IR-1 / CR-1 Spouse Visa Process & ProceduresThe whole process - USICS and NVC

I have been reading a lot on the process and am trying to obtain a clear understanding of the process. I am still very confused by the NVC process especially with the many discussion on shortcuts etc. I have put together what I have read with questions. Can you assist me in verifying my understanding? Also suggestions for doing things faster is welcome.

Step 2: National Visa Centre (About 30 days process)[/b][/u]
1. Obtain case number
Use the CIS (NOA) receipt number from your approval to find out.
On calling the NVC automated voice response number (603) 334-0700 you will.... press 1 for English press 2 for Spanish
press 1 for information about your immigrant visa
It will then ask you if you know your CIS receipt number.....press 1
(Once you have a case number you can use this.....press 2)
You then follow the instructions to key in your number.
If will then tell you if NVC has received the petition, and assigned a number.

When you call the number, follow the options to speak to a live person. Give the person your case number. The phone system does not work the way you mentioned above anymore.

2. Once case number is obtained, the beneficiary can email choice of agent to NVC
(Qn: If beneficiary email NVC for choice of agent, can we ignore the DS3032 when we receive the hard copy)

YES

• Original Employment Letter OPTIONAL

• Most recent tax return (all forms)

better to send the transcripts. Make a request from the IRS for them.

• Copy of PAY STUBS for current year (showing how much money you have made year to date)

4 or 3 pay stubs from current year will do. Do not send all of the paystubs.

• SPONSOR: I-864 + all above documents for sponsor. Each sponsor that lives in the same household as the petitioner, should use I-864a, instead of I-864
(Qn: What is meant by sponsor? )

The Petitioner is the Sponsor. You will need co-sponsor is the person does not make the minimum required salary.

• Make 2 extra copies of this package. Send 1 copy to the beneficiary

4. NVC System generate Immigrant Visa Bill Generated. (see my qn on DS3032)
• Agent receives the IV Bill.
• Agent sends back the IV Bill payment.
• IV Bill entered into NVC System.
• DS-230 package generated.
• Agent receives DS-230 package.
• Agent sends completed DS-230 plus documentation required by NVC.
• DS-230 package entered into NVC system
• If more info/evidence is required, then NVC will generate and send a checklist.
• Agent responds to the checklist and it is entered into the System.

Supporting document for DS-230
• BARCODED Cover Sheet (to be printed from web when your status is PAID online for IV bill)
• You OWN cover sheet listing what documents are in the package, so they're easy for the reviewer to locate
• Completed DS-230 part I & II and ONLY part I signed by beneficiary.
• Photocopy of the beneficiary's passport biographic data page.
• Original/certified copy of beneficiary’s birth certificate.
• Original/certified copy of beneficiary’s and petitioner’s marriage certificate.
• Original police certificates of the beneficiary.
• Original/certified copy of military record, if applicable.
• Original/certified copy of divorce decree, death certificate, etc. of previous marriage, if applicable.

See My inserts above. Looks like everything else is okay

IR-1 / CR-1 Spouse Visa Process & Proceduresi-130 RESCISSION?

Now, I'm filling the I-130 form and do not know if I should answer YES or No to the question 16: Has your relative been under immigration proceedings? I was always legal in the US and I am not sure if I should answer YES because they denied this visa.

Thanks

Sorry for editing the post

You were not under immigration proceedings. Persons under this are usually people who have overstayed, broken the law and are being deported.

You are okay. Good luck.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhen all does the USCIS/NVC contact the beneficiary?
If you sent in the G-1145 with the petition that is how they will have your email address. They will use this to send the case number, Invoice ID number and the DS-3032 to you.

When your beneficiary send the DS-3032 they can get it from that. However, you can also call NVC and give them both email address.

IR-1 / CR-1 Spouse Visa Process & ProceduresLetter from NVC
Did your son get his US passport already?

You did not get denied. They are just telling you that you must file an I-130 for your son if you want him to 'migrate'. If he is already a citizen this isn't a problem for you. Don't worry about it.

IR-1 / CR-1 Spouse Visa Process & ProceduresForms.. dumb question
I stapled anything that had more than one page. Based on the 'dont' staple' above maybe it does not even matter.

I had no problems.

IR-1 / CR-1 Spouse Visa Process & ProceduresSworn Affidavits of bonafide marriage BEFORE marriage

Ummmmm WOW thats alot of gr8 evidence

If I were you I would just forget about the affidavits. Its used mostly when other evidence is lacking. You have more than enough evidence.
good luck.

I agree. Affidavits not necessary when there is so much evidence of the relationship already.

IR-1 / CR-1 Spouse Visa Process & Proceduresprocessing time for LPR
As soon as you have your case number from UCIS you can email the copy of the naturalization certificate. Processing times has slowed down and now takes almost 7 months for a response after filing. You should hear from them within 6 weeks after you request the upgrade and things will move quickly.

Just get things ready.

IR-1 / CR-1 Spouse Visa Process & ProceduresEmployement letter
Remember that the employment letter is optional. You do not have to send it as long as the beneficiary can send some pay stub which clearly indicates what he earns and who is he is employed to.

