I personally would stick with the K3 visa. Get your loved one in the country and then apply for your AOS and Green Card. It may cost you $1010.00 more, but honestly, money is money. Being with your loved one ASAP, is much more important. You have 2 years to apply for the Green Card.

Im the beneficiary, and my wife is the petitioner, she has been here (in Italy) until august 14th, she waited here for that reason, so now watiting a couple of weeks more, but enter the us with all the benefits of a permanent resident i think is better.. Not because of the money, we spent plenty of money with plane tickets and stuff, but for the working situation, because she is the citizen, and she cant find a job because she is pregnant... So I will be the one to provide for everything, and going there without a working permit will mean living under a bridge °_°

Hi everybody..
Today my wife received in her email the packet 3 for the K3 visa..
My question is the following.. Since I got approved for both I130 and I129F at the same time, is it worth to go on with the K3, or it is better to wait for the IR1?
Another big question, does anyone knows if there is an expiration date for the forms to be sent out?
And still..... If I go on with the K3, what's going to happen next with the IR1? I will just have to have my docs in the US with me?

Hey there, you may have figured everything out by now on this post but I just wanted to let you know what I got in the Packet 3. The instructions said that in order to schedule the interview (in Naples) that I have to send in only DS-230 Part I and Applicant's Statement in order to let them know that I have finished gathering all the documents needed for the interview. And that everything else has to be presented in the interview. Then regarding the proof of relationship. I found that the proof has to be sent in as part of Form DS-156K Nonimmigrant Fiance(e) Visa Application. In any case, it's recommended that you have a copy of everything that the sponser sent in the original application.

It's not an automatic work visa.
It allows you to obtain a temp work authorization (90 days upon US entry), big difference.
You'll either get that at JFK or some landline borders or by applying for one with USCIS (which is kinda pointless cause the time it takes to process the application is pretty much the 90 days time frame mentioned above). You are not allowed to accept employment without that permit. The K1 alone doesn't do it.
And believe me, not every POE will issue the temp work permit. Atlanta for example sure didn't. If you want to make sure you get it when flying into the US, enter through JFK.

Well I can finally believe it now that I have the visa in hand! Just got it in the mail today. Plus the sealed envelope which I saw from someone else's post that I'm not supposed to open it. There are no instructions or anything so I was just wondering who does this envelope go to and what do I need when we enter the U.S. I've heard I should ask for a work authorization stamp. We will probably be entering into NYC. I'm the citizen and he's Albanian. Will we have to enter in different lines? And will he have problems because he doesn't speak English? I also just realized that at the interview when the returned to us our original docs, they forgot to return one of our police certificate originals. Will we need to submit these certificates again at sometime in the future? And should I just go ahead and get another one while we are still here? Thanks.

Did they also send you an email packet? We did ours all with forms they emailed us and had no problems. I heard them when they were interviewing other people that some of the forms they had been sent were outdated and they were filling out others but they were all K3 applicants. It wouldn't hurt to do both since they are pretty much the same. The only extra hassle is getting them all notarized. Plus I believe the I-864 is little more involved requiring the tax returns. We had printed out bank statements and had a letter from the employer which they did look at. Make sure that you have a photocopy of passports of both sponsors because they told me it was very important. They seem to look closest at the cosponsor info. In any case, I had done the I-134 for our K1 Naples interview but I believe that when we get to the states, marry and adjust status we must also do the I-864 for the adjustment.

I think you will have to get that test even if it means rescheduling your interview. That or else get a family member in your country of origin to hunt down some records from the state or maybe even the schools might have it. The vaccines are necessary for U.S. entrance. You really don't want to go through the hassle of paying for train tickets and hotel in Napoli only to hear you have to go back for these records or test. You may try calling the Institute where they do the medical exam to ask if they can administer the test your speaking of. Maybe they can rush the test results the day before your medical interview. I'd recommend finding someone who speaks Italian to do the call though, cause their English isn't optimal. Good luck!

Welcome to our little bunch, glad to see you here! I've posted in your DCF, hope I was of some help, about your husbands US jobs, just keep asking around, I'm sure someone has had a similar experience, (I used a joint sponsor)

as far as transportation and hotels go...

