hello dear friends!

i met my love in the summer of 2005. in May 2006, we decided that i should come to the US to participate in a teacher training and meet my girl friend.i applied for the B1 visa but it was denied.in Sept 2006 my fiancee filed a k1 petition and the case was approved and i have an interview by the end of this month (Nov).now i'm so worried about the refused B1...will it have any effect on our k1 application???on the B1 application, i said that i had no fiancee in the US which was true at the time.we were still in the phase of getting to know one another (boy friend/girl friend) and the consular officer didn't ask if i had a girl friend in the US.our official engagement took place in Turkey (August 2006).we are so worried friends! i'm sure i didn't lie in the first interview or on the first application but still i have these worries.has anyone here had a similar experience???!!!! do you know any similar cases!!!!??? any thoughts and ideas to help me calm down.pliz pliz! i'm waiting...thank you in advance.

Sijel al Adli is different than the police certificate (Hussen Sira).in Morocco , we get hussen sira (police certificate) from the police station in the city where you live but sijel adli (judicial record) is obtained from the court (mahkama ibtidaeiya) in the city where you were born.let's say that you were born in Taza and you live now in Casa.you get sijel al adli from Taza and you get husen sira from Casa.i think the difference between the two documents is clear.on my day of the interview ,i had the police certiciate and they took it from me but they asked for sijel adli too which i didn't have.

when and where did we meet?
how much time did we spend together? and she checked some of our pics (didnt ask for emails). at the end she assured me that everything was fine and that i can tell my fiancee that the interview was successful.she just told me to bring two more documents before my visa can be issued.

so all Moroccans and their beloved ones need to know that the consulate has started asking for the following two documents with translation to English.
1- Certificate of celibacy (chahadat al ouzouba)
2- Court/judicial report (Sijel Al Adli)

the other thing i noticed is that the consular officers are friendly and nice people.they become tough when the applicants argue with them or don't answer the questions properly.pliz guys if you are marrying an English speaking person,try to improve your English.i noticed today how a consular officer couldn't believe that a man who speaks no English has already married a US citizen.the applicant claimed that they spoke in Arabic and he had no evidence to prove it coz his emails were in English.it's obvious! no visa for him...he left with a broken-heart.i felt so sorry for him...really.

You are qualified to apply as a spouse of a us citizen (3 year rule). i'm in a similar situation. i even asked an immigration lawyer about it and she said that it doesnt matter for how long u have been a resident. all that matters to apply as a spouse of a us citizen is that u reside continuously in the states and be married to the same us citizen during the three years preceding the application for naturalization.

Actually, if part of a day on US soil is considered a day spent in the US, you need to subtract 2 days from that total, which makes 364 = less than 1 year... Are you sure of that rule?



The guidance in the USCIS publication (Naturalization Guide) states that days spent partially in the US count as full days.

I also have my communication with the US consulate in my country which I will submit with my N-400 app. I had some complicated issues getting my airplane tickets to get back within a year. Ultimately, the Department of Homeland Security gave me a letter of transportation to get back on time (they even extended my stay in my country by one week. I could have stayed one year+ a week and still be admitted to the states).

What does that have to do with the price of fish? Even if you apply based on marriage your USC spouse doesn't attend the interview with you, it's just you. Also, lengthy absences don't matter as long as you didn't break your continuous residence and as long as you've been in the US the proper amount of time.

I suggest you file based on the 5 years. It's much simpler. Basically the only requirement is to have been an LPR for 5 years and not broken your continuous residence or been out too long... if you file based on 3 years you need to show bonafide marriage as well as all the other stuff. Honestly I don't know why your lawyer would suggest the 3 years when you qualify for 5 years.



I think applying according to the 5 year rule makes sense to me as well, but she is the lawyer and she has been in this business for a while. I paid 300 bucks for her advice.

I think she advised to apply according to the 3 year rule because my absences are strongly tied to my wife's nature of work (She is affiliated with a US institute of research and had to do some research overseas).

Thanks for your note. That assumption wasn't the core of my post though. I am totally aware that one should be:
1- married to a USC for at least 3 years
2-a permanent resident of the US for at least 3 years
3-physically present in the US for at least 18 months out of the 3 years preceding the date of the application for naturalization

My issue was with determining if the 90 days thing apply to a person who meet all those requirements + being married for over 5 years and maintained the resident status for more than 5 years. Someone has addressed the matter above. Thank you guys for your responses.

