US Citizenship General DiscussionN400 appointment for me but not for my wife!!!?

Me and my wife applied for N400 citizenship applications same time, and I sent all papers in the same envelop. After that we received finger print appointment, and it was same day same time. Then I received the yellow paper saying that they want my driver license in the interview, but the did not sent one for my wife, then I received the appointment day for me only, I dont know why they didnt sent appointment date for my wife. Out uscis office is about 5 hours drive so that I wanted to be in the same time or day to save driving twice.
We sent our papers to Texas and we interview in TN Memphis
can some know why we didn't receive the interview in the same day, and my wife didn't receive her appointment yet ?
Is main office receives papers and send them to Memphis as a separate files>?, or different officers ?

If she traveled outside the usa year and a half a go for 21 days only, is that will cause her security result will be slower ??



I can't remember that i read anywhere that applying on the same day with another person means that ur process will be the same. they are dealing with you as two different people i think. doesnt sound like there is any major problem or at least based on what u have said so far. good luck!

According to many posts, they specifically ask for valid and expired passports! Perhaps they might want to see if you have traveled (why?) to some counties that USA considers to be "enemies". They dont ask to see your valid and expired passorts for the past 5 years only....they dont specify the time frame which means that they are interested in looking at all of your travel history. So the passports arent just used to determine your time out of USA. It is more complicated than that.

Hi all,

My friend went to his second Naturalization interview 2 days ago, since he did not pass the English test at the first time which was 3 months ago.

At the first interview in January, he passed the U.S Civil and History questions, English writing, but failed the Oral test and questions listed on the application.

He was scheduled for the second interview, which was 2 days ago. He got interviewed by the same officer, he was very glad that he answered all the questions listed on the application correctly this time, also answered the questions (oral) the officer asked.

When the officer was about to give him the result, he had some chitchat with my friend; my friend could not understand what he was saying. Surprisingly the officer marked "you did not pass the second and final test of your English ability"......

Any ideas what my friend could do now instead of paying the application fee and 6 months waiting again?

He thinks the officer discriminates him, can he file any compliant?

so quick update. went to oath, my wife's officer announces my name before my oath ceremony, to ask whether my wife was there with me. and then he says that he never got time till today to review her file and approve it on the same day when my oath was ... grhhhh.

 

but he said, he is going to approve the file and she will get the oath letter in mail. all in all, it will be little incovenient to go again for the oath ceremony,, but thats ok.

 

all's well that ends well.

coming back to topic, what do you guys of the decision cannot be made. do i have to worry about anything?

As we think and talk more, in her employment information we put the corporate headquarter address which is in different state then the local state she is working at. Io asked her about it and she said that the address in n400 is the corporate address and she works at this location near our home.



The address doesnt seem to be an issue! She normally has to put the address where she works/worked and not the address of the headquarters unless she works there. I have never encountered any case where someone had issues because of an employment address.

The IO told her during the interview that she needed to put the local address. Did the IO make a big deal of it? Did your wife lie about it? Was she trying to hide where she works for some reason? It seems like a minor issue to me unless the IO thinks that your wife lied under oath, which is very unlikely as there is nothing at stake.

You didnt answer a question that someone ask you above! What was the correction about?

Honestly, you want us to tell you "dont worry", but you will feel worried regardless. There is nothing that you have mentioned so far that makes your wife's case look "bad". Who knows what USCIS is thinking!? Please let us know what the issue is when you receive your letter or may be you will end up receiving an oath letter instead (I hope).

It's quite common to mention ethnicity or morphology when someone's had an "issue" with an agent. You will find at one particular embassy for example people will ask "did you get the asian lady?" because she's well known at that embassy to cause problems.

So I assume the same reason here, the OP was using identifiers (since they don't usually tell you their name) to "warn" people about her or hope someone says "don't worry, she's always grumpy but it will be fine". I don't think it had a negative tone at all.



That's right! I remember when I was going through the K1 process, many applicants complained about particular officers and referred to them either by ethnicity or physical features. I totally understand that. I am not sure though when people highlight the ethnicity for no obvious reason. Prejudice is widespread. As a minority myself, I witness it often. So I asked the guy above to clarify as I don't know where s/he is coming from.

i went to chicago do for the interview today, 5 year (employment), gc for 10 years now. interview passed for me with congratulations checked in n652 ,

but wife interview english/civic test passed but the IO said to her that he "needs to check more and you will get the oath letter" and n652 checked with decision cannot be made. io was asian for her and was really not in good mood and corrected her multiple times. on n652, interview date was marked as 04/10 instead of 04/11,

I am really concerned and dont know what to do. is this really a big issue, or what is your feedback.

