I'm planning to file at the end of this month to remove conditions from my husband's residency. I am planning to include the following documentation:

• Copies of the passports and green cards of Rahmatulah Wahidi.
• Copy of the tax statementS for 2011 and 2012, which we filed jointly.
• A letter from my 401K provider stating that my husband is the beneficiary on my account.
• Letter from my company of the designation of my life insurance to my husband.
• Copies of various car insurance notices.
• Copies of auto loan statements, showing that we are both named on the auto loan.
• Copy of our MasterCard Cards showing a joint account.
• Copy of our American Express Cards showing a joint account.
• Copies of the last 6 months’ bank statements from our joint checking and savings accounts.
• A copy of our airline reservations for a trip that we took in March to Las Vegas.
• Letter from my physician stating that we are expecting our first child August 1, 2013.


Do you think that is enough? Do I also need to send photos? I am missing anything important?

Any advice is greatly appreciated! Thank you!



Looks like more than enough. I submitted less documents and my application was accepted. I think your life insurance is the killer of the killer, especially if the amount is sizable and your husband is the sole beneficiary. Good luck!

Dear VJ family,

My husband is working on his Master's degree and he has been receiving financial aid for the past year and a half. I have been out of the country for almost a year, which means I did not earn any income within the US.

Should we still file for taxes? What is your advice?


I was in a similar situation. My wife and I didnt file any taxes while living abroad. We contacted IRS and were directed to their website. If you made less than the required amount, you don't have to worry about filing taxes. Good luck!

Removing Conditions on Residency General DiscussionSTILL waiting for 10 year permanent green card...should I worry???

My 2 year temporary Green Card expired in August 2012. In July 2012 I sent in my application for "removal of conditions on Residence" on the I-751 Petition. I was contacted VERY quickly to have my biometrics taken (within a month). At the time, the Vermont Service Center said it was an 8 month waiting period compared to that of the national average of 6 months. NOW the USCIS site says 8.9 months waiting periodfor Vermont and that some cases in Vermont were switched over to Nebraska because of a case "overload".

I guess my question is this.....HOW LONG DOES IT TYPICALLY TAKE AFTER BIOMETRICS WERE TAKEN...TO GET THE PERMANENT, 10 YEAR GREEN CARD. I know it's not technically 8 months yet but since they only send it regular mail, I'm starting to worry maybe we missed it???

Any help or feedback would be deeply appreciated!!!



Look at my timeline! Mine took about 5 months. I submitted my application to Vermont center. There is no way to know the processing times for sure...wishing you good luck.

Removing Conditions on Residency General DiscussionHELP! My wife stuck in Brazil airport (TAM/Rio) with an extension letter (non-original)

Hey everyone--

TL;DR: Help! My wife is stuck in Rio with an expired greencard and a copy of her extension letter. What do we do?

My wife is currently stuck in Rio (not her departure city) because a TAM employee at the gate wouldn't accept a greencard and a *copy* of the extension letter. From other posts, it seems we messed up. She should have had the original extension letter though that may not have worked.

The airline is sending her to the consulate in the morning. Looking around a bit, I found something on the Brazilian embassy site that says anyone who is "removing conditions" needs to get something called a "boarding foil" (formerly a "transportation letter") if they want their airline to let them leave Brazil. I think this is what they are sending her to get.

(Warning to others: this contradicts many posts on VJ saying a green card and an original extension letter are fine.)

Worse, the site says it may take *5 days* to verify your immigration status and give you a "boarding foil". This is insane. LINKbrazil.usembassy.gov/immigrant-visas/other-services/transportation-letter.html (I don't have permission to link yet, I'm a new user)

Five (business?!) days is totally not okay for us. So I'm wondering if there's anything we can ask for that will speed this up.

Questions:

A. Has anyone been through this "boarding foil" process in Rio (or Brazil)? If so, could you describe what happened and what the time frame
was? Has anyone talked their way through this with the airline after running into a similar barrier?

B. Do airlines have any ability to verify immigration status electronically? Can we put down a large deposit covering the cost of her return if she's sent back (which we know she won't be)?

C. Is the following our best plan?

1) Visit the consulate in the morning and see what they say (particularly re: wait time)
2) If the turn around time is more than two days AND the airline commits to accepting the original extension letter, consider Fedexing the original (which can arrive in two days).
3) Keep pestering to get the airline to accept a copy of the extension letter, or give us another option (though I'm not sure what else we should be asking them for).

