K-1 Fiance(e) Visa Case Filing and Progress ReportsK1 Philippine Filers for JAN/FEB/MAR - CSC/TSC/NSC

Jim I have a timeline for OCT/NOV/DEC Filers but they are only for the ones that have received NOA2 and have interviews and I didn't want to cause insult to injury on your part, especially through this difficult process your enduring at this time.

Thanks Austin you're very considerate. It doesn't bother me that much, I do avoid reading the VSC posts though, lol. Seems something is wrong about someone posting that they've been waiting 2 weeks and no NOA2. Did you ever read my list of the top 10 things to do while waiting on your NOA2? I'm on number 8 now.

1. Take an underwater basket weaving class at night school.
2. Iron your underwear and socks.
3. Teach cats to walk a tight wire.
4. Watch championship bowling on TV then talk to all your co-workers about it constantly.
5. Read War and Peace, backwards.
6. Learn every dialect of the Chinese language.
7. Sing the Batman theme incessantly where ever you go.
8. Embroider your name on every stitch of clothing you own.
9. Try to start conversations with as many 1-800 operators as you can per day.
10. Write a book on 101 things to do while waiting on NOA2.

K-1 Fiance(e) Visa Case Filing and Progress Reportspl. contact your congressman to complain about the slow processing times

Yeah, I don't think the current wait times are too too bad. The thing that I gripe most about (the difference between I-129F processing times depending on where you live) seems to have an easy solution: send NSC or TSC petitions to Vermont! I think evening out processing times would make a lot of people less grumpy.

Yeah, I made that comment in another thread. When they stopped proccessing I-129f's in TX why did they transfer them to CA, the center that was just as behind as TX? Government logic at work I suppose.

I too have complained about this...the difference in processing speeds, it does not help, they are aware of it, and quite frankly it pisses me off knowing that both them knowing and not caring and me having to wait longer than half the country...the governement did not hesitate to tell me that I was going to Iraq...sorry for the rant.

Wait a minute!! You mean you could not tell them that your processing time is 6 months? Then setup an automated phone answering system with a series of menu choices that take them back to the same rhetorical reply, that their orders for you to go overseas is in processing and you'll let them know as soon as you're ready?

Wonder how they'd deal with that? (nevermind answering I know in reality how they would) It'd be darn nice to have that luxury huh?
Jim&GemzMalePhilippines2007-04-10 07:41:00
K-1 Fiance(e) Visa Case Filing and Progress Reportspl. contact your congressman to complain about the slow processing times

What would the point of complaining be? Unless they have the funding to open another service center or hire more people, it's not going to happen. USCIS processing times are MUCH faster these days than they were in the past and generally speaking the delay is at the consulate end. (Imagine if you had to wait six months for a spousal visa petition and then 12 months for an interview date in Ciudad Juarez where the backlog is that long)!

You're right. Which is why raising awareness for funding is important. Of course, it's important to remember that USCIS is a self-funding agency - which means it spends what it brings in on its petition fees. That's where we get back into the whole debate about raising fees. There's always the argument that USCIS should get funding from additional soures - which is something anyone is free to bring up with his/her representative.

But everything you cite as being a reason why complaining is pointless is a reason why it's important to call and voice your concerns.

If I personally felt the wait times were "so unfair to the US citizens that we have to wait this long for the processing time" perhaps I would call. I know that the priviledge of being able to file in the first place does not guarantee a fast process. I got caught in IMBRA so my I-129F took 5+ months instead of the average 90 days. I did get my senator involved - because at first, no information was provided to filers and once it was, petitions were approved completely out of order. I thought THAT was a valid reason to voice my concern. But I don't believe a few months wait is any reason whatsoever to involve my elected official. I pick and choose my battles carefully and I definitely don't agree that wait times are unfair to USCitizens. It's all about perspective (and patience).

I respectfully disagree.

I frame the unfairness, however, with a bit more detail. I think the wait times are unfair to US Citizens because they are so drastically different depending on in which state of the Union a citizen lives. That's not only uncool, but, potentially illegal (though for a whole, long, stupid judicial reason - based solely on case law creativity, is probably an unwinable case). The whole benefit of having united States (capitalization not a typo) is guaranteed rights to the citizens of the several states. When VT filers enjoy basically expedited service and CA/TX/NE filers enjoy longer delays, that's unfair.

