From what I have read, it can take several hours depending on the number to take the oath. I would just plan on at least 3 hours and be happy with less. It is a one time event, so don't miss it. Good luck. I think they take applications for passports, but I remember from some reason it is better to wait.

I don't know for your particular office, but ours is only open Mon thr Fri. Our office will only do biometrics on the day of or later. They will not do it early. Other offices do it early. There is no phone number for local offices, you have to go in person. You should get an INFOPASS to make an appointment, unless you go on the day of your biometrics.

Can you go on the appointed date without your husband? He does not need to be there. All you need, if I remember correct, is you Biometric Letter and your Green Card.

Why are you worried about a 2003 DUI, if it happened before you got your 2 year GC and then received your 2 year GC?

Did you just get a ticket and pay the fine? Did you go to court and put in jail? What were the circumstances?

Unless you have a special case, I do not recommend an attorney. You can do it yourself. It takes extra time to put all of your information on a form for them to take the information and put it on the USCIS forms. It takes the same amount of time to gather all the information.

I suggest you download the forms and instructions from the USCIS website.
Read the Guides above on VJ.
Start filing out the forms.
Ask questions on here for anything you need to get a better understanding.
Search the forums on VJ and see what others have submitted.

Just my opinion, but I have done everything myself and have not had a problem yet.

In submitting the N-400, I will send in the IRS tax transcripts for the last three years. Should I include the last three years of State Income Tax forms? We do not have transcripts, so I would have to copy about 6 to 10 pages of the copies we submitted for the last three years.

I had the same thing happen with the same dates. I called USCIS and the girl said I would have to wait 15 days and then call back and they would mail me the RFE letter again. I asked her to connect me to an Immigration Officer. She said she would, but I would get the same answer.

I got connected to a nice man and he told me that the N400 was new to the tracking system at USCIS. He said the letter online was for the Biometrics. He said that was what was automatically generated and they were aware of the problem. He doesn't know when they will fix it.

It really scares you when you get the Biometrics letter, register on USCIS, and then see the RFE letter they said they mailed you and you never received it. It states they need additional information which is in the letter they mailed you and if you do not comply, your case will be closed. It also states your cases is suspended until you send in the requested information.

I hope I can believe the IO and it is only their attempt to say you have to comply with the Biometrics appointment.

Welcome to VJ.

Timing is different for everyone. Normally, you get your Biometrics (Picture and Fingerprints) within a month of submission of the N-400. Then another 3 to 6 months for the interview. The oath may be the same day or 2 to 6 months later depending on where you are. You can look at other peoples Timelines and get a better idea.

I our case we will have to travel to New Orleans for the interview and then have the oath ceremony in Jackson, MS later.

I don't know about St. Louis. I don't know if anyone knows the approval percentage other than USCIS. If you submit what is requested and take all your original and additional information to the interview and you have not been fraudulent, then everything should be all right.

Did you file a change of address with USCIS? If you use your college address, you had better file the CoA. I think you have t 10 days to file after you move. I believe you do not have to file one if your move it temporary.

Is one of you at college and the other at your normal residence?

I am not sure which guide you are speaking of, but if you search on USCIS for the M-476, you need to go to the back of it where it starts the M-477. That is the instructions for filing the N-400. There are a lot of "and" and "or" that you have to look out for. I hope this helps.

There are a lot more things listed in the M-477 than what you intend to send. You have to include what is asked for in your individual case. I think there are two pages of instructions. In our situation, we only used what applied and it was all on page one.

We send in the last three tax transcripts you can get free from IRS. The phone works 24/7.

PJ, I called USCIS and the girl told me that if the spouse and child received their 2 year green card on the same day or within 90 days of each other, the child could be listed on the I-751 with the spouse. She told me to search on their web site for a reference. She would not give me one. I did search and found this:

Sec. 216.4 Joint petition to remove conditional basis of lawful permanent resident status for alien spouse.

Dependent children of a conditional permanent resident who acquired conditional permanent resident status concurrently with the parent may be included in the joint petition filed by the parent and the parent's petitioning spouse. A child shall be deemed to have acquired conditional residence status concurrently with the parent if the child's residence was acquired on the same date or within 90 days thereafter. Children who cannot be included in a joint petition filed by the parent and parent's petitioning spouse due to the child's not having acquired conditional resident status concurrently with the parent, the death of the parent, or other reasons may file a separate Petition to Remove the Conditions on Residence (Form I-751). (Amended 5/23/94; 59 FR 26587 )

I don't know if this will help you in your situation or not. I hate that your son's got denied because he was over 21. I know that is wrong. I am going to submit the above reference in my cover letter and put my step-daughter in item 5 on the I-751 when we file.

