His K-1 visa expired when he entered the U.S. It's his I-94 that allowed him to stay 90 days in the U.S. and remain in status. Now his I-94 has expired and it's his AOS letter that is keeping him in status. Since he doesn't have his conditional green card yet, it's his AP which would allow him to re-enter the U.S.

I don't know if it would help if you traveled with him.

 

 

His K-1 is already cancelled since he used it, so the date on it doesn't make any difference.  He will be reentering on AP as an AOS applicant.  K-1 is over.

Thank you both so much for these great advices. Its so hard when a death in the family occurs and you have no way of traveling to see your loved one.

As we all may know, a lot of I-130 petitions on NBC are getting transferred as part of "Immigration Relief" USCIS is giving Filipino families. I have not seen a list/spread sheet tracking this so I decided to create one. This will give us an idea on how USCIS are handling the cases transferred.

 

Please note that I have read people getting updates, like mine, that says "transfered to local office" but in reality is its either one of the other service centers (VSC, NSC, TSC, CSC). So I will wait for the hard copy in the mail and update my info later.

The 12yo is exempted from the seminar.  No need to bring him/her to CFO.  You just need to have him/her registered and get the sticker.

For those who have their minor children attended the CFO, one of the requirement is 

 

 

  1. One (1) valid identification card with photograph (eg., SSS ID, GSIS E-card, PRC ID, driver's license, postal ID, ARC, etc.)

 

Since my children are 12 and 15 years old, they only have passport and school id.

 

What other photo id can they present that will be acceptable to CFO?

Btw, this could be the restrictions ur fiancé is talking about...I remembered when I went to Singapore this February, my sis brought my ticket online using her credit card...I cannot check in if she is not with me cause airline required the owner of the credit card should be physically present...so she took a leave for work to accompany me to the airport in the check in counter...it was Tiger airways.


Yes they ask you for the credit card used when you purchase the ticket upon checking in. It usually states that if the person purchasing it is not one of the travelers they must call the airline to avoid any problems.

Sorry to hear that.  It always makes it harder when family support is lacking.  Your parents must learn to back off and realize that it's YOUR life, and YOUR marriage.  As much as they don't want to see you get hurt, or be in a bad situation, we must make our own choices in our grown up lives.  Some parents seem to have a hard time letting go..

Totally agree with you. I kind admire every American who are all so independent. I am at the right age where I can make my own decisions I feel like I am still like a 16 year old who has to do what they say. I appreciate them that they want the best for me but I am old enough to make my own decisions in life. When I visited the Philippines to see my fiance for the first time I was 25 back then but had to be chaperoned by my 2 17yr old cousins just to make sure he doesnt get me pregnant and the second visit I got yelled at for checking into a hotel alone with him because again they were afraid of me getting pregnant but I am not that stupid to get pregnant while the guy is in a different country & he would never do that to me as he doesnt want me to raise a child alone.

Two pieces of advice from an old man:

 

1) Wait until you are both ready, both emotionally and financially, to have kids

2) No matter how long you wait, you will never be ready to have kids

 

Other factors may come into play and cause a child to happen before you're ready, and that's life.  You deal with it.  But if you can plan ahead for such an event, all the better.

 

On the subject of your parents feelings about your guy working... unless they are paying the bills until he is working, I'd tell them to butt out.  Rushing him into the NCLEX and a job is NOT their place, that is a decision for the two of you to make.  I agree with the above... get him here, worry about USCIS stuff, driver's license, marriage, and getting to know each other.  No need to rush testing nor kids.  It will all come in time.

Thank you so much for this great advice :) My parents have offered to rent out their basement to us but I decided not to take their offer and rent an apartment as I do not want my fiance to have to be put down by my parents just because he still looking for a job. We've gone through this whole battle with my family about how he is not like my brother in law and I had my mom tell me that if he does not find a job or gets picky about getting a job she will make sure he get deported back to the Philippines :(

I would say wait until you are both ready.

 

At the very least wait until after he gets Green Card, so you're not worried about USCIS and baby stuff.

 

Also, it's a good time to make sure your emergency fund (6-12 months of expenses) is fully stocked. I know mind has taken a beating from the visa process haha. Tell me about it. Luckily I found this site and researched how much people usually spend to do a fiance visa so I saved up 3yrs for this. haha.