D. Does anyone have any other suggestions or information on what to expect?

I was in similar situation back in 2010. I wanted to travel back to USA with an expired GC stamp in my passport (extension of my conditional GC)and a USCIS letter stating that the conditions on my GC were removed. First, most airlines refused to sell the tickets to me. I finally found one airline that sold the tickets, but the security at the airport refused to let me board the plane. They asked me to come with them to an office to "calm" me down. We talked about the situation in the office and they explained to me that any airline that takes me to the USA will have to pay 40.000 dollars as a fine for bringing someone without proper documentation + possibility of fine, imprisonment and/or removal from USA for failure to travel with proper documentation. The letter that I had stated that I shouldnt travel outside USA. I traveled before receiving it with my valid GC stamp which expired when I was abroad. A friend scanned the removal of conditions letter and sent it to me.

So the security kept calling the US consulate for instructions. They finally got through. The consulate asked them to send me over immediately. So I took a taxi and went to the consulate. At the consulate, a homeland security officer interviewed me about the situation. In about 30 mnts, he determined that my reasons for not having the proper documentation were legitimate and he ordered a staff member to issue me a "letter of transportation". I paid around 160 dollars for it. The letter was valid for travel for one week. I went back to the airport immediately but I missed all planes going to USA that night. I spent the night at the airport and flew the following afternoon.

At JFK, things went smoothly. They took me to an office and asked about my long absence from USA and my GC situation and I was good to go. I traveled couple of times afterward with no issues at all.

Removing Conditions on Residency General DiscussionA complicated situation re. I-751 and being out of the country. Please help.

Hi everyone, and thanks in advance for reading! It might be a little long. I'll put my basic questions at the end. You should know that I am completely aware of how poorly we have planned for and dealt with this situation. You can tell me we're stupid, irresponsible, and that this is all our own fault, but you won't be telling us anything we don't already know :-)

My wife and I submitted my I-751 at the beginning of the month. It was submitted three days after the 90-day window had expired. We enclosed a nice, apologetic letter and a mound of evidence.

Further evidence of our poor planning - just after we submitted it, I was due to leave the USA for a holiday in England. I left, despite the worry that getting back in might be a challenge. My flight back to the USA is on March 25th.

So far:
- our check has been cashed
- we have received the form I-797C Notice of Action, which gives me a date for the Biometrics appointment, March 13th
- according to the USCIS website, my case is in "Initial Review"

Our problems are twofold -
Firstly, I won't be in the country for the date that the biometrics has been scheduled. My wife has today sent off a Request for Rescheduling to get the date changed. Fingers crossed.

Secondly, I might not be able to get back into the USA. As I understand from a cursory reading of some forum posts, the notice of approval + my expired green card will get me back in. I'm not entirely confident on that.

Which leads to my questions!

1 - Does receiving the biometrics appointment letter mean that the lateness of the I-751 submission has been forgiven?

2 - Is there an approval letter, separate to the biometrics appointment notice, coming in the post?
2i- If so, is it strange that the biometrics appointment came first, or is this normal?

3 - What will get me back into the country? Expired green card + biometrics notice? Expired green card + as-yet-unreceived approval letter? Something else?

I was in a kind of similar situation. Well, I left after doing the biometrics (unlike yourself) with a stamp of extension in my passport, but I overstayed abroad as I was accompanying my US spouse while she is doing research. My stamp expired abroad and I didnt have my GC on me (wasnt issued yet). Even when 10 year GC was issued, I didnt want my friend to mail it to me for fear of losing it in the mail. But I didnt want to stay outside USA for more than a year as that will terminate my status as a LPR. I contacted the US consulate in my country and explained the situation and the consulate told me to get back within a year without any further details. I went to buy my plane tickets but the airlines refused to sell tickets without my GC or valid stamp so I asked my friend to express mail my GC. It didnt come on time (I waited for it until 2 days before completing a year abroad), then I contacted the consulate again and they issued me a letter of transportation immediately (for 160 dollars/ valid for one week). But I had to declare that my GC was lost in the mail to get the transportation letter....I arrived back to the states and my GC arrived in my home country. I asked my family to send it back to the states...

I went for an infopass to discuss my situation. USCIS had no idea about the declaration of loss (Homeland security told me at the airport that my GC was cancelled and that I need to apply for a new one/replacement). USCIS during the infopass told me that my GC was functioning fine and that I didnt need to replace it (I was confused). I traveled outside the US for few weeks later and got back with no problems...glad I didnt have to go through the replacement process.

