Just an update on this, I have been in the US for 3 months, tourist visa has now expired and I'm back in my country. Well, the reason why I needed a tourist visa was because I have been arrested once in the US, for a traffic violation, something that in my country would be punished with a fine. But for this reason I can no longer be WWP.

Anyway, the process is now rolling, just need more patience

I just wanted to ask you why did you need to get a tourist visa. I thought Italy was like in Spain, they have a visa waiver program (VWP) and that allows you to visit the US for up to 90 days, I have never had any problem visiting without a visa.

Hi guys,

this time no question, a lot of members asked if they can travel or get a tourist visa while the petition is pending. The answer is yes, there is no law that prevent you from asking. The main problem is to proof that you are leaving enough behind and that you are not willing to immigrate on that tourist visa. I had an interview for a tourist visa and the consular office gave it to me. I'm allowed to travel for 3 months. So my suggestion is that if you want to try just make sure you have enough that will make you come back. A job is the first thing they ask for, a house, a car, a bank account.

I was told not even to bother to try, well, I did and I got it. Now, I don't know how the story will be at the POE, but for now I got my visa, I will let you know how it goes.

Yes I definetly will try to go the CR1 way, unless the K3 comes way earlier. Reading around the forums I realized that now the approved I130 are kept on hold once approved if the person has filed a 129F. The fact that we filed it after the I130 has been sent to NVC should solve that problem now, correct?

I hope I can get through quickly now, the shortcuts are kind of scarry to me, I'm afraid to make a mistake... but I'll look into it better in the morning and see what we can do. E-mail the choice of agent seems to be a popular shortcut too.

Hi everyone,

I'm confused regarding the path that we should follow. As from timeline below, we never received the NOA1 from I-130 so we filed the I-129F when we received the NOA2. Now we have the I-130 sitting at NVC and the I-129F at CSC (transferred from MSC). Reading in the forum we got a bit confused and we decided to try both paths. I read that if you go with the I-129F the I-130 get stuck somewhere because the office assumes that you will pursue the K3 way, is that right?

Our I-130 as been approved pretty fast 89 days, what should we expect at the NVC stage? The timelines are a bit confused but it seems like another 120 days at least.

Any suggestions? Honestly we filed the I-129F but I think that the CR1 will go through first...

sorry if I'm too confusing, but I'm losing my mind with all this process... :)

I have a question regarding the form DS230 #14. My wife (USC) took my name after we married, question #14 ask for maiden or family name. Therefor we decided to put her maiden name. I read in another forum people using the new family name but why would they mentioned maiden family name.

We sent a copy of our joint bank account, we decided to open one before applying as we are going to need it anyway it was better to have it earlier.

I don't know if this made any difference though... we got our I-130 approved in 89 days we sent the new form

I'm trying to read the instructions about the I864 on travel.state.gov but I have some points that I can't figure out.

Situation:
Ok, my sponsor (the petitioner) does not meet 125%, she is still making something so she will sponsor me. Her parents definetly meet 125% and they accepted to be a cosponsor. One of the cosponsors is selfemployed while the second is employed. My wife sponsor is employed too.

Question 1
Which forms do they have to fill out
I864, I864EZ I864W... I don't understand.

Question 2
3 years of tax returns, are these documents available at IRS offices? If they can't find them at home who should they ask?

Question 3
How much is the IV fee for NVC (CR1 visa)? 380$ or 350$ the internet site of state.gov says the latter, in the forum people payed 380$.

Question 4
Where can I download the IV fee so to get it ready to send it as soon as NVC sends it out?

I'm new too, we just called NVC yesterday and found out that they generated the choice of agent, so what I did was to try James' shortcuts. I e-mailed the choice of agent and try to follow step by step the link to james shortcuts. It seems overwhelming if you read it, but if you do it step by step it doesn't seem to be impossible. I tried and printed out the AOS fee... just try, you are going to save a lot of time.

From what I understand your approach is exactly the NVC approach, of course you should prepare everything in advance so that you can mail it back to NVC as soon as requested. You'll be fine, if you are not sure no need to risk. Personally I did e-mail my choice of agent as soon as generated and paid the fee too following JSC. I'm not so sure about the I-864... you'll be fine!

Go for K1 Visa, it' called fiance visa, you will have to marry her within 90 days when you enter the US on that visa. So far seems to be the fastest.

If you guys decide to marry than you'll have to apply for CR-1 visa with I-130 and than as soon as you receive the NOA1 from CSC you'll have to file a 129F for a K3 visa. This is the process I'm following.

Any american citizen can be your sponsor, tipically is your fiance or spouse, maybe it can be a permanent resident too, I don't know this.

Good luck, anyway, look up K1 visa and if you decide to get married first CR-1 / K3 visa, these are your options.

As far as I know the OF form are obsolete, we now need to file the DS-230, and depending on your country you will have to file only part I or both part I and II. Probably you will need to file them both parts with the supporting documents, I would suggest that you provide them with certified copies and keep the originals.

At the embassy in Neaples they schedule the medical one day before the interview, and they give you there all the shots, take the blood samples and so on...

It's not cheap but, it seems to be the easiest way.

Well, my wife just called NVC, they received the AOS fee yesterday (sent 7/25) and they said to allow 15 days to process e-mails, this is the time they need right now! So today I got my choice of agent in the mail and I'm thinking to express mail it back tomorrow, do you think this will hurt? What will happen if they receive the two (e-mail and printed form) forms?

hi guys,

Last week (7/24) following JSC I e-mailed my choice of agent and printed out my fee that my wife sent the next day with overnight mail. Today, my wife called NVC again and the automatic system is still saying that my choice of agent has been generated nothing new. Should I worry. I haven't received anything from NVC and I'm sure that they received the fee. Anybody has a similar experience. Tomorrow my wife will try again to talk to an operator.

In my understanding yes there should be no problem sending the DS230 before the affidavit of support, you are sending in one as petitioner and one as agent, they will process the case after they receive both.

How long from case complete to interview depends on your embassy or consulate, they all have different waiting lists.

Fill in your timeline, the more people introduce the datas the more accurate it is.

Well, at least you guys are together! It will take a little longer, but as long as you have everything ready before they ask you the docs and you use express mail you can still save some time. In my experience mail sent from the US take about 6 to 7 days to come, in my case to Italy.

Procedure are different depending on the country. I was reading another thread about this. As far as I remember if you have to send to NVC part I & II of the DS-230 than they schedule the interview, otherwise if you only send Part I to the NVC is the consulate that takes care of that. and the waiting time depends on the consulate, there is no general rule.... as far as I know

In my case it took them 16 days to process my e-mail, maybe you could download and mail the choice of agent with express mail. At the moment NVC seems to be overloaded with e-mail. If you have 2 case numbers use 2 e-mail or two envelopes. I don't have direct experience with this case but that's what I would do.

I honestly don't think a lawyer can speed up anything more than you can do yourself by using the shortcuts and having your SO in the US call everyweek NVC to find out where you guys stand.

Actually in my experience a lawyer doesn't send the document right away but they lay on his desk for a while before they get to it... just my bad experience!
But with a lawyer you have someone that is supposed to know about immigration and how to fill out forms right... that's a plus.

The name issue on that part shouldn't be a problem, NVC is more focused on other stuff. Honestly they seem to be way less formal than USCIS... of course we can't stretch it too much smile.gif