 

While you make enough money to support a family you have to consider the worse case scenarios. Like something happens and you are unable to work for an extended time. Or maybe you want to spend more time with the baby and take a few months off work. If he already has good job in his field then these things won't be an issue for you two (or three). Just some things to think about. - Good point but luckily my job allows me to work from home 3 days a week and require me to only go the office 2 days. My problem is my parents expect him to be a RN here in America so it makes it more difficult for him to work + review for the NCLEX exam. I feel bad already that my parents are putting him down that he won't be able to support me unless he is an RN. It would be nice if he becomes an RN so we don't have any problems about who has to babysit :)

 

Personally I think waiting a year for him to get settled in, get green card, and find job isn't a big deal. We have decided to wait 5 years for kids. I wanted to wait 8-10 years and she wanted to wait 3 years. We settled on 5 years haha. I think we are too young for kids now (I'm 26 and she is 23). - I guess you're right we can compromise on 3.5yrs and enjoy traveling for a while before having kids. We may never go to see the place I want to see unless he makes good enough money for us to go on vacation. haha.

 

I know you guys can come up with a plan to work for both of you.

I would like to have a baby once my fiance gets here but my fiance wants to work first before we try to have a baby because he wants to be able to support the child. I told him that once he finds a job then he can help me support the child and I am pretty sure that it won't take him 4 years to look for a job here in America to not be able to support a child. You know I envy those applicants who has their partners by their side! But I realize if my partner will be here he'll be annoyed with all my nervousness HAHAHA!! The day of my interview while waiting for the last interviewer (American CO), I felt all the biological factors, bowel movement, frequent pee, nausea, dizziness, shakiness, and everything lol. It was funny but the moment when I was called, the American lady who interviewed me was really nice and all the nervous were GONE!

 

Your fiance will do just fine ;-) Talking to other applicants during the wait also helped me Big time!! I found new 3 friends over there, K1 applicants as well, and were now planning to take CFO seminar all the same time. Instant friendship too!

Thanks! My fiance was like I will just think of it as going on a job interview except this one I'll be sure to get hired. lol. My fiance is all calm while I am the one getting nervous for him and I am not the one going on the interview...hahaha. I am hoping that the American CO will not be strict. He stayed at Tune Hotel for his Medical & CFO last week and really liked it which is like maybe 2-3 blocks away from the USEM. He isn't nervous at all & feels very confident but I am getting so nervous though that the Consul he might get will be someone who is very strict. Hope you see my fiance there. ^^Goodluck. On my end i booked flights after I saw my visa issued on the ceac site. I don't recommend following what I did since so many things can still go horribly wrong...from 2go to cfo and airfares are not cheap to gamble...its just someone wants to book right away and wanted me to fly asap heheh...good thing, everything so far went smoothly. But again I wouldn't really want to take that risk...

hahaha. so funny how everyone is just taking risk to get their loved ones asap. truly understand though as i havent seen my fiance since last september to be exact so i am hoping the rest of our journey will go smoothly and he will be here before september ends. luckily i had him get his cfo out of the way so all he has to do is just get it stamped.

A.S.A.P. dancin5hr.gif but still waiting for my visa ClockWatch2.gif . It is too risky to buy a ticket ahead of time since the issuance of the approved visa/passport are unpredictable.  And it is an additional $$$ to move the date.  So we might as well wait for the visa, take the CFO Seminar  then book the  ticket.  Our plan is I will stay in Manila then off I go, since the expense is just the same going back to Angeles City. 

 

Besides it's nice to stay in Manila.... need to shop and fill in my luggage...rolleyes.gif  hahaha.  just kidding! My Fiance no0pb.gif  might read this ...lol

I stayed at Casa Bocobo Hotel, P1650 for 1 person while P2200 for 2 during my medical, interview and when my fiance left for WA.

Overall experience where all great.  I am planning to stay there again when I get my CFO seminar and a day before I leave for WA.

YES! Same thing. I wasn't able to go due to no vacation days left. I had trouble sleeping and focusing at work (not good when you're trying to make software). I kept looking over the copy of the documents I had and reading the instructions from the embassy, Hanks guide, and Robb&Anns site trying to make sure I didn't skip anything.

 

You will be so happy when you hear that Visa was approved! I was so happy and couldn't believe it. It seemed too easy haha. After 8 long months of battling the USCIS and NVC with delays at every step it was finally over!