I do remember 3sila and mollyrena mentioned hotels a few pages back, but it dosent look like they had the best experience there. IMO downtown Naples isn't a nice place, I mean yes there are things to see, eat but....

After calling many many many times and insisting, I finally discovered that the Immigration Office in Naples only takes calls on Tues and Wed at exactly 2 - 4 p.m.

Best luck when I called at 2.00 on the dot!!

The "operator" will connect you to the office, and it may seem like the phone keeps ringing, but your really on "hold".

I don't think that they will deny the petition and put you back to square one. He might get some kind of pending letter, maybe they will look at the other documents, and tell him as soon as he has the BC to come back. The people at the Consulate really were polite and patient, don't be scared, u 2 don't worry too much, it will work it's self out, you'll see!

Sorry I didn't see your post sooner. I'm glad to hear your progress, and yes it seems simple until you sit down and actually do it. I dont know how many practice runs i did until i felt confident with my answers. Keep in mind that those forms are used for all kinds of visas, not only for spouses, (children and relatives) so they can be confusing, i know, you'll be fine.

:star: I went and double checked my forms, and I used my Italian address on all. Once i think it asked for U.S. domicile address, so only there did I put my U.S. address, on all others I put my Italian address. I did that becausue I've been living in Italy for 5 years now, and in the last year I've taken steps to "re-establish domicile in the U.S. and I included all that info seperatley for the I864 docs, in case they wanted to see my U.S. ties, which they didnt ask for. I also wanted to put my Italian address because I wanted no confusion as to where to mail documents from the Embassy. I called once and asked, and they pointed out that the petitioners address was requested more for mailing purposes.

So on every form I put my Italian address.

:star: I printed out the whole form, 4 pages was it, which included 2 pages of identical bio info, one for each spouse.

:star: We have a bank account at monte dei paschi di sena, we went to a main branch (sede in italian) and asked for a "assegno piazzato" a favore U.S. Embassy Rome, in U.S. Dollars. The I-130 packet was clear that it should be payable to a U.S. bank and already in U.S. dollars. We got it one the same day if I'm not mistaken, I don't remember waiting a week. The check was payable to the American Express Bank LTD. of New York. Have you called the Embassy, and asked them if there is an alternate means of payment? Ask if you can send a western union money order or if they have any other suggestions.

What is the fee increasing to? If it's soo much, will you consider going to Rome? In my opinion there is an advantage in paying in person, it seems, seems, that compared to another person who started the filing process who personally delivered the I-130 and mine, which I mailed, well they had a faster I-130 approval date. It could have been because that person didnt file during the Adam Walsh Act mess and I filed right at the begingin of the confusion, but I called many times and mine was just jumping from room to room, waiting to get on the right desk. So there might be that advantage if it is possible for you to file in Rome personally.

you'll need the DS-230 part 1 and 2, youll fax part one to the Consulate when they get your I-130 approval info from Rome. but youll keep part two and sign part to at the interview with the consular officer.

the consulate later, super later sent me these forms which even are expired! So i filled out both just in case, and gave them the ones that I downloaded from uscis.gov

Hi and welcome to our little bunch, glad you found your way here. In no time you'll sort your options out and find the right one for you and your husbands needs. Don't put too much worry into the process like I did, you'll see in the end that it wasn't that bad at all, quite simple once you get the hang of things really, so set your worries aside!

whattodo did a great job of explaining things, nice and simple unlike me....

First things first, do you have a permessio di sorrgiorno/Permit of Stay in Italy? You'll need that to be able to use the DCF option.

You mentioned "Well, it seems as though that fast track may not exist here in Rome."
If you are talking about DCF an option in Italy, Rome/Embassy just takes care of the first thing you will file, the I-130. I believe yes, Italy still offers DCF or have things changed that much since I filed? Here's the number I called quite often: 0646742190

You will send just the I-130 form and the documents they requested to the Embassy in Rome who will process just those papers. Looks like they take about a month to be approved. After approval, they will contact you stating that the I-130 Petition for Relative was approved and sent to the Consulate in Naples for further processing. In my opinion, all the staff at Rome couldn't have been more polite and helpful. I'm thankful I was able to call them for any concerns or questions.

