National Visa Center (Dept of State)missing documents question
My case was completed yesterday(november 22nd). the lady said its waiting to be scheduled an interview date. NVC does that on the 2nd week of each months. I will have to wait till the second week of december to know my interview date. The lady also told me that I can call the US embassy in Ankara to reschedule the date to a closer date.

National Visa Center (Dept of State)missing documents question
OK some more updates....

My mails finaly made it to NVC (or they made it to nvc way back but nvc just picked them up) on the 9th of november. Now they have everything they needed and processing my case. I was told I should allow 2 to 4 weeks for them to review them. Its already been 2 weeks almost, so i should hear from them soon(hopefully). Well all of the extra stuff they ask for turkish citizens, which makes everything take longer and harder, there is one good thing they do, they schedule the interview dates right on the same day they complete the case. So i can know my interview date when my case completed by calling NVC.

And i have just gotten some info from the US embassy in ankara. there are about 70 K3 applications and 7-8 Cr-1/Ir-1 applications per year. Which is not bad at all. But they still schedule the interview dates 2 months or so ahead.

National Visa Center (Dept of State)missing documents question
Ok some updates

NVC sent out a check list on OCTOBER 3RD , that our I 864 package was incomplete. I called NVC on OCTOBER 5TH and asked them whats missing and mailed the missing documents on OCTOBER 6TH.

then NVC sent out another checklist on OCTOBER 14TH, the originals of birth and marriage certificates were missing( i gave them certified copies in the package) so i sent the originals on OCTOBER 18th.

Now it has been 4 weeks since i mailed the missing documents for I864 and over 2 weeks for DS 230.

Still they havent gotten them or they are not entered into the system yet. The officer told me they would wait for both mails to reach them then they would process them which is an additional 2-4 weeks process.

the officer also said they recieve 1000s of mails everyday in their mail box, but it takes 2 to 4 weeks for them to get to officers due to high volume of mails.

So in these cases. they have the missing documenst for I 864 already(since it has been 4 weeks) but they are waiting for the missing documents for ds 230 to get to them(probably in anyday next 2 weeks). then they will process them together.

I asked the officer how long would it take to process such documents, he didnt give me any clue.

here is what i think . I mailed the documents on the october 18th, in the morning. It reaches to NVC on the same day or next morning, so lets say its in the mail box on 19th for sure. then maximum of 4 weeks for them to recieve it . thats novermber 18th. then 2 to 4 weeks process time. anywhere between december 1-18th.

Does any of you has anything to add to this ? any opinions? or any part you think i am wrong?

any info will be apriciated

thanks

what is a certified copy then? if not noterised? noterisation is the most accepted way in all around the world.

National Visa Center (Dept of State)missing documents question
they were noterised. all the copies we sent were noterised copies. they asked for the originals to send to turkey. the officer said they can only send the originals to the embassy. the officer also said allow 2 to 4 weeks for them to recieve them. its already been 2 weeks she said call back after 2 weeks to confirm they recieved it.

National Visa Center (Dept of State)missing documents question
OK i called NVC a few seconds ago , Just to get some detailed info about the process. here is how the officer explained.

Due to high volume of mails they recieve, i should allow 2 to 4 weeks for them to recieve the mail. (so the mail is not lost, its sitting there somewhere, waiting for its turn to be processed) once they recieve the mail , i should allow 2 to 4 weeks for them to process the documents.

so the total process should take 6 to 8 weeks.

here is my advice. make sure you send all the necessary papers along with your ds 230 and i 864 packages. you dont really want to get a missing documents list. it delays everything upto 2 months and mostlikely not less than 1 month. i know this is crazy but because of nvc 's mistake i will wait 2 months for these missing documents.

good luck to everyone

alix, you probably didnt read it well. it has been already 2 weeks since i sent them. My wife lives in Massachusetts and NVC in NH, its only 1 hour away. The regular mails reach to NH on the same day or the next morning due to the short distance.

THe originals of the marriage and birth certificate is something for the embassy in ankara/turkey and some 8 others countries (also the ones in africa) NVC sets the interview dates and sends all the documents needed at the interview to the embassy directly. The officer told me there is nothing to review on them but they need the original documents to send to the embassy along with the package.

well for the how long part. the automated system says 6to8 weeks but i talked to the officer she said no its 2 to 4 weeks not 6 to 8. I called the nvc today again, they said they dont have it in the system.

maybe they do have it but sitting on the desk waiting to be reviewed and put in the system.

well for why we didnt not provide them the originals at first place. Because they did not ask us to. the list was clear and we provided everything they asked. my wife went to the town hall and asked the person there who helps with the immigration issues. and they said we have everything they need and everything is done correctly. we also called nvc and double checked all the items . but after 1 month of waiting they asked for the originals.

well above explanation was what they told me , for those 8 countries nvc sets the interview dates and they need the originals to send to the embassies.

National Visa Center (Dept of State)missing documents question
the originals of the marriage and birth certificates were missing. we gave them certified copies. it has been 2 weeks now and i called the nvc today they still dont have them yet. The post office is sure that they delivered it the next day(about 2 weeks ago) . what kind of mail pick up service does nvc have? this is not the first time it takes weeks for them pick up the mails from their mail box, or its sitting on somebodies desk , waiting to be put in the system.

what kind of work could they be doing on the marriage and birth certificate. they had the certified copies they could work on them and when they got the originals , put them in the case folder and complete it. they are just making things more complicated.

the whole packages were supposed to take 2 to 4 weeks(864 and 230) . missing a few papers shouldnt be more than a few days. this sounds like kinda a punishment for those who sends incomplete packages. 1 month more waiting for each missing document.

nvc was kinda fast in september now it slowed down to halt again.

