you will not believe the run around we are getting trying to find out about civil marriage. the marriage registrar himself says that we must have a religious ceremony and then bring proof of that and then only will he register the marriage.

can you please tell me a little bit more about your civil marriage process.


OP, I do not know which part of India you are from, but I guess this works the same in most places. I am from Chennai and I have friends who did it, so here is how it could possibly be done if your Registrar office insists on a religious ceremony. Get married at a local Indian temple with the temple priest officiating,take a few pictures with guests during the marriage ceremony, speak to the temple authorities and ask if they will sign a letter saying you got married at the temple. Most temple authorities will oblige, if you agree to make a donation to the temple. This certificate is considered valid enough at most Registrar offices, you can say you did not have a formal wedding card printed and get affidavits from your parents etc. if needed. Once you get this stuff into the Registrar office, it takes about a week to get the marriage certificate and then you are good to go. You really do not need to wait till end of year to get married.

I also know of cases where people have completely skipped the religious ceremony part (what if you happen to be an atheist etc.?) and done only the civil marriage at the Registrar office itself.

Hey guys,

i just got my US Visa few days ago and now booking flight.

It looks like my POE will be Newark, NJ and i will have 1 hr 30 min to get through immigration.

Is this enough time?

also need to consider the time i need to reclaim the baggages and send it once more at Newark Airport to my final destination.

I would say that should be enough, provided your flight arrives on time. Newark has always been my PoE and I find that the queues there move fast enough and baggage clearance is uncomplicated too. Just make sure you have all your papers ready for checking by the CBP officer, if you fiddle for too long with your stuff, they tend to get a trifle annoyed.

No offence meant to you, but 'targeted malice' and 'abuse', this certainly does not seem to be. If you were not present during the interview, you may have to ask your wife to recount the sequence of events once again. There is definitely another side to this story, me thinks.

Bigdog - my wife who is the real victim in this situation thanks you and I thank you for not berating me and or her as some have done in this forum. To state factual situation is being termed "venting" and "mega chip". Well that is why I served in the US armed forces to protect the "Freedom" of those who speak in this forum. My wife was very sad to see some of the other comments and then she cried when she read your heart warming encouragement to her. So both thank you.


I don't mean to offend you, but were you at the interview along with your wife? It does seem
highly intrusive if the CO actually said things like 'disabled cripple' and asked stuff like why your 'attractive' wife wanted to marry a disabled cripple, when she could have easily married on dowry. Granted that COs are known to be aggressive in trying to weed out falsity, but they also receive cultural sensitivity training and I have a tough time believing this, especially given that you are a war veteran.

Seems to me they were actually doubting the bonafides and motives behind your marriage, rather than its financial foundations. All will depend on what answers your wife gave. Good luck!

We are preparing to file I-130 for initiating CR-1 for spouse of a US Citizen. Other than the documents showing co-mingling of finances, joint property, lease etc, what other documents can be shown as evidence for a bonafile marraige


Insurance certificates showing both your names, pictures of the two of you and with your family/friends (not too many here, maybe three in each category) and if you have been married for less than a year, affidavits from friends and families that you are in a bonafide relationship may help.

Thank you for replying, when we went to the courts system to register the marriage they stated that since I was not born in India nor did I have any legal address in India they could not register the marriage because I could not prove any residency there. They stated that the marriage cert that I was given is considered to be legal. I found it somewhat odd myself, but my brother had encountered the same issue when he got married 12 years ago but since at the time my parents had a legal residence in india (which they no longer have) his got registered. I called the 1-800 number and spoke to a iso he advised me to write up a letter stating what happened and to provide some additional affidavits and send in and see if they will accept that. I have provided pictures from our meeting our ceremony our wedding and honeymoom and chat logs phone logs and even evidence that I am financially supporting her from the us until she gets here. He stated that to try this and see what they say. He also did advise me that he has heard that in the past people have been the victims of bad information while traveling in a forgin country. Both me and my wife are very stressed out by this since we are missing eachother and also as everyone here knows how hard it is to be seperated from your significant other.


I can understand what you are going through. Your best bet at the moment is to go by what the ISO said. Frontload the letter with as much documentation as you can. Do you have proof of what the court said? For example, a filing fee receipt etc?

