Hello All,

So I am at a stage where I have to fill out I-864 form. I have not filed for taxes for last 3 years because I have not worked due to finishing college. Now is it required by law that I have to fill out I-864 form even though I did not file for taxes? Also my uncle is helping me as a joint sponsor (who meets 2009 proverty guidelines) for my spouse. Is it OK for me to just submit my uncle's I-864 form and not mine?

As far as I remember it is fine, as your uncle is the sponsor he is taking responsibility for your spouse. I assume you should file a statement explaining why you did not file taxes, but yes put your uncle info as he is the sponsor.

Hi All,

I was just trying to collect all possible stuffs that I need to carry with me for the Visa Interview.

I got married last year but it wasn't a social marriage.We had very less time so only my parents and my husband's parents were there for the formal temple marriage followed by the court marriage.2-3 close friends of my husband were also present as witness.
So we just have very few pictures say some 10 pics.But the pictures are very much evident of our wedding.
I was wondering if the count of pictures really matters and if the Counselor will be satisfied enough with them?

The social marriage is planned after I get my Visa,so we don't have any wedding card as well.

Can someone let me know what are the important stuffs that I need to carry in the above scenario?


I don't think quantity is the issue, you have to focus on quality. I sent a few pics of my wedding, I sent evidence of an ongoing relationship like printouts of my email accounts which showed that we emailed each other, phone records, airway tickets, post cards. I had a very easy interview, the person asked a couple of tricky questions about my wife's family to make sure that I knew about her for real, but that was it. As soon as he realized that we actually knew each other he was satisfied.

Don't stress too much on it, if you guys are married for real than you'll be fine!

Hi Tyler,

the consulate in germany, as far as I know, will accept documents in English or German, you will need to translate anything that is not in english or in the language of that country. Everything you send to the US needs to be translated in english.

Hi, no she is not over 125%, she might be even under by herself that's why she gets the stamps. And yes we have a cosponsor for the affidavit, that's her parents, they both work and have no more kids to take care... so it should be ok. The funny thing is that we need the affidavit but I'm the one that will provide for both of us...

we are filing for K-3 visa, my wife (USC) in the US, as she has a low income and 1 kid, could ask for food stamps. will this mess up our petition?

Her parents will write an affidavit for me when we will have to present the documents. I told her to go ahead and ask for the stamps. If the government would let me go there I would take care of my family but I can't :(

What do you guys think?

The way the embassy works for any kind of Visa is that you pay to the bank they tell you prior the interview and go to the interview with the proof of payment. If you contact them they sure can tell you to which bank you need to go, and I'm sure you can find one close to where you live.

The amount of the payment vary according to the visa type.

What are you saying has an expiration date? Yes, if you don't respond with the evidence in time, you'll be starting all over again. It's a bad result but one that could have been avoided by carefully reading and following the instructions that come with the I-130.

You are absolutely right, I work in Italy as a contractor, and I know that you have to read everything 3 times, and you are lucky if you dont miss on anything, but I couldnt be the one to file the petition for myself, for the only reason that I was in italy, or else we wouldn't have gotten any request for evidence... After all it was clearly written what they ask for... But you know, who never had to deal with legal papers just think of it like "ok, whats the worst thing that could happen" or "what they need this for??" and actually, this is it, wasting 7 months waiting for a paper, and then not beeing able to accomplish on anything, and everything turns into a waste of time and money...

The NOA arrived at my mother in law's house, she scanned it and emailed the scan to me, then she mailed the original NOA at my house in Italy, because the evidence needed was here, so I have what they asked me ready to be mailed out, but it clearly says on the NOA that we HAVE to send the original along with the evidence, and now we don't have the original, we called the USCIS and they said that they want the original and no copies or scans....

I finally got the mail, they ask me for an official marriage certificate, and 2 passport size photos of my wife (that is the petitioner)...
My wife sent them the marriage certificate, but it was not translated, i guess that was the problem... anyone had the same request???

The only italian was the birth certificate of the baby, but after reading the guide with my wife, we got it, there was no cover letter and no marriage certificate, and plus, she didnt send them the pictures as explained in the guide...

Yes to your last question. While waiting thoroughly look over that copy of the entire petition that you made before you sent it in. Do you see anything that you missed? They are asking for initional evidence; not sure what that means. Maybe more proof of a relationship?

I have no idea, I copied and pasted what is written on the USCIS website... My wife also sent them birth certificate of our son, the italian certificate and the american born abroad certificate...
Anyway, ill go check the guide for this... THANK YOU AGAIN GUYS!!!

Today i checked my case status online, like i do everyday since Feb, and I saw there was a change in the status... But when I opened the file it didnt look like a nice thing:

Here is what they say:
On July 9, 2009, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested. Meanwhile, processing of this case is on hold until we either receive the evidence or the opportunity to submit it expires. Once you submit the evidence requested and a decision is made, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your mailing address.

Is that normal?? I havent read anywhere on the forum about RFE from the service center, I thought u could get approved or denied.... What is it???

There may be confusion with someone telling you you'll have two sponsors (ie wife- even though she has no money- and co-sponsor).

Hi everybody!
I have this kind of problem, my papers are still in VSC, but seen that they requested me for evidence, and they got what they asked me for, im expecting to be approved soon, so to start the process at the NVC..
I already told someone on the forum that my wife has no income in the last 4 years, and someone told me that we need 2 joint sponsors, because she cannot sponsor me in any way...
Preparing the papers, my main sponsor noticed the basic requirement to be a sponsor (125% of the poverty line), and he told that his income is way higher than that, probably 350% of the poverty line, or something like that, so I was wondering, in this case does anyone knows if i can only have 1 sponsor?

I could find another sponsor, but it will be a self emplyed person, and I'm a little worried that he's not well organize with his taxes and stuff, and im scared to get an RFE from NVC because of the extra papers sent in the AOS package.

Once NVC sends your file to the embassy , the embassy will then send info to the beneficiary. Best wishes.

My advice follow the CR-1 and forget the K3!!!! CR-1 is the best visa anyways!!!!!

What is the difference, for the procedure and also for the type of visa?

I'd recommend going after the immigrant visa (CR1 or IR1 depending how long you have been married) as those couple of weeks of wait time will be greatly beneficial once you enter the US with visa that turns to temp GC until you get the real GC and you skip all the Adjustment of Status processing and paying additional $$$.

I think most important thing is the possibility to work ASAP...

This may be true, for some people. However, some people would like to work the minute they step into the country. And if you read the OP's situation, he does need to work ASAP - which the K3 will not afford him.

Looks like the best way to go for me is IR1...

I totally understand what are you saying, plus we have a son together and its really hard for tha whole 3 of us...
Im the beneficiary, and my wife is the petitioner, she has been here (in Italy) until august 14th, she waited here for that reason, so now watiting a couple of weeks more, but enter the us with all the benefits of a permanent resident i think is better.. Not because of the money, we spent plenty of money with plane tickets and stuff, but for the working situation, because she is the citizen, and she cant find a job because she is pregnant... So I will be the one to provide for everything, and going there without a working permit will mean living under a bridge °_°