What's wrong with being Asian? I personally cant see what the problem is with your wife's case based on the facts you have presented so far. Just be patient and wait for their letter.

There is that AR-11 you have to report to the USCIS whenever you move.  And something about with a new address, have to live there 90 days before applying.  Most states require you update your drivers' license within 30 day of changing your address as well as other governmental certificates.  Have to deal with utility companies, enroll your kids in a new school if any, move all your stuff, get settled, clean up the old place, and even more complicated if you moved because of a new job.  Dealing with the USCIS, is just more one thing to do.

 

I moved from my old address 5 years ago. I always changed my address on USCIS website when I moved. Thanks man!



People move all the time.  They don't care if you have old documents with old addresses, as long as your current address matches your filing.  If you move, notify them, but really your old addresses on forms won't matter.

Hi guys,

I just discovered that the address that I used to file the 2012 taxes is different from the address that I have in the lease that I submitted to USCIS (address in the N-400 application). The address in the tax documents is my older address. Should I call IRS to get it fixed? Do the addresses have to match? Anybody went through a similar situation?

 

I should have told the lady that did the filing for us (free government tax service) not to use the address in my driver's lisense because it is the old one.

US Citizenship General DiscussionApplying for N400:married to US citizen 3 year application. Do I need to write past 5 years for residence and employment?

Hi all,

 

I am married to a US citizen and am applying under the 3 year term for N400.  The application everywhere says to put in your last 5 years of residence, your last 5 years of employment, and your last 5 years of places you have been outside the states.  Do I put it down for all 5 years even though I have only been in the US for 3 years? I did a lot of traveling to various countries within the 5 years but before I came to the US, and lived in a bunch of places, and also was working in another country prior to coming to America.  Did you write down all this info, or did you add a note that you were not in the US?

 

Based on many similar questions here, it seems that you only need to provide details about the past three years even though the app asks you to list details about the previous 5 years.

 

Apparently, USCIS should create a new N400 form for spouses of US citizens.

 

I hope other users jump in and answer your question!

True! I personally didnt file taxes for 2010 and 2011 because my wife and I had low income. I quoted IRS website (minimum requirement to file jointly) and took with me to the interview sheets of paper with detailed income information for those two years (letters from former employers) as well as my email communication with IRS regarding my income. USCIS officer didnt bother to look at the sheets. USCIS officer asked me the standard question "have you ever failed to file a required income tax", I said "yes" and she asked me to explain and I explained my income situation during those two years. She didnt ask for any documentation though. She commented  something like " I also think that you didnt file because you were outside of the country". I nodded my head "YES". Then she moved on...

 

Notice the question says "required income tax". I said "Yes" to the question even if I wasn't required to file based on IRS requirements because I wanted to be on the safe side and also because I had an explanation.

 

If you didnt file because of your low income, you are fine! As long as you have a valid explanation. You can't be denied US citizenship because you are broke! That's a form of discrimination against poor people.

 

My immigration status now is "in que to take the oath...". My N400 is marriage based.

Hello guys I've been a Greencard holder since July 2007..

last November 27,2010.. I needed to go to philippines cause of my grandmother (70yrs old) being very sick because of her brain tumor..

and Around April 2011 I was about to go back to United States but she accidentally fell on the stairs and broke her hips and neck.. she can't move and needed surgery..

So i need to take care of her from April 2011 - November 2, 2011 ... and because of this my stay outside of United states is a total of 11 months and 4 days..





 

Now I'm applying for my citizenship. what do i need to show them in order for me to prove that i didn't ignored my resident here??

I live with my parents and doesn't have a job from 2010-2012 cause i was home studying. No tax return from 2010-2012 either.

The only thing I have is the letter from the doctor in the philippines and a letter from my mom saying that I took care of my Grandmother from Nov 2010-2011 that I showed to Immigration Officer when I got back here in United States..

And A tax return from 2008 and 2009 and 4 credit cards that I'm paying every month since i left the United States...

Is this enough prove that I didn't ignored my resident here? My mother is a US Citizen is her tax return and residency gonna help me prove it to the IO?

can you guys help me please?? I really need to be US Citizen..







 

I was in a worse situation and I just got scheduled to take my oath. I was away for 364 days at one time and for 11 months a few months before that trip. I didnt file taxes that year and I didnt have a lease here in the US while being away for almost a year. I was away on a tourist visa to a third country (i wasnt in my home country). I was with my wife (US citizen) who was conducting some academic research (she was affilated with with a US university). During my time abroad, I took temporary employment and we had a lease there and i enrolled in a distance learning program at university in that country. The officer during the interview examined my timeline very carefully and asked lots and lots of questions.

