K-1 Fiance(e) Visa Process & ProceduresK1 application rejected, I don't know why. please help
QUOTE (fwaguy @ Nov 21 2007, 08:02 AM) <{POST_SNAPBACK}>
Anybody consider that the OP may not have put a US based address on the petition? If the OP used a foreign address this would prompt a return... would it not?

Is DCF available to the OP should they decide to marry abroad?

I live abroad too, in Japan with my fiance, and my I-129F was just approved yesterday without any problems, so they should be OK.

maybe some christmas cards or letters addressed to the both of you.

I live with my fiance now, during the K1 process.

We just sent in photographs, things that listed us as having the same address, photocopies of passport stamps showing us taking trips together....that was about it. We didn't include any letters or e-mails.

Do people even track if you go back and forth from Canada nowadays? I admit it has been awhile, but last time I went it was just a matter of driving to the check points, answering a few questions and then going right across. Maybe the driver needed to show a drivers licence, but no passports or anything was required....

K-1 Fiance(e) Visa Process & ProceduresApproval but no hardcopy?
The USCIS says our application was approved on Nov. 19th, but so far I haven't received any sort of e-mail notice, or more importantly the hardcopy.

Is this unusual? I know quite a few other folks were approved on the same day, so have you all received your hardcopy? I tried calling up the Visa Center today to see if my case had been received, but they didn't have my case number on file and told me that if I didn't have that letter than the website approval didn't really mean very much.

QUOTE (u2rsobad @ Nov 30 2007, 03:14 AM) <{POST_SNAPBACK}>
In Japan, you are required to have a professional translate your documents. Having friends or you yourself translating is not acceptable. It will state in packet 3 that you receive from the embassy which documents pertaining to your file will need to be translated. Good luck.

I had a friend (non-professional) translate the documents for the initial application, then had the translations notarized at the consular. That seemed to have worked out just fine. From what I read, it said anyone could do the translations so long as it wasn't yourself.

Haven't gotten packet 3 yet, but I was planning on doing the same thing in the future...

Congratulations!!!

But a little warning....don't get too excited just yet. We got our NOA2 back in November 19th, and it still hasn't been sent to the NVC, much less been forwarded onto the US embassy in Japan.....so, I think your expectations of "process quickly" might be a bit unrealistic.

But here's hoping you have better luck than us on that count!

I think you will need the originals of any documents that you sent in with the initial petition. If you included birth certificates, photocopies of airplane tickets, or anything like that, then you should have the originals to show during the interview.

It does suck very hard that they are taking so long just to send the mail though....you wait so long for that fricken NOA2, and you think "Now things are going to happen!" But no....you have just stepped into the next queue.

I remember hearing once that if you took an American football game and paired it down only to the time that the ball was actually in play, then an entire game would take minutes rather than hours. The rest of it is all waiting. Seems like they have taken the same strategy for visas.... crying.gif

K-1 Fiance(e) Visa Process & ProceduresGuam = USA?
We are currently filling out Packet 3 for the K1, and it asks her to list all of her entrances to the US. Unfortunately, they only have space on the form for three times....of course, they leave enough space for someone to have eight children....not sure what the thought process is there.... wacko.gif

Anyways, she has only been to the US proper three times, so no problem. But she has been to Guam a whole bunch of times, and we aren't sure if we need to include those or not. Her passport lists her Guam visits US Immigration, but it really isn't the US....so are they necessary?

If so, what can we do about the limited space?

Thanks!

K-1 Fiance(e) Visa Process & ProceduresOne-way vs. Round Trip
Hey all!

I am sure this has been covered somewhere before, but after searching the archives I couldn't find what I was looking for, soooo.....

Is it OK for the K1 fiance to come to the US on a round-trip ticket? After checking ticket prices, it seems like a one-way ticket is roughly $1,000 more expensive than a round-trip. While that sounds like pure and utter crazy talk, that is that the internets is telling me.

I can usually find a nice cheap flight back using Air China....provided the plane actually reaches its destination.... whistling.gif but I don't want to cause any hastles at immigration if she walks in with a return flight ready in hand.

Is it cool?

Thanks!

K-1 Fiance(e) Visa Process & ProceduresA question for the experts
I am not sure how much this would help you feel better but at least your case was touched again in July,
I am assuming that it should be more encouraging than our case.

Our NOA1 was issued on March 31st 2008 and our case was only touched on April 21, 2008.
It has not been touched since then.

My job is nothing like governmental. Neither is my American fiance's...
I am so scared to think what if something wrong is going on with our case,
or our case is being left unnoticed....

Each case is different but I wish you the best.

Is March 12 the date your NOA1 issued?? Or they just received your petition??
In order to issue NOA1, I believe that your check must be cached first.

I dont think anybody is going to be able to tell you if whatever it is they are questioning you for at POE is relevant to your wait at the uscis. It sounds simple enough to be questioned. They can never scan my passport for some strange reason. I always end up getting asked more questions.

There seems to be a small group of filers who have similar dates to yours. I'd say it's more likely your adjuticator is on vacation. huh.gif

Thanks for posting a comment Kim! I have been going nuts to find out what is causing this delay...
I think this is what the wait at USCIS does to most of people and there is really no way for us to
find it out. Only USCIS knows. I hope my adjudicator will come back to work as soon as possible
and get the work done!!!