IR-1 / CR-1 Spouse Visa Process & ProceduresUpgrade I130 petition
As soon as the case is upgraded you will get an email saying your case is ready for processing and you will receive the invoice ID and Beneficiary with it.

Cheque the email you sent to see if you sent it to the correct email address.

It seems you have received the automatic response that all email gets. You can call them and cheque if it was received.

Good luck.

IR-1 / CR-1 Spouse Visa Process & ProceduresDo I get an email confirmation when DS-230 is accepted?
NVC seems to have gotten their act together or are tired of people calling to ask is their case is complete. Persons are reporting since last October that they have received emails for case complete so you should be getting one. You still have the option to call after a reasonable time has passed.

IR-1 / CR-1 Spouse Visa Process & ProceduresDs3032 not accepted or rejected!!!!

Have you called NVC to see if they accepted your DS-3032? One sure way to know is your IV Bill is invoiced. You sent so many you probably overwelmed them You need to call NVC.

IR-1 / CR-1 Spouse Visa Process & ProceduresNeed some advice
If the I-130 has not yet been filed then do what Darnell said.

If it has already been filed she can send in her naturalization certificate as soon as she gets it so that the case can be upgraded and your processing done faster.

IR-1 / CR-1 Spouse Visa Process & ProceduresINTERVIEW DATE SCHEDULED.
You are able to pick up the medical package the day before the interview. You can also ask someone to collect it for you but you will have to give them the receipt to do so. They will not deliver it to the embassy for you.

I am suggesting that you call the office where you plan to do the interview and out what is the shortest possible period of time you can do the medical before the day of the interview so that you dont have to do two trips to Jamaica. I think it can be done 5 days before although they usually prefer to give you appointment two weeks before the interview.

If you do not have a place to stay for free then try and find somewhere that is very reasonable so that you can only make one trip. Airfare is expensive especially at this time of the year.

Good luck.

IR-1 / CR-1 Spouse Visa Process & ProceduresWill I get denied or a RFE?
There have been cases where persons send in additional proof when they are sending in the DS-230 with the required documents to NVC. I suggest that you gather other evidence to send at that point.

IR-1 / CR-1 Spouse Visa Process & ProceduresQUESTIONS regarding interview documents...
The interview letter which they will email to you will list the things that you need for the interview. They wont send you copies of anything.

As a back up most people take copies of the items which they have already sent to NVC when they are going to the interview in case something is missing from the file. Sometimes the CO does not look through the file properly and may miss something that really is there.

IR-1 / CR-1 Spouse Visa Process & ProceduresEvidence of a Bonifide Marriage - Suggestions please?
You have been married for 7 years and are living together since that time. In my opinion you do not need a ton of other evidence for your case. Send your child's birth certificate. Are you named on his employee insurance? If so you can send that and anything else that speaks to being beneficiary for each other. You can send a few photographs also.

IR-1 / CR-1 Spouse Visa Process & ProceduresMoving to other country while your case under process
SEE BELOW:

A green card holder is not supposed to stay out of the U.S. for extensive amounts of time. According to the law, the maximum admissible period out of the U.S. is "one year less one day, counting from the day that you left the U.S." USCIS officials generally send to secondary inspection those Green Card holders who spend over 6 months outside the U.S.A. If, for any reason, you need to be outside the U.S. for more than one year, you must request a "Reentry Permit" from USCIS. The Reentry Permit is a permission to stay outside of the U.S. for a maximum of two years without losing your LPR status. You must request this in person from USCIS in the US before you leave to go abroad.

IR-1 / CR-1 Spouse Visa Process & ProceduresBiometrics form question

One more question: On the top right of the form is a space that says "FILE NUMBER" and under it an A______. I have no idea what that is. Do I leave it blank or put a N/A?

They are asking for your Alien Registration Number. If you never had a greencard before then you do not have an A#. Write 'none'.

Go and read his post again. maybe that would help. You should not have sent the IRS transcripts with the I-130 if that is what you really did.

IR-1 / CR-1 Spouse Visa Process & ProceduresBiggest Mistake of My Life?
In my opinion it is not the 'intent to marry' that caused the problem. The one way ticket and the documents you had said 'intend to marry, stay and adjust status'.

You still have to submit the I-864 showing zero balances and send a letter with it explaining the reason you are not required to file taxes.

As the sponsor the request copies of the last three years Tax Transcripts from the IRS website.

Your petition for your husband will not be affected by your use of medicaid.

It will not affect your cosponsor in anyway since you are a USC and it is you and not your husband who will be using it.

If you sent them in the same package they will be joined. If you are unsure then do as you can check with NVC.

You will have to send 2 DS-3032, 2 I-864, 2 DS-230, 1 ASO fee $88 and 2 IV fee $230.

Send AOS and then DS-230.

Really it does not even matter because you just need to get them in. You may receive an RFE either way but dont worry as long as you have sent them in and call to see if your case is completed.