Glad I am not the only one who feels this way :) We originally planned for me to go home to the Philippines but we decided its best for me to stay here to save my vacation days and the extra 3k that I will be spending for the trip to the Philippines. I have been reading everyones reviews and tips about their interview to make sure that we are not forgetting anything. We've come such a long way to reach this point and we are both hoping everything goes well next week. We were gonna reschedule his interview for 8/15 after finding out he had passed the medical last week but then decided to just stick with the original interview date of  8/20 to give us an extra week to go over everyhing and make sure we are not forgetting anything he needs to bring to the interview. Praying and crossing my fingers I will get some good news next week :)

My Filipina fiancée just had her K1 interview yesterday, August 13, and passed and was out of the embassy in 2 hours.  She was asked 3 questions:  1) have you ever been outside Philippines, 2) when is your wedding date, 3) when do you plan to travel to USA.

I could not be with my fiancée either due to cost and my vacation time that I wan to use when she arrives in California.

YESSSS I was very nervous and she was also nervous, that is perfectly normal.  If you feel confident about having all your documents and they are up-to-date and you have all the information the embassy requested then She will not have any problems. 

My fiancée found all the people at the US Embassy very nice and smiling and helpful. 

Your fiancée will do great and yes you will both feel nervous.  But when she calls you to say she passed and will get her visa you will feel GREAT!!!

As I was talking to my fiance making sure he has everything he needs for his upcoming interview on August 20, I asked him if he wrote N/A or NONE on anything that is left blank like I told him but unfortunately I just found out that my fiance printed out all the DS Forms and did not put N/A or NONE on the questions that he did not answer. Would it be an issue if he just wrote N/A or NONE by hand on the things he left blank so he does not have to go back to the internet cafe to print it out again? Thanks

What nursing school did you graduate from in the Philippines? My fiance graduate in 2008 from University of Perpetual Help Dalta System. If my fiance had passed the NLE 4yrs ago I would have had him take the NCLEX in the Philippines as my sister's friend advised plus she would have given him a job in he hospital where she works and my aunt was going to give him a job at the nursing home she works in also but since he didnt pass we have to look for another for job for him.

The requirements to sit for the NCLEX are the same in the Philippines as they are in the U.S.

I guess it would be better to take it in the Philippines so that they don't have to worry about taking it here. I wish my fiance had passed a while ago so that he was able to take the NCLEX in the Philippines. I was a little sadden to find out he didn't pass since my aunt was able to get him a job at the nursing home where she works but just gotta be positive and there is some sort of solution to every problem right. :)

Question. Do you guys recommend Reviewing for NCLEX while in the philippines? Or better to review in US?

My sister's friend who is a nurse here and my aunt's neice who is a nurse in the Philippines advised me that if my fiance passed his NLE there he should take the NCLEX in the Philippines so that he does not have to take it here and when he gets here he will be able to work as a nurse but sadly my fiance did not pass the the NLE so he would have to take his NCLEX once he gets settled here. For me you might as well just take it in the US to avoid any problems at least you'll know for sure that the requirements are ok already.

Studying for the NCLEX is a full-time job. I hope that when he comes to the U.S., he can concentrate on that and not get distracted by working some job.

The payoff will be a lifetime career with excellent wages and benefits.

What documents did they request from your wife when she took the NCLEX? We are looking at taking the NCLEX in New York as it may be easier since he just needs to get it verified by CGFNS. Did she have to go back to school or just take the review classes? It would really be nice if he does become a RN here as when we decide to have kids we wont have to worry about who will be watching our kids.:) I'm sure its easier to find a job here than in the Philippines.

Your parents are misguided. In my opinion, your fiancé would be wasting his time and money studying for the NLE and taking the exam. As I said, the NLE is nothing like the NCLEX. Why waste valuable time studying for the NLE when he should be concentrating on studying for the NCLEX?

Even if he passed the NLE, it's almost impossible to get a job as an RN in the Philippines. It's even very difficult to get on as a volunteer unless he has a backer. Is your fiancé willing to spend the next three to five years in the Philippines working as an RN (if he can even get a job) to gain the experience he will need in order to get a job in a U.S. hospital?

Instead, he could pass the NCLEX and start out as an RN in a long-term care facility in the U.S. They hire newbies. This path could give him the work experience he needs to make the jump into a hospital, if that's his career goal. As a bonus, you two would be together a lot sooner if he followed this path.