Naples, will take care of the other forms and surprisingly was also wonderful to go through in my opinion. Yes, they were slow sending us papers, but in reality we didn't need to wait on their papers because you can download and print everything you need from the internet! We were assigned an interview date really quick too. There are easy as cake to contact for questions on Tues and Wed, and are SO laid back, they asked for those required documents at the interview, (birth certs, marriage certs, etc. ) and that was pretty much it! I'm sure every case is different, but if yours is straight forward, they will be staight forward also.

Our whole process took 3 and a half months! They estimate that it will take 4-6 months. That wouldn't happen in the U.S. as far as I know it's more like 6+ months!?! It would have been even faster for us if the Adam Walsh Act didn't confuse and put a hold on things at the Rome Embassy for us! You can look in the processing times or the immigration timelines tabs at the top of the page and get a better idea as to what the california service center looks like. I haven't done my research, but in my opinion DCF is generally alot faster!

You might need to consider the I-864/Affidavit of Support, it is a form stating that the spouse immigrating will not become a public charge in the U.S. (ask for food stamps/other help from the U.S. goverment) You will always be the main spronsor for your spouse and only U.S. income is counted. If you have no or not enough U.S. income (i think its some where in the 16,000$'s per year or xxx much cash) you'll need to get a joint sponsor who is a U.S. citizen and makes more than that to support your spouse.

If you just do not have anyone to be a joint sponsor THEN I would consider you going to the U.S. continuing to work for the I-864 purpose, keeping the 16,000+ amount in mind.

So my vote is DCF. I'm thankful we were able to do it! But then again I don't know so much about the U.S. route, can your husband be in the U.S. during the process over there? I thought no, but I'm not sure. All i know is that it seems to take longer. Sorry I'm not much help, you might try to post there too and see about others, or check peoples timelines.

Another thing i wanted to add. If your married for less than two years at the time of the visa approval, (called conditional) your husband will later adjust status in the U.S. if instead you are married for more than 2 yrs at time of visa (called unconditional) then he will not havve to adjust status later.
cr1=conditional=married less than 2 yrs and ir1=unconditional=married more that 2 yrs.

So, I would suggest the DCF Italy route to everyone! lol

When you reserve the room, say the room is for __your last name___/__his last name__. Or when he checks in, have him give them your last name for the reservation and then he'll give his documents. I really don't think they'll care who's staying in the room as long as it's paid for, lol, and they're not all that strict here in Naples, I doubt there will be any problems. Just explain that the credit card last name and the person staying's names are diferent. Dont sweat the small stuff, if i were you i would make the reservation and payment over the phone, that website with out the contact number seemed a little strange to me... Good Luck on that part!

In a nut shell it says that you'll need the Vaccine Certificate from the ASL for the Medical, 180 Euros, pictures (how many, was it 1?)Interview: origional documents for them to verify the copies that you'll give them, asked for passports, marriage certificates, divorce certificates, any military or court documents, husbands Birth certificate (the one with his parents names and places of birth). DS-230 form 1 and 2 (we faxed them part 1 like they asked but found out thtat they didnt have it on file.) part 2 unsigned, evedience of relationship, I-864's.

Good luck on the petition fee, they did us a huge favor by accepting our cash, I'm sure they only did because it was a particular situation, but again ask. They are always very kind and helpful. As for the BC, simple, we went to the County Hall in his birth city, the records office and asked for the BC articolo 3, we specified that we needed both parents names included and they pulled it up from their files and printed a recent BC, I think it might have cost a couple of Euros or so.

In the Packet three they sent, they requested a recent marriage certificate.

Good to hear your starting to get those first steps down.

Hi guys.

Is it true that you have to pay the petition fee in Rome with a cashier's check or money order from a US bank (or cash if you're delivering it in person)? People doing DCF in other countries talk about their credit card being charged... I know, this is Italia...
Luckily, I'm planning to be in the US in July and can get a check while I'm there and, luckily but unhappily, I just noticed that the fee is going UP, but I'm just wondering if there's some other way to pay, by mail from Italy without having to go get the check in the US.