Hi, I have a question about taxes and citizenship.
I came here in 2012 with a K-1 visa and have the intention to apply for citizenship when the time is right. I'm just really worried about something: in 2008 AND 2009 I came to the US as a J1 visa holder in a program we call Work and Travel. We would come to work seasonal jobs (ski resorts, casinos, etc) for about 4 months and then return to our country. Since I wasn't a resident or anything, I didn't think I had to file tax returns, so I didn't! Does anyone know if this could be a reason for denial when I apply for citizenship? Is there anything I could do about it?

Well, you aren't required to file taxes if your income was below the amount required to file. Do you remember how much you made? Check IRS website for details about the income required to file (You should be able to find a table with details about the types of filings and the required amount). If you can document your income that would be more helpful (pay slips or any form of receipts). This was an advice to me by my immigration lawyer as I didnt file taxes for couple of years since I made less than the required amount (lived in a foreign developing country and got paid in local currency). I also kept my correspondence with IRS. I am applying for citizenship this month. I will update you about the outcome later. Email IRS now and inquire about the matter and present the correspondence with them later to USCIS if needed.

In the citizenship forms, you will have to answer this question: Have you ever failed to file a required income tax? Yes or No? Now, you need to make sure that you werent required to file, otherwise you need to justify your failure to do so or pay your over due taxes now (as someone indicated). I am not sure about the procedure of the latter.

I am filling up the N- 400 form, and it is asking me about the dates of my previous employment and school I attended. I completely forgot this. I have look around all my documents and emails and can't find the dates. What should I do?


Guess the dates! In the N-400 instructions, you can write just the months and the years if you can't remember the days-Check it out before your fill in the info. I sent my application last week and I included the days of my travels, employment, school and address change by mostly just guessing (too difficult to remember the days. The months and the years are easier).I determined the dates of employment after checking old emails and talking to friends. However, the dates of travels are the most important. They have to be accurate as they are used to determine physical presence and continuous residency.

The processing times of the N-400 application for naturalization differ from a service center to another. You will generally become a citizen in between 4 and 5 months. Some people naturalized in less than 4 months while others have waited for more than a year. The majority though seems to get their oat ceremony in around 5 months. It all depends on your case. If you meet all the requirements and they dont need more info from you and you pass your English and civics test, you will probably naturalize within the standard period (around 5 months or less).

You can actually find out the processing times on USCIS website. Check this link! At the bottom of the page, you will need to provide the appropriate details and look up the processing times of the office/center where your N400 will be processed:

3-You have spent half of the 5 years preceding your N-400 application in USA.
4-You are a resident of the state where you will apply for 90 days before sending your application.

If you say yes to all the requirements above, then you may be able to apply in August or September 2013 (You need to know the exact date that you because a permanent resident (GC holder).

After 3 months I made reentry permit and left USA for 13 months
Came back to USA in March 2010

I've been reading in the forums and notice a post where someone says this to another poster...




That bold part has me puzzled. I know about being out of the country for more than 6 months in a year. But is there a requirement for new permanent residents to stay inside the US for the first 3 months after initial arrival?

I'm curious because I was a student in my home country when the I-130 process was completed. I entered the US, spent a few weeks with my husband, went back to finish up school and came back to the US right after I took my final exam 9 weeks later.

The poster above makes it seem as though because of this I should let more time pass before I attempt to apply for naturalization or face them rejecting the application if I apply in the 90 day window from my "resident since" date.

Can anyone knowledgeable about this kind of thing verify whether this is true or not?


you need to live for at least 3 months in the state where you are applying for citizenship from (assuming that you meet all other requirements). you can also apply for citizenship 90 days before you complete 5 years of residency. these are the two periods that you should care about: A- 3 months residency in your state B- apply as early as 90 days before completing your 5 year residency (3 if u r a spouse of a us citizen).

Plus, people's postings arent always accurate. my comment above is based on my superficial understanding of the process...you need to check USCIS website for accurate information. so dont stress out over what people have to say.

I obtained my citizenship back in August, the same day that I had the interview. The ceremony and interview took place in Mt. Laurel NJ.

I met the physical presence requirement just barely at more than 800 days out.

To establish continuous residence, the IO viewed my entire history and not only the last 5 years to make his determination. Since I re-entered every 6 months during my employment abroad, and the employment was limited to 2 yearly contracts, he didn't see a problem with my case. During the last 10 years of keeping a home in the country, and 8 of those years as a greencard holder, only the last 3 years have prolonged absenses with trips lasting almost 6 months.