Trust me I totally agree withe you and apple21. I have cousins in the Philippines who are nurses and yet they can't find work and only do volunteer work. That's the thing even if he did pass the NLE in the Philippines he is not gonna be able to use it anywyas because he will be living here and wouldnt be able to be an RN here regardless because he still has to take the NCLEX. My parents wants him to be like my brother in law because he was a licensed engineer in the Philippines but still my brother in law had to get has masters degree and also take the board to get his engineering license here and plus since his engineering license already expired in the Philippines and he has been here for 9yrs already. They think just because he is an RN in the Philippines it will be easier for him to get a job. He plans on working any jobs here and then once he gets settled he will study for the NCLEX and takr the test to become an RN.

I feel sorry already for your fiancee.  You have to tell your parents that he is not the same person as your brother in law.
 
Your fiancee will find work based on his own capabilities, RN or not, so don't put the world on his shoulders.  He will make it as long as YOU love and support him.

Success doesn't come overnight weather you have a license in whatever course you finished. After Chinook passed the NCLEX and endorsed her license to Washington State, it took her three or four months to get her first job as an RN.

Chinook said that the NLE didn't help her pass the NCLEX because the NLE is all about memorization and the NCLEX is not. The thing that helped Chinook pass the NCLEX was studying full-time for it and not having to work while she studied.


I'm just in a tough situation because my fiance is being compared to my brother in-law who also came here thru fiance visa. The only thing is that my brother in-law is a licensed engineer in the Philippines so my parents expect that my fiance should be an RN in the Philippines also so he won't have a hard time looking for a job. The thing is even if my fiance passed the NLE in the Philippines he still wont be able to work as a nurse here in the US as he is not licensed here unlike engineering or accounting you can still find jobs in an office. I know passing the NLE is important but I feel like if he did pass the NLE he wont be able to use it here and still needs to take the NCLEX. Plus he wont be working in the Philippines anyways so him being an RN there is nothing.

Has he taken the Nurse Licensure Examination and passed in the Philippines? He should, it helps with the NCLEX and it doesn't hurt to be qualified for both. My future step daughter is going to take that path as she is in her fourth year of college. At the end of her first semesters break (Oct 22), and if we pass the Embassy interview (Sept 27), she will come to the USA because she has to get in the country before she turns 21. She will get all her documentation, do some work and save some money and then return to finish her degree and take the NLE there and then return back to USA and take the NCLEX and then find a nursing job.

I guess that depends on what you believe you are qualified for and what your future employer see in you.
 
If you like working in the service industry like retail or restaurant, then you can find some very good entry level jobs. For instance, the economy here is getting better and there are help wanted signs everywhere in this industry. Wal-Mart, Target, McDonald's etc. are always looking for good employees. I have a friend here and she is Filipina and works in McDonald's. She started there as a counter cashier and has worked her way up in 8 months to shift manager. The owners LOVE her! They have sent her to different seminar's to help improve her skill set.  This may be for you or it may not be.
 
If you have call center experience those jobs are available. Look on your job boards for advertisements.
 
If you are care giver or nurse those jobs are abundant and the best way to find those jobs, in fact any job is to net work with others who are in that industry.
 
I recommend that she get involved in your community with a Filipino group and network. Get involved with a Filipino Church and net work there.
 
If she wants to work and work well, then I think the world of employment in the States is WIDE OPEN!
 
You can find some pretty good jobs on Craigslist for your area.

THANKS EVERYONE :) I make twice the amount for the poverty guideline but only have maybe like 3-4k in my savings since I suck at saving but because he listens more to his aunt that I have to have at leat 20k in my bank acct in order to qualify to petition he is worried that he might have a problem. I told him to relax because his aunt was petitioned like 8years ago and to listen to me because I am asking people for advised who just went through this petition recently. He has the bank account but I told him if they don't ask for it don't give it to them.

Those who make above the poverty guideline when you provided your supporting docs for the affidavit of support did the CO ask for a bank statement even if you are over the poverty guideline? If I am making 35-40k a year will they ask my fiance for my bank statements?

im just praying that the typhoon will stop already so that everyone can go to their as scheduled. wondering if those who didnt get to go the interview today will be able to reschedule their interview for an earlier date and not have to wait for what is available.

I know I am worried too since my fiance has interview on Tuesday as well and he will be coming from Batangas but will check into a hotel tonight nearby the embassy.

Do you think USEM will re-open tomorrow? My fiance has his interview tomorrow but said he will see what the weather will be like. I told him we can just reschedule since I don't want him to have a hard time commuting to Manila tom. I will pray that the rain stop. Be safe everyone :)
