If your case in not in the system yet then I don't know what to tell you. What I find odd is that you already have a receipt # so that should indicate that you should be in the system, or else how would they have generated that number in the first place?

You can check out my timeline and see what I've had to go through with CSC to mail me the NOA1 for the I-130. It's been almost 3 months and I still don't have it, BUT they did assure me that I was in the system. :huh:


I don't have a receipt number, I wish I did, I have the receipt from the USPS because I sent the package with express mail and I have the post money order because I asked the post office to track down the payment to see if they cashed it. I don't have any receipt number from USCIS... I wish I did... I don't understand why everybodyelse gets it within days. I'll have my wife try to call them again, she said they are really rude to her though.

Do you think a copy of the receipt of the money order and a copy of the receipt of the package would be an evidence good enough. If our I-129F get stock like yours it doesn't really do me any good to try it... do you guys think the above suggested evidence could be accepted?

Hi,

we filed our I-130 march 21 to Nebraska that sent it to CSC. They received it March 23 (tracked the package through USPS). They cashed the postal money order enclosed but we never received the case number. My wife tried to call and they said that the waiting time is about 4 weeks. Now they are saying it could even be longer just to receive the NOA1. We plan to file the I-129F asap and this waiting is just making everything longer!

I noticed that everybody on this forum received the NOA1 within days... is it normal to have to wait so long? Any suggestions on what to do? We should receive within a couple of days the postal money order as proof they cashed it, should we try to fax it somewhere?

Is anybody aware of any official timeline?

Your husband will have to file in the US, you cannot pick the service center, you have to file according to his state of residence. With the NOA1 ( the receipt called I-797) you will have to file the I-129F to Chicago.

While you file if you have a job in Canada and you can proof that you have a life (house, bank account, phone bill, car....) you will probably be able to travel back and forth no problem (probably, not sure... at the POE you might have problems). You will have your interview in Canada at the counsular office.

I feel confused too, but this post helped me out too. Our 130 has been approved in 89 days but we never received the NOA1 so we filed the I-129F when the I-130 had already been approved. As far as I understand they will now both go their own way and we will pursue both to get whatever comes through first.

Regarding the CSC, we called over and over and never got an answer regarding the missing NOA1... well, good luck everybody

A person we know is here on a tourist visa and has been in the U.S. now for 8 years can they get married here in the U.S. and then adjust status to a permanent resident, without leaving the country?



an 8 year visitor visa? Legally? If the person is legally in the US for 8 years from what I read here, it would not be impossible to prove that there was no intent to marry when he/she first entered the US as a visitor and that the situation changed with the time. If the person is illigally in the US I guess for longer than 180 days they need a lawyer...

I did e-mail the choice of agent as I haven't received the form yet. We called NVC automated service and found out that the fee and the DS3032 had been generated so, following James' Shortcut, the system is now ready to receive these info. You received it already, just overnight mail it to them, you'll be fine. But yes you have to mail it back in order to proceed with the process.

Farcry, the DS3032 is the choice of agent, you need to appoint your agent, usually people appoint the USC because it shortens the mailing time and the chance that documents get lost. Doing this you just have to send to your husband/wife everything ahead of time so that you guys are ready to send back everything NVC asks for.

You can appoint anybody you want as agent.

Regarding the fee, I have been told not to use a personal check but a money order payble to the Department of State.

Cross check all the info on the deparment of state homepage.

The I-129F would be faster, but if your NOA1 comes. I never received mine, I received only the NOA2 3 months later... and now I still have 2 horses running. You need to consider the delays don't take for granted that the I-797 will come right away.

I had a similar problem, we never received NOA1 from CSC, my wife called a lot of times and every time there was a different reason. We actually received NOA2 and used that to file the i-129F...

I'm one step behind you and honestly I think that my I-130 will definetly be faster than the I-130. And from what I've seen around here, a lot of people waited longer than that to have the I-129F approved, so don't worry about that... you are close to the visa! I'm still waiting for the confermation of my e-mail :(

From personal experience I know it's possible, it's not 100% it all depends the Ukraine citizen has enough evidence to convince the officer at the embassy. Honestly I think it is worth a try... it's your decision. I don't think that anybody here will ever tell you that you will get a tourist visa. Immigration in the US is not a perfect science :(

Take all the evidence you have and if you have some extra money to pay for the fee, try!

Personally they asked me a business card, I didn't even show it to them I just said I had it. But I think that any letter stating that Mrs X is working as.... since and is just going on paid vacation and is expected to be back in her office a certain day should be enough. Still it is no guarantee! But don't panic, it worked for me!

With the K3 you are facing 1010$ AOS fee, and you still need to adjust the status once in the US, while with CR1 you already have the green card and everything. How long it takes it's impossible to say, it depends on the name checks that NVC runs.
Personally being so far in the CR1 process I would stick with it, although now there is not much you can do, just go ahead with the process and than take whatever is there first. You are 380$ away from the CR1 visa.

I don't know about the difference in time between IR-1 and K3, it depends on the consulate, check on this forum about that, I'm sure you can find a lot of canadians. In Italy, where my consulate is there seems to be no difference in the waiting time for the interview.

I guess your I-130 following the new guidelines has been retained from USCIS because you filed the I-129F. Honestly I don't know what is best. How to activate the I-130 again and how long this would take. If I were you I would call USCIS and see what they say about it (probably nothing).

