Yep, we made a mistake of sending nothing but the forms... but as an after-thought, a month later we sent some additional info. In the RFE hardcopy we got today all they asked for was copy of his (US citizen) passport, 2 passport photos of him and a copy of each our divorce papers.

Today at 9:30am I was working and unexpectedly noticed a text and email on my phone from USCIS informing me they sent an Request for evidence on May 11. I was thrilled to see that. I already knew I was going to get an RFE because I made the dumbest mistake and forgot to add my proof of citizenship....LOL...but I am very very HAPPY that they are looking at our case. It has been 4 months and 2 days since the NOA 1 so I'm hoping to hopefully get an approval around the end of this month. :dance:

Although we are still in Japan and will be until the end of July and my ticket back to Vancouver isn't until Sept 15th so we are not in a rush, it's just hard when I'm not there to get the mail and wait every day for a message from the future inlaws saying it has arrived. And then hope that the embassy sends what they need to before or after my mom leaves on a month long vacation and no one will be there to receive the mail regularily. Ugh! :blink: Oh well, guess I have to keep practicing patience and ZEN!

In some cases, it can take the full sixty days or longer. Take us, for example:

- April 18: Received e-mail notice of RFE
- April 20: Received hardcopy notice. They wanted (1) passport photo of myself. I already sent (2) of myself with the original application.
- April 20: I sent back the photos.
- April 22: Received and signed for (USPS notification) at VSC
- May 2: VSC confirms via e-mail that they have received and are processing RFE response

Tomorrow is June 26. We have not received NOA2 yet. That means I better here something this week if they are to meet their sixty day notice rule. I am crossing my fingers but not holding my breath. I have read of some people taking 3 months after sending in RFE response. Of course, some get approved within 2-3 weeks. It just depends.

We sent an RFE response June 14th and received the NOA2 in the mail today (June 24th)! From what I've read here it seems to only be a few weeks in most cases. It probably varies depending on what information they are looking for? My understanding is that they review it as soon as they have the info.

Hello. I was wondering if it is O.K. for my fiance to travel from Japan to the US to visit me while the K-1 visa is being processed? If this is ok what kind of proof would I need to give to show that we do not have the intention to marry before the official approval?

Entry into the US is entirely up to the officer at the POE. In my case I was able to come to the US from Canada and back several times as well as from Canada to Japan and US to Japan and back to the US all while awaiting our K1 visa application acceptance. I personally just had to answer a few questions (it seemed that Homeland Security had already started to do security checks and the officer knew I was going through the process - perhaps it came up on the computer system) but it is recommended that you bring proof of a return ticket, all your K1 application process paperwork showing that you are going through the legal channels and for some they say bringing proof of ties to your home country like rent receipt, hydro bill, proof of employment - I didn't have these because I quit my job and moved to my mom's and am in the US until a week before my interview in Vancouver but I was not asked for them. Be honest, answer questions but don't offer too much information or babble. Good luck to her and enjoy your visit.

I understand that once you get your NOA1 you are entered into the Department of Homeland Security database as they run their initial background check and it would come up in their system when they process you at the POE. So just be honest and cross your fingers that the officer is having a good day. Thankfully he was for me in March. I'm still here and will be until June when I go back for a week and then and hopefully all will be good when I enter again in through Seattle for another visit while I wait for my NOA2 and consulate appointment. :luv:

Does not matter where you from – this is all on digression of the officer at POE. He can let you in and he can turn you around, there is no such guaranteed that you will be able to see your fiancée as you already have B1/B2 stamped.
Letter of employer is also not really a good reason, you can always enter on B1/B2 showing the employer letter and you can resign after you get in US.