We may not have a right to have anything processed in x number of days, but we do have a right to have all our petitions processed in a similar number of days.

(That's one easy way to highlight fundamental unfairness - but I'm not entirely sure I'm willing to waive away a right to feel like the process, even in VT, isn't unfair to US Citizens as well.)

Well, in the IMBRA forum here someone posted the ruling by a judge recently in a case filed to strike down IMBRA, that it is not a constitutional right to have a foreign spouse or fiance(e) be granted entry based on that status. Additional laws have been written over time that allow for it, but it's not guarranteed right as a US citizen.

I agree that it isn't fair that once center has such a short processing time over the other. I'm not sure why it wasn't split with the Mississippi like so many other things are here. All petitions from states east of ole Miss, go to VSC and all petitions from states west go to CSC. Maybe it's too logical? I brought that up before in a thread on this same topic and someone brought up the possibility that CSC is much larger and able to handle a bigger case load. Well if that's how they based their decision then they were wrong if they didn't increase staff to handle the influx of petitions at CSC.

Also you can sense the US goverments whole attitude of the immigration process in one concept they have stated needs to get accomplished. USCIS must become self sufficient in their costs starting fiscal year 2008. There isn't a whole lot of concern on capital hill about the K-1, K-3 petitioners. There are bigger immigration issues in their minds, to get resolved.

K-1 Fiance(e) Visa Case Filing and Progress Reportswhere are the bloody noa2's?!?!?!?!?!?

Jim&Gemz,
I hope if anyone gets an approval, its you and jlcross ! I would gladly give up my place in line if it meant you getting your NOA-2. Trust me, I know what your wait time has been like. It happened to me last year. It isn't very pretty.(F)

Thanks, I appreciate the sentiment. I've quit waiting for the NOA2, now's I'm just waiting for the 6-month mark so I can call and, hopefully, get more than a canned answer.

Well jlcross, I wonder if our cases are stuck together in the same "I don't feel like workin this case today" bin. I have been watching the USCIS web site that shows what month CSC is working on because it usually gets updated around the 17th of each month. It's still sitting at 13 September right now. I have a feeling that if you try to call them before that "Cases currently being worked" date is beyond your NOA1 date, you're going to get a canned, scripted, typical answer and I don't think I need to repeat it, you know what it is.

I wonder how they'd handle it if a few thousand petitioners showed up at their front door one day and surrounded the building and started shouting for some action! BAH! Bad idea now that I think about it. Then they'd be standing by the windows looking at us instead of approving cases.

Have you tried contacting your member of congress or senator? That's an unduly long wait. Average time should be 2.9 months. Call and don't let them wiggle out of helping you by citing that USCIS processing times website. Tell them you know better, you've done your homework, you know how it works, and you need. help. now.!

Go get 'em.

Yep, been there, done that. USCIS responded to my congressman with "we'll deliver a decision on this case between 10 and 30 days" and that was the last week of March. Still doesn't fill me with a lot of confidence it'll be adjudicated soon. It did not say "work" days which I know the goverment is famous for pointing out when you're waiting on action from them. 30 working days will take the case well into May.

erm.....me.

I take it that you're speaking of a previous petition because your timeline doesn't show that? I'm sorry to hear that happened though, whenever it was. It's so hard to sit around pretty much in the dark wondering when and what will happen with your petition. What a crushing blow that had to be.

Well, I'll say a prayer for you for this petition and I hope it goes smoothly and much more expeditiously.

K-1 Fiance(e) Visa Case Filing and Progress ReportsSix months of waiting and I get an RFE?

Just a hunch, but I think that they might be taking a closer peek at your petition because of the incredibly short duration of your relationship. (I think I've heard two years being tossed around a lot on here?) Obviously, it shouldn't have taken six months for your RFE to arrive, but I think you might have to go out of your way to provide a lot of evidence as to your relationship...

Yeah, yeah. I know. Just thinking ahead and muddling through where the boy and I are in the process as well. The point: that the visa officials will probably hit the OP up for loooooooots of evidence.

