K-1 Fiance(e) Visa Case Filing and Progress Reportsinterview today!

Dankjewel! :) We are super excited!! <3

The whole interview, including everything around it takes about an hour.
I can't really tell you what they focus on because you're not there when they go through your papers.

They ask for the affidavit of support, birth certificates, police records and passport pictures.
On arrival they ask for your letter that states the date of your interview.

Good luck!!!

K-1 Fiance(e) Visa Process & ProceduresAffidavit of support, etc.

Any USC or LPR.

what's LPR? And do they have to live in the same household?

The USC petitioner still needs to fill out an I-134 and provide their supporting documents, even if they do not meet the requirement. There is no combining of incomes with an I-134, so you need to choose 1 co-sponsor that meets the requirement for their own household size plus the foreign fiance(e). The co-sponsor will need to provide their own I-134 and supporting financial documents.

This still doesn't answer my question if my father in-law can support me... But thanks for the rest of the information, I appreciate it!

Hey guys,

- My fiancee doesn't make enough according to the federal poverty guidelines. But my in-laws are willing to also support me. My father in-law gets money from the government because he

is a 100% disabled. He's a retired veteran. (He got injured in Vietnam) Does he still make a good candidate to be another supporter besides my fiancee?

- She still lives at home. Can only her parents support me or also her siblings?

- Do they need as much prove from secondary supporters as from my fiancee?

- Do they take in account the amount of savings my supporters have?

I think this is all! I would really appreciate it if you took the time to answer this, thank you in advance!

K-1 Fiance(e) Visa Process & ProceduresNL - USA K-1 Fiancee Visa

Hey guys,

We just received a letter from the NVC!!!! :) Our case number is being sent to the Netherlands as we speak! We didn't get notified that they received it just that they sent it.

Do you guys know how long this usually takes? We're super excited. Is there still a big change to get denied?

How are all of you?

K-1 Fiance(e) Visa Process & ProceduresNL - USA K-1 Fiancee Visa

The next thing to happen is the petition will make its way to the NVC (National Visa Center) so that it can be given a Case # for the Consulate. I would suggest calling DOS (Dept. of State) after about 2 weeks to get your case # @ this number: 1-202-485-7600. When you call you will the benficiary and petitioner information such as name and DOB. If they give you a case # then ask if the petition has left the NVC. After this I would suggest going to the Netherlands Portal. Hope this helps.

Thank you so much, super helpful! :)

Congratulations!! You will receive the hardcopy of NOA2 in the mail soon.

Thank you, we're excited!!! :)

K-1 Fiance(e) Visa Process & ProceduresNL - USA K-1 Fiancee Visa

Hello dear fellow applicants/petitioners,

My name is Britt van de Casteele and I'm from the Netherlands in Europe. I've been with my American fiancee for 2 years exactly on this day. :)

Yes, we are a lesbian couple filling for the I-129f fiancee petition. I have some questions concerning the next step in our process...

09/26/2013 - Sent I-129F form

10/05/2013 - They received our application (NOA1?)

10/23/2013 - They changed our alien registration number

(Never got any notification for this but we checked our status here)

11/14/2013 - APPROVED wub.png good.gif on 11/12/2013 got notified today. (NOA2?)

So, so far it has taken 46 days which in my opinion is quite fast! :)

Can anyone tell me what's next. Are they sending the paperwork to me? Since my fiancee has filed for it I believe i'm next.

Do they sent it straight to my embassy? Or does Kristin have to pick it up and sent it? I have a lot of other questions but

I'll ask them when the time is there! :) This forum has been really helpful so far and I enjoyed reading other people's experiences!

We didn't get any help from attorneys or companies we did it our self and we have this forum to thank for a lot of it.

If anyone could be so kind to answer our questions that would be great. We've been researching but nothing has really given

us a satisfying answer. We just want to know what next! :)

Much love,

Kristin & Britt

K-1 Fiance(e) Visa Process & ProceduresQuestions about Affidavit of Support/Co-sponsor

That site was speaking about joint sponsors for an I-864. Not sure what info you think sounds incorrect there. For the I-134 with the K-1 visa, a co-sponsor can be used, BUT not all consulates allow co-sponsors. Sometimes a CO decides whether or not a co-sponsor is allowed on a case by case basis. Ask your consulate directly if they accept co-sponsors for a K-1 visa. For the I-864, after you are married and filing for adjustment of status, a joint sponsor that meets the requirements is always accepted.