And do you know if the fee for the immigration visa (thru DCF) will be the same as for AOS? I don't see a visa fee on the new price list.

I hate that I don't have good info's on that for you.

We did the check, payable to a U.S. bank and in the very end it went back to the Embassy because it was more than 6 months old. Our case was put on temp hold. I freaked thinking that it was going to be a mess to do that all over again. So I called the Embassy and the nicest lady said, just send cash through UPS with your information to the same address that the petition was sent to. So we did. Not the safest thing in the world, but it worked for us. (thank God)

If I were you, I'd just give them a call, and ask if they would accept a Western Union money order (which are everywhere) or if there are different ways of payment. One would think there would be.....

but I had a lot of time to prepare for the interview and while strolling down
memory lane, things just… accumulated! I’m glad your having a good time too. (L)

Molly- My husbands medical took place in Vomero, which is far from the Consulate.
We live in Naples (ONLY FOR THE MOMENT!!) so that wasn’t an issue for us.
The Consulate advised us of where it would take place when we got our interview
date. I don’t know if there’s something closer, you’d think they would try to organize things
that way, for our sake, but… seems they don't. Anyways the Instituto Varelli was very nice,
great staff, and easy enough to get to. If you need very detailed driving directions, let me know! ;)

3sila- What does that mean exactly? :o That they are taking more time to look over your documents/
evidence? Is it a bad thing or does it mean just waiting? Sorry to hear about that, hope all turns out well.

Hi everybody!

:star: The Naples Consulate did the interview, which was over at about 10.30 a.m. an told us that he should come back at 4.00 p.m. to pick up his visa.

:star: In packet 3, they asked to bring documents and evidence of relationship, which could be anything you have from a statement signed by the beneficiary and the petitioner swearing that they met at a certain place at a certain time, with photos to show the two people were together. It could be wedding pictures, letters from family or friends recognizing you two as a couple. Plane tickets you used to visit eachother. Anything that shows you two do have a real relationship.

During my husband's interview, they asked ONLY for our marriage certificate, and then a few simple questions like how did you meet. We took lots and lots of evidence, just in case they wanted to see it.

:star: The Naples Counsulate accepted documents written in Italian and English. The Rome Embassy only accepted documents in English.

Molly- Hey there, welcome, I'm glad your getting something out of what I've left, I really need to organize a better post on the topic and ask to have it pinned. I will. Anyways,

:star: No, a statement from the Beneficiary saying that no court, military or divorce IS NOT necessary. I went overboard and did that anyways, I didn't know what to expect. They simply asked Were you in the military, every married before?

:star: No, stato di famillia is NOT needed either, once again I went for overkill. :blush: I had planned to use it for Evidence of Relationship, it wansn't mentioned anywhere at all, somethign I threw in.

:star: No, I don't think it will throw the officer off, just throw a few in to be on the safe side, ONCE again, I over did it and had 40 of documents and evidence to tote around all day...lol @ me.

Our I-130 was approved by Rome on Feb 23.
Naples got our case on March 5th.
Packet 3 got to our house on April 10th.
Our Interview was May 7 and 8.
The visa was issued on May 8.

In one of my last posts I gave almost all of the information that they will send, so from that you can already start to get things ready, instead of waiting for packet 3 to get to you. That way you will already be prepared.

We got our MC in the same county where we were married in, Naples. It just took a second for them to get the record, print, stamp and sign another one. At the Consulate at the interview they asked for that and it was just fine. Our other one was from 2004, so we thought we'd be on the safe side and get a more recent one, which was like 8 months ago. While we were in the county hall, they did say that every thing expired except for a BC & Death Cert. Don't ask me.

where are you again, i've totally forgot or have a foggy brain from my needed nap. Where are you and where is he? Not too sure when we will be in the U.S. Hopefully sooon! thanks again for the support you left in the DCF section before our interview, i dont think i mentioned it there.
