You can send in the Federal Transcript and copies of the State tax forms. That is what I did. There is not a transcript for the State here that I know of.

My wife received her Biometrics appointment letter today for an appointment on 3/2/09.

Her daughter finally received her Notice of Action extending her GC for one year. I don't know why they waited so long to send her something. Her Biometrics letter should come within the next three weeks, I presume.

We are so happy that the process is working. Now to wait about 11 more months for the 10 year GCs.

Your case is similar to ours inasmuch as my wife's daughter did not receive anything for a long time. My wife received her 1 yr extension, and then the Bio appointment letter. Our daughter just received her 1 yr extension. Your son should receive his papers shortly.

I am confused as to why you may need to fill out a I-90. The instructions say:
If you are filing because:
• Your card was valid for 10 years and is expiring or has expired
• Your card was lost, stolen or destroyed;
• Your card is mutilated;
• Your name or other biographic information has changed since the card was issued;
• You have taken up Commuter status;
• You were a Commuter and am now taking up residence in the U.S.;
• Your status has been automatically converted to permanent resident;
• You have an old edition of the card;
Then your payment is the base application fee is $290 plus the biometrics fee of $80. Total filing fee = $370.


If you have reached your 14th birthday since the date your card was issued, your payment is the biometrics fee of $80 is required. The base application fee is not required if you file the Form I-90 within 30 days after your 14th birthday. Total filing fee = $80.

I think the bold part refers to the information above it. The I-90 is for a replacement card. If your son gets his card and it is correct, it doesn't matter what age he is.

Am I confused?

The USCIS representative told you your case was about to close. I presume you filed in Vermont. You just filed Jan 20, 2009. That would be great. You would be breaking ground since most of the others have had to wait almost a year. I hope they are speeding up. California is getting very fast.

Thanks for the explanation. I would put my real name on the form and put the mistaken name in other names used. I would also put an * by it and put a note with your cover letter explaining that it was a mistake and you did not catch it at first. Tell them it is not your real name. Hopefully, someone will read it and make sure your real name is put on the GC. It should be your real name anyhow because that is what you would put in the Name block. Good luck.

I am confused with your question. I female on a K-1 will enter the US in her maiden name and get married, usually taking her spouses last name. Then her passport will have her maiden name and the other documents she obtains after marriage in the US will have her married name. A male on a K-1, I would think would keep his last name when he got married. A k-3 is married in a foreign country and then comes to the US. The others I am not sure of. What am I not understanding about your question? \

On the I-751, put the present name and then list all other names used.

I would not wait to get started. Get the I-751, fill it out and get all the supporting documentation you can to prove you are happily married and living together....pictures, affidavits, bank statements, lease, mortgage, insurance (car, health, life), utility bills. Anything with both of your names on it.

Then include a fee waiver request with all the documentation you can get. Previous earnings statements and present statements to show the difference in salary. Cover all the points in detail as listed in the above reference from queendlee.

Submit everything in the same envelope, divided into two sections.

The I-751 is for removal of conditions on residence. It is not for AOS.
It looks like from what you said, ?Stiggy?, it looks like you will pay the filing fee of $465 for yourself. If one of your children came to the US within 90 days of you, you can pay for your biometrics $80 and $80 for your child. If the second child, your son, is coming in 5 months, then that is after the 90 days from when you arrived in the US, you will have to pay another filing fee of $465 and $80 for his biometrics.

At last, we are getting some things accomplished. My wife had her biometrics completed today. Then we went to FedEx to send her International Passport for renewal at the Russian Embassy in Houston. That will take about 3 months. All we lack is for her daughter to complete her biometrics next Tuesday. She is now in another state attending college.

We were getting anxious about my wife receiving her 1 year extension NOA and her daughter nothing. Now everything is in place. We will have our place in the long waiting line for the 10 year GC.

I am having surgery Wednesday for a blockage near my kidney. Hopefully, all will go well.

I don't know what has caused more tension, USCIS or the surgery. We have been just taking everything one day at a time and it is all working out.

If it were me, I would call the 800@ and explain the situation to them. They may move you up to a supervisor. I have been moved up several times with questions. If you don't get a good answer, call again. I have had to talk to them two or three times to get them to understand and give me a good answer. They can sometimes help you without going for an INFOPASS.

If all that does not work, then get an INFOPASS.

You have a 10 yr GC and are not supposed to have.