The USC petitioner is always the primary sponsor, even if they have zero income. No, you cannot have someone else act as the primary sponsor instead of the USC. The USC petitioner fills out the I-134 and then you have one qualifying co-sponsor fill out their own separate I-134. There is no combining of incomes with the I-134. The co-sponsor must meet the income requirement on their own. They need enough for their own household size plus the foreign fiance(e), as I stated before.

When it comes time for AOS, then the USC petitioner/sponsor fills out the I-864 and if the USC spouse does not meet the income requirements, then a joint sponsor can be used and will fill out their own separate I-864. If the USC spouse has a qualifying household member that is willing to help sponsor the foreign spouse, then they can fill out an I-864A and combine incomes with the USC spouse/sponsor. A household member filling out an I-864A is not the same as a joint sponsor. This is all jumping ahead though. Right now you only need to worry about the I-134 for the K-1 visa interview.

Thank you for this information!

Hey guys- Britt here.

Other question. Kristin doesn't make enough and co-sponsor is going to make that alright? Cause I read different opinions on that. Can someone give me a straight answer?

Thanks!

found this after I posted this:

http://www.immihelp.com/affidavit-of-support/joint-sponsor.html

you guys all agree with this or is this a BS website? tongue.png

and then I find this:

Joint Sponsor

A joint sponsor is someone who is willing to accept legal responsibility for supporting your family member with you. A joint sponsor must meet all the same requirements as you, except the joint sponsor does not need to be related to the immigrant. The joint sponsor (or the joint sponsor and his or her household) must reach the 125% income requirement alone. You cannot combine your income with that of a joint sponsor to meet the income requirement

found that on USCIS.gov so I guess that says it all, right?

K-1 Fiance(e) Visa Process & ProceduresQuestions about Affidavit of Support/Co-sponsor

Household size is not based on who lives in the same house. If you have no children and claim no one else on your taxes, then your household size is 2, you and your fiance(e).

You fill out the I-134 and provide most recent tax transcript, letter from employer and/or most recent pay stubs. Co-sponsor fills out their own separate I-134 and provides the same types of documentation, plus proof of being a USC or LPR. Any USC or LPR residing in the US that meets the income requirement for their own household size plus the foreign fiance(e) can be the co-sponsor. If the father meets the requirement, then he can co-sponsor. You just need to make sure he provides solid proof of his income.

How to count household size >

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or Form I-864 EZ,

So, if my father meets the requirements than he can Co-sponsor, so does the fact that his income comes from the Government and not from a job matter at all?

THANK YOU SO MUCH FOR THIS INFORMATION!! THIS IS GREAT NEWS!! :) Such a relief!!

Ok household size doesnt mean the number of people living under one roof. Household size is the number of people the sponsor has to support. You dont support your parents right? Then they are not included in YOUR household size. You only count those people you support in your household size. If its just you and your fiance, then your household size is just 2.

Yes typically you can use a co-sponsor, and they need to meet the poverty guidelines as well. You need to have 125% of the poverty level for your household size, the same applies to your co-sponsor if you use one.

Thank you!!!! :) this is awesome news!!

K-1 Fiance(e) Visa Process & ProceduresQuestions about Affidavit of Support/Co-sponsor

Hey guys,

I have some questions, hopefully you all can help me out.

I am the petitioner and I don't make enough money to support my fiancee according to the guidelines, however, I am completely confused about the Proverty Guidelines for the Household size.

I live with my family/parents still but I don't support the household. So would I still use the guideline for Household size #7 because I have 7 people living under the same roof as me (including my fiancee when she comes here)? Or would I use guideline 21 since its just me supporting myself with my job and then I would support my fiancee when she comes to USA?

Also, I don't have to support her on my own can I? I read from other forums here that you can have a co-sponser, how does that work exactly? Can i get my brother to support her? Or my father? However, my father is 100% disabled and gets income from the Government since he is a retired Vetern, can he still Co-Sponser with me for my fiancee?

