4) I will go back to Japan within 90 days. maybe I will go back to in 2 months.

5) and I will wait for receiving from U.S. embassy in Japan.

6) Do paper work by myself for interview

7) medical

8) interview

9) get visa

10) enter America


When I enter America for doing paper work together, I should not say about I am preparing for K-1 visa??? I just say sightseen??

Immigration people at airport will feel doubt me, because I will stay 2 or 3 months???

What should I say when I enter America for preparing for K-1 visa???

Hi my fiance and I am doing paper work for I-129F package.

[Our situation]

My fiance is US Marines. and he belong to California base. but now he is training in Virginia for 3 months ( until April 4 ).
We thought that his address not stedy, so we wrote his parents's address ( Florida ) with his parents name ( C/O ~).
but there is question, he wrote his California address as his the latest address for G-325. but he will send from Virginia. so California Service Center people will think wonder why he send from Virginia even his latest address is California.... To send from Virginia to California Service Center is big problem??

and also I have a question, he wrote his parent's address ( Florida ) for every place on papers except G-325 latest address. So, We should send to Service Center for residence in Florida ???

We wrote and glue our envelope. and he doesn't understand about K1 visa. so, we will send to California Service Center..... but he doesn't send yet.

He has a working place address for a mail. He said he use this address, but letter through the office.

We will use his parent's address for a mailing address.

When I ask a lawyer ( not mine ), he said if he doesn't have a residence address in California, he cannot send to California Service Center.

I wanna ask all, Does anyone send to a service center that not your residence?

CSC officers will transfer to Vermont Service Center, if we send to CSC ? or CSC send back to him ?

Hi,

I still confusing about where should we send the packege to ?

My boyfriend is Marines. so right now he is living in Virginia until April. He was living in CA, also he belongs a base in CA. BUT he moved out from an appartment where he used to live. so he doesn't have any address in CA now. So, we wrote his parent's address ( they are living in Florida )

So there is question, Should I send to Vermont SC ??? because he doesn't have right to send to California SC, because he doesn't have address in CA. It means he is not a residence in CA now.

I asked about this for a lawer, he said if you send to CA, your fiance dont have a address, so CSC will approval, and send to VSC, and it will take long time.
So, you should not send to CSC. He said also I never do like this situation, so I don't know well.......

What should I do???

I've been previously married and my ex-husband has a Middle name too.
In G-325A: Former Husbands or Wives First Name, I just need to write ONLY HIS FIRST NAME?
Or I need to write his middle name after his first name in a space for the first name?
In a copy of my Divorce Certificate, his First, Middle and Last name is written.

Did you get married in Japan and get divorced in Japan?

If the answer to both is yes, all you should need to prove termination of that marriage is a divorce decree from Japan.

If you got married in Morocco the answer may be different.


You are asking about the locations of marriage and divorce, not the law of the country, right?

Yes I got married in Japan ( under the Japanese law) and I also got divorced in Japan ( unser the Japanese law).

But what I am worried about is, my ex-husband has his family book ( issued by the Morrocan government) which contains my name as his wife.

Anyway my answer to the both is YES. So All I need is a divorce decree from Japan.

I was legally married in Japanese law for sure, then I terminated it by submitting a divorce notice in a city hall in Japan.
Now I'm legally divorced in Japanese law.
I and my ex-husband didn't marry in Islamic way.
The Moroccan embassy in Japan said that Islamic marriage (a marriage in mosque) is needed to be legally married in Moroccan law. So it means that I was NOT married to him in Moroccan law.BUT MY EX-HUSBAND GOT HIS FAMILY BOOK WHICH SAYS THAT I AM HIS WIFE.
That's why I am not sure if I was legally married to him or not.
If he doesn't have his family book which contains my name as his wife, it means I was NOT married to him legally in Moroccan law.
In Japan, we don't have the system of FAMILY BOOK. We just have a family register (just paper and it's issued in a city hall)and it's NOT A BOOK.

I hope you understand what I mean.

( I think that we're not required to do so... All we need to do is to show the Divorce Decree from the countrie of our nationalities....right?).

What I'm sure about is that we were legally married in Japanese law.
But I'm not sure if we were legally married in the law of my ex-husband's country (MOROCCO) or not.
We didn't do Islamic Marriage (Marriage in Mosque) but we just got some paper from the Moroccan Embassy in Japan to get his residence permit in Japan. (His residence permit in Japan has already expired and he is not in Japan now).

Hi everyone! I really need your help.
I'm applying for K-1 visa soon, and I've got a big worry.
It's said that to qualify for a K-1 visa, the following condition is neccessay.
*Both parties are legally free to marry, that is to say neither party is currently married.
I've been previously married and my ex-husband isn't a citizen of my country.
(We had an International marriage. He is NOT a US citizen).
Our marriage was terminated to submit a divorce notice in a city hall of my country, and now I'm legally divorced in the law of my country.
But I don't know if my husband did a process to terminate our marriage in his country or not.
So what I'm worried about is if it matters that I may be still married in the law of his country or not.
I haven't kept in touch with him since I could finish the process to terminate our marriage in my country.
With I-129F petition, I will submit my Divorce Decree issued in my country ' which says that I'm legally divorced'.