Be ready with all the forms and evidence to file for your 10 year GC when they tell you to refile. You have everything back from them without processing. Correct?

I would not get an attorney. What can they do that you can't do? You have all the information.

I would not keep the 10 year GC and do nothing until you file for citizenship. I would not take a chance on messing things up at this point. You have too much time and money invested so far. I would not play games with USCIS. They are too big for me. It is an error on their part and you need to get them to fix it.

Good luck with your decision. You are getting a lot of advice on here. This situation affects you both and I strongly suggest you try and correct it.

You need to read the instructions for the I-751. No financial information is needed. However, there is a pile of information you need to submit to prove your are and have been married and living together.

Yes and a lot more. They want joint documents, not just one person's name.

There is normally no interview for the 10 year GC.

As far as travel, I think you can leave up to 6 months. Someone can correct me on this.

I personally would not get an attorney unless it was something that I could not find an answer for by calling the 800#, getting an INFOPASS, searching on VJ, asking on VJ, doing a google search, etc. Good luck with your decision. OK, I am trying to prepare this form, and I have questions:
1. Do I fill in blanks with N/A, None, or just leave blank?

2.My fiancees city or town name is very long and when I put it all on there it prints out with a + over the last letter that fits, will this matter?

3.If I make more than whats needed for the poverty guidelines, I am military, but I still make 125%, what do I need to send as supporting documents? Do I still need the letter from the bank, and employer? I included my last 12 LES's(pay statements) and last 5 years of W2's.

4. I am deployed so I do not have other than my 2008 tax return available, is there a way to get copies? Ok just read, that I can get tax transcripts from the IRS, are they sufficient?

5. In the instructions for the I-134, it said include people I claimed in my tax returns for question 8, do I just put who is on my tax return or all 3 of my kids, I only claim 1.

Sorry, but I did not realize that people slammed the heck out of someone when they were trying to get information. I am sure we all have done things we are not proud of in our lifetime. There are three sides to every story: Yours, Mine, and the TRUTH. We have not walked in the other person's shoes and do not know all of the circumstances. That is terrible and I know nerve wrecking for you. You can only keep e-mailing and hopefully you will get a positive answer soon. No one knows what goes on behind those closed doors. They have not telephone number for the public to use. Have you thought of calling or writing your Congressman? It may help or it may hack them off at the CSC. Almost 5 months is a long time to wait for your NOA 2.

You may want to put a time-line in your signature. It may be helpful for us to respond to your questions in the future.

I don't know the answer to your question, but it takes time in this process. There are investigations to be completed, documents need to be reviewed, and a lot of waiting because of the workload. Your timeline will help answer your questions depending on when you submitted your documents.

Yes, it would be discussed in Russian. No, the attorney/lawyer would not have to understand the US Laws. He would only need to understand the content of the Pre-nup after it has been translated and certified. He should also tell her not to do it. He should just be able to understand what is written in the agreement. He should argue against her signing because it may not be the best thing for her. Then it would be great if she signs it. She would have a complete understanding of what she is signing in front of witnesses and them sign it also and it should be certified. I would think that would be a solid understanding of what she is signing and in her own language. Just my thoughts. Have a great weekend.

If you decide on a Pre-nup, you may want to have it prepared in the US. Then, send it to your fiancee and have them get it translated and certified. They should then get their own lawyer to explain it to them what it contains along with someone with a video camera taping the discussion. If they understands it and agrees to it and signs it, then you may have a solid Pre-nup agreement. They could not argue that they did not understand or you made her sign it.

These are the two questions I sent to the Embassy and their answers:

1. My fiancee has a daughter who is 20 years old that she wants to bring with her to the United States. Does she need to get a statement from her ex-husband giving his permission for the daughter to leave Russia for the purpose of immigration to the US?

Children older than 16 are not required to provide permissions to travel from their parents.

2. Is there a problem with a 20 year old coming to the US with her mother on a K-1 Visa? The daughter is listed on the I-129F.

Your fiancee’s daughter should receive her K2 visa before she overcomes 21

I called NVC and asked about Aging Out. The Representative transfered me to a Subject Matter Expert. She said do not worry about Aging Out. It does not apply to the K-2. I asked her a number of times and she was getting upset with me. She was nice and assured me it would not affect a K-2.

Maybe we will be all right if we ever get an interview date. Ones with numbers before ours and after ours are scheduled, but not us. :angry:
