NOA means Notice of Action. It basically just means that they have looked at/shuffled around your paperwork. (I didn`t know either when I joined).

Have you gotten all the packets of information? I received notice that the case had been sent to the Tokyo embassy. My finace then recieved a package with a million more papers to fill out (including medical check, etc etc...). There is then a paper he`s going to send the embassy today saying he`s got everything and that we`re ready to get an interview date.
I`m sorry if that was really redundant and you know it all, but really, without seeing a timeline and knowing what you HAVE gotten and done, it`s hard to be more helpful.

I am kinda skeptical about those dates. When Keith and I sent ours in Texas was still supposedly only processing petitions received before July something or other. And while the date never changed online we got our, NOA1, NOA2, and packet 3 (I think that is the one to get ready for the interview). I would suggest not looking at that page, as it will probably just drive you nuts.

The interview process went very smoothly after a hitch due to a notary seal or lack there of. The person who did the actual interview was very nice and didn`t ask more than the average "where you meet? why do you love her? etc"

It did take a few hours though, but least we got to see the Oscars :whistle:

Keith got packet 3 and got everything together--medical, forms from me and my Dad (co-sponser), and then faxed ONE SINGLE form to the embassy. I can't remember the number/name, but that's all he did. Something saying that he was ready for the interview. The embassy then sent his interview date (packet 4). We kept all the forms and everything (and did an absurd amount of photocopying in case they wanted to keep everything) and brought them to the interview with us. (Lemme tell you how fun it was taking chest x-rays onto the Tokyo subway and trying not to bend them :blink: )

Keith and I kinda took a gamble and started looking at setting a date and booking places once we started the whole visa process. :blush: We had places booked and deposits paid before we got packet 3. It has worked out for us--although we knew we were takin a risk handing out money so soon. The contract for the hotel we booked said something about rescheduling being allowed in circumstances beyond your control (as I remember, I haven't looked at the contract since we signed). Certainly this whole process is beyond your control. I was going to try and play that card if we got delayed at all. As long as you pick a date that is believable for her to have her visa by, if it takes longer, you can explain that an unforseen processing delay is causing you to push back the date. Might work. :innocent:
Also, if you are REALLY worried about it, talk to the managers and the venues you're looking at. I'm sure some can be more flexible for you. :luv:

I would recommend waiting the two months. One--it'll cut down on the harrassing paperwork, which, unless you have it all ready now, will take at least a week or two to get together. Which would put down your waiting time to 6weeks. In the long run in this process that's not a lot.

You could maybe get everything together so that when you find out for sure you can either send in your papers right away or look into the K-3.

I don't know alot about the K-3 so you might want to check out exactly what you'll have between the 2 visas and decide that way?

I was wondering about the residence requirements to do DCF in Tokyo. I am wanting to obtain a US spousal visa for my husband who is a Japanese national. I was under the impression that you had to reside at least 6 months in Japan in order to do the DCF filing. I have been living in Japan for almost 1 1/2 years with my husband but have returned home to a few time for visits (Christmas, summer break). I came back to Japan in July from a trip and will be going out of the country again in Oct. for a wedding. Does this mean I have to live a continuous, 6 month time period in Japan with no trips abroad, or does it mean just have residence (Japan spousal visa, foreign registration card, work, etc). I have a friend in a similar situation and she said that you have to be in Japan for 6 months and not travel abroad. I'm really confused now. Please help!

You mention your husband's case is complicated but dont say why. The guides here on VJ are very good and he can complete them on his own. If he has any questions he can post them on this site and there are many people who are willing to help. I used an attorney for my K1 before I knew about VJ and he did nothing that I could not have done myself. In fact he hid behind his answering machine during the whole process (Attorney George Sabga from California) and was more of a hindrance than help. I did my adjustment of status (AOS) myself and we just completed our interview with no problems. Good luck to you.

Just an update: Im legally married and just came back from a usa embassy to have my marriage certificate translation into English notarized and got some new information that left me confused

1) They said I still wasn't done notarizing my marriage or something like that. I know I should've asked them to be more clear(just got over some bad food poisoning for the 5th time this year), but I didn't press it further because I'm like "The USA embassy clearly listed the steps, and after I translated my marriage and had you guys sign the paper notarizing it, what else is there to do? As far as the site says, I'm done..." And when I did a search in the forum, I found a topic saying I needed 3 pages containing certain stuff which I clearly have

This isn't new, and I tried looking around but didn't really find a a particular topic to match mine. :unsure:

