Removing Conditions on Residency General DiscussionShould I hire a lawyer to be safe?
I am sure you have other information available. I would suggest you start on this page and check what people have asked. Go back about 15 -20+ pages. There are a number of posts about documents to include. See what others are sending and I am sure you will find other things to include.

Maybe 2006 Tax Transcripts. Copies of both DL to show same address. Maybe prepare a lease or get receipts for rent.

Good luck.

I don't know why they took away his GC. It is still valid for about 90 more days. USCIS can do what they want to do.

Glad everything is going good now. Good luck in the future.

I disagree. I think you should send everything you can to prove a valid, happy marriage. I have spend far too much money and time to get to this point. If they use it fine; if they do not use it fine. At least they have everything I can send to include pictures which are not required. Just my opinion.

Removing Conditions on Residency General Discussionneed help
Look under Example Forms above and there is an example. We typed our own. You shouldn't have to pay to have it done. Just use the format example and have someone write what they want to say about your wonderful marriage and they can type it or you can type it. You can have it notarized at your bank or their bank.

Good luck.

you'll notice the I-751 doesn't even ask for your telephone number)

On the I-751, you will notice at the bottom of Part I, they do ask for your phone number. At least on my I-751, they do. I still recommend calling. You may even want to write USCIS Service Center referencing Case #, A #, etc and give them your new phone number.

Good Luck.

Removing Conditions on Residency General DiscussionQUESTION?????
I don't think anyone has looked at your file at this point. There are certain things that are automatic when you send in your case. Is it timely? No, then they return your case. If Yes. Then someone will send you the NOA for the one year extension. Next, someone will send you the letter for the biometrics appointment. When that is completed, someone will probably put that with the case and then it goes on a shelf or drawer until an immigration specialist reviews your file. That part is what takes so long. If not all right, then you get an RFE. If it is all right, then they approve your case and send you a letter of approval and order your 10 year GC.

No one knows for sure, but that is the way it looks to me. Good luck.

Go to My Assistant at the top of the page and fill in your Timeline.

Removing Conditions on Residency General Discussionaffidavits sworn by two people
can someone give more a better example than the one given by the instruciton letter? What should it contain and how do i give evidence to support it? I will be using my father and my uncle.

Go above and click on Example Forms. There they have 2 examples of Affidavits. You don't give evidence to support the affidavit. You father and uncle will write the affidavit to say how happy a couple you are and what a great marriage you have, etc.

You may want to check and see what others have sent in with their I-751. You can go back 10 to 20 pages and open the posts that are appropriate. There is a wealth of information on here. I bet you will find things that you have not thought about.

Good luck.

Mail a copy of the AR-11 with receipt number to the service center. VSC? Reference your case number and A #. Add a note about checking status.

Call the 800 number and ask for a service request and give them your new address.

Just filing an AR-11 does not guarantee that it will catch up to your case.

If you meet all the requirements for citizenship, you can apply while your I-751 is pending. It will not be processed until your I-751 is approved, but it will, supposedly, get your I-751 on a faster track. I hope this helps.

I found out through the Representative's office and USCIS 800# that my step-daughter does not have to attend the interview. We just need to follow the instructions in the Interview Notice. Great news because she is in Oregon attending the University and it would have been another expense to get her here for the interview.

Should I be worried about the last statement about possible video taping the interview? Is this normal on an interview letter? USCIS said this was a normal statement, but we are still concerned.

Why bring 2 passport photos? She just had her biometrics with pictures March 2, 2009.

Thanks. We are both a little concerned about this. I hope there is not any problem with our case.

Kathryn41, gave the following response from the second post: Thank you Kathryn41
Videotaping interviews is quite normal and nothing to be alarmed about. That is a fairly standard phrase to cover them if they do tape. There is a chance that they won't be taping as well - it doesn't really mean anything to worry about.

Bring the two passport photos - they may want ones that are more recent than the ones from the biometrics (or they may not, too - you may end up taking them home also )

Bring the originals of everything you submitted with the original I-751 plus bring originals and copies of documents that cover the time from when you submitted the application to the time of the interview. You can offer the copies to them to keep in their files. Bring the other items that they mention - tax receipts, lease or mortgage, etc. - the originals if you have already submitted copies, or copies and the originals if you haven't. You can order in the most recent tax transcripts for 2008 by calling the IRS. Try to bring a variety of different types of documents showing how you are mingling together your financial, social and personal lives. The more the better.

I wouldn't be worried too much. USCIS is required to have a certain number of interviews for statistical purposes which means that there is nothing out of place about your file and you just have the luck of the draw. Or, there may be something minor - you didn't sign where you were supposed to or something like that and they will take care of it at the interview. This is a standard interview letter, not a special one, and is designed to cover a lot of different reasons for having an interview.

Good luck.

Removing Conditions on Residency General DiscussionUSCIS Information
I called USCIS again on August 7, and the lady put in a service request. She said I should hear something within 45 days.

Today, I got an e-mail:

Type of service requested:
-- Outside Normal Processing Times

The status of this service request is:

Our computer systems show that your Petition to Remove Conditions on Residence (Form I-751) is still pending United States Citizenship and Immigration Service consideration. For case status and processing times please visit our web site at www.uscis.gov.

Please remember: By law, every person who is not a U.S. citizen and who is over the age of 14 must submit Form AR-11 AND notify this office of their change of address, within 10 days from when they move (persons in "A" or "G" nonimmigrant status are exempt from this requirement). To notify this office of a move, visit our website at: www.uscis.gov or call the National Customer Service Center at 1-800-375-5283. Instructions for filing the Form AR-11, including mailing instructions, are included on the Form.

