This is a statement that is made by an official person in her country which will basically say that 'SHEA' and 'LASHEA' is one and the same person.

 

In some countries a Notary Public or other government official would do this.

 

She should also go get her birth certificate corrected to show the same name on her passport etc.

I thought if you are married for more than 2 years and then you get your residence card then yes, you would get the 10 year? a friend of mine was married for 3 years and when he finally came on a cr-1 a few weeks later he got the 10 year...so in this case, was that correct?

 

Apparently they made the change at POE so it is correct.

I just did more searching.. It seems that for a minor child, no G-325a but a birth certificate is required (as opposed to beneficiary birth cert only required at NVC for spousal petitions)?

Do I have it right this time? :blush:



The birth certificate is required.


The form that the parent will sign on behalf of the minor child is the DS-230 at the NVC stage. The DS-3032 (choice of agent) can also be signed by the parent.

NO. Children do not submit g-325 at all.

Yes. The parent (you) signs it in this case.

Apply ASAP!! Sometimes, these timeframes can seem fast but when it comes down to it you want an approval as soon as possible. You can always slow things down at the NVC stage. Trust me. I wish I had listened to this advice about 4 months ago. I thought I would only be waiting about 4 months, too, but now I know I will probably be waiting about 6 months because of an unusual slow down at VSC. CSC is fast right now, but nothing is certain with the government. Just apply as soon as you can, and if you need more time for the process, wait for a little bit to respond to NVC.


i think apply by the end of December 2012, you should be alright and can make it in the time frame your thinking about. :thumbs:

It asks for a SSN. An ITIN is not an SSN. Why would you put the ITIN when it doesn't ask for it? It asks for SSN. You do not have one, so write 'none' or N/A.

That's like saying they ask for a birth date and you want to put the date you lost your first tooth :)

The POE was a couple of days after our second wedding anniversary so perhaps there has been a mistake? The IV issue date printed in his passport by the Embassy in London was for three days before our anniversary so perhaps that is the reason the conditional status? Any more advice is greatly appreciated...

The conditional status is really because be received his entry visa before you were married for 2 years. It is not the POE that matters so there is no mistake.

Just like IVY posted above I have travelled back and forth on my B2 visa on to visit my husband and had no problem.

Hey all, I was reading through and came upon something that struck my curiosity. When I send my I-130 for my wife, do I also need to send some info on my newborn daughter? Let me just add that my daughter is only a Serbian citizen at this point, we are in the process of getting her dual citizenship. Do they need to see that my daughter is an American citizen also? Is it wise to wait until my daughter gets American citizenship before filing for my wife? Thanks :thumbs:


Doesn't the I-130 only ask for the name of child, date and country of birth? Even so it should not cause any problem because it would only depend on what her citizenship at the time you are submitting the I-130.

It is $420 when sending the I-130. You will also have to pay $88 for the affidavit of support and $230 for the IV later on.

Hello folks,
My spouse (Brazilian), our kid (USC) and I (USC) have been here in Brazil for 5 years now- working, studying. Mr Torque got his green card in 1998 (applied in Tokyo, received quickly, back when it was easy), and we lived in the US til 2006, when we came here. He has a SSN, but we intended to move to Brazil long term, if not permanently (i.e. we left no domicile in the US, only a bank account.); he still has his green card "just in case we had to go back" which i'm sure brings other problems.
For various reasons, but mostly our kid's welfare, we're ready to go back to the US. I should add we don't have huge financial reserves (I've been studying and working little, he runs a small business that is just scraping by).
Seeing as we intended to move here, and didn't really maintain anything, I'm assuming SB is not an option and I need to be looking at IR1/IR5.

Brazil has just stopped doing DCF, so I'm wondering what my options are. Do I need to move back to the US to apply (ie. kid and I need to go up alone and risk him not being granted? and maybe lose my Brazilian status, if i leave with intent to move but need to come back if he's denied.)? The way it stands right now I don't think I could show intent to establish US domicile from here. I'm also not sure I could meet the affadavit of support, as I need to move back to the US and find a job first. I might be able to get a family member to sponsor him though.
Everyone I know who has been in this situation has applied from here (before DCF ended), and it's been a real trial for those who've been granted, and several folks i know have been denied. I'm a bit overwhelmed.

Based on your post it seems that your husband the brazillian has abandoned his green card because he was out of the country for more than a year after getting it and you and your child has US passports.

There are instances when family members are estranged or they do not like your spouse and have no interest in attending weddings. This is not a big issue.

Note also that the Police Certificate from Jamaica comes with an original and a copy. They give it to you stapled together. When I got mine I thought the copy was for me. When I asked the person who issued it if the copy was mine she said 'no, both must be sent to the NVC'.