I think your best bet is a transportation letter as long as you still fit in the category of " (conditional) permanent resident". A transportation letter is issued to any LPR who is unable to come back to the states because they dont have their GC on them (lost, stolen, broken etc etc)...technically, your GC has been extended for one year, so I imagine that you are considered a permanent resident still. But if you stay outside the country for more than a year, you will have to apply for a "returning resident visa".

Can you use your extension letter to get back? You should receive one when your 2 year conditional status ends! Look into that...I didnt receive the letter and I went for an infopass and got a stamp in my passport instead.

Salam and I'm happy that you have been feeling great. Your husband is not mature and all the weeping reflects that and he needs time to adjust to his new life. It took me about 2 months to find a job. If his sister and her husband know English, they should speak English in your presence unless they are saying some culturally specific which they cant talk about in English (because the vocabulary doesnt exist in English). I'm from Morocco and I can understand his behaviour and culture. You are such an awesome person! You helped him as much as you could but I think he needs a little bit more self-confidence to survive in the USA. I'm not being harsh with him. I'm just being fair...we all have vulenrable moments but our reactions differ depeding on our experience in life. Wish you good luck...both of you.

Most people use the airlines of their countries because they offer direct flights. in many cases, the spouses might need transit visas to go through other countries if they fly with foreign airlines. Someone with a Moroccan passport can transit through most European airports without a visa--So you could try a one stop or two stop flight!

I find Royal Air Maroc to be more expensive than its competitors.

 

In fact, there is nothing special about flying a spouse. a flight is a flight...what matters is the service and the safety record which one should look into. In one occasion, I wasn't treated so well by the staff of Royal Air Maroc. I usually fly with Lufthansa now.

i met my love in the summer of 2005. in May 2006, we decided that i should come to the US to participate in a teacher training and meet my girl friend.i applied for the B1 visa but it was denied.in Sept 2006 my fiancee filed a k1 petition and the case was approved and i have an interview by the end of this month (Nov).now i'm so worried about the refused B1...will it have any effect on our k1 application???on the B1 application, i said that i had no fiancee in the US which was true at the time.we were still in the phase of getting to know one another (boy friend/girl friend) and the consular officer didn't ask if i had a girl friend in the US.our official engagement took place in Turkey (August 2006).we are so worried friends! i'm sure i didn't lie in the first interview or on the first application but still i have these worries.has anyone here had a similar experience???!!!! do you know any similar cases!!!!??? any thoughts and ideas to help me calm down.pliz pliz! i'm waiting...thank you in advance.

It worked ! Both of you guys were right !

 

It seems that it's best to call them at 8 a.m. and onward PST. Moreover, when I called them back, the magic "3" option came on and I was put in contact with a CSR.

She actually was incredibly more capable than her predecessors, so we went ahead and made the address change to have the NOA2 hardcopy resent to my friend's address.

 

I guess now we have to wait for USCIS to send the package to NVC. I thought this took a couple of weeks but it seems to be longer. I'll check with a tier-2 ISO tomorrow.

After 1-1-1-1 and entering the receipt number, I enter 1. It gives me the option to enter 1 or 2. When I press "3"

at that point I get "The key that you press is not a valid choice on this menu". I'll do this before or after it has

me go through the whole speech it gives me on how I can contact them electronically.

 

So I remain frustrated ... :( ... I honestly appreciate the help though.

Unfortunately, the option of just waiting and then a Spanish-speaking rep. coming on does not seem to work.

It just tells me in both English & Spanish that if I've called from a rotary phone to call back during working hours and speak

with a rep. ... Then it hangs up :(

 

As to the 1-1-1-2-2 option, I tried it but right when I hit "2" after 1-1-1-2, it told me that "2" is an unknown option. Ughhh ...

 

It's driving me nuts but I sincerely appreciate your feedback.

Dear VJ members,

 

I'm writing about a matter that seems to have troubled a bunch of people in here. Quite simply: How does one

get hold of a CSR on the USCIS phone system ?

 

There seem to have been plenty other posts on this matter, with various suggestions but none seem to work right now.

The simplest way to go was this strange little trick of doing nothing and having a Spanish-speaking rep. come on, at which

point you would request English. This doesn't seem to work anymore.

