Cookiehigh, If you have not filed yet. May I suggest a spousal visa? CR1. Get married and then apply for a CR1 visa. It costs around $945 (see here: http://www.visajourn...content/compare )and takes about the same time as a K1. And the foreign spouse does not have to adjust status. You still have to prove support, etc. But the fees are cheaper, and you don’t have to hassle with adjusting status. Of course plane tickets to get married would be expensive.

hmm. I am a little confused about what you said here. Are you suggesting that we get married in the U.S.?
I don't think I can go to America with tourist visa and get married.

I was talking to my boyfriend and we thought getting married in Japan first and then apply for a spousal visa might be the way to go.

In many websites I see they say that there are only two ways for an international marriage which are 1. get a fiance visa and get married in the U.S. or 2. get married in Japan and apply for a spousal visa.

So you are suggesting the 2nd option here?

The alost $1100 is to Adjust status (AOS-adjustment of status) to get your green card. Typically the EAD (employmen authorization document) is filed along with the AOS for no additional fee. If it is filled seperatly, there is a fee.

Yes the US petitioner will need to prove they can support the forign fiance. They will need to prove it at the embassy stage, and the AOS stage. They are looking for consistant salary and employment. You will probably need a Co-sponcer. Such as the petitioners parent. You must make arround $18,400 per year to prove you can suport you and yuor fiance. Or you need a co-sponcer.

I see.
My fiance does make enough money which is more than $18,400 but he does not have any savings. He also has a massive debt from his student loans.
I have some savings to support myself until I find a job in the U.S.
I wonder if that would work...?

As I said in the earlier post, I was going to learn this whole process as we start filing the documents.
I feel like it might have been a wrong thing to do...
Although, I know it will take about an year until I receive K1 visa and until then I can keep on making money.

I wonder how other people do this.

I have no idea how much it costs to get medical check ups. I don't even know what tests need to be included in it either.
I am still learning about this whole process and I was going to do that as step by step as we start the process...
But I guess it would be difficult as it costs so much money and you wouldn't want to risk failing.

Also, during the process I noticed there is a part where you have to state that you are able to support your fiance or the other way around, is it correct?

Does that mean that if we don't have massive amount of savings we are not going to be able to get married???

We are just out of college and still trying to get our lives sorted out.
But we figured money can be earned anywhere...For me, I need a visa to get any jobs in the U.S.

How much would you say should people have before starting filing anything? How much do we need to prove we have in the form of financial statement?

Hello. I have been trying to gather information on how to apply for K1 visa.
As many of you have probably noticed, it is incredibly confusing...There is too much information regarding to it and I am having a hard time figuring out which is correct and which isn't.

What I wanted to ask people for help was about the fee.
I noticed we pay $350 when filing the petition with I-129.
And when fiance applies for the visa (before going to the interview apparently) we again pay another $350?

I am extremely confused about this. USCIS only says "K – Fiance(e) or Spouse of U.S. citizen category visa: $350.00" but the website of American embassy in Japan says they require another fee online after I-129 is accepted.

If anybody knows anything about this please help me.

COPY OR ORIGINAL???

Hi. There might have been a similar topic in the past but I simply cannot spend hours going through every single topic here. so please allow me to post a new question here.

My fiance in America has been putting together the documents in a file for K1 visa.
Through the process we agreed to put photocopies of every documents instead of originals.
However, I came across a post on some website and people said that they sent original copies of the documents.

Now what I am concerned is the ones I have to sign such as letter of intent and G325A.
I just scanned the signed documents and sent them to my fiance as a file on email.
Would that work? or do I have to send the original signed documents in a mail to my fiance?

Also my fiance printed out our pictures(as a proof of having met in the last two years) on A4 paper instead of photo style paper.
It looks legid with colors and descriptions on the side, but I know some people say it needs to be printed on a photo style paper with descriptions on the back. I was hoping our way of doing this would work since I don't see why it should be a big deal...

However, since I do not want to screw this up I need your advice.

Any comment would be appreciated.

Regarding the DS-230, the DOS instructions seem relatively self-explanatory, fill it in online. print, sign, and submit it at the CO interview. Remember, you need to use the latest version of Adobe Reader.