My fiancée and step-daughter arrived together in the US. My step-daughter will be 22 when the I-751 is filed. They both received their green cards at the same time. I am trying to fill out the I-751 form and have some questions.

1. In Part 5, I-751, it asks that all your children be listed. My wife has a 27 year old son who lives in Russia. I presume we will list both of her children. On the line with her son’s information, we would only list his name, Date of Birth, and “NO” in the Living with you column.

For her daughter, we would list her name, DOB, A#, Address. What is the immigration status? Is it Legal Resident? And then list “YES” for living with you.

2. In the instructions, it states that any resident children should be included in Part 5 or they may file separately. When does a resident child have to file separately? My step-daughter was 20 when she got her green card.

3. Are there any references that can be cited? I can not find any information on the form, instructions, or in my searches.

eau_xplain is correct. Include your daughter on the one I-751. One fee and two biometric fees.

The conditional resident signs the I-751 and the US citizen spouse signs. There is no place for the child to sign.

What is affected by my step-daughter moving to another state to go to college? Can she still be included on the I-751 with her mother since they both arrived in the US on the same date?

I know that if she was still living with us, her mother and her can be put on the same I-751 with only one processing fee and two biometric fees.

I can't find anything about this anywhere. Her mother and I are very concerned. I know there must be other instances of this and also for a child to get married before filing for the 10 year GC. Anyone know of any references?

I would say yes. My son, adult, living at home, wrote one. I do not see where it is prohibited.

The instructions say "The original affidavit must be submitted and also contain the following information regarding the person making the affidavit: his or her full name and address; date and place of birth; relationship to you or your spouse, if any;"

There were other affidavits submitted who were not relatives.

I sent copies of credit cards and bank statements without deleting any numbers. The numbers of your bank accounts are on the statements. The numbers on the credit card are the same with each of our names. I have not had a problem. That doesn't mean I won't have one. To me, if you black out the numbers on your credit/debit cards, then how are they going to know it is a joint account.

My step-daughter was 22 when we applied (see timeline below) and found out a week later she was going to get married in July this year. She will be 23 in May. I am not aware of any "aging out" for K-2's. She was under 21 when she arrived in this country and when she was was given her K-2 visa. As long as she was a legal K-2 and arrived at the same time as her mother, then she can be on the I-751 with her mother.

She is also in another state going to college and she changed her address. I don't think that will be a problem either.

Removing Conditions on Residency General DiscussionHow should we package our I-751?
They used to have instructions on the USCIS web site on how to assemble the K-1 package. I can't find it now, but it may still be there. Basically, ACCO fastener at the top. I put a piece of cardboard (folder) at the bottom of the package and clipped all the papers above it. On top was the cover letter with an envelope with the check inside on the very top. I wrote on the envelope what the submission was for and the amount of the check. Then I put a clear piece of plastic on top of the whole package. I also put little tape tabs (Post-it Flags) on the bottom and numbered them the same as my table of contents. It made a nice package.

Good luck with yours. I have read of people using rubber band, large clips, notebooks, folders, etc. I don't think anyone has been denied on how they sent their package. It would be nice if someone could find the page on USCIS and post it. Thanks.

We got the NOA today with the one year extension. kicking.gif We are very excited about it. Only one week from when they received it in Vermont.

Why does this NOA say if you have not already done so, provide supporting documents to assist USCIS in processing your petition.......then they list lease, joint ownership of assets, tax returns,etc. That is what was included with the I-751 filing and you needed to submit these documents with the I-751?

Can't tell from you post which ACS office you are talking about. They are all different with different procedures. In mine, you cannot have your biometrics done early. They tell you to come back any Wednesday??? after the initial date. Just my experience. Hope you got it done.

I don't have a personal experience, but you should not have any problems with your expired GC and you 1 year extension letter returning to the US. I am sure someone has an actual experience. Customs is aware of the NOA, 1 year extension letter. It will be the same as if you were traveling with your GC and it was not expired. My wife has returned home twice with her GC. Good luck.