 

Note that I'm in Athens, Greece right now. The only way I can call their 1-800 # is via Skype but I don't think this is a problem.

I actually called up USCIS at the Embassy in Athens and, as polite as they were, they had nothing to offer, simply emphasizing

that it's "The US government's policy to not allow easy access to personnel on these systems".

 

All I want to do is speak to an ISO to resend me NOA2 on a recently approved K-1 Fiancee petition. The original NOA2 was

declared undeliverable. I happened to have a forwarding order with USPS on all my mail, as I wasn't aware that mail with

"return service requested" (e.g. government mail) cannot be forwarded and is returned to sender. I've received lots of super-helpful

feedback here on this matter but the challenge now is to speak to a person.

 

If anyone has any insight on how to find a real human being on this system please let me know.

Hi folks,

 

If I may add a comment to your discussion: I was a Jan. filer who got transferred from VSC on 5/24. They first sent me an email notice that my case was transferred to another office

and that I should expect a notice with instructions in the mail (that's b.s. ; you only get a notice eventually). 4 days later a new notice came through that the case has been transferred

to my local office. A day after that, a third notice that it has been transferred. That was 5/30. On 6/6, I got the actual hard-copy notice in the mail that indicate the case had been transferred

to TSC. On 6/20, I received the email notice of NOA2.

 

Everything you all describe sounds extremely similar to what we went through, so I'd be optimistic. They needed some time to train the new people in TSC and the cases were transferred

there due to overload in Vermont. I have a feeling that things will move forward for you. So hang in there !

Identical message with what I got on July 11th. NVC is part of the US Dept. of State and indeed your application is en route to NVC.

Based on my experience, I would give them a week and would the call NVC (1-603-334-0700) and inquire if they received your petition.

I'd also follow Scott's advice and would send in an email. It looks like you're on your way. Good luck !

Just to make sure I understand: You can use that email to speed-up the actual interview at the embassy ?

If yes I'll inquire with Athens. However, I'm a little confused as I thought that they send you a letter with instructions,

you scramble to get certain paperwork ready (ideally, most of it is ready already), send it back to them and they

come back to you with an interview date. What am I missing here ?

I actually just called them and spoke to this really nice lady (it's amazing what a range of people you find operating these phones).

So yep, we are on totally parallel timelines. My application was received and inserted yesterday into the NVC system. I was also

given my NVC#. However, I will follow your advice and will also send them an email (I'm assuming it's the email-contact link they

have under "Contact us" ?).

 

Hopefully, this will make its way to the Embassy w/o too much delay.

Dear VJ members,

 

I'm writing to request for some of your helpful insights on an issue with my K-1 Fiancee Visa application.

Specifically, it has to do with the delay between my receiving my NOA2 and the petition arriving at NVC. There

are plenty of similar posts on this sight but I think there might be a subtle difference or two in my case.

 

Here's the story: I received an electronic notice of my NOA2 on June 20th. I'm currently overseas in Greece visiting my fiancee

and have activated mail-forwarding to a friend's house. For this reason, the hard-copy of NOA2 that was sent to me in the mail

was returned to USCIS. I did call them last week and changed my mailing address to that of my friend until I return to the U.S. in

mid-August. They said they'd said the NOA2 w/i 2-3 weeks. Nevertheless, my understanding is that I primarily need the NOA2 for my fiancee's

interview and that this delay in the mail shouldn't impact USCIS sending the material to NVC.

 

According to the K-1 Visa flowchart on VisaJourney, it is advised that 2 weeks after approval I should start contacting the NVC

to see if they've received the application. I tried a week ago but they had received nothing. The employee was really nice and helpful

and recommended I call once a week.

 

Now, on July 11th, I received the following email notice:

 

"On July 11, 2013, we shipped this approved or re-affirmed case to the Department of State for visa processing. For more information, please contact them directly. "

 

Maybe I was too ambitious but I called NVC again yesterday and got this rather not-so-intelligent employee who indicated nothing

had been received. She insisted I call back 8 weeks after my NOA2 date.

 

I know I may have rushed a bit but I do notice that the time between NOA2 and NVC reception is much faster for some other folks on this site.

So I have a couple of questions for you:

 

a) Has anyone received a notice like the one I got on 7/11 ? If yes how soon after that does NVC acknowledge reception ?

 

b) I understand that telephone is the only way to check with NVC. At some point, would it be good to give them my email ?

