Thanks for the info, will do, but can I send in whatevers missing or not filled in once I speak to an operator before I receive their packet?

IF something is missing after learning of this from an operator, you'll have to wait for the letter from NVC because it has a barcode sheet you need to return with it.

I too call the NVC auto system and was told that i had info missing on our I-864 (i literally cried when i heard this) crying.gif I've been waiting so long for this case to be completed.

The system also told me sometime ago that the information packet for my DS-230 was generated on March 19th but to date we have not received that packet. I have already sent all my supporting documents to my husband so all we are waiting for is this instruction packet.

Not sure how much longer i will have to wait..Guys i need some prayers at this time to keep strong.

How long do you figure this instruction will take to arrive....and also after you get a RFE how long before you know if everything else is ok???

Thank you much

thank you guys for all the suggestion made. Just an update. Yesterday my hubbby received the instruction packet for th eDS-230. We will send out same this morning. The RFE for the Affidavit of Support is the missing Fed Tax Returns for 2007 and W2's, also my hubby signed but did not date the form hence we have to do the whole thing over.

We are trying to get this out the door by tomorrow.

Thank you guys and much love,
Kishmar

So you sent the I-864 already, right? If this is correct, the RFE they're talking about refers to the DS-230 they are missing. They're missing it because you haven't received it yet. It takes about 2 weeks to get to you even though they will say it takes up to 6 weeks. If you feel comfortable enough to use James' shortcuts and generate the DS-230 yourself, you can go ahead and do it now and get the process completed faster.

Diana

Diana,

I was told that there is a something missing on our I-1864 (reason for RFE). Auto system said that instruction packet for DS-230 was generated on March 19th.

You have to calm down a bit about the waiting. There is little you can do but ride it out.

Was the form generated on the 19th or the 29th? I've seen both dates in 2 different posts by you. Either way, that's only 2 weeks. Not an overly long time to be so worried about.

Call and speak to someone if you need clearer answers.

Instruction packet for DS-230 was generated on March 19th. FRE i was told was mailed on march 19th. but im somewhat weary about the info i get when i call the NVC. Three different person three different advise.

Hello All.

This whole process at the NVC is driving me nuts. On March 19th the auto system at the NVC told me that the instruction packet for my DS-230 was generated to date my agent has not received it. To make matters worse i also got an error message for RFE on I-1864 which i was told my a customer service rep was mailed on March 29th, to date nothig

Not even one of the mails.....Could somebody please please shed some light on what is going on. This waiting is becoming so unbearable.

Thank you for any suggestion you may have.

Is all this info for the NVC or USICS??? Cause i was approve by the USICS without sending in nothing to show i was bonafide married to my hubby we are now at NVC stage (got one RFE for missing info on our Affidavit of Support) but no one has asked us thus far to provide proof of our marriage.

We sent in our marriage certificate and whatever info they asked for but no pictures or none of those other stuff i read about here....so please enlighten me as to what point in the process will they ask for all these proof.

I agree with YD. I would have a sponsor lined up too.

If he can produce 1099's or W-2's from work with his father, as well as tax returns for that time and was above the poverty level, he should be fine.

Free lance.....as in a Schedule C for the tax return? Again, if he made above the poverty level, he should be fine.

From what you said, I get the feeling his income may be a little spotty for the last three years or so. They are not going to be happy with that at the embassy. Find out if he has proof of income over the poverty level for, oh, say the last 3 years, AND CAN PROVE it! If not, get that sponsor in order.

JG,

To tell you the truth im so frustrated now with this process. I gues i will just wait and see what happens. I will also try to get his dad/mom to fill out the papers (by the way his day is self employed. I think his mom been working at the same place for over 20years).

I just frankly tired : blush.gif Im gonna let this process run its course or else ill be too stress to deal with my everyday life. Im already not sleeping well at nights

Length of employment can and does concern the visa interviewing officer, the affidavit of support is only one thing used to determine if the prospective immigrant wont become a charge of the state, the I.O. can demand additional evidence that the immigrant will not become a charge of the state.

So do you think it is a good idea to have his parents fill out those forms now or wait to see what happens???

QUOTE (Jomo @ Apr 16 2008, 12:55 PM) <{POST_SNAPBACK}>
That would depend........

Did he make above poverty level before this job?
Did he have steady jobs before this with little to no gaps in employment for years back?
Can he prove all that with W-2's and tax returns?
Is this job permanent? And, can he get a letter stating this?

Probably what happened to that other person is the job they had before was not above poverty level or there was not a steady enough employment history. Just because someone makes enough now, without proof that they are able to keep the job and keep up the means, it may not be enough proof. Proof of steady employment is best if you don't want to have to find a co-sponsor.

Yes he did make above the poverty line before now...also he did alot of free lancing because he works in the computer industry and this allowed him to be able to travel back and forth to come see me over the 4 year period that we have been married.

Worst case scenario ill just ask his mom/dad becuase they said they would help if needs be (im so angry right now this whole process is wearing me thin)

The gaps in not sure of......

What do you mean for years back.....he worked with his dad for a while when he met me he decided to work out

So here goes Eresh said that she has not been working long enough on her current job, hence when her SO went to do the interview they asked for co-sponsor.

Has any one had the same problems lately.

