its more than likely he will miss his connecting flight. there is no way you can go through immigration, customs and tsa within an hour....i had 1.5 hour connection once and i barely made it on the flight, my bag didnt make it. you need to change those travel plans. good luck

if your denied, you can reapply but whats the sense....you can also appeal but the best way to deal with a denial is to work on the issues that lead to the denial in the first place.....if its lack of genuine relationship, you have the opportunity to make a 1 or two more trips to see each other....get more involved with each other families and then you can even get married and file the IR1/CR1 petition which would allow the foreign fiancee to enter and have his/her green card within a few weeks of arrival. :thumbs:

Hi everyone,

I've spent several hours reading through the forums trying to get help/ advice on situations where people are in the K1 process and have managed to successfully visit their Fiances in the US, however most of the applicants are in 1st world countries ( UK and Canada mostly). Here is our situation:

NOA1 received in April 2012, K1 being processed in Vermont, the 5 months normal processing time have already passed, I called USCIS and they said that they are still processing February 2012 applications so we have to wait 60 days until we can make a case. With the two months for them to process (NOA2), it will probably be another additional 2 months before she can come to the US (most likely December 2012 or January 2013).I have not seen my Fiance since January and we are now seriously considering applying for a tourist visa so she can come visit me in the US for a few weeks before returning back to Zimbabwe for K1 processing. I cannot get leave from work so will not be able to visit her unfortunately.

I called both USCIS and State Department about the possibility of her getting a tourist visa while our K1 is pending and both said it is possible as long as she can prove she will return to her home country after her vacation in the US. She is currently employed and can provide documentation showing she is employed and that she has sufficient funds. I also am working full time and can provide the necessary financial evidence. We have maintained good records of the entire application which we can also provide if needed for the tourist visa.

My questions:

1) Given that she is from a 3rd world country and also is a widow, are we simply going to get denied the tourist visa or she will be refused entry at POE? As much as I want to see her, I would hate for her to fly all the way to the US and then be denied entry. I understand we first need to obtain the visa in Zimbabwe and then pass through POE.

2) If we take the risk and go ahead with applying for the tourist visa, if we either get denied the visa or refused entry at POE is this going to negatively impact the full K1 application? (We are willing to take the risk but not at the cost of the K1 being denied)

If anyone has applied for a tourist visa while K1 is being processed from a 3rd world country ( especially African countries), then please kindly share your experience. Also for those of you who are more experienced with these processes your advice / feedback on the above would be very helpful.

first off, congrats on the engagment.
Answer #1. its up to the CO to decide if someone gets a visa or not, you have to go to the interview trying to convince them that you will return and ur intention is only to visit
#2. Yes you can visit while the K1 is in process and a denial will not affect the outcome of the K1 visa.

i think you should be able to get this updated when the petition reaches the NVC stage if your doing a K1. Call them and see if they can do anything. if not, she will have to contact the embassy as soon as the case arrive to notify them. good luck :thumbs:

It's a must that petitioner and beneficiary have met in person within 2 years prior to filing the I-129F.

It appears USCIS have overlooked the application and the Consulate caught it. I'm just surprised that they didn't send it back to USCIS to re-review it and got an automatic denial.

Hello and welcome.

The evidence that you need to present when filing the petition is not to prove an ongoing relationship, but rather that you have met in person, at least once, in within the past 2 years.

So, on question 18 of the I-129f, you should have explained how you two met, correct? Something like: We met in Hungary when I visited her in <insert date>.

The evidence you'll send, is to prove that you have, in fact, met her in Hungary in <insert date>.... makes sense?

If you are going to send copies of the pages with the passport stamps, from both of your passports, I suggest you copy ALL pages of each passport. Because they'll have to match the stamp to the person, and a simple copy of a page with stamps will not be enough. Save youself time and possible RFEs and copy the entire passports, front to back.

All other evidence you described, seems to be OK Posted Image

The fact that you are in Hungary, at this moment, is not an issue, at all. You do not have to be in the US to mail in a petition.

After you send the petition, keep documenting your visit, and you she'll be able to present that newer evidence at the time of the interview to prove ongoing relationship (along with other things, of course).

you should request a copy of the interview letter by email so you can schedule your medical. After that, wait for the packet to arrive in the mail. BTW, did you email the embassy a scanned&signed copy of your completed DS-230 part 1?

you need to be on top of things. since you were approved the 15th, you can call NVC next week monday or tuesday to find out if they get your case. I can only help you when your case is on its way to ja consulate. in the mean time, have your fiancee go to get a police record, it only cost $2000 for the express service which he should do. this link will explain all about it http://www.my-island...in-jamaica.html

Next thing he/she will need to do is get a non impediment letter which he will apply for at the RGD office (he needs the original birth certi to do this) in the parish he/she lives. this cost about $6500 for the regular service. in the mean time, just wait for the case to reach and leave NVC and let me know

You are early on enough to not have any future issues should you go this route again. Watch my/our timeline for more as I cancelled my ex's in the 11th hour as she was going through medical. I am certain of an RFE for mine is forthcoming in the next few months. I am starting month 4 since my NOA1 so we will see. And never say never as I tossed all my documents after my break up as "I WAS NEVER DOING THIS AGAIN". Once again, time heals and never say never.

best time to call NVC is early in the morning when they just open or close to when there are about to close in the nights. the NVC letter should state the consulate that the petition is being forwarded to. good luck