 

c) They request a receipt number. I give them the one assigned to us by USCIS (i.e. EAC**** ; we were processed by VSC).

Is there some other number I should give them ? My fiancee has been assigned an Alien Reg. number which I have.

 

d) Also, are we assigned some other number by NVC once they've processed our petition and sent it to the embassy ?

Since I'm overseas and I'd have to wait for the forwarded mail to reach my friend, can I ask NVC to give me that number over the phone ?

 

Any feedback you might have is hugely appreciated !

Excellent news ! I'm quite sure that w/i a couple of days the USCIS website will list your status it should be.

It shouldn't take more than a week for NVC to send the material to the embassy. Hopefully, w/i a few weeks after that

they should forward a copy of the NOA2 to your fiance.

PS: And don't worry about the status on the website. I forgot to say that on 7/11 (NOA2 via email on 6/20), I did get a notice that my package was shipped to the NVC. At that point, status will change back to normal.

I'm quite sure the same will happen to you. Be patient, it's a bit of a game of nerves ! We have an interview on 9/17 and I'm quite sure you'll get there !


Sorry, my status went back to normal on 7/11.


PS2: 15-20 min. waiting time at NVC is normal. Hang in there ! :)

Hi Yelena,

 

Sorry to hear you ran into this situation. It's exactly the same thing we went through, i.e. the message was exactly the same with what you've highlighted.

However, despair not. Allow me to tell you what else has happened:

 

a) I only contacted USCIS via phone, nothing online. I spoke to a CSR and told them that the mail with the NOA2 had bounced back. We went ahead

and put forth the address change request. She claimed there was no problem and that al my mail would be forwarded.

 

b) The petition package still went through to NVC. We had hoped for 2 weeks but it took a little longer, about 3.5 I think ? The range of people you

get at NVC will vary dramatically. At NVC it only spent 5 days and they forwarded to the embassy pretty quickly.

 

c) Now, I was perplexed that 3 weeks after the request of an address change, nothing had reached my friend's address. So I called USCIS and inquired,

quite frustrated. The CSR I got this time told me this happened because we had never submitted a "service request" to have a new copy of the NOA2 sent

to the new address. I went ahead and did that. That was on Aug. 2. Two weeks later, I got an email from them indicating that this address change was official.

Today, 8/29, nothing has reached my friend.

 

d) Why do I say don't despair. Around 8/10, my fiancee received a DHL package from NVC that included a statement that they had processed the package

and forwarded it to the embassy and an actual official copy of the NOA2. This is what she will use for the interview. I'm quite sure you should get something like that.

 

So here's my suggestion: Don't despair, be a little more patient with the NVC, badger the USCIS folks a little more (I haven't done that yet because I'm comfortable

with having the other copy of the NOA2) and have your fiance be on the alert for the NOA2 copy from NVC (It'll say form I-797).

PS: Sorry to bother again. Still no luck with the USCIS phone system but I was able to speak with a representative at NVC. Needless to say,

this person seemed a lot more capable. He clarified that there shouldn't be any mail forwarding issues on their side but also indicated to

me that our petition has not yet been forwarded to them. The VJ flow-chart indicates that 2 weeks after reception of the NOA2 one should contact

NVC to check and see if they've received the approved I-129F package. The gentleman said that nothing had reached NVC yet and it might take

up to 8 weeks after the notice is sent out.

 

In your own experience, how long did it take between NOA2 and NVC reception of the approved package ?

 

I'm assured from your words that the returned NOA2 snail-mail is not stalling anything.

Hi folks,

 

I'm just writing to update here and express an extra degree of frustration. It now seems impossible to get  hold of a human being on their friggin' system ! :( ...

 

Note that I'm in Greece right now and the best way to contact their 1-800 number is via Skype. Until Friday, I could do the trick of just not pressing anything

and waiting until a Spanish speaking CSR came on and I politely asked them to speak in English. Now this option seems to have been disabled !

I've tried all the other suggestions you folks have given me, including various key combinations such as 1-1-2-2 etc. and I can't get a hold of anybody.

 

I actually called the Athens embassy's USCIS office and they had no further suggestions. They were extremely polite but told me that it's the US government's

policy to not allow easy access to a human being on their 1-800 number. What the heck ?

 

All I'm trying to do is have a piece of mail sent back to me. Should I just go online and try ?

 

I'm going to put forth another post on getting hold of a human as there seem to be plenty different possibilities with none really working.