Thanks for the information. What an insight! I am learning so much from and about USCIS. I have been looking at the USCIS website and nothing has changed since the initial submission. I was under the impression that a Service Request may actually get the case moving a little since it is outside normal processing times. Now I can just sit back and relax. I know it is still pending. ranting33va.gif ClockWatch2.gif

Removing Conditions on Residency General DiscussionUSCIS Information
I called today to USCIS since we have not received anything from them in over 6 months. I checked the automated system and put in our Reference number. The recording could not find my wife's case. I called back and talked with a Customer Service Representative. He could not find anything on our case. We have the NOA's for the 1 year extension and the Biometrics. He transferred me to another representative. The man did find our case online and said that it was still pending. He assured me that a RFE had not been sent and additional Biometrics were not sent.

I asked him why the telephone could not find the case and the first CSR could not find the case. He said the first person I talked to was a contractor with limited information access. He said he was a federal employee of USCIS and had access to more information and that is why he was able to locate my wife's number in the system.

I only hope he is correct in that there has not been a RFE or additional biometrics needed.

I told him that there was a number of cases that were submitted in January, February, and March to VSC and they had been approved. He just told me that a lot of cases were pending now. There was a time when people had to wait 2 years for approval.

I thought this was very interesting and seems to explain a lot to me. Hopefully, it will give a better understanding to others.

Removing Conditions on Residency General DiscussionCan I expect updates on my online status between now and biometrics?
How are you checking your status online? Most of us have to have our biometrics done and then use the Receipt Number from the biometrics in order to register at USCIS online. At least that was the case for us. We could not register using the Receipt Number on the one year extension NOA.

Once you are registered, then you just sit back and wait for a touch or RFE or interview notice.

Good luck in your journey.

I have a few questions. My wife's daughter is in Oregon attending the university there. She is on the I-751 petition with my wife. Since the letter only tells my wife to bring me, then I am not going to worry about her daughter having to fly home for the interview. Is this reasonable?

Should I be worried about the last statement about possible video taping the interview? Is this normal on an interview letter?

Why bring 2 passport photos? She just had her biometrics with pictures March 2, 2009.

Thanks. We are both a little concerned about this. I hope there is not any problem with our case.

Removing Conditions on Residency General DiscussionAny I-751 VSC filers not approved from Jan 09 and before?
Thanks Darcy. My wife is really upset over finding out her case has been transferred to NO. She thinks something is wrong with the case. I hope not. All we can do is wait and start getting everything together for a probable interview. I am not aware of a Field Office approving cases without an interview.

I called the Representative's office back. I told her that my wife will be leaving the country in a few weeks for a month and my step-daughter is in Portland at the University. She said to wait until she hears back from NO. She has sent them an e-mail. She is fast.

I hope if there is an interview and my wife is out of the country, that it can be scheduled before she leaves or after she returns. I still don't know about my step-daughter. If she would have to come home to be at the interview or have hers in Portland.

I think I am getting a little upset myself. Anyone know anything about a case transferred to a Field Office? Why? Interviews with K-1 and K-2 in different locations?

Thanks for any help.

Removing Conditions on Residency General DiscussionAny I-751 VSC filers not approved from Jan 09 and before?
Update: The lady just called from the Representative's office and said our case has been forwarded to the New Orleans, LA Field Office. She did not know yet when it was sent there. I presume it is for an interview in the future. At least it is moving. I really don't want to go to NO, but I know we will have to. I am going to have to find all of our information and gather up new evidence and pictures for the interview.

My step-daughter is in Portland going to the University there. I hope she does not have to fly home for the interview. Maybe her part can be done in Portland. Does anyone know anything about how this may work?
John24689MaleRussia2009-08-26 13:15:00
Removing Conditions on Residency General DiscussionAny I-751 VSC filers not approved from Jan 09 and before?
The USCIS states on their website: "If at any point your case is outside our normal processing time and you haven't received a written decision or update from us within the last 60 days, you can help us by calling Customer Service at 1-800-375-5283 and letting us know. We will research your case, see what needs to be done to get it processed, and get back to you with an explanation."

We requested a Service Request and received and e-mail which stated: "On 08/10/2009 you, or the designated representative shown below, contacted us about your case." "Our computer systems show that your Petition to Remove Conditions on Residence (Form I-751) is still pending United States Citizenship and Immigration Service consideration. For case status and processing times please visit our web site at www.uscis.gov."

We already know it is pending by looking on the USCIS website.

This morning, we went to our Representative's office. The lady took our information and immediately called USCIS and left a voice mail. She will send a letter and an e-mail to USCIS requesting the status of our case. She said to call her back Friday. I doubt she will have any information then, but I will call.

Now, to sit back and wait. We want to be sure there has not been an RFE sent and we have not received it. We can wait our turn in line, but it is hard when we filed in January and there are cases being approved in Feb, Mar, and Apr.

Good luck to all that are waiting. Our time will come, it is only a matter of when.

I keep seeing Feb, Mar, and Apr 09 filers who have been approved. We have received no e-mails and no updates on the USCIS site. No RFE either. I was under the impression they worked these cases in order. We are beyond the 6 month processing time for VSC. I saw another case approved from Sep 08. I know our turn will arrive one day, but when? When they are ready!!!! Good luck to all who have not been approved who have filed last year and earlier this year and have not been approved.

Just wondering how many others are waiting outside the 6 month processing time.
