Here is the law. It says to me that the parent and child or children can all be on the same I-751 if the conditions are met, otherwise, they have to file separately.

Sec. 216.4 Joint petition to remove conditional basis of lawful permanent resident status for alien spouse.

Dependent children of a conditional permanent resident who acquired conditional permanent resident status concurrently with the parent may be included in the joint petition filed by the parent and the parent's petitioning spouse. A child shall be deemed to have acquired conditional residence status concurrently with the parent if the child's residence was acquired on the same date or within 90 days thereafter. Children who cannot be included in a joint petition filed by the parent and parent's petitioning spouse due to the child's not having acquired conditional resident status concurrently with the parent, the death of the parent, or other reasons may file a separate Petition to Remove the Conditions on Residence (Form I-751). (Amended 5/23/94; 59 FR 26587 )


Ken and Inna, I don't know why your files got processed the way they did. I thought your wife and step-daughter should be in the same file. It is probably too late, but you could have filed an I-90 to get another GC for your step-daughter due to USCIS error. No cost.

If you haven't returned the I-751, I would call the 800# and get and INFOPASS and explain the situation. I do not understand why they did not have the same dates on both GC's.

Good luck and let us know what is happening. Both my wife and step-daughter were issued GC's the same day and are both on the I-751.

They should file the AR-11 online and get a confirmation number. I am sure they missed the 10 day requirement, but it is best they do it now. There is not a date of moving to be filled out on the AR-11, if I remember correctly.

If they are filing while living in NJ, I would not even think of putting a CA mailing address. That would raise a red flag. They should put the NJ address.

When filing the I-751, I would suggest sending a copy of the online AR-11 with the confirmation number. I know that the NJ address would be on the I-751, but it is different from when they filed the I-130. If the AR-11 is not included, then it could cause problems because of the previous CA address.

Just my opinion. Good luck to them.

I suggest they register on VJ and fill in a timeline so it can be helpful in answering questions. If not, they maybe you want to fill in the timeline for them. It is nice that you are trying to be helpful.

Point to be made. The K-1 and K-2 are non-immigrants and not immigrants.

One reference is on the instructions for the I-129F. Filing Limitations on K Nonimmigrant Petitioners

Immigrants come into the US on their own through other procedures. K's are Nonimmigrants.

Someone correct me if I am wrong, but I don't think so. I learned this a few years ago and then knew the difference.

It looks like you have to file 90 days before 6/19/09. You have time to get the IRS transcripts which can be ordered over the phone on their 800#. Also send copies of the state taxes - all forms.

We sent affidavits and pictures since our wedding. You can send copies of the personal letters also. Copies of passports are not necessary.

I suggest you read the instructions for the I-751 very closely and make a list of what they suggest. Don't forget the copy of the GC, front and back.

I would also suggest you search through VJ and find what others have submitted. Joint checking and savings accounts, lease/mortgage in both names, utilities & phone in both names, life, health, investments in both names. There will be things that you have not thought about. We searched and added a few more things.

Most I have seen want to see more evidence about your marriage. You can appeal a denial. I have not heard of anyone being deported, but it is possible. If you have a bona fide marriage and enough evidence submitted, then I would not worry about it. Just wait and see.

It looks like you just filed the I-751. If so, you may want to search VJ and see if others included evidence you did not include. Then you can start collecting it in case you get a RFE.

I don't think you did anything wrong. I would get an INFOPASS and call the 800#. Explain to them the situation. You will need to file a separate I-751 for your daughter when the 90 day time period comes. It is too early now.

Search this forum and read what others have submitted. Download the instructions and form from USCIS website. Start making a list of what to submit and start getting the documents together. I just submitted ours and I am still finding things I could have sent by reading what others on here have submitted. Read, read, read. Then ask questions. Start filling out the form now so you can get your questions answered before the last minute. You can submit the package 90 days before the expiration date on your GC. Not 91, but 90 or less.

The I-751 instructions say:

5. Affidavits sworn to or affirmed by at least two people who have known both of you since your conditional residence was granted and have personal knowledge of your marriage and relationship. (Such persons may be required to testify before an immigration officer as to the information contained in the affidavit.) The original affidavit must be submitted and also contain the following information regarding the person making the affidavit: his or her full name and address; date and place of birth; relationship to you or your spouse, if any; and full information and complete details explaining how the person acquired his or her knowledge. Affidavits must be supported by other types of evidence listed above.

I do not see where it says no relatives or you have to be a USC. It does not require you to put your citizenship, only your place of birth.

Please share where you find that it is best for a USC and should not be a relative. I send an affidavit from my son who lives with us. I personally think the more affidavits, the better. Not just two, but three, four, or five. It can't hurt.
