K-1 Fiance(e) Visa Process & ProceduresFilling in G-325A and I-129F
Hello everyone,

We are just going to file for K-1, and would like to do everything correctly right from the start to avoid losing time with RFEs....hence the questions:
1. G-325A: Employment and residence in the last 5 years: Should the EARLIEST date be exactly 5 years ago? For example, if I moved to an address in 2000, shall I put Jun 2000 or just give them the five years only and cut it to Apr 2005? Same with the employment dates...
2. G-325A Employers addresses meaning number, street, city , country, or just city, country?
3. I-129F Question 13 - Children - Present address - same question - just city, country, or full address....Am asking that because they do leave way too little space for the answer if they want full addresses
4. G-325A: if the answers don't fit in the box, use additional sheet... - One question=One separate additional sheet? Three questions=Three separate additional sheets?? :unsure:
5. Four copies of G-325A = Four copies of all additional sheets?? :bonk:
6. I-129F - to staple or not to staple the 3 sheets together?

I know it might sound like I'm going into TOO much details :wacko:... but we just really would not like to take any chances of our case getting 'stuck' due to some tiny thing. Thank you for your time in advance. :)

hi there,

I'm afraid she will have to return to China anyway, she will need to get a certificate from the police at a later stage - need that for the interview :yes: - and after doing some online reading, I haven't found anything saying she can apply for her K-1 from abroad... Plus, if you file your petition now, that puts you somewhere around October for the interview - will she still be in Australia? And which address are you putting on your I-129F and G-325A for her? The Chinese one or the Australian one? :wacko: Frankly speaking, I'd advise you to email American Embassy in China and ask them if you don't get any comprehensible reply here - they are usually helpful.... if they ever reply :whistle:

bnjmn,

pushbrk obviously meant the Instructions to I-129F downloadable from USCIS official site , from the same page where you download the I-129F itself. You were talking about the K1 Step-By-Step Guide here on VJ.
quoting the official instructions for you once again:
Make the check or money order payable to U.S. Department of Homeland Security.
If you live in Guam and are filing your petition there, make it payable to Treasurer, Guam.
If you live in the U.S. Virgin Islands and are filing your petition there, make it payable to Commissioner of Finance of the Virgin Islands.
NOTE: Please spell out U.S. Department of Homeland Security; do not use the initials "USDHS" or "DHS."
Notice to Those Making Payment by Check. If you send us a check, it will be converted into an electronic funds transfer (EFT). This means we will copy your check and use the account information on it to electronically debit your account for the amount of the check. The debit from your account will usually take 24 hours, and will be shown on your regular account statement.
You will not receive your original check back. We will destroy your original check, but we will keep a copy of it. If the EFT cannot be processed for technical reasons, you authorize us to process the copy in place of your original check. If the EFT cannot be completed because of insufficient funds, we may try to make the transfer up to two times

I sent my docs and passport sized photo from Russia to the USA by UPS - $70 and three business days with possibility of tracking your envelope online. Thinking Italy is closer, the price should be lower... Good luck.

why can't I edit my own post? :unsure:

Mark-2010,

I thought that probably you were asking the uscis site address as well. It's www.uscis.gov.

To track your case, see Check My Case Status in the left column of the Home page.

Good luck.

how can u guys check online for the NOA1?

I think you need a receipt number to do so right?

Nope. You need to contact your bank, they can see the number you case has been assigned by USCIS, on the reverse side of the cashed check, online. Maybe you can do it on your own. The case number starts with three letters, WAC, for example, and 10 digits.
After you know your case number, you can go to uscis site and track the changes in the stages your case is currently at, online.

Good luck

Khandog25,

They created two more centers for processing some forms. Starting mid-May, part of petitions will be redirected to TX and AZ. Yours has been redirected to TX, apparently. Hoping, this measure will make the wait shorter.

Official info from News page of USCIS site:

WASHINGTON - U.S. Citizenship and Immigration Services (USCIS) today announced that it will be transitioning the intake function of several more forms from the Service Centers to its Lockbox network. By centralizing form and fee intake to a Lockbox environment, USCIS will improve consistency and integrity in the intake process.

The forms scheduled for the transition:
I-817, Application for Family Unity Benefits (If filing under section 301 of the Immigration Act of 1990);
I-526, Immigrant Petition by Alien Entrepreneur ;
I-539, Application to Extend/Change Nonimmigrant Status (Only those filed separately from the I-129);
I-129F, Petition for Alien Fiance ;
I-140, Immigrant Petition for Alien Worker.

The transition will start mid-May with the Service Centers forwarding applications to the USCIS Dallas and Phoenix Lockbox facilities for processing. In June, USCIS will post the revised filing instructions, update the web page for each form, and announce the address change with a USCIS Update.

Throughout the transition period and up to the point where USCIS formally announces the new filing addresses, customers with concerns should contact the National Customer Service Center at 1-800-375-5283.

K-1 Fiance(e) Visa Process & ProceduresTraveling today!!
Hi there,

1) why five? you'll need one
2)U.S. Citizenship and Immigration Services is USCIS,
so it's variant a) without USCIS bit
3) you'll actually need one. But take all of them :)

As for Letter of Intent, as well as other docs, here's one piece of advice. Take lots of BLANK sheets of paper and have her sign them in the places where her signature would be in different forms or letters.

If by the time you are ready to file, some address changes or you reread a filled in form and see a typo or something, you'll just print another one on an ALREADY SIGNED sheet. :blush:

K-1 Fiance(e) Visa Process & ProceduresK-1 Documentary Proof of Having Met in Person in the Past Two Years and an Ongoing Relationship

In #2 of the step by step guide, it states, "Color Photo's of you and your fiance(e) together. Make sure you write your names, date, and location on the back of every photo."

Does this require BOTH of us to personally write our names on the back of each of the photos?

Gosh, no :) They just want to know who is in the photos and where and when the photos were made. Like, 'Jack and Jill at Jill's house in Madrid, Spain. Sep.10th 2010" or 'Jack, Jill, and Jack's friends from college at Disneyland, Paris, France. Oct. 7th, 2010" Relax, it's simple, it's all gonna be fine, just don't overreact :)

K-1 Fiance(e) Visa Process & Procedureswho can translate letters my fiance sent me?

Thank you for the information. Somebody who had a successful K-1 in the past told me this. My fiance is a professional translator, but I did not want to find out the hard way that she was not allowed to do this, so she had another translator sign off on them.

This is good to know.

You are more than welcome. I am also a professional translator, and a K-1 holder. Just for your information: when after you marry your fiancee you will be filing papers for Adjustment of Status, the translation requirements will be the same: she CAN do everything on her own, and you do NOT need a single notarized or officially certified copy of anything. Just read instructions to each form (at uscis website)and follow them :)
Good luck with your visa journey.... and I can feel NOA2 in the air for you , somewhere very close :thumbs:

K-1 Fiance(e) Visa Process & Procedureswho can translate letters my fiance sent me?

I don't think the petitioner or the beneficiary can be the translator. I may be wrong, but I don't think I am.

You can still do the translation; just get another bilingual person to sign off on them.

I am sorry , but you are wrong on this one. Absolutely anyone can be the translator. I (beneficiary) personally did all my translations myself and certified them according to the standards, and I know a lot of people who did the same. No problem at all.

It does NOT have to be a professional at all, you can translate them yourself. Same with official documents like Birth Certificate etc, you translate them yourself and just type in the bottom of EACH page of the translation :

I [typed name], certify that I am fluent (conversant) in the English and ________ languages, and that the above/attached document is an accurate translation of the document attached entitled ______________________________.

Signature_________________________________