I see. ok. I think I wasn't familiar with the concept of "fill it in online."
When I hear it, to me it sounds like there is an online form (like when you do online-shopping you know? where you put all your info and click "submit" at the end- type of deal) rather than PDF.
Also I am talking about K1 visa. I need to fill this in and return it by mail immediately... not at the interview.

Hello. Please allow me to post a new topic.

I have received a package from the american embassy in Tokyo yesterday and I learned that I need to provide them a copy of US visas if any.
I once had a student visa and it was attached to my old passport.... which I do not have anymore.

I was wondering what to do.
Since I will attach a cover letter when I send them DS-230, I can tell them that I don't have the copy (or original) of my student visa in my hands anymore. Do you think that would work? or if there is any other suggestions please tell me.

Also...I was wondering what they meant by complete DS-230 "online." It is PDF. I figured they wanted us to type it on our computer rather than handwrite it.
Or am I understanding it wrong?

No proof of ongoing relationship

I see a lot of people saying here that they brought a proof of ongoing relationship to the interview.
(and it seems that the proof has to be of between the time of filling the petition and now.)
Well. I haven't seem my boyfriend since before we filed the petition and we usually talk through online telephone service.
He didn't propose me and give me an engagement ring.
There seems to be nothing to prove our relationship...

The embassy doesn't say anywhere that it is required to bring a proof of relationship. I just see a lot of people here and other websites did so.

So....do we really need it? Would I be in trouble if they asked for it at the interview and I didn't have it... even though they didn't ask for it in any of their instructions?

In my case, the IV BIll entered into system Aug.6,2007 message has changed wednesday night(Aug.8). The following week monday (Aug.13) was expecting of the DS230 generated message, but, automated message said we have missing docs. , so, my husband made a follow up call with a live operator at the NVC and found out that our missing document is the DS230 and that the form was sent Aug.13. My husband waited for the real form though I already sent the packet using JSC on Aug.14. And on friday Aug. 17, my husband received a letter from NVC but with a surprised that there was no document not even the DS230 coversheet. The letter contain the same thing as the automated message said, plus submit all the missing documents to proceed with further processing. STRANGE......that the NVC did not send the real packet????????????Now, waiting for the message CASE COMPLETE.

As I'm increasingly trying to make this thread better, I added in a link to the newest version of James' Short Cuts, which can now be found if you press the JSC button . I also changed the ways the moving averages are counted. Now I take a nine month average from the NOA2 date of approved applications instead of taking a six month average from NVC complete. The reason for this change is well... jaxguy . His case is a bit different and for that reason he will have around 820 days between NOA2 and NVC complete. If that is counted into any average it will lift it up with over 40 days . It will simply produce an inaccurate result. The previous 6 month method produced a timeline overestimation of around 5 days, the current method will produce a timeline underestimation of around 2 days, so it's still better, even without extreme cases like juxguy's. I hope no-one minds this too much. The average number of days is still more usefull to us than the VisaJourneys own chart, since almost all of us use the shortcuts in here .

G-325A fillable fields too small....?

Hello.

I was trying to fill the "Applicant's residence last five years" section. When I entered numbers for "Year" fields, "+" signs appeared on top of the numbers. I guess it means that what I entered was too big for the fields. When I print the form, "+" signs still show.

Did any of you have the same problem? If so, could you tell me how you fixed that problem? Or did you just hand write that part?
I am using Adobe Reader 7.0. I searched online for solutions, but I had no luck... It may have been possible to change font size if I had Adobe Acrobat, but I dont have it.

We will definately keep contacting them.
CSC told my fiance that there is a record of them receiving the package, but there is not enough information to issue a case number; whatever that means.
My fiance already gave them the name of a person who signed the delivery confirmation receipt....

They will keep looking for it for a little longer until they give up and tell us that they lost it, I guess. But they told my fiance that our petition will be fast-tracked. I hope they keep the promise.

Here is our update....
CSC still has not cashed our check or sent us NOA1. It has been more than one month since our packet was delivered (February 23rd).
My fiance in the US called CSC two weeks ago and they told him that they would see what is going on and get back to him in a week or two. He had not heard from them as of today, so he called CSC this afternoon and they still have no news for us!!
I can't believe this is happening to us..... I just hope that they have our packet somewhere and won't ask us to refile....