It just doesn't seem right that one person has the right to turn you back for no good legal reason, just because they "feel like it". I am leaving for Virginia on Saturday to stay until May 18th - left my job and apartment (moved my stuff into mom's) so I have no "ties" as they put it but I do have a return ticket, all my K1 paperwork and I even had my fiancee send me an email confirming in writing that he's requested I quit my job and will support me so that I can be with him while we wait out the process... and of course I will have to be back for the remainder of the K1 process. I will ask to speak with a supervisor should the officer not let me in as there is no legal reason that I shouldn't be able to go though.
My fingers and toes are crossed that it goes smoothly but I'm getting to the airport early regardless. :luv:

In your case your best defense is your NOA and a copy of your paperwork. For some Canadians that's the only thing that allowed them entry after being pulled into secondary..... showing they had every intention of going the legal route. Unfortunately, it is up to you to convince them so the less evidence that you have, the less likely it is that they will trust you to return to Canada. Perhaps a letter from your Mom saying she expects your return, your return ticket, a copy of your bank statement and any credit card statements showing credit available (means of support), an upcoming Dr's appointment..... things like that. Thanks so much, I have the NOA1 and back-up stuff prepared but the extras will help... but he is supporting me so that I can be with him while we wait and until it's legal for me to work in the US so that will be another issue to contend with... I am planning on applying for online Canadian transcription and telecommuting jobs while I'm with him in Japan so hopefully I'll have that under my belt before the Seattle trip, along with returning to temp work while I'm back in Vancouver awaiting the consulate visits and such.

It is perfectly legal for someone to visit the US when they have no intentions of violating their visa. Unfortunately, you have to prove that to the Officer at the POE, and for some that has been problematic. Here is a good link:

So what if the fiance (like myself) has quit her job and is storing all her stuff at mom's to spend time in the USA (none over the legal out of country limit) with her intended while waiting for the paperwork? I will not have a letter from an employer and will have a different address now than what we originally filed with, which is mom's place which means no hydro bills or rent receipts. Of course I intend to return for the consulate visit and medical and police checks and such, wouldn't have paid the money and started the process if we weren't going to follow through, so what right do they have to deny entry and how do we go about avoiding it in my situation? I will be crossing via Greyhound or Amtrak in Vancouver, BC.

Just thought i'd share:

I was fully expecting an RFE as we:

didnt send in passport sized photos,
didnt write/sign/send intents to marry,
got my father's birth place wrong,
all we sent for proof of meeting was photos, no boarding passes/passport stamps etc

just got my NOA2 today, no RFE.

The USCIS website didn't say to send anything else so we didn't but kinda wished I'd see this forum before filing... I have everything ready so when it's requested we'll be good to go. :D

I would appreciate anything you could provide in the way of evidence to back up you statement that "VSC is slowly picking up on their work." I would love to believe that that is true, but I don't.

Alternatively, I would still like some real information about what slowed them down so in the first place.


I understood there were an influx of people filing from Haiti and they get priority due to their situation and this caused some back up ... I could be wrong but that's what I had heard.

I also notice there is no real rhyme or reason for some people getting their NOA2's more quickly than others when the situations seem the same. Some get RFE's with a lot of info provided and some with just the basics sent get their NOA2 with no RFE's... :wacko: confusing and frustrating to say the least. We still have a long wait so I'm not freaking out... yet.

We were looking to set up bank account to start saving jointly during the K1 process is there a way to do this? Do any other Canadians know of a bank that will allow my fiance to access remotely or jointly during the process while in the States? Any info will be appreciated. :thumbs:


I (the Canadian beneficiary) am with Scotia bank and spoke with them about adding my USC fiance to my account or opening a joint account so we could transfer monies back and forth as needed for visa stuff and moving expenses etc. They said no problem but he would have to come in and be present with is ID etc and would be given a debit card that can be used at Bank of America with no fees. Unfortunately there is no way to deposit US money using the card nor is there any means besides the very expensive Western Union option to transfer money into the account from his US bank account and vice-versa. So instead he has given me his visa card number if need be and/or we just exchange cash when we see each other.

From what I understand I can't open a US based bank account until I am residing in the US and/or have the proper visa paperwork completed. Funny though, you can get a US department store credit card???

I know that the medical cost $350, and there's a fee to get a police records check but is there a cost for the interview? I seem to recall reading somewhere that there was but can't seem to find that info.

Just to be clear. We have 4 - 5 months to reply to the NOA2? We will be in Japan for a month and want to finish the paperwork state-side when we get back so we can also have a better idea of when I/we should go to Canada for the interview etc.