Hi everyone,

I was hoping to get some guidence. I got married in India in November in a Hindu Marriage Ceromny. When we tried to register the marriage in the court systems they told me that we could not since I was not a Indian citizen. They advised me that the temple wedding is considered legal and the marriage cert I got from them was as good as theirs. I sent in all the paper work to the us customs and they sent me a request for more evidence stating they wont accept it. The letter they sent me stated that in its place I can submit 2 sworn affidavits by people who attended the wedding and that would suffice. They now sent me another letter for evidence stating that the marriage cert is not legible and that I need to provide them with a civil registered cert. I am not sure which way to go with this now. When I tried I was told no since I was not a Indian Cititzen and that I dont have any legal address there in India. Any guidence would be greatly appreciated.

That is very wierd....I have heard of so many US citizens getting married to Indian citizens and obtaining marriage certificates. Which state are you from? Is there some way you can prove that your court in India told you they could not issue you a certificate? Sometimes, it works if you can documentarily prove to USCIS that you made all possible efforts to obtain the marriage certificate. Temple certificates are not considered valid.

Not really. Just that no one attended the ceremony. It was just an official affair.


Are you the OP's spouse? If you do not have any of the red flags, nothing much to worry about. Just try getting pictures taken of the two of you together and with friends, if possible, and you should be good to go.

You can always explain the lack of parental consent. I do not see too much of a risk here, though other members may see it differently.

I am new to this site and find it very helpful. I am preparing for the interview as my case is at NVC. Anyway, I have a doubt over my marriage ceremony.

Actually my wife from US and I married in India despite my family consent. My parent were very hostile to this idea of getting American DIL. They tried all their best to stop this marriage though.

Because of this fact we were compelled to marry without consent and even keeping other closed family friends at dark about our date and place of marriage.

Now can this cause a case lac of document for interview. They are not even ready to meet my spouse.

can it be a deadly issue ??


Lack of parental consent itself may not be an issue, if you can prove that yours is a genuine marriage not entered into for immigration purposes. Does your case have the following classic red flags?

1) Big age difference between you and your spouse, usually the woman being older
2) Both of you are from vastly different educational, cultural and religious backgrounds
3) Previous marriages,with children
4) Marrying upon first visit to India and not having met often after that
5) Lack of proof of ongoing relationship

If your answer is no and if your relationship is within acceptable Indian social and cultural norms, you should be okay. If asked, just explain.

This is incorrect and far too sweeping a generalisation.

I personally know at least three people whose fiance visas got okayed in the past ten or so months.

I am guessing the OP's problem is that his/her visa was put under AP since he/she likely has a name that has raised some red flag (happens to applicants from certain faiths).

OP, please do not spread misinformation. If you are still under AP and have not been denied, then there is still hope. Getting married in Mauritius etc. will only complicate things further. All the best!

At this point your guess would be as good as anyones.. there is really no telling what happens behind those closed doors at USCIS. You just have wait it out unfortunately.

Typically if there are a couple of updates or touches to your case, it could mean they are close to approving it.. yet it could mean nothing at all. The only good thing about a touch is that at least you know that they are doing something with your file, and that it's not lost or sitting at the bottom of the pile in somebody in-box.

I received an RFE on 6th april , for not providing primary evidence ,coz we are not aware of it. Initially we had sent our engagement pictures only.

RFE letter clearly mentioned to provide flight tickets, boarding passes , place of meeting , credit card transactions, hotel bookings, movie ticket stubs, etc.

We have sent them on 17th april and received a confirmation email from CSC on 2nd May 2007.

Anyone has a clue how long does it take for approval?

It's only one regular birth certificate sufficient for nvc, your husband can get it from his city, and he should certify it from foreign affairs.

I think it's not a good point for your case. Tell your husband to not be stressed and speak English at interview as he communicate with you, he mostly would get a bilingual CO, and if he didn't understand a question, CO will repeat it in Arabic. That's what happened with me.

After you have case complete at NVC you wait for interview for Egypt that can be a 4 to 8 month wait (even though this last months assignments were encouraging people waiting since March and April got interviews).
 

There are good news for Egypt; some cases completed on July have been scheduled for September.

You can make POE after you were issued a visa.
As your second anniversary is a week after, when you got approved after your interview, you will be issued IR1 visa which give you permanent residence after you make POE to US.

My fiance who lives in the USA has Breast cancer - i am from UK and we have applied for the K-1 visa in August. Can her having Breast cancer affect our application for visa?

 

Also she is not working due to this reason and is on governemnt funding. She will not meet the financial requirements
