K-1 Fiance(e) Visa Process & ProceduresPossible to change a K-1 to a K-3 in midprocess?
Me and my fiancè have a funny situation. He is Albanian but we live in Italy. I have already applied (6 months ago) for a K-1 fiancè visa for us to go to the U.S. Just recently the opportunity has come up for us to have residency papers in Italy. Our K-1 application has already had the first part approved and we are preparing documents to have the interview that will be held in Italy. I don't know which will come first but is it possible to change the K-1 into a K-3 visa where we could remain living in Italy but he have the K-3 multiple entry to U.S. visa? Or is it possible after having the K-1 approved, us go to the U.S. and marry there but then be able to receive somekind of multiple entry visa and not make the change from non-immigrant visa to immigrant? From what I understand, if we begin the process of applying for permanent residency in the U.S. he is not allow to leave the U.S. for long periods of time. Is that correct? Are there such things as exceptions like for job reasons that would allow us to live outside of the country? Just trying to figure our options before we have to chose between countries. Any info is appreciated. Our goal is just to have some place we can call home and build a family. Thanks

Just to add info. Anyone who has to get a police certificate (Certificato del Casellario Giudiziale) in Florence Italy, it's not through just any Procura like the embassy says. Go to the Casellario Giudiziale which is located in the Tribunale building in Piazza San Firenze (close to Pz. Signoria.) They are only open from 9am till 11:30am. You will need to buy two stamps beforehand (called marche di bollo), from any tobacco store, one for 14.62€ and another (if you get the urgent one which means they give you the certificate right away) is for 6.20€. If you are getting the certificate for someone else you need that person to fill out a simple form that just asks when and where they were born and a signature. Then you need a photocopy of their passport. And you will have to present your id too. They excepted my U.S. drivers license that I said was my I.D. card, but to be safe might be better if you have your passport. It will not matter if the person is or was a legal resident. They just check the registry if there is any criminal record of that person and if there isn't the certificate will say there was NULLA (nothing) in the registry.

(Just everyone keep in mind this info is for Australian immigrants but I though it might help)
I myself have to get 3 different certificates. So far some differences from what is stated here, in Albania they asked us to present a personal certificate and a family certificate. Not sure but could be because a non family member went for us. Also the address for the Ministry of Justice in Albania was given to us as being on Buleavardi Zogu I in Tirana and the name of the certificate is called Deshimi. As for Greece, I tried going to the Greek consulate here in Italy and they told us that it could only be acquired by someone in Greece. I have read but I'm not sure how accurate it is that the Greek certificate is called Pinikou Mitrou. And that they possibly ask for names of both parents of the person who needs the record in order to confirm identity. I have yet to go to the Italian procura.

I have read that they put a lot of weight on your income and whether or not you have ever been on benefits in order to judge how likely you will be capable of supporting your family and not going on welfare. It can help you (to show you are not just an unemployed bum) and go ahead and file an American tax return. You will probably be able to file for the foreign income exclusion. You can find it all on the IRS website. (They even give you longer to file taxes when you are overseas) That and a letter from your employer or if you aren't earning income a letter that explains why you are lacking years of income tax returns. (and of course the co-sponsor to fulfill the income requirements) Even to say you were a student is sufficient.

Again, this boils down to intent... if the intent is to use a student visa to come to the states, get married, and stay... That's fraud, using a visa for purposes other than what it was designed for. There's visa's for immigration via marriage. People should use them.

It's not fraud if the fiancée comes on a student visa, gets married, and the K-3 process is started at that point. The wife would then return to the home country when it's time to complete the K-3 application, etc.


I'm not recommending committing fraud. But if there are real intentions to come to the U.S. to study a student visa is a good way to do so. And it is also good for the couple to have more engagement time before having to decide if they really want to marry or not. If while you are a student you fall in love and get married while you are still in the U.S. legally you do not have to leave the country to file for a K-3 visa. I know through personal experience that this is not so. You file to adjust status and apply for permanent residency after you are married. Of course best to look at Homeland Security's website for the details. You do still have to file an affidavit of support.

Did you file also file a K1 for your ex-husband? They may just ask extra questions as to your former marriage but probably won't even come up. You could always attach a note of explanation to your forms if you feel it's necessary. Especially if you aren't able to be at the interview. One thing to keep in mind if your ex-husband got his green card through your marriage that means at one time you filed an affidavit of support for him. Which means your responsibilities to him don't end until he is a citizen or has worked to earn enough credits with social security (about 10 years). Your responsibility to him as a sponsor to his residency does not end with divorce. This just means that when you calculate your income requirements for your present fiance you will need to include your ex husband in the family size. On the second question, my fiance is Albanian and we reside in Italy. Ours took the full 6 months from NOA1 till NOA2 approval. It kind of seems like cases get lumped together though cause I've seen other cases approved at the same time as ours but submitted later than ours was. But it might also depend on which service center is processing. It seems though that they aim to complete the cases within 6 months. It does take a little bit of time to prepare the next steps and get the interview scheduled.

