K-1 Fiance(e) Visa Case Filing and Progress ReportsUSCIS Sucks

I used - VSC.Ncscfollowup@dhs.gov -i dont even know where i found it now - think on USCIS website some where, the email above was the second one I sent, the first one I got a reply saying go away about 6 days after, i then sent this. I gave up on the call centre until the night before approval when our call was taken by a senior member of staff. We tried all angles.

lucy! hiya sis...just noticing this post...how does one get to talk to a senior member of staff?

K-1 Fiance(e) Visa Case Filing and Progress Reportsuscis error
hi all.
on december 30 vsc sent my fiance a notice saying the ere acknowledging our withdrawal of our petition. we did not not apply for a withdrawal! my understanding is that the only way to withdraw a petition is if the petitioner dies or writes a letter and have it notarised stating such...my fiance is very much alive and wrote no such letter!it took us 3 calls to the call center for them to tell us to wrte a letter to vsc stating that we did not apply for withdrawal.they got that letter on jan. 05. we got an email address for vsc and emailed them.it took them 1 week to respond with instructions to make a service request from the call center.that was jan12.the call center made the request on that date nd they emailed us today saying to give them a minimum of 60 days to review the matter (oh and not to make any more "request for corrective action)...MINIMUM F 60 DAYS! and our 5 months was up on the 13 of january cos we r august filers....

during the 3 weeks we hav contacted senator, congressman and had an infopass interview at the local uscis office. the infopass was a waste can tell us nothing but to wait and we r still waiting on the politicians.

just wanted to kno if anyone has had a similar problem with a uscis error and if so how long did it take to rectify the problem?

thanx much.

I don't like any of this lol. I had heard that the NVC schedules appointments during the first two weeks of the month so I was expecting that. That waiting is brutal. Can I get an AMEN?!

US Citizenship General DiscussionQuestion??
If it is your stepson he will not get citizenship through you.

When you file the I-130 and he arrives in the USA he will be a green card holder and eligible for citizen when his mother acquires citizenship.

US Citizenship General DiscussionI need to know
you were married to a us citizen before you migrated in 2009. That means you became eligible to apply for citizenship 3 years after that if you are still married to the same person. You do not need to wait anymore. Go file the paperwork.

US Embassy and Consulate DiscussionNo impediment certificate

My lawyer, who prepared and submitted my petition states that Kingston does not require a no impediment certificate.
I am trying to figure it out. Where is the information that requests this certificate? Has anyone from the Kingston bunch ever been asked for this certificate? Any info will help on this matter. My fiance's interview is May 7th.
Thanks

You WILL need to get the no-impediment certificate, if your fiance(e) doesn't have it at the interview he will not be approved for the visa on that day and that will cause unnecessary delay. The no imped certificate is used to prove that your fiance is not married or have never been married and is free to marry you. however, if your fiance was married before all he/she would need to provide is the original divorce decree. DON'T LET THE LAWYER TELL YOU #######.

Removing Conditions on Residency General Discussionunstable husband...roc interview

Hi there

I'm a long time member of this forum, but this is a sensitive topic so I chose to post this anonymously.
I have been married for 3 years now (living here in the U.S. since 2008) I have to file roc in September.
My marriage has been slowly deteriorating and I can no longer trust that my husband will help me through the process.
Worst case scenario: What are my options if my husband decides in the last minute to not participate?
e.g. Once I get the interview letter how should I proceed if the day before or the day of my husband decides to not go to the interview with me?
Bottom line what happens if I show up to the interview alone and have to explain his absence?
I know I have the option to file on my own, but that requires finalizing a divorce. In that case I can't trust him either to sign the papers on time.

I am desperate for any advise that you can give me. I highly appreciate it!

Based on my understanding from what I read here I think your best bet would be to file jointly(being that he doesn't have a problem signing the docs) and hope you're not called for an interview. As long as you file ur ROC on time whether jointly or single and you can prove that the marriage was entered to in good faith you'll be fine. You can also find all the information helpful to your situation here. http://www.uscis.gov...f6d1a/?vgnextoi

How to Get a Waiver of the Requirement to File a Joint Petition

If you are unable to apply with your spouse to remove the conditions on your residence, you may request a waiver of the joint filing requirement. You may request consideration of more than one waiver provision at a time.

You may request a waiver of the joint petitioning requirements if:

* Your deportation or removal would result in extreme hardship

* You entered into your marriage in good faith, and not to evade immigration laws, but the marriage ended by annulment or divorce, and you were not at fault in failing to file a timely petition

* You entered into your marriage in good faith, and not to evade immigration laws, but during the marriage you or your child were battered by, or subjected to extreme cruelty committed by your U.S. citizen or permanent resident spouse, and you were not at fault in failing to file a joint petition

Note: Refer to Form I-751 for more specific information on waivers

If You Are In Divorce Proceedings But Are Not Yet Divorced

If you are still married, but legally separated and/or in pending divorce or annulment proceedings, and:

* You filed a waiver request. We will issue a request for evidence (RFE) specifically asking for a copy of the final divorce decree or annulment (if applicable).

* You filed a Form I-751 petition jointly. We will issue a request for evidence (RFE) specifically asking for a copy of the final divorce decree or annulment and a statement that you would like to have your joint filing petition treated as a waiver.

Upon receipt of the final divorce decree or annulment within the specified time period, we will amend the petition, to indicate that eligibility has been established for a waiver of the joint filing requirement based on the termination of the marriage.

Removing Conditions on Residency General DiscussionLetter from Immigration- Any ideas
Don't sweat too much about the letter. My Conditional expires on 10/12/2012 and they did send me a reminder in June.

I got into the states on Jan 22nd 2011 on a CR1 visa. I am eligible to remove conditions by next month. I was always told I will not get a reminder about filing to remove conditons. I moved from my previous address in December 2011 and notified the USCIS of this change. I just got a call now at my old address saying I have a letter from immigration. Usually my mail gets forwarded to my new address by the post office. I am not sure why this was not the case with this letter or what the contents of this letter could be. I am far away from the old address and I have asked them to mail me the letter. In the meantime I was wondering if anybody in the house could advise me of what the contents of this letter could be.

US Embassy and Consulate Discussioneveryone

How can one probably reply to a question like this cos I read a review of someone's interview, and was asked * why do u want to marry in US? * who made the decision for you to marry in US? Hope to get a good response ,cos I heard this forum helps a lot.thanks

My fiance the petitioner said this is how he would answer:The reason I want to get married in the US is that this is where I am spending the rest of my life and to marry anywhere else does not make sense.

Me (Beneficiary):The reason why i want to get married in the U.S is because i want to marry my fiance and spend our lives  together after the wedding rather than to marry in my home country and be apart.we are engage and apart and i don't like it.this was our number 1 reason to choose the K1 visa.