I need to know because my hubby just started a job this year and the deal is he earns way above the poverty line (so what is this now that im hearing)

I thought they were concern with current status mad.gif

the CO told him that as long as we get a joint sponser he will get the visa!!! The CO told him my income would have been fine if I had been working for a whole year at both jobs but since its only been 8 months, they can't rely on that. rolleyes.gif Basically then, that whole current income thing is not the only thing they are looking at, it's also the length of time earning the income. Anyways, already got a joint sponser lined up so I'm not worried about it. It just kinda irritated me a bit because I don't like asking someone to do this for us. {it's why I started working 2 jobs, I didn't want to ask} I owe my uncle bigtime now. So, it will put us back a couple of weeks, but what is a couple more weeks when we've been waiting this long right? laughing.gif Anywho...I'm happy and relieved they only wanted a joint sponser !!!

Congrats,

Are you saying that if your petitioner earns above the poverty line now and not working at the job for a year they want a co-sponsor. Because my hubby earns way above the poverty line but has not been in this job for a year.....Also what does CO stands for (sorry, i really dont know)

Of course not. There's only a need to inform others so they don't make the same mistake.

So i am just a bit confused by all that i have read here. Am I to believe that when I get to NY later this year God's willing (in the process of doing IR-1 visa) i will have to remarry i husband that i have been married to for 4 years now. The marriage took place in Jamaica and he lives in NY.

Please clarify for me.

Thanks

Of course not. This is precisely the kind of misunderstanding I'm trying to avoid by posting in this thread.

You're already married in Jamaica. If you get your name changed in your passport now, while you're still there, there will be no need to change names again later.

The OP who began the thread is not an immigrant. She is a US Citizen wanting to use her foreign husband's surname. It is a different process but somewhat the same, in that passport is the first thing to change. The OP indicates there is not federal office nearby, so she went to a county office first. That was the beginning of her problem. As an immigrant, even if you don't change your passport name before US arrival, you can do so through a Jamaican Consulate in the US, later. You should apply for the visa in your married name if that's the name you want to use. You also have the option of keeping the name you used before marriage.

Thanks for the clarity. From the day i got married I have used my husband name on all my documents. It is also the name in my Ja passport and that is the name they have for me at the NVC. I did not give up my surname i just addedd my husband's name to it.

Once again thank you for clarifying for me

I call the NVC everyday before i come to work only to hear.....that im not scheduled yet. You cannot call the US consulate here in Kingston they prefer if you send them an email. Ive done that so many times and all you get is an AUTO response. I dont even know if they even bother to read the emails

I was logging in like i do every day and it dawned on me...."what's the point?"

So i want to ask everyone, why do you bother coming to vj everyday? I don't mean this in a mean spirited way, i am only curious. I know there are loads of info here, but once your paperwork is filed what is to gain? We can't find any more info about our case then we can at uscis.gov.

is it the emotional support? the willingness to answer others questions?

Is it seeing other people's approvals? if so, does that excite you or depress you? or both i suspect.

i just wondered what everyone's compulsion is because i don't know about mine.

Well my reason for coming here is that i have made very good friends here.....one of which will go the extra mile to do what she can for me...she supports me emotionally when i feel down and depress.....and sometimes i just come here to see how others are coping during this stressful period

Thanks a ton to VJ forum helping us go through this journey, I can't imagine without this forum how we could go through the process and get all the information we got here. Probably now I can laugh at it, from VJ it is not just my husband and I who became knowledgeable but also a very well known law firm in NY/NJ as well. Based on the information we had, my husband and I had to educate our lawyer to do the necessary step by step and still they made mistakes that costed us time and not to speak about the lump some money that we are going to shell out on them. Based on this bitter experience we both are smarter when it comes to lawyers now and no regrets as it was just my husband's love towards me that he insisted on hiring him so that things don't go wrong star_smile.gif (Now I can say that ... after grumbling to him many times how dumb the lawyer is cool.gif

A family member of mine is married to a Jamaican Citizen he is now a naturalized US Citizen, they have a 5 month old son together, my question is should he file 2 seperate 1-130 petitions (one for his wife one for the child? we contacted the Jamaican embassy about it by email, we explained to them that we are going the CR1-IR1 route, i even asked about the consular report of birth for the child, i dont think they seem to know what that is, they replied to us saying that if the child isnt qualified for the consular report of birth (which we dont know if he is or not) the husband should file seperate 1-130 petitions, what do you think we should do? any info will be greatly appreciated

I agree with checking with the US embassy in Jamaica. Went through similiar situation in Guyana recently. Went to embassy got forms for consular report of birth, also application for passport. Fill it out, and then take it back to embassy with baby. It also best if both parents and baby go. Web also has most forms which are fillable pdf etc

Thanks for all the info really apreciate it, i will ask my family member to go to the US consulate in Jamaica and speak to someone there, since we emailed them we havnt got any concrete info. will let you no what happens

Isnanddream,

Here's the explanation on the instructions for the form. (Key words would be - under age 21, and are they dependent on him..)

good.gif

How Do I Count Household Size?

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or Form I-864 EZ affidavit of support whom you are still obligated to support. If necessary to meet the income requirements to be sponsor, you may include additional relatives (adult children, parents, or siblings) as part of your household size as long as they have the same principle residence as you and promise to use their income and resources in support of the intending immigrant(s).

Thanks Karin und Otto, my friends kids are under age 21, he supports both of them, none are listing on is income tax

is it still possible to call nvc and get the IIN number ?

No. You'll get it when they e-mail you the AOS fee bill.

Who do they email ? the petitioner or the beneficiary ? what email address do they use ? i didn't put one on the i130 .