 

I returned from that that long trip about 2 years ago and I am fully settled back and paid taxes for the past year etc etc...

 

 

To make my case, i submitted the following (in addition to the initial evidence for marriage based N-400):

 

1-cover letter signed by both myself and wife explaining in details my where abouts and the nature of her work and reasons why we both didnt file taxes.

2-detailed income information for the year I was abroad with copies of my communication with IRS about attempting to file taxes (never did because IRS guidelines exempt people who make less than a particular income from paying taxes).

3-documents from my wife's school detailing the nature of her research abroad and its time frame.

4-leases and tax information for the year after i returned from the long trip.

5-copy of my communication with the US consulate in my country about the problems I had in buying a plane ticket with an expired GC stamp in my passport (airlines refused to sell tickets to me wich delayed my trip back even more). This happened in my country because i traveled back there briefly from the third country where i lived with my wife.

6-bank and credit card statements (dont have driver's lisence).

7-a notice of rejection of application for travel permit (applied for one but wasnt issued because of a problem with the check).

 

I asked two lawyers about my chances and they both werent that sure about getting an approval...they both gave me helpful feedback!

 

Maybe u should ask a lawyer! people here answer out of experienc, but lawyers base their feedback on the law! especially experienced lawyers.

 

my only advice is that u need to be honest! never ever try to hide anything or lie...just state the facts and present the evidence that u have.

 

i wasnt approved during my interview. i got the decision cant be made statement. while preparing more evidence to send in case uscis requests it, my status changed to inline to take the oath (10 days after the interview). the interview itself was smooth...no issues at all. i answered the officers questions and asked for clarifications when i didnt quite understand the questions. i was to the point and didnt argue or interrupt the officer. my whole interview was about 20 minutes.

Anyone has any idea when are the oath ceremonies in fairfax, VA? I passed my interview for citizenship last tuesday june 11th, 2013 at the fairfax office....any ideas of how long yours took for oath in VA? Dates?

 

I live in NY so i cant really answer your question, but i just want to note something. A friend of mine who lives in the same city where I live didnt go to the same oath location where im going. his case took 3 weeks between the approval and the oat day. he was sent to another city to take it. but it is gonna take me around 2 months to get to mine which is in the city where i live. I think this applies everywhere. USCIS gives u either the earliest date or the closest location depending on what's available.

 

If fairfax is a big city with lots of immigrants, the processing times might be predictable....i hope someone jumps in to answer ur question.

I can't comment on VA dates, but it took 2 weeks for me in NY.

 

I live in Upstate NY. I had my interview on May 29th and got the approval on June 10th and my oath ceremony is on August 7th! It is almost 2 months between the approval and the oath date! Well, I live in a small city. Probably there are two or three ceremonies a year here. I could have taken the oath earlier if my file was sent to a bigger city where they hold oath ceremonies more frequently. No complaints though! I'd much rather walk to the oath rather than drive for 4 or 5 hours. It feels a little bit disappoting to have to wait for 2 more months to become a proud citizen of the USA, but we have waited for years for this moment anyway! 2 months shouldnt be that much of a wait...

 

From people's timelines in different states, it seems that most people wait between 3 and 5 weeks to get to the oath ceremony. Lucky cases get same day oath or less than 3 weeks. But there are some cases that have to wait for 8 weeks or even more (like mine).

Filed in April yes, thank you for asking smile.png I'm in-line for interview so I suppose I could hear any day now! It's not a short drive (3 hours one way on a basically flat and desolate interstate!) so I was really hoping I could do same-day Oath but apparently my office doesn't offer it anymore. I'm still going to ask seeing I don't need to do a name change it doesn't need to be a fancy ceremony, otherwise I'll ask for it to be done in a ceremony closer to where I live (45 mins from home). It means waiting a bit longer (they only do them here once a month) but it'll still happen and that's the best part biggrin.png

Well, it didnt scare me (it got me thinking serisouly though) because I already talked to an experienced lawyer who has been working in immigration law for decades. She told me that the worst that could happen would be sending you to face an immigration judge, but then your wife will be able to stop any deportation attempt. But she didnt think  that would happen at all because from my timeline and circumstances, the intent to come back to the states is there. USCIS doesnt care about the intent, but immigration courts do. According to my lawyer, It will be very difficult for the judge to rule that I moved overseas to stay there permanently (I was in a third country on tourist visas during my absences).

 

I doubled checked with a second laywer after reading your comments. The second lawyer confirmed what the first said and he seemed more positive that deportation or revocation of the green card arent on the table. He said what's at stake was the application fee!