Sorry, I hope somebody here in the forum has some experience about asking to "activate" the I-130 again...

Yes it's normal, now all the I-129F forms are processed at California Service Center. Actually now everybody needs to submit it there.
For your I-130 call NVC with your CSC case number and ask for your NVC case number (it's an automated message) so you'll know where you stand

Hi, I did travel and the point is that you need to show them that you have good reason to come back to your home country and that you will not immigrate. So if you have a home, a job a bank account. Bring with you all the evidence that you are not going to immigrate on that trip.

It's not illigal to try but it might be a waste of time and money, it's a risk, the only thing is that you have to be totally honest with the officer. I did try and it worked... I read several cases of people that did it... it's your choice. We can only tell you that it is not illigal to try.

A joint sponsor could be a solution. Unless he works for an american company and he will have the same job in the US his income don't count. His assets do though. Everything that can be turned into cash within 1 year counts for the affidavit. We put my bank account on my wife's I-864 (she is the USC). You can be in Ireland and try DSC which is actually way faster.

Honestly I would wait and go for DSC after you guys get married, if you plan to stay for 2 years you have plenty of time to file! Don't stretch the immigration laws...

K-3 Spouse Visa Process & ProceduresWhy did I get an Affadavit of Fee Bill (I-864) when I am going for the K-3?
Ok, it's a bit confusing. You received the NOA2 for I-130, and it went to NVC. NVC processes the I-130, you have to pay the 70$ fee + 380$ fee + send all docs (I-864, D23032 and DS230) than it goes your embassy. The 129F just makes a pitstop at NVC get a case number and goes to the embassy. Which kind of approval did you get? If you go for K3 (I-129F) you will have to pay the fee later and show the embassy all the docs. They do the job that NVC does.

From your post it seems that your received both NOA2, so the I130 is still at NVC for processing while the I-129F will only stop there for probably a shorter time.

NVC will process both petition unless you write them a letter stating that you would like them to hold the I-130 because you are going the K3 path. Which from July 30th cost more than 1000$ in fees for adjustment of status.

Hi, yes you can be the choice of agent.
If you decide to go for IR-1 or CR-1 (depending on how long you have been married), once you will receive the NOA2 your case will move to NVC, there they will send a letter to your husband called DS-3032 (choice of agent) he will have to put you as agent (it's pretty common, that's what we have done too).

You can choose, K-3 at the moment doesn't seem to be much faster than CR-1, but now the rules are different and you can mail both at the same time. Technically K-3 has less steps, there is only a short pit stop at NVC after being approved so it's technically faster. CR-1 is better because your husband will be able to work right away without AOS.

The RFE depends on the docs you sent and it's different for everyone, a friend of ours forgot to include a copy of the passport. It's not necessarily a big deal, comparing your package with the list of required docs is the best advice.

I was advised not to so I didn't but a lot of people use a copy of the cashed money order as prove of filing the I-130 and I have read some threads suggesting to file the I-129F without any prove as now they end up in the same place. we still filed the I-129F just to be on the safe side in case the first got stuck somewhere to me it was better to have two horses running.

File in the UK, the DCF doesn't take as long as the other process. Don't try to fraud the US immigration, never.

You guys can also ask for a tourist visa in the mean time if you need to be in the States for 90 days during the process. I know that they say that they will not grant those during the process but they did it for me. All they wanted to know was that I was not going to try to trick them.

As long as you are on the plane you will not have overstayed your visa. I had the same problems years ago because of a flight cancellation so I asked an officer and the answer was that they do understand that there could be problems. Don't stay here and try to fool them changing your status, you are better off explaining your situation...

Hello, I really need some help here.
I came to the U.S. from Canada on September 30th 2009 on a b-2 visa for 6 monthes. I showed the poe agent my return ticket and he stamped my Visa till March 30th (today) I just realized that my flight leaves here at 11pm so I will still be in the U.S. on the 31st. I have to stop in Phoenix and Philadelphia on the 31st before returning to Canada.

So my question is: Will I have overstayed my Visa and be banned from coming back?
Should i just stay and start the immigration process?

Please help cause I'm not sure if I should get on the plane or not tonight.

P.S. I got married to an American citizen on March 15th.

According to my personal experience I can tell you that after applying for CR-1 and K3 Visa, back in 2007, I was able to receive a tourist VISA to come and visit. I am not sure were you read that applicants cannot get one. I can say that it will be hard because your fiance will have to prove that she is not willing to trick the system, but it is not impossible. I talked to the embassy directly and I was granted a tourist visa.

Anyway I cannot assure she/he will get one but it is possible to try

Hello All,

So I am at a stage where I have to fill out I-864 form. I have not filed for taxes for last 3 years because I have not worked due to finishing college. Now is it required by law that I have to fill out I-864 form even though I did not file for taxes? Also my uncle is helping me as a joint sponsor (who meets 2009 proverty guidelines) for my spouse. Is it OK for me to just submit my uncle's I-864 form and not mine?

As far as I remember it is fine, as your uncle is the sponsor he is taking responsibility for your spouse. I assume you should file a statement explaining why you did not file taxes, but yes put your uncle info as he is the sponsor.