Please help, I am just confused. lol.

Thanks.

K-1 Fiance(e) Visa Process & Proceduresquestion on travel after approval.

My fiancee is going into Miami, so she can spend a week with her sister.  Then she'll fly to me in WA.  So yeah, your fiancee shouldn't have any problems.  Best of luck to you both!

Thank you! :) Congrats on the approval!

The POE(Point of Entry) is the first place someone will go through US immigration. Someone with a K-1 visa can enter at any POE and travel anywhere throughout the US freely after that.

Thanks for the reply! :)

K-1 Fiance(e) Visa Process & Proceduresquestion on travel after approval.
Okay so I was thinking while I was in the shower (haha)

Not sure if this question belongs in this category but...

If my fiancee and I were to get approved--well WHEN we get approved (gotta stay positive!!) :]
Does my fiancee have to make her travel destination the address (City, state) where I live and
What's on the i-129F form?

We are planning to get married in New Jersey, so we decided she could travel to Philadelphia,Pennslyvania
Since it's cheaper flight and I meet her there and we go to Jersey to visit my extended family.

What im trying to ask is, the sealed package the benifiery brings with and will let the immigration
Services at the airport open, does that airport (city, state) have to be my address? Or can her destination be any US State??

Thanks!
-Kristin

I know I saw this question and answers before but I dont remember where so im asking it.

On the form, do I (the petitioner) check wholly or partically for question #8?
What does the Co-Sponsor check?

do we both do partically? or do I do wholly and he do partically??

Thank you!

K-1 Fiance(e) Visa Process & ProceduresQuestions regarding Co-Sponsor.

Hey guys,

I finally found a co-sponsor, knowing exactly if the Consulate we use will allow a Co-Sponsor, I'm not sure but I had some questions.

1. Does the co-sponsor have to have a copy of his birth certificate?

2. I read on other forums that there is a section (I think section 9) on the i-134 form that the Co-Sponsor fills out that he has to put down who wil be his dependents, obviously my fiancee will be but I read that I as well have to become his dependent and he has to meet the  income requiremets of dependents that includes Him, me, and my fiancee. Is this true? and can someone explain to me exactly how this works. Will he be claiming us on his taxes?

3. Since I don't have any recent taxes (besides 2013-started working in October) do I have to write a statement as to WHY I don't have any recent taxes? I've been in college and was unemployed in 2012 to half of 2013.

4. My uncle whom will be the co-sponsor made more income in 2013 than in 2012. Which tax return will he have to have a copy of, his RECENT as in 2012 or 2013? (since it is 2014). haha. I just want to be absolutely correct before I give him anymore information.

5. Any evidence of income will help with the requirements, right? So he can get a copy of his 1099 as part of his military benefit income?

I think for now that is all my questions, I'll do another post if I have anymore. I hope you guys can help.  :)
Thank you.

K-1 Fiance(e) Visa Process & Proceduresanother job
I had a concern, my recent employer wants to cut my hours down to part time, I already don't make enough as it is so thats why I have a Co-sponsor. She knows about the visa process and she did say she would wait to do any cutting until my fiancee has her interview next month. I don't want to believe her word and then she cut me out of nowhere before the interview.

So if I was to start looking for a job and I found one (hopefully full time) would my decision to quit and start that job asap mess up our visa process?

Could I still use my recent taxes/pay stub/letter of employment from her as well as my new employment documents once I get a pay stub from there?

I just don't want to switch jobs suddenly and it mess up this process, my worst fear is something going wrong during our visa process! :(

My point is, can I get another job during the visa process and before or even after the interview and it wont mess anything up????

Help!
-Kristin

Sounds like it was sent to the NVC so you can get your case number for the embassy / consulate.

Probably it is just slow update on the USCIS website or some glitch. Have you enter your receipt number in correctly? I've tried before to combining different numbers from my receipt number and the odd thing was I found different petitions from that.

When did you receive the NOA-2 hardcopy?

Dont remember exact day/date....it was probably about a week later. It didnt take long.
