting in 2010.

She is there now and is returning to the US in 10 days.  She is still a citizen of the Philippines (US green card holder).  Will she have to pay the travel tax when she returns?

Yes she would have to pay the travel tax. She should apply for her US Citizenship if she's been in the US for 3 years that way she won't have to pay the travel tax next time she goes back :) I believe its like 1k+ pesos for the travel tax and 550pesos for terminal fee.

PhilippinesBringing a maid to the US

I am very happy I found this forum because I have been searching everywhere without finding an answer to the question(s) below.

I am a Swedish citizen who have lived in the Philippines for the past 1.5 years. Now I have started a company in California and I have been issued an E-2 investor's visa. My wife and kids have E-2 "family visas".

We want to bring one of maids with us to the US and applied for a B1 visa for her here in Manila and she got that. It was a very straightforward process and the US Embassy here in Manila is great, at least based on my experience.

Now to my questions: Does my maid need to have any "approval" from any authority here in the Philippines or pay any special fees to be allowed to leave the country? Does she need to stand in the OFW queue at the airport? Or is her US visa that is stamped in her passport enough for the Philippines to allow her to leave the country? She will be travelling with us, if that makes any difference.

Thanks in advance!

Hi. Can you let me know the steps on how you were able to bring over a maid? My family also wants to bring our long-time maid in the Philippines who has been working for our family for over 30 years already. Any advice on what you did to get her would be really appreciated.

PhilippinesFlying from Manila to Maryland in June '14?

Hi mga kabayan! Is there anyone here flying from Manila to Maryland (or DC) in June? My mom's visa interview is scheduled for May 15th and assuming everything goes well from her medical to visa delivery, she can leave the Philippines by 2nd week of June. The problem is she doesn't want to travel alone. She's 61 years old, healthy, speaks very little English and as of this writing, freaking out about travelling to the US alone. I cannot go home to pick her up because I just started at my new bank job and the budget is a little tight right now since we are moving to a new house also in June. I was wondering if there's anyone here willing to meet and travel with her?

Thanks.
Beth

My tita is the same way. She is 72 years old and is also very shy and doesnt like to travel alone because she feels that she will get lost or left behind by the plane but she has already traveled here to the U.S twice and when she travels we requested for her to be on a wheelchair and she says that is hassle free since the attendents take care of her. Good luck to your mom on her interview.

Hello hank! I know right! Thats basically the main reason why we have to go back and get married again or should i say renew our vows. Kind of filipino tradition. My husband and i are both filipino. But geez dealing with the paper works for a church wedding is just insane. ??

My sister also got married here and then did her church wedding in the Philippines in 2008 and she didn't really have to do too much paperwork. We are also planning to do a church wedding in the Philippines hopefully in 2017 :)

JayAnn, I think you have helped her enough with the link and something she could have easily googled herself. That's all she needs to know. In case she ask more questions, tell her to read on the USEM webpage. If they have spare cash, then by all means, why not? Let her experience it upfront.

i guess she was too lazy to do it herself and she always goes to my husband for help. she thinks that a tourist visa is simalar to a k1 that you will get approved if there is doctors note proving her grandma needs help. funny she is like excited to leave pinas already.

And people from the PI want to know why it's so hard for their relatives to "visit" the US.

Fraud by people similarly situated.

Don't blame the US government for not giving out tourist visas when people like these are looking to abuse the visitor visa system.

Agreed! Sucks to have people like that. Jealousy can do stupid things.

Well, if the grandma's first companion did not return to the Philippines, then the second cousin will have a harder time proving that she would.

She def wouldn't return as her aunt who lives here as well plans to find a guy for her to marry. If she gets approved she doesnt want to stay in California and wants to come here to New York.

JAYANN & JAYFemalePhilippines2014-06-02 09:44:00
PhilippinesApplying for a tourist visa

It is a valid reason to apply compared to tourism purposes, of which majority of visitor visas from Philippines are. But regardless of what the reason is for the visit, there is no guarantee that the second cousin's visa will be issued. Strong ties to the country have to be proven during the interview for B visas.

If she's single and doesn't have a permanent/stable job and properties, the odds are against her.

She is single and does not have a stable job or any properties. I told my husband this but he claims that the grandmother was able to bring a companion here. Not sure if she returned to the Philippines though.

PhilippinesApplying for a tourist visa

Accompanying Grandma is a reason to issue a tourist visa.  Getting a tourist visa is always a (steep) uphill battle.

Would you happen to know what she would have to do first? What forms she has to fill out what kind of tourist visa would it be? The grandmother's doctor here in the U.S issued a letter saying the grandmother needs a companion. Wasn't sure if it would fall under B2 visa since I know you have to pay the visa fee at BPi correct?

She has been dying to come here to America ever since my husband came and most of my husband's cousin are asking him to find them a man or woman just so they can come. Things jealousy can do to people.

PhilippinesApplying for a tourist visa
Hello. My husband's second cousin is applying for a tourist visa. Here are some information: my husband's second cousin has a grandmother in California who is a green card holder and she is currently in the Philippines. When she comes back to the U.S my husband's second cousin's family asked her grandmother's doctor to write a note saying that she has to be accompanied by someone. The grandmother wants to come back to the U.S in July so my husband's second cousin is asking how to apply for a tourist visa as a companion. Any advice would help even though I shouldn't help because I feel like my husband's second cousin is just coming here to the U.S out of jealousy and she also has an aunt who lives here.

PhilippinesWhat airline would u recommend

It will be my first time to travel to US. What airline would u recommend. Has anyone tried Eva Air? :) Thanks

Eva Air is good. I live in New Jersey and have been using them for quite some time (6 years). Plus flights are some what cheap. My husband used Eva Air when he came here in September 2013. We paid $700+ for his one way ticket which included the travel tax so all he had to pay for at the airport was the terminal fee. I would definitely recommend taking Eva Air. :) Plus they always arrive on time and have never been delayed.

PhilippinesPassport expiring October 2014

Hi every one! I just got married last month gladly with my fiancée. I am from Philippines and was approved to come visit my fiancée in US as K1 visa. So after getting married we filed my I-485 and I-131 and EAD. Now our problem is my Philippine passport will expire this October 2014. And we're clueless if I need to renew it in my country? We'll we are still looking on what the next move should we do.

Hope to hear from anyone who have an idea on this. Will totally appreciate it . Thank you so much

I live in New York and we renewed my husband's passport in July 2014 unfortunately we did not know that it would take about 8-10 weeks for us to get his passport back since the Philippine Consulate here told us that they send your passport to Manila to be processed :( Hope it is different from where you live.