And when we reply to the NOA2 should we include my change of address at this point as next set of paperwork (packet 3 & 4) will be sent directly to me? Or do we call the consulate in Vancouver once we receive confirmation from NVC that paperwork has been forwarded there? And if so how long is the process between it leaving NVC and the consulate sending out the packets? I do have mail forwarding but that will likely delay everything and I don't always trust the post.

We just received our RFE hardcopy May 12th and are going to be putting together and sending off our RFE info while we are in Japan. Since we are not back until June 21st we expect to be there when our NOA2 arrives in the US (it does get sent to the US citizen correct?).
What I need to know is what size and how big is the NOA2 package? I will need to leave an pre-addressed envelope and funds so it can be sent to us ASAP. And how long do we have to reply to the NOA2?
Also, does anything get sent to the Beneficiary in Canada directly?

CanadaKind of an unusual question..

I finally got my visa last week, and will probably be making the move in a couple of months. However, I've had one dilemma that I'm uncertain of. I'm 26, and while I have my learners licence, I've only driven a car once (my first job was within walking distance and my current job is very accessible by train). I want to get my drivers license for the move since it'll probably be more important to have there, but am unsure if it is better to go to drivers education and try to get it here, or wait until I'm down in the states where there are probably different laws? Not sure whether anyone here would be able to answer this but worth a shot. :blush:


In my case my Canadian drivers licence had expired 8 years ago (although I'd had a licence and had been driving for 20 years before that) but when I got to Virginia I studied for the test expecting to get a learners permit first but they accepted my old licence, I took an eye test and was given a drivers licence right away. I drove with my husband close by home for a few days to get comfortable with the area and now all is good.

If you can get any practice where you are go for it but I suggest waiting until you are in the US and apply in California.

Where I'm at: I have received a Permanent Resident Status card after our K1 process and we are at the stage where we can start applying for Removal of Conditions (we still have 1 year, 10 months before my card expires). I have recently returned to Canada for a visit and only required my PRS card at the border crossing while driving through. While flying within the US I have only been using my US Drivers Licence.

My Question(s): My Canadian Passport expires July 2012 (less than a month from now). Do I need it any more? If so, do I need to renew it and how do I do this from the US? ALSO and IMPORTANT: If I travel from the US to Japan or Europe do I need a passport or will my Permanent Resident Card be enough?

No one was hiring because of the election? Interesting, because I know lots of places hiring right now. The company I work for just hired 3 new employees last month.

You must have filled AOS or you wouldn't have a green card. You mean ROC perhaps? But yes, if you move back to Canada you will lose your GC and if you and your husband ever want to come back to the US you will need to start all over again.

A member here Colleens recently moved back to Canada. You might want to look her up.


Oops, yes sorry... haven't done Removal of Conditions yet. Husband has work for 6 months before his company may close as they are completely dependent on funding for the military. We will wait it out and hope things get better before considering the whole process.

I need some help please my I-751 people.  I'm sure I saw this question somewhere but can't seem to find it.  I have a daughter living in Canada and not moving here with me.  I have 2 step children, one lives with us the other does not.  Do we have to add them on the list of children even if they are not involved in the process?  And if they are over 21 are they still considered children?

This new form is a bit different than the older one... ugh, I really hope there are no RFE's or more delays... or that I get my biometrics appointment scheduled while we are on vacation in Florida at the end of March kicking.gif

Wedding date(s): Oct. 22/11 or Dec. 21/11 or Dec. 31/11
Why: A year since we met or since he officially proposed or when I got my ring (really depends on when paperwork is done)
Where: Virgina (his home state) or Washington (our intended home state) or Hawaii (the state where we met)
I-129f Sent: Jan. 8/11

We've decided on a courthouse ceremony if we're in Virginia and then a wedding with friends and family whe we get to Washington. Hawaii would happen only if he's back working there. No concrete plans yet.

The sooner the better for us... life is too short and we're getting too old not to be with the one we love.

We cope by living our lives. We are in constant communication throughout every day that passes. We do our best not to think about this part of our relationship too much. We speak on the phone in the evening, watch television and movies together, play silly online games together, do our best to prepare for the next step when I'm finally able to be in the United States. It helps that we see each other every few months. He was here for Christmas but I likely won't visit him again until this process is complete.