 

Both lawyers didnt worry about me applying now! They just kept stressing on providing good initial evidence and cover letters to make sense of my case to USCIS.

 

I am glad the lawyers didnt take advantage of me. Both of them gave me the option to represent myself or hire a lawyer. They were like "you dont need a lawyer if you could do/show this or that...."

 

Thanks again! I'd rather hear realistic feedback then someone painting a rosy picture or not even taking the time to look at the details before passing a judgement.

I just wanted to updated everyone here, especially you because your evaluation was a bit straightforward. I passed my interview on May 29th. I wasnt approved during the interview. The officer asked specific questions about the reasons for my long travels and more questions to determine if I abondoned my residency. The interview went very smoothly.

 

After the interview, I received an online change of status that requested more evidence, and I started collecting what I could think of. But today I received a new change of status stating that I am being scheduled to take the oath. I think my wife and I won our case!

 

I dont want to get excited until I actually take that oath!

 

Thanks for your realistic comments above! It really helped in making me see things realisitically and prepare what I can.

We both didnt file taxes when we lived abroad. I had an interview with a homeland security officer at the consulate in my country. I explained to him my circumstances and the reasons why I didnt have my GC. He was understanding and he issued me a letter of transportation ( a letter of transportation isnt issued to an LPR who is out of status). Out of status LPR applies for a returning resident visa. The letter was valid for one week beyond one year (he told me that i was allowed to stay another week in my country if i needed to).

When I returned back to the states, an airport/homeland security officer took me to a separate office to verify my letter and asked me the same questions i was asked at the consulate. She then told me to apply for a new green card as my older one was cancelled (i had to declare it lost according to the consulate's advice to get my letter of transportation). The GC took longer than expected to arrive by mail (a friend of mine mailed it from the states to me) so we assumed that it was lost.

I scheduled an infopass with USCIS soon after to inquire about my status and apply for a new green card then surprise surprise! the USCIS officer interviewed me about my long absences and stuff and after 15 mnts of talking he asked me " so what's ur problem? why r u here today?" I said homeland security cancelled my green card. he said "no, they didnt...your green card is FINE and u can still use it". My GC was sent to me from my country and im using it now. i traveled twice with it after this drama with no issues or questions (less than a month trips).

So taking my GC more than 2 years after this drama doesnt seem that possible to me, but u could be right. they could always say " we were wrong! now we got u". I think then i will have to leave and apply for a returning resident visa or my wife will petition for me to come back again on K1". Too bad because we now have a son and having to deal with the removal will disrupt our life.

Just a question: So you were out of the States for basically a year? Because that is very different than 6 months. Also I don't think a rejected reentry permit is going to do any good. Applying as a spouse does look like the better option because of your travels but I don't think that will be enough. Good luck though.

No, I will be traveling for a few weeks in the summer. It is one of the reasons why I decided to file my N400. I want a US passport because the passport from country is about to expire and I will be dealing with a lot of bureaucracy to renew it and it will basically take the same amount of time like applying for US citizenship or even longer. The immigration lawyer that I consulted recommended waiting if nothing was urgent, but I told her about my passport situation, and she thought that it was ok to go for N400 now as long as I present a solid case.

I have already submitted my application! So no going back now!

i actually have a similar case as yours.
i applied on my 5 yrs green card,and during that period i took 2 trips outside of US for more then 6 mnths,one for 7 mnths and one for 8mnths.
i have been in US for last 3 yrs continously,the trips were during my first 2 yrs,as i was doing my studies in my home country.
i had an interview and the IO was fine,he asked me alot of questions why,where,when.where did my family stay during my stay abroad.
i rcieved an RFE,and i submitted some documents,like my US driving license which was from last 7 yrs,tax documents of my parents in which i was dependent.
havent heard anything back from uscis from last 40 days.so lets see what happens.

What are the chances of my N-400 getting approved? These are the facts:
1- I am married to a USC. Have been married to the same person and kept my GC for the past 6 years.
2-I submitted N-400 as a spouse of a USC (based on the advice of a lawyer)
3-Have been in the states for more than 18 month during the past three years.
4-Have been out of the US for more than 6 months twice in the past 5 years (one more than 6 months absence in the past 3 years).
5-While abroad, I took employment overseas and didnt have a lease in USA. I never filed taxes because I made less than the amount required (have my correspondence with IRS about the matter). I kept a US bank account. I traveled back to USA between the long two trips and stayed here for about 4 months.
6-I have one absence of 366 days within the past 3 years (days of departure and arrival included). Received a transportation letter from a US consulate to come back because I didnt have my GC. I submitted my communication with the US consulate abroad with my N-400 app (I contacted the US consulate 3 months before completing a year n explained my circumstances--Not having GC handy as it wasnt issued yet. I just had a stamp in my passport that expired and airlines refused to sell tickets to me).
7- I have a rejected application for reentry permit (reason for rejection is a problem with signing the check). I didnt apply again because I had a plane to catch. My lawyer thinks that it is a good document. It shows my intention to return to USA.
8-Why did I go abroad for such long trips to begin with? My wife is a Phd student and she was doing research abroad. We are a family and wanted to be together. My wife's university gave us a letter that she was overseas for Phd research. We returned permanently to USA over a year ago. The letter clearly states that my wife's stay abroad was temporary. I looked into the exemption given to spouses of USCs affiliated with US research institutes recognized by the attorney general. Her university is listed, but she wasnt an employee! Not sure if researchers are included.