Sure, and we're prepared for that. We have documented conversations 2 times a day for 3 hours on weekdays and 4 hours a day on weekends. Every day, of every week. I have plenty of phone records, and she has some snail mail I've sent (at least the few that have made it through the filipino mail system). I provide financial assistance to her twice a month and have sent about 250 pounds of gifts last Christmas, not to mention birthday, valentines day gifts, flowers etc. Also I've provided assistance to her family. She has enough relationship evidence she might have to cart it in if she took it all.

Additionally I now intend, if at all possible, to be with her when she goes in for her interview. Whether they ask to see me or not I want to be there to show my support.

K-1 Fiance(e) Visa Case Filing and Progress ReportsSix months of waiting and I get an RFE?
Right, the RFE is asking for evidence of having met in person in the last two years.

The consulate at the embassy will be the one wanting proof of a relationship at her interview.

Thanks so much, I am thankful for the support here at VJ. I've spent quite a lot of time wondering if our case was lost so I'm glad to see that it isn't. Whatever I can send them, almost all of it is going to be duplicate of what I've already sent. I have seen most cases get approved pretty quickly after the RFE is submitted, but if it isn't any different than what I've already sent, I'm not sure what the outcome will be.

I'm digging through old credit card bills now!

K-1 Fiance(e) Visa Case Filing and Progress ReportsSix months of waiting and I get an RFE?
Well, it seems as though someone does have our petition. We have sat waiting now for over 6 months. Today in the mail I get an RFE that was dated April 26th. Seems as though they want some more evidence of meeting. I sent over 20 photos of us together, hotel receipts, passport entry and exit stamps, copy of airline purchase order and I guess this wasn't enough.

Not sure what else I can dig up except maybe credit card bills that show purchases made in the Philippines. I'm pretty disgusted right now.

That wait is terrible, of course you know that. I have read on here though that the wait in Dominican Republic is very long. I wonder if it's because they don't have enough consulates or other embassy staff there. I would definitely contact your Senator/Congressman directly and complain. Not sure anything will happen, but the squeeky wheel gets the oil you know.

Still here. Still no NOA2. There is life at CSC though, as I received a RFE, after 6 months of waiting. If they don't get around to approving our petition soon, we'll miss another Christmas together.

Maybe one of the qualifications you need for working there is to be emotionally detached from the world. You cannot be affected by the idea of keeping people apart I guess. Or they seem so.

Jim&Gemz, can I ask if you had any special issues that might hold it up? Did you have a divorce or tried to do the 1-129F in the past? I just wonder if those with different circumstances get held up for whatever reason.

I've never filed for any visa before so no IMBRA issues there. I did have a very recent divorce before filing but I included a notarized copy of the final decree and a full page letter explaining the 6 year separation that preceeded it.

As for me, nothing yet!

Have you ever called? It's an automated menu system and you don't really talk to anyone. You cannot get customer service on the phone until you're past their "current processing" date, which is still September.

K-1 Fiance(e) Visa Case Filing and Progress ReportsIs this horrible feeling in my gut justified?
We'll add you to our prayers. It's tough having to wait, believe me I know. I will have to say this about the wait though. It surely gives you time to really get to know your SO. You can't go on normal dates. You can't veg in front of the tv. You can't just sit in quiet complacency. When you can talk, you have to talk. Either on the phone or through chat, talking is all you have. I think it makes the start of your relationship stronger because I sure have talked to my girl sooo much more than I have with any other relationship I've had.

It'll come soon I'm sure. I wouldn't put a lot of faith in what the USCIS web site shows because so many people here have said the info on the site didn't change and they received their NOA2 in the mail.

Good luck and keep your thoughts positive!

 Congratulations!!! Wow it makes you wonder what happened to the cases that just lay around for 6 or 7 months? I can only imagine that the number you call is staffed by someone who is given a script to follow and that's pretty much all they know. If you ask a question, they look it up on the list and give you the canned answer. Once they do that 75,000 times a day they stop referring to the script and adlib things like. "oh whoever said they received an approval, that filed after November must be lying" That person is a loose cannon and needs taken off the customer support line immediately. Is it possible to send in additional evidence while your case is pending at USCIS? I don't have an RFE but I wanted to provide another document I think is important to their decision. If someone h as done it, how do you send it in? Just address it to the service center and include both names and case number on it?