We cope by speaking of the future. Telling each other what it is we're looking forward to the most when we can FINALLY start our lives together. We plan how we're going to decorate our house, how we're going to organize my move there, etc.

We just go about our business, knowing eventually that this waiting will be over and once it is, the time we spent waiting will seem insignificant.


Good advice! Communication is very important ... we talk, skype and email constantly every day, talk about the future and try not to dwell on the distance. We are also, it seems, older than many of the people I've seen on here - don't know if I could have been as patient in my 20's.

It's very fortunate that we have been able to be together twice since meeting in October and have future plans for me to visit him (first visit in 28 days!!!) while he's working in Japan - we seem to be only able to go 7 or so weeks between visits but it turns out that so far that works for our work/vacation schedules.
I am trying to keep myself busy off work hours with planning, organizing and packing up my apartment and generally getting things in order so I will be ready when it's time to cross over on my K1.

It's not easy, but know you're not alone. And that one day all this waiting will pay off to be with the one you love. (L)

I try not to check the list yet since we just filed in January but when I do I just keep in mind that not every applicant that has applied is on this list or this site... I just have to believe that for every one we see approved there are so many more we don't see. Keeps me hoping!

Have to agree with a whole lot of positive thinking and happy thoughts... and while we wait it out I skype with my perfect-for-me guy every day, even for a few minutes and email A LOT (just checked and we have an average of 500 emails a month since Nov '10) and talk on he phone when we can. It helps to keep busy... and we are fortunate to be able to have visits while we wait... after a quick trip to Japan (he's there working) next week I'll be busy while I am packing up my apartment and storing my stuff at mom's and I have quit my job so we can be together where ever he is working until I get called back for the consulate appointment and that paper that says I can go be with him forever.

Patience isn't my strongest suit and it sure is being tested with this process... but I'd wait forever for my love, just glad we don't have to! :luv:

K-1 Fiance(e) Visa Case Filing and Progress ReportsVSC - No petitions processed on Febr 15 ?

I keep checking Igor's List since morning and still no petitions for yesterday at VSC, is this true or I don't know how to use this website anymore ?! If it is a nightmare please slap me to come to reality but if this is real we are in a huge dilemma here: did they take a break after V-Day ? Anyway even if VJ is a small percentage from the amount of K1s at VSC 0% from that amount statistically takes us very close to an overall 0% solved petitions.
Ok guys, we are 5 months and nothing happened. With this 0 petitions / day will we get NOA2 before 21/12/2012 (I want to get married before I dye) ? My lawyer said he will wait another week to do something and I am very , very .... disappointed ... and hopeless ...
If you got approved yesterday "Congrats!" and please post because I cannot handle it anymore !


I'm guessing if we didn't see any progress on the 15th it's because that day they only processed K1's (and other types of visa applications) from people that are not part of VJ and Igor's list... true we are only a VERY TINY portion of what is actually being processed at the centers and Igor's list is only accurate if people actually update it. Someone can correct me if I'm wrong on this. :luv:

"The Vermont Service Center is currently working on 08/21/2011 applications, which is 23 days away from your date of 09/13/2010. The supervisor asked that VSC be given those days to get to your application before doing a "service request".

You don't know actually. The only ones we see approved are the maybe 5% of applicants registered with VJ but of course there are all of those others not registered that probably get approved that we don't see so hold out hope... we'll get there... but it sure would be nice if the wait wasn't quite so long... 6+ months to wait for our forever time with our true love is not easy. :luv:

I think many of us would have done the same and won't admit it. I know if my husband or finance were in Japan right now I would be worried to death....THE WHOLE COUNTRY IS GOING TO BE AFFECTED ADVERSELY!

Yes we do worry, and I was in a panic until I was sure he was ok. My USC fiancee is in Japan right now but is thankfully ok - although shaken up by the quake and subsequent aftershocks he is in the Yokosuka area south of the epicenter and everyone and everything there is ok, for now. Still it's very scary not knowing what is going to happen with the reactors and whether they will have to be evacuated.
I have a ticket to go see him March 26 and stay for 7 weeks... now who knows - it's hard being this far away. :crying: I can't imagine how awful it is for those with loved ones in the disaster area... my heart goes out to them all. (L)