Up until now, I thought maybe I was being impatient and should not worry too much. But now I am really worried!
Will we still be considered and treated as a February filler even if we have to refile our application?

Hello.

We sent our petition package to CSC and received a delivery confirmation signed on Feb 23, 2007.
Well, it has been about two weeks now, and our check has not been cashed and we haven't received NOA1 yet.

I looked through other people's timeline on this site, and it seems to me that our case is not moving as fast.

Should I start to worry that our petition package may have been lost?

Any advice would be very appreciated.

When my fiance complained several times, I guess there were others who got their petitions lost and complained. So the person who was overseeing that section realized the problem was big enough for him to take care of it. That is how we got the manager to respond to our complaints. It wasnt really our effort, it was just due to the degree of the problem. He even told my fiance that he could get fired for this problem. And guess what, he no longer works at CSC. And people at CSC are now pretending that there wasnt a problem and they have no record of our problem!

Wow, sorry this has happened. On the plus side, it's amazing that you got through to anyone at CSC, let alone a manager, without the intervention of your Congressman. How on earth did you manage that?

Update:

My fiance contacted his congressman and two senators and only congressman's office called back. The person my fiance talked to said he might be able to help speed up things. But my fiance got a call today from the congressman's office staff and was told there is nothing he can do for us since our case is still within the normal time frame.
When my fiance first talked to this person, he sounded sympathetic to our situation, so we got our hopes up....

I guess it is official that we filed our petition in April, not February to everyone else.....

To Dan&Tiffany: my fiance already sent copies to CSC about two weeks ago with a note stating the office manager's name who had been dealing with our case. The office manager told my fiance to do that so that he could personally process the case, and he said he would let my fiance know when he receives the copies. That was the last conversation my fiance had with that person. My fiance kept leaving messages for the last week with no calls returned. And today, he finally got to talk to a supervisor there and the supervisor told my fiance that the office manager no longer works there....

Here is our situation: we submitted our petition packet to CSC and we received a delivery confirmation dated Feb 23, 2007. We didnt get NOA1 and our check wasnt cashed for almost one month, so we decided to contact CSC. Then they told us that they would investigate and after almost four weeks since we contacted them, they told us that they had misplaced our packet. This person who said he was the manager of that section told my fiance that someone who was working on our case quit and left our packet in pieces and those pieces were taken by several people and he could not locate the complete packet. But there is a record that they received our packet, so the manager said he would take care of our petition personally and requested my fiance to send him copies of everything. He also told my fiance that our petition would be fast tracked, and he would contact my fiance as soon as he receives our copies.
My fiance never heard from him again. Up until the point he sent the copies of our petition, my fiance could get in touch with that manager without problems, but now the manager doesn't return his calls. But our check was cashed and we got NOA1 saying that they received our petition on April 16.

And finally today, my fiance got an answer from CSC saying that the manager no longer works there! How can this happen!!?? The person who was working on our case quit and now this manager quits? So I dont think that fast-tracking deal that the manager made will happen anymore and our case will be treated as if it was just received on April 16!

CSC basically wasted our two months of wait....

I am really shocked that this is happenining to us....

I can understand my fiance ( American ) ( I am Japanese) have to file to Sevice Center.

but I can't understand NOA ( 1st of Notice of Action) and NOA2( 2nd of Notice of Action).

Keith I have just gotten everything together for the interview. We are however, a little unsure about sending the paper that let`s the embassy know we`re ready.
The reason being: We`re trying to do the timeline math. Keith has read somewhere that it`s better to enter America with over a month left on the Visa for processing purposes. We are contracted thru the end of July to teach english in Japan. If I`m doing the math right that would mean we might be calling it close. :unsure:

I thought I had read somewhere that once approved for the Visa you had 4 months in which to actually get it (pick it up from the embassy perhaps?), and then the Visa was good for 6 months. I recall reading this in August or September of last year when we started the process, but for the life of me can`t remember where. :blush:

For those who have done this part: In you opinions would it be better to wait a little longer to let them know we`re ready? Or is there in fact those four months? :unsure:

(I know the process might not go as fast as some of the timelines say, but we need to be prepared for the off chance).