So, I was recently engaged, and plan to go the spousal visa route for me and my fiance. I currently live with my fiance in his home country of Japan(been working here for 9months now, lived together for 6 months, and plan to leave by the end of November). After reading about how there seems to be an unspoken expedited service for petitioning the CR-1 visa when an expat lives overseas in America's case, We decided to get married by the middle or end of the month and have my I-130 out by then too. In your opinion, is that to soon to file for the petition?
I also don't plan to change my last name, I'll save all that paperwork change and stuff when I get back to the states..will that also raise some eyebrows?
I mean, yes we love each other...and we've been in a Long Distance Relationship for 5 years, but I wonder if they would think its a sham marriage...
We also don't plan to have a real official ceremony till 1 year later hopefully

I'm just nervous because we're hoping everything goes right and that he'd be able to join me in the states by late December or January.
Should I wait a lil bit after we're married before we file for the CR-1 visa?

My parents are sponsoring my husband and she doesn't need to show all three years of 1040&W2's right? Just the most recent year should be sufficient and I won't get an RFE, yes?(She didn't file in 2011 due to an issue in pay so its wrong, and thats really going to hold us up in the visa process if we try to fix it right now but her 2012 info to file her tax return is good to go)

Also, since my mother is the one above the poverty guideline and able to sponsor my husband, do I need to submit my 1040+W2 with my I-184 as well?

All, I called NVC and called USCIS today and here is what they are saying....

NVC says to file the I-130 immediately for my step-son and that I can wait to pay for my wife's visa as long as I stay in contact with them. Then they can create a bill with it together...Or I can complete the wife's visa.

USCIS says that I-130 is required or need to file 129f and can revert back to K3/K4 if it is approved. Problem is, I don't think that will be any faster than the I-130. USCIS also says that if I keep the visas separate and my wife enters, she can't return to take care of him unless she has a "welcome packet" and stamp in her passport specifically granting her ability to re-enter. They also said that this process may or may not happen at the port of entry. I asked for the standard process and the agent wouldn't be clear. I think this is so they don't guarantee this process. Can someone explain the standard process? I need to try and have my wife immigrate and return in order to move things along and take care of her son.

Also, with the new rules, it looks like I could file a 129f with CSC for free? (TSC sent my I-130 to CSC where it was approved)

Looks like the new I-130 will be $355 and not the $190 that I paid for my wife.

You do have to list all children of your alien relative [wife in this case] on the I-1-130 tho.
As per instructions I submitted 2 separate I-130s for my wife and stepdaughter at the same time .
You don't have to do both at the same time tho.
Better tho as they processed them together.

Actually I'm the beneficiary and my husband did'nt apply for a separate petition for my child since he clearedly stated all the request on his petition letter.So, he thought that was ok. But, when he received the IV bill, he wondered why it was only one bill and my child's name was'nt there. He is planning to call the NVC tomorrow to clarify.

Step-son is not the petitioner's biological child(unless adopted) so, she/he can't be considered as alien relative. As I understand in a situation like this a minor(step-child)derives a visa from the primary applicant which is the beneficiary(spouse) who is the alien relative of the petitioner.

Why is that the CSC approved the petition for the primary applicant (beneficiary)without requiring the petitioner to submit a separate application for the step-child since the step-child name was mentioned on the petition letter. Just received the IV Fee bill as I'm listed as my wife's agent. The bill states there should be one bill for each traveling applicant. Will my step-son not be listed? He's a minor, so I don't know if this is normal. He was listed on the I130 package.

Please respond with your experience in how the CR1 treats minors when petitioning for a wife/husband.

Each person must have their own I-130 for an immigrant visa. If you only filed one I-130, the step-son will need his own. Listing him does nothing. That works only with K visas.

File the I-130 for your step kid ASAP. Maybe try James' shortcuts with his.


Confusing huh! I-130 says it's a petition for alien relative(spouse,parents, child). Step-son is not the petitioner's biological child(unless adopted) so, she/he can't be considered as alien relative. As I understand in a situation like this a minor(step-child)derives a visa from the primary applicant which is the beneficiary(spouse) who is the alien relative of the petitioner.

Did you submit a family register(koseki tohon)when your translated document certified at the Consulate office? Marriage Certificate must be in three pages. First page, the Certificate of Translation(with Consulate seal).Second page, Translation of Certificate of Acceptance of Report of Marriage. Third page, Acceptance of Report of Marriage in Japanese(Kon-in Todoke Juri Shomeisho with seal from head of municipal or ward office). Hope this helps.

My Husband also received that one and he scanned and sent it to me.. That was before we received our IV Bill from NVC.. What we did was we just ignored it..Since we are still waiting for our IV Bill thats why we cant send our DS230..

I think NVC send that form to those who didn't send their DS230 yet.. Im not sure if we need to use the address on that checklist, but we use the address in the jame's shortcut when we send our DS230.
