We couldn't fit all of STewart's either. We attached a sheet. On the top of the sheet we put the form number, his name...EVERYTHING and then finished his work history.
We put a few, then see attached, then the attachment :)

So you are getting married next summer?

If you do a k-1 visa (fiance visa...) you will have time to come into the country....and then once you are IN the country - 90 days to get married.

SO...even if you start NOW...let's say it takes 5-8 months...at the earlest you're in March, latest (assuming all is well) June or so. That's TOTALLY guestimation on my part...but the point is, if you're planning on getting married next summer you'll need to start soon.

That is, of course, unless you're going a different route, get married and then file..and that's a different discussion :)

Here's one...i've seen MANY but this is the first one I could rememebr the name of the person

Just called DOS this morning and was told that our petition was returned to USCIS from Chennai Embassy, and that it would be around 4 months before we would receive a letter. She said at that point we could appeal. Got on my phone to senator and was basically told they have no power to do anything except to check on cases for us. He said their office was told that the case was sent to fraud division, and we needed to be patient and let them look at our proofs. I asked him "what proofs? the embassy wouldnt take any and refused to look at most of what my fiance had."... Everytime my fiance tried to give proof or say something he was given the same reply, "sir we dont believe you ".

So what does this mean for us now? Do we just wait patiently for a denial after waiting a year already? I have heard that even appeals are not successful most of the time.

Any info would be helpful.. Im so near to just giving up ..

You DO have to be married, yes, but if you can get married, the processing is SUPER fast. They've made a few changes since I did it -we DID interview and get visa on the same day, but there are some changes now.

Even with the changes, I'd say it would only take a few months from start to finish. The USC has to be there at least once to file the petition for ya'll. Lunamel just did DCF there so you can read her experience, but if you have a little extra money to get the USC to Australia and don't mind getting married to do this...it's a good option. Cuts heaps of time off of your journey.

We married in Dec, and I went back in MArch, but COULD have done it all at the same time. We did it all in ONE day...again changes have been made, but Australia is one of the few countries where you can DCF regardless of residency of the USC. Heaps of Aussies on this site have done it.

i think your background check is done around the same time as the medical?? We did it differently so I'm not sure. You background IS checked, however.

If it was handled as ours was, no. As I stated, DUI is NOT a crime involving moral turpitude. Like you, my husband was arrested and charged, had to pay a fine, attend counseling AND complete community service. We took ALL the supporting evidence and NOT ONE PIECE was looked at. We tried to show and the didn't care - and as I stated, just dismissed it as it's not a CIMT.

3. If the anwswer to questions 1 and 2 is yes (my god, I'm even starting to write like a USCIS guy), is there anything I can do to minimize the delay (submit records of my arrest for example)?

I think sending them un-asked for paperowork might slow it down - I mean, worse case, they send an RFE - but I guess you run the "slow down" risk either way.

Of course alcohol abuse is closely related..but you did fullfill the court demands and haven't be in trouble since... I feel they will see it for what it was...A mistake that we all have done...


From my experience (personally) and all the research I did BEFORE we filed, DUI is not considered alchohol abuse, nor a CIMT!

DUI is not a crime of moral turpitude. My husband had a DUI in the states August 2005. He included all the info on his forms - and brought all SORTS of supporting evidence that he had done all he needed to do to pay fines, do community service etc etc. They didn't even LOOK at it. Just wrote "Not CIMT" on the petition and moved on.

What country are you from?

Not sure if this is what you were asking but DUI is NOT a CIMT!