I was ready with a very thick folder full of proof that I still retained ties with the US. I had everything from pictures, bank statements, facebook pages to affidavits signed off by my parents and friends that remained in the US. I didn't even have to open it. Even if I didn't use it, making it made me feel much better about the whole process.

Now my question is would the following be enough to convince an IO that I did not in fact abandon residency:

-My tax information
-My bank statements
-The visa that I was given for Korea was of 1 year and tied only to the company I was working for (under their laws I could not work for anyone else)
-The housing was as temporary as the contract
-my immediate family (on which I depend financially remained in the united states and in my primary residence)
-I have now been in the united states for 4 months
- my immediate family will become citizens (they pass all requirements with flying colors)


Also, What is it you mean by "preserving your GC?"
Is my status in danger even if I am already in the country?

Hi.

I have just filed a N-400 application with USCIS and got my notice of acceptance and biometrics appointment today. I became a legal resident through marriage on 06/24/2010. I sent my N-400 application on the 26th of April which, according to the 3 months calculator on the USCIS website is the first day I am eligible to file. My question is, seeing how everything is moving so fast, if I receive an interview appointment before my 3 year anniversary (06/24/2013) should I go to the interview or should I ask for it to be rescheduled? And also, how do I find out if my local USCIS office (Tampa office) provides the option to have the interview and oath ceremony on the same day?

Do you mean you applied on March 26th? You said April 26th. Go to the interview whenever u are asked to, it doesnt matter as long as it is after the 90 day period starts. Travel should be ok as long as you submit your request in advance to reschedule any appointment that you cant keep. Good luck! Maybe someone else can shed more light on your case.

Folks - does anyone know how many months it takes for a New York (Queens) applicant to wait for the interview after fingerprint? where the interview venue is? Jamaica? Also, am I expected to receive an "in-line" letter as well as a correpondng USCIS online update after biometrics? Thanks.


No one will have an exact answer for the first question. It generally takes between 1 or 2 months to get to the interview after the bio. It might take less or more. It depends on the number of applicants in your area in a given month! If you look at people's timelines, you might have a better idea about the time frame.

Yes, you will receive a letter (you are in-line for the interview) after the bio. It usually arrives within 2 weeks after the bio. Mine arrived within 4 or 5 days. If you subscribe to USCIS online status updates, you will receive updates before you receive the letters in the mail.

Not sure about the interview venue as I live in Upstate NY.

Hi All,

I will be taking my oath tomorrow at the LA Convention Centre (yes, i still refuse to write center) and I just wanted to say how glad I am to finally reach the end of this journey. It wouldn't have been possible without all the helpful advice I've received on here. With your help, we managed to file everything ourselves, saving thousands on needless attorney bills. Looking back I didn't think it was going to be possible and it felt like the end would never come but sure enough here I am picking out an outfit to wear to my naturalization ceremony. :dance:

My Wife is not in USA, I have filed for her and she will be here soon, My question is How do i go with the Marital Status in Citizenship form if i have filed for my tax as single? Help Please



Is your N400 application based on the 3 or 5 year rule? If it is based on the 3 year rule then you should have filed your taxes as married and filing jointly or have some compelling justification for filing separately. Filing taxes jointly, along with other evidence, helps establish the legitimacy of your marriage.

The bottom line: BE HONEST! Why did you file as single if you were married? Is it because your wife was away? Do you think that makes you single? I am just trying to understand the big picture because you havent explained that much.

What seems logical to me is to say in your N400 form that you are married and prepare some valid justification for filing taxes as single!

US Citizenship General DiscussionN400 appointment for me but not for my wife!!!?

Me and my wife applied for N400 citizenship applications same time, and I sent all papers in the same envelop. After that we received finger print appointment, and it was same day same time. Then I received the yellow paper saying that they want my driver license in the interview, but the did not sent one for my wife, then I received the appointment day for me only, I dont know why they didnt sent appointment date for my wife. Out uscis office is about 5 hours drive so that I wanted to be in the same time or day to save driving twice.
We sent our papers to Texas and we interview in TN Memphis
can some know why we didn't receive the interview in the same day, and my wife didn't receive her appointment yet ?
Is main office receives papers and send them to Memphis as a separate files>?, or different officers ?

If she traveled outside the usa year and a half a go for 21 days only, is that will cause her security result will be slower ??



I can't remember that i read anywhere that applying on the same day with another person means that ur process will be the same. they are dealing with you as two different people i think. doesnt sound like there is any major problem or at least based on what u have said so far. good luck!