All matters is if I'm legally free to marry in the law of my country?

While I was with my fiance in the US, we filled out I-129F and sent it to USCIS.
I'm Japanese and entered the US on the VWP too.
I arrived in the US on April 28, 2010 and left there on May 4, 2010.
We sent I-129F on May 1, 2010.

Well, about #12 on the form, we wrote
*He or she last arrived as a : visitor
*Arrival / Departure Record (I-94) Nomber : ( We wrote the number of form I-94W in my passport).
*Date of Arrival : ( We wrote my arrival date)
*Date authorized stay expired, or will expire as shown on I-94 or I-95 : (We wrote the date stamped in form I-94W).

When we sent I-129F and other documents to USCIS, we enclosed a letter to show that I will leave the US on May 4, 2010.
That's because foreign fiance(e) must be out of the US to apply for the K-1 visa.

This is how I wrote.

Declaration of Stay in the USA within authorized period

I've registered for automatic case status updates by email, so I'm supposed to get the email when the petition is approved.
But I haven't got any emails yet.
I just checked our Case Status on USCIS website now.
The last update was July 12,2010. ( But still Initial Review).

I asked my fiance to check his mailbox everyday :)
I hope he will recieve NOA2 in a few days! ;)

Hi everyone!
I mailed in I-129F on May 1 and got NOA1 dated on May 4.
When I checked my Case Status (on the website of USCIS) 1 hour ago, it was 'Decision' and it said that USCIS approved the petition and sent a notice.
When I found it, I was very happy.
But when I checked our Case Status again (a few minutes later), it was 'Initial Review' again.....
I was so disppointed.

So what is my Status now....? Still Initial Review?
USCIS changed their mind to approve our petition?

Has enyone had the same situation??????

The plane ticket in order to marry can negate the cost-savings of the CR-1 vs K1. It will also delay you if you have to wait to marry (ie can't fly out tomorrow). So really every situation is different.

The visa fee is $350, the initial fee that you pay with the petition ($340 or whatever) is not a visa fee but, err, the fee for filing the petition. They don't make this easy to understand!

My advice would be to start the process asap. File the I-129F and pay the $340. Once you have done that you can figure out the next stage of the process. You will have several months before you need to pay the next fee, which you should be able to manage but there is also always the possibility of delaying the process a few more months if you need longer to get the money together. But you should be fine if you two scrimp and save for a little while :-)

As far as the requirements go, your fiance just needs to earn over $18,387. If he can prove that then you do not need to worry about his student loan or your savings. Those are things that you guys will need to think about when considering your actual financial condition, but as far as the US immigration authorities are concerned, all that matters is that your fiance earns over $18,387. So you are all set!

You did not explain how you or your fiance met. So I just want to check that you know that there is a requirement of having met in person within the last 2 years in order to get the K1 visa. So if this is not the case then one of you will need to fly to meet the other one before you can do anything. (In which case definitely get married on that trip and file for the CR1!)

Right. I agree with you. I strongly feel that we should at least start the process by filing I-129 since it takes a long time.
However it does concern me how I will not be able to work right away with K1-visa. And that it costs $1100 for AOS which sounds ridiculous!

I prefer waiting for my green card while I work and make money in Japan rather than staying at home with no car in the U.S.

For the paper work to get married in Japan, my boyfriend does not need to be here. I can take care of everything. And even if he did decide to come we can still find some fun out of it.. compare to paying $700 for mere paper work. So the traveling cost should not bother me.


However, In my research I came across something that suggested I would not be able to see my boyfriend while waiting for CR-1. Do you know if it is correct?

So the biggest difference is that, with K1, you have to pay $1100 for AOS and with CR-1 you don't, correct?
I also came across something that said while CR-1 is processed you can't travel to the U.S. Is it right?

Cookiehigh, If you have not filed yet. May I suggest a spousal visa? CR1. Get married and then apply for a CR1 visa. It costs around $945 (see here: http://www.visajourn...content/compare )and takes about the same time as a K1. And the foreign spouse does not have to adjust status. You still have to prove support, etc. But the fees are cheaper, and you don’t have to hassle with adjusting status. Of course plane tickets to get married would be expensive. :wacko:

I don't think I can go to America with tourist visa and get married.

I was talking to my boyfriend and we thought getting married in Japan first and then apply for a spousal visa might be the way to go.

In many websites I see they say that there are only two ways for an international marriage which are 1. get a fiance visa and get married in the U.S. or 2. get married in Japan and apply for a spousal visa.


So you are suggesting the 2nd option here?