K-1 Fiance(e) Visa Process & ProceduresDoes the history of having F-1 visa delay getting approved for I-129F?
Hi, everyone!

My fiance filed the I-129F on March 26 and the NOA1 was issued on March 31.
Our case has not got approved yet and I have been wondering why it is taking USCIS
so long to process my case.

I, the beneficiary, used to be a student in the US with F-1 visa.
My student visa was good till 2007 but I decided to quit the school in the US before my visa expired
and returned to my Japanese university that I was originally enrolled in.
Although my visa was still good, I have never used my student visa to enter the US
since I quit the US school as I was no longer a student in the US. I would only stay in the US for 2 and half months
tops.

The oddest thing is that since I returned to Japan 2005, I have been always sent to a different room
upon entering the US. At the costum, they always tell me to go to a different room with my passport
and whenever I ask them why, they say the information that they need to confirm does not come up
on their screen. They have also said that it had something to do with my history of having F-1 visa before.

Every time when I go to the different room, some officers ask me simple questions such as
what I used to study or if i officially withdrew the school. Some never asked me a question.
They just looked at my passport and typed something in and handed in my pasport and let me go.
This is what always always happens.

They always tell me not to worry because it makes me feel like I am a suspicious criminal or something.

Has anyone experienced the same thing before??

Do you think the delay of getting approved has something to do with this???

Thanks for reading and if you could leave me some comment regarding this matter,
I'd really appreciate it because I am so worried to feel left behind.

K-1 Fiance(e) Visa Process & ProceduresHow do we get to talk to a representative at USCIS??
Hi, guys, thank you so much for the comments!!!

My fiance got to talk to a representative yesterday, but she was just reading the manual to him and only
made him upset. She sounded quite rude too, which was all predicted before we called.

BUT, WE JUST GOT APPROVED right after we called.
We called USCIS from Japan and my fiance and I got in fight because we were so frustrated about not finding a way out of this
and we just woke up and found the email!!!!!!!!!!!!!!!!!!!!!!

I am sure this is simply nothing but a sheer coincidence because all the representative said was
what is written in her manual and things that you can read on UCISI website.....

I have waited for this for about 5 months....Most of the March filers got approved in June/July so
it was really hard.......

Let me thank you guys for sharing your experiences with me because last night I really felt like low and
scared to think that our case was skipped and left unnoticed but it cheered me up to read somone else's experiences.

God's girl, pressing "0" was what we didn't know and it actually transfer my fiance to a representative!! thanks!!

K-1 Fiance(e) Visa Process & ProceduresHow do we get to talk to a representative at USCIS??
Our case has been pending since this March.

My fiance tried to call USCIS but it would not tell him how to get to speak with a representative.

the numbers that he called are as follows; (800) 375 – 5283 or 1-800-767-1833

I have heard that many people at VJs talking about their experiences of talking with the USCIS representatives on the phone
and I really need to know how my fiance can get to speak with an acutual representative, not just answering machines...
USCIS makes the customer service so complicated and tricky.

Is there a certain way or number to press in order to get connected to a representative???

I know speaking with a representative probably will not result in NOA2 or any change but my fiance and I
feel like we just have to do something....enough for sitting and trying to keep the faith and believing in USCIS.

Please someone give us some advice. We are so desperate....

Thanks

K-1 Fiance(e) Visa Process & ProceduresDoes having a previous F1 Visa affect the processing time of a K1 visa?
in addition, i never had a problem with the law in the US.
I got in a little trouble when I was trying to enter the US from Canada
because I didn't have my I-20 with me besides my passport and
the officer was very upset with me saying that she could send me
to some facility in NY till she could confirm my I-20.....
I tried my best to have my roommates locate it in my room but it didn't work and
the officer told me to let it a learning experience and not to make the same mistake again
and permitted me to enter the US. This is the only thing that I could think of
as far as the US law is concerned in my history. I don't think this is affecting my processing time though.

K-1 Fiance(e) Visa Process & ProceduresDoes having a previous F1 Visa affect the processing time of a K1 visa?
Damian

I have posted a topic on the same issue!!

I was a student on F-1 from 2003-2004 and did not finish school in the US.
I have been waiting for NOA2 for over 4 months at VSC
and it seems to be beyond the average processing time at VSC!!!!

It seems that normally people would receive NOA2 within 2-3 months
after they file the petition at Vermont so I have been wondering why.....

Have you entered the US after you returned to the UK??

My F-1 was good till 2007 but I was already back in my japanese university in 2005.
Whenever I was trying to enter the US at the custom, I would be always
sent to a different room by the officer. Their explanation was always
something like this "don't worry, we just neet to confirm something that does not
come up on the screen at the custom because you used to have a F-1 before!"
They would never tell me anything further though. I was never rejected to enter the US
but it has never been smooth since I returned to Japan.

my american fiance have to write how we met ? We met in 2004. It is not within 2 years. Can I write?

If we can write inside of box on NO.18, we dont have to write on single typed page attachment that say in No.4 step-by-step guide on how to file for a K-1 visa for your foreign fiancee? so we dont have to prepare no.4 ? No. 4 is only for person who want to have more space to explain how we met?