We just finished a Skype conversation. He uses a skype phone (or internet when available). In USA we only have Skype on PC. Your work is useful and always in demand. Send to your girl a copy of your diploma (laurea) in university to make a translation. It will cost about $100 but you will find it money well spent.

To eat here, you must believe every horror story that you hear. Sorry, but you will see the health of many people here and know why. Bravo to you because you can cook...but be careful the meat is different and più schifoso. Most produce will have a little less flavor unless you buy "organic". However, you can eat well but you will miss many things. (fresh mozzarella, all seafood, good bread, spicy food) My Benito came to enjoy Japonese and GOOD Chinese food.

You will not have a problem with speaking here, especially in California. In North Carolina Benito had trouble because of the accent is very full of slang. We speak Italian almost exclusively with each other, but I am also a teacher and I have Italian students often. Sometimes I repeat an entire lesson for them in Italian so I hope that my grammar is not too bad. Right now I see that your comprehension is good and you make common syntax mistakes that I see in all of my students. (They are nearly always the top graduates in my classes!)

You should encourage your girl to learn Italian for the sake of your future family. In many cases in the USA the culture of whichever country is lost forever, and the door to preserving your heritage is language.

We will be in Napoli in April, but we have not made plans for a long stay. If you live in the city we can certainly take a caffè or lunch together, no problem. Benito can certainly tell you a lot, he is from Calabria. While you wait, learn every small piece of information about immigration, USA, and California. there's nothing noble or rare...the thing that she had son with the wrong man is not meaning that she must be by herself for the rest of her life....specially because she's my love...she's special for me and I want to be the one for her more than anything else in my life...I love her more than my life. I'll teach her when I'll be there even if right now she's studing on the book but her enerises are not so much...everyday she wakes up at 4 to go work...she's nurse and it's very stressfull job....but she's the best nurse in her hospital and I like to show this off.

1.pick up the "super Zero Mondo" like cellphone from the company "3"....he will pay every call to the italian housephones just 15 eurocents and he will have 1000 minutes every mounth (if he wants to use the cellphone)

2. I'm going to link in U in privare the site where he could find the card that I was telling U...they will give him a code and any phone numbers....her will have to call the phone number and make the code and afther your phone number. Lass than 10$....u'll call for 30 days...it's cheep and very easy.

what's my job? OMG it's a a big question...could be more simple tell U what is not my job biggrin.gif

I can fix pc, cellphones and other electronic stuff; I can make pizza and cook like chef; I worked in a big store like seller; I have diploma like surveyor and I'm cad dseigner...I'm always in the tecnologies and I never was scared to learn something new...I also made jobs like builder, baby sitter and entertainer. For passion I'm basketball player/coach...what else? biggrin.gif....I forgot, I worked in a telephone customer care.

With my girl the story was long....I saw her the 1st time on a pubblic video chat...I didn't have camera and I was so attracted from her that I was not able to take off from her virtual room. But she was keeping on ignoring me until I didnt buy a camera and I prayed her to talk to me...from that moment we switched our msn contact and we spent all days 24/7 together...at the start she way paying bills like 800$ because we didnt know other ways to hear each other when we was not home...but I searched and I picked up a plan very good....with lass than 10$ at mounth I can call all house phone and all cell phones in the usa for 30 days without limits...I just pay a normal call to house phones in Italy...very cheep and good.
She bereley come out from a very bad history 14 yrs long with her ex...someone lazy, fatty and rough...they was living with her mom but she kicked him out in november 2007. At the start he was going at her house everyday and everytime I was checking her status and taking care of her with her mom and her brothers but little by little he's going away even if he keep on saying that she's his private business and nobody could stay with her. We had myspace and we hat to erase it cuz he found that out and he started to threthen us overthere...one time happened that he waited her outside of her friend's house and jumped into her car...using knife to force her to come back with him but fortunally nothing happened and from that time I promised myself that I was going to keep on taking care of her...givin her advices and making her think about whatever option.

She's stronger girl and he understood that...and he knows that this is coming from me and I'm very proud of her...together nothing and none could stop us. I need to take care of her life more than everythingelse in my life...more than take of my relatives...she's part of me....right now I'm listening her sleeping in fron of the camera and U cannot understand what kind of joy I have feeling her quiet and relaxed. I'm proud of us we're growing up together and that's the best thing could happen to me.

I studied english in the school but a lot of time ago...during this year I keep on improving it but the funny thing is that she learned my way to talk and she's not correcting me nomore...I hope I'll dont have problem with lenguage because right now we talk just our language and it's so funny biggrin.gif

thank you for moving in the right place and even for the advices...are very preciouse...but I also know my feelings and how love...it's so strong that I cannot leave it without try the best of me to make it true.

I'm not risking my future there's not another mom for my kids in this world...I'm sorry for what happened about U and I'll remember your words if I'll be wrong but right now I'm jumping in this story so that I'll be never regretting anything.

The love is a big adventure but if u're not brave u'll never enjoy your life and that's the way i always thought.