How do you think USCIS will look at this case?

Dear VJ members,

 

I have a quick question for your expertise regarding scheduling the interview for my fiancee's K-1 Visa application.

Our current status is that NVC shipped the package to the U.S. Embassy in Athens, Greece on July 22nd.

The USCIS office in Athens insists on communicating via email, though I must admit they're quite punctual about getting back to me.

 

I just wrote USCIS-Athens an email inquiring about the possible reception of the petition. My understanding is that, as soon as they receive

the petition, they will send her a package with a checklist of items and paperwork that must be collected (we've already begun working on all of this).

She then sends the completed paperwork back to them and they schedule an interview for her.

 

However, in a previous post I made here, some friend indicated that if you show the embassy the NVC notice of approval you can gain significant

time in scheduling the interview. This was at least the case for Manila, Philippines where his fiancee was from. Supposedly, I needed an email

from NVC. I actually wrote them but never heard back from them and have only been able to communicate w/ them by phone.

 

Could anybody clarify the above for me ?

 

Also, should I be expecting anything at my US address ? I'm in Greece visiting right now (until 8/14) and had my mail forwarded to a friend which

caused a delay in their sending the NOA2. 3 weeks ago I contacted USCIS to use my friend's address but so far they've only sent him an update

on the change of address. No NOA2 ...

 

Any wisdom you might have would be much appreciated !

These are the numbers of USCIS. I'll give it a shot. They always defer me to the Immigrant Visa folks who mysteriously don't have a phone #. Hopefully, we can

work out an appointment through USCIS. I'll let you know what happens

PS: I called up USCIS and I spoke with someone helpful who suggested we address the package to "Immigrant Visa Unit" with the street address being the standard one. However, he recommended we confirm with the IV guys so I hope they reply to our email at some point.

 

If I may ask though: Which number do I call for an appointment to hand-deliver the paperwork ? I've been scanning through the Embassy's website and am rather confused.

Do we call the non-immigrant visa office to schedule something (they offer a phone # online) ? Or do I call the central phone number of the embassy ?

A big thank you to both of you for getting back to me ! I'm guessing/hoping the address you both recommend is the right one but I will indeed call them. In fact, my fiancee lives right at the Vyronas/Pagrati border and she is keen on delivering it in person. Maybe that might work a lot better ...

Hello back !

 

Thanks so much for the quick response !

 

The address they list is for the USCIS office. When I called the USCIS office a few weeks ago they indicated I should deal with the Immigrant Visa Office of

the Embassy. The IV office is keen on communicating via email only, as you probably know. Initially, they were very polite and responsive but now

I've experienced delays and not so clear responses (presumably a different employee). I've written them since Thursday a.m. regarding the

exact email address but haven't heard back.

 

Would you happen to know if indeed the USCIS address on the website is the right one, i.e. I should list "Field Office Director,
U.S. Citizenship and Immigration Services, Department of Homeland Security" or there are a few different first few lines one should use for the IV people ?

Dear VJ members,

 

I'm in (hopefully) the final stages of a K-1 fiancee Visa application with my Greek fiancee.

The embassy  emailed us a few days ago the instructions to what is presumably Packet-3.

 

I am in Athens, Greece now visiting my fiancee until 8/14. We pretty much have collected all necessary documents and she

will have her penal record (in place of a police certificate as emphasized in the instructions). We now would like to send back

 the packet-3, i.e. DS-230 (part I), DS-156 (in duplicate),  DS-156k and I-134 (which I included for the heck of it as they specify

it in the enclosures ; I've given my fiancee all supporting evidence).

 

What's really frustrating me is to find the U.S. Embassy's Visa Unit's exact mailing address. I know that of the Embassy but I

can't find what else I have to list. Do I write "Visa Unit" or "Immigrant Visa Office" ?

 

If anybody has any feedback I'd greatly appreciate it.
