Hello everyone,


My husband and I has been living in Jamaica for about 5yrs and married for 4yrs, we have a 2yrs old infant and both of them just went to the States about 2wks ago.

We have been gathering all our paper work and getting them together, we found out that we could apply for a K-3 visa.
My husband and i have decided to use a cosponsor, which we have.

we have signed:

KI-130
G-325a
129F

We have most of the supporting documents(photos, Birth Certificate etc).

I need to know

1) is the right and quickest path to take for me to get to the States?
2) is there other forms to be filled out that we don't know about?
3) what are the chances of this all going through?
4) does anyone know how long all this processing takes?

i filed my i-130 and G-325A for my wife.Its already about 18 months and now i think i have missed some information like providing my previous job details and the time I have spent within 5 years.what should i do if I had some mistakes on these field? what happens to my file processing period? Does it start from the same place(its already a long time) or I again have to re-file it? Any suggestions would be appreciate.

Seems like the consulate in India is pretty hard huh. Read about a recent denial at the same consulate. All i can say is dont give up. if you really love the person, which i hope you do, you all will figure a way out to make it work. Just address the issues. try get stronger evidence to support you all relationships and more trips. these stuff help to clear doubts at consulates such as yours that is very hard on issuing the visa

no one can tell exactly when u will have an interview date. you just got to keep checking with NVC to see if your case has left and DOS to see if you got a date. Usually you get a date within a month waiting and the interview is like 3-4 weeks away so you it shouldnt be long to go. good luck :thumbs:

When you send the I-130, you need to include the G-325 for each of you, along with other documentation. One G-325 completed for you and by you and the other completed and signed by your spouse. Slow down, you do not need to submit the I-864 until you received you NOA2. Please read the guide for complete details. If in fact you sent the I-130 in without the completed and signed G-325's, you will get an RFE (Return for Evidence) asking to send them in... You also need to attached passport photos of each of you to each G-325.

Changing one's name is their choice, however if they choose to take their spouse's name, then legally that is their new name as stated on the Marriage Certificate no? Isn't one obligated by law to change all documents within a certain period of time from said marriage? That would be like having 2 names if you are able to keep the old documents with Maiden name on them.



No one is obligated to change their name or documents after they get married.

They are only required to use one or the other and be consistent especially on legal documents.

The record indicates, assault but he was never in jail or sentenced. He had to pay a fine of only 500 euros. Would this affect our application? Please Help!!!


Every jurisdiction is different. It may or may not still be on his record depending on how long ago it happened. If you do not get the answer here try using google or just ask the authorities in the country where it took place.

Because of my job, I cannot get more than a week off. Because of my criminal record, I think I should not waste my time with a K1. I basically want to know if I should get a CR1, and if so, should we marry in Japan or USA. The issue is we usually need "evidence of a bonafide marriage" which is difficult to produce because we do not have shared property now. I can make a bank account and share it with her or something, but its tough if she does not have a SS number, right? Everything is in my own name because I live her alone.

The other thing I am thinking about is VWP and getting married in the USA. I know its wrong but maybe we can do it?

I just want to be with her and she wants to be with me.



Try your best to have more visits before you get married. Evidence can include photographs that you have taken on these trips which may include family and friends. You also have your email and skype records which should help. Some banks allow you to add other signatories to your account without SSN she will have to be there to sign some papers and provide her identification. Go to your bank and check it out.

You can get married on the VWP when she visits. It would only be a problem if your intention was for her to visit, get married and then file for adjustment of status while she is in the USA. She should go back home after the wedding and you file for her. You can also choose to go to Japan and marry there.

The shots to get depends on your immunization record which you have to present. If the person had Chickenpox in the past then this shot would not be given and this shot cost $5,300 while the others were less. These must be paid in addition to the $9,500 for the medical for an adult. If the person is under 16 years it is $4,500 plus cost of shots.

If you have already sent in your DS-230 and AOS package your case may be complete by now. Call NVC as find out your case complete date. If the case is complete you should get your email for the interview about 1-3 months after that. Most persons seem to get the interview letter emailed to them within 6 weeks of your case complete date.

If the I-130 were sent in the same package and processed together then you will get the same interview date. You will get separate numbers when you go to the embassy but you will be interviewed together. When they call the first number number you should point out to the CO that you also have a number.

They will concentrate on questioning you. Your son may be asked who is filing for him and if he has travelled out of the country. He wont be asked much.

Even if they have put in for the work visa I believe you should put in the I-130 since this if for permanent residency. The work visa does not guarantee permanent residence status and this is what you are looking for.

There is nothing wrong in having both petitions in at the same time. The DCF filing also has shorter processing times.