U can always say yourself that u tried and U gave a chance to the best love story that u had...obly the end is terrible but nobody will give u back that experiences of that moment...look at that in a positive way...the life is beautiful because can always shock us with something new.

Yes you can file on the first day, as you will have met in person by then; you can prepare the papers and things (such as birth certs etc) ahead of time. Once you get to the US, you can make a photocopy of your plane ticket, passport stamp, and maybe take a photo or two of you two together as a couple, and then send it all off. For the rest of your stay, keep hotel recipts, take more photos (ideally with friends and family in the photos, that shows that they know and approve of the relationship), for bonafide evidence at the interview.

It bears saying that you do not need to live together/ be in the same hotel room for the "meeting in person" thing. As she is having trouble with her ex, you could always visit as "a friend of her brother", maybe even stay with him and she can visit you, thus the ex won't suspect anything.

Hi,
I need to have few information.
I never met my girl cuz a lot of reasons but now the time is coming and we are planning about a K-1 visa.

I knew her online and I helped her to come out from a bad story with her ex and little by little we fell in love for each other...is 1yr and half that we are always together online constantly 24/7...spending even the time that we sleep online on camera....so I was thinking that now is the time to meet each other and try to make her my wife if everything when I'll be there, will be good like I think.

1. About the proofs that USCIS ask to have...can I use present's receives, letters and other stuff like that, coming from before the day that we met in person?

2. Can I say at the POE that I'm coming to visit my friend?

3. I have problems to find the prices of all the k-1 procedure....how much is going to be +or-?

4. How long I have to wait in Italy afther that I'll have my 1st trip in the USA?

My fiance and I posted away our application on the 24th of Jan 2007 and still have not recieved the NOA1. The delivery of our I-129F was made to Nebraska and the cheque that was enclosed has been cashed.

Any ideas, why the wait?




My fiance mailed our application on the 30th and we haven't gotten any NAO1 either, but the cheque got chashed a week ago. I was also wondering why it taks so long especially seeing that most get it a couple of days after it was recieved.

So it sounds like your statement should say something like--
I have not included tax returns for the years 200x and200x for the following reasons:
-- in the tax year 200x my income was $0.00???? and according to IRS guidelines I was not required to file a return .
-- in the tax year 200x my income was $???? and according to IRS guidelines I was not required to file a return .


And include a statement like
I, Mary Jane Smith, certify under penalty of perjury under the laws of the United States that the information I have provided in this statement is true and correct.

<Signature and date>

Here is my story... in 2007 I moved to Italy for two years. I was not working because in Italy it is impossible to get a working visa. I have no clue what to write in my explanation letter of unemployment and why i did not file taxes for 2007 and 2008. Is there any special requirements needed on the letter.

I too, don't think that a few months every summer for a family visit wouldn't be grounds to have his green card revoked.Thank goodness Officers have famlies too. As long as he won't be working in Canada, and like you say, his purposes for going are just for visiting, all should go with out a problem.

For some kind of security upon entering the U.S. you might have your husband collect as much info. before the travel, that will prove to the officer that, yes, he has always intended to reside in the U.S. Proof of strong ties to the U.S. could be....(let me break out my stars....)

:star: letter of employment, work schedule and requested vacation, pay stubs, w-2's

:star: U.S. drivers licence, bank statements,ongoing payments

:star: letter from landlord, housepayments, rent reciepts, etc

:star: doctor bills, memberships.....

We just got home from a visit to my family of 20 fun filled days, but it's never enough is it!? Hope your husbands future visits will be good ones!

I'm the male and the foreigner, my wife is US Citizen. I was employed in europe and now I'm studying for my MBA.

My wife was on medicaid or medicare before we got married and now is applying for a similar state run insurance. I will get insured through my college. I read somewhere that the food stamps don't count as financial help... might be wrong.

Hi I finally made it to the US but right now we have this problem, I am a full time student and my wife is not making less than enough for living, I bought her a house and cars but right now our income level is low and she applied for medicare for her and HER daughter and food stamps too.

Will the food stamps be a problem for my conditional residence situation I'm here on a CR-1 visa and my green card will expire in 2 years from now.

I I just want to cross check if I got it right before I write it in my calendar.... I entered the US on Jan 13 2008 with a 2 years (CR-1) visa. I have to file the I-751 90 days before my green card expires right? around october 2010.

Hey, congrats, I've the same problem, we got the I-130 approved and never received NOA1 so we still decided to apply for K3 sending I-129F to keep 2 doors open. Now, I honestly think that the CR-1 will go through faster. As far as I understood reading in the forum most of the opinions seems to be that it is possible to have both paths open. Am I right?

We are now waiting for any movement, I hope the choice of agent will come soon from NVC as a sign that things are really moving.

Just an update on this, I have been in the US for 3 months, tourist visa has now expired and I'm back in my country. Well, the reason why I needed a tourist visa was because I have been arrested once in the US, for a traffic violation, something that in my country would be punished with a fine. But for this reason I can no longer be WWP.

Anyway, the process is now rolling, just need more patience