National Visa Center (Dept of State)missing documents question
we submited the ds 230 and i 864 with all documents asked some weeks ago. NVC officer told me it would take 2 to 4 weeks for them to review them before they could send them to the embassy where i will be interviewed.

well it has been over 4 weeks and i called them last week. the officer told me there were some missing documents. they wanted the originals of the marriage and birth certificvates. My wife mailed them the next day. and now it has been a week i called them last friday the officer told me they still did not get them but i am sure they do have it . i called the post office and they said it was delivered the next day 9 am in the morning.

anyway this isnt whats bothering me. the problem is the officer said i should allow them 6 to 8 weeks to complete the case after they recieved the missing documents.

why is it 6 to 8 weeks now? they said 2 to 4 weeks when they had none of the ds 230 and i 864 and now after 1 month of review there are 2 documents misiing and they need 2 months to complete the case.

it doesnt make sense at all.

is there anybody with such experience and how long did you really have to wait?

thnx

People at the NVC level and the ones who already got their greencards, How many of them doing /did K1? K3? Ir-1/Cr-1?

My I-130 was approved before I-129f(we filed it pretty late), SO I am going for IR1. My case was just completed last week, waiting for an interview date now.

i called nvc today. the lady said NVC schedules interview dates on the second week of each month but they can not guarantee which month urs will be scheduled:) The number of interviews per month is limited , they call the embassy and ask for the available dates, according to that info they schedule an interview date for each case.

NVC will not schedule a date in the same month even if there are dates available . you have to be notified 1 month advance so it has to be the next month the earliest.

My case was completed on Novermber 22nd. I am a Turkish citizen . NVC schedules the interview dates for Turkey, Albania, Canada, Philippines, Lebanon, UAE and the continent of Africa. Could anyone from these countries tell me their experiences about what happens after this point.

I was told that NVC schedules the interview dates on the second week of each month. Mine will be scheduled someday in between December 8th and 14th. And the interview date has to be at least 1 month ahead of the day of notice. But I can call the US embassy in Ankara and ask for a closer date.

DO i need to know anything further or i am mistaken about anything above?

Please help

thnx

One more question.

should I go ahead and have my medical exam done? for how long is the medical exam report valid? seems like I will have my interview in late january or february.

Will I need anything other than the medical exam reports? NVC already have the originals of birth , marriage certificates, police report.

National Visa Center (Dept of State)NVC scheduling interviews in Dec.
I have my interview date available!!! I called NVC yesterday the lady told me they have the date. It was scheduled on the 7th of this month(what a long time to update the system). Its in mid january exactly 2 months and a couple days from when my case was complete. I am sorry for the wrong info above(i told you december 15th) but that was what I really was told.

I think its all different for each nationality and visa type but Canada might be little longer than Ankara as much more applicants from there.

Its really crazy for Abu Dhabi. I guess there are too many applicants from there or the quota is too low. There was about 4800 people which of 1800 were family based got greed card from Ankara embassy last year. I dont have the exact numbers but I believe there were about 7-8 Cr1, 70-80 K1 and 70-80 K3 applicants. DV (lottery people was the majority of these numbers above)

I hope this info helps you to figure out how much longer it may take for you

National Visa Center (Dept of State)NVC scheduling interviews in Dec.
unfortunately they dont update their systems instanly, I called them everyday from the 10th trough 24th. My case was complete on the 22nd however 24th was the date I was told the case was complete. The automated system takes couple more days to update.

You are right they dont usually say much. But calling 4-5 times is really nothing if you want to get some info. I called NVC everyday and most times they told me nothing other than you have to allow 2-4 weeks or 4-8 weeks blah blah. But for a couple of times I had happened to happen some nice people who gave me some more info than usuall.

While I was talking to these NVC people , I noticed some of them were really experienced and knew everything. Those probably work on cases and sometimes answer phones I guess. but some of them were nothing more than me, they said they just answer phones and give info from the system, they dont know anything on how process goes. If you have questions , email NVC. Maybe they didnt want to say much. Who knows...

I am also waiting to be scheduled for an interview. I have called NVC several times. The officer told me they schedule interviews on the 15th of december. I know its not the second week of the month but that is the responce I got from her and I asked couple more times to double check if I got it right. Friday is the 15th, call NVC Friday night or Monday, I think we should allow a day or two for NVC to update their systems. Here is how they line up cases. My case was completed on the 22nd of novermber, so people whose cases were complete between 16th and 21st will get an earlier date however my interview should be sooner than the ones compelete at or after 23rd. NVC says they will try to schedule the interviews for the following month which is january in this case, however the number of interviews available limited . NVC does not guarantee a date in january. My embassy is Ankara , the officer said Ankara gives them plenty of date available , mostlikely my interview will be in january or early Feb. But I dont really want to keep my hopes high, during this long visa process I have learnt not to be dissapointed:)

Call back on friday or monday, hopefully you will hear a date.

K-3 Spouse Visa Process & Proceduresprocessing time
well. I have my noa1 (I130) dated feb10th 2006......i go on the link above which says processing times then go on to vermonth service center. and there I 130 for spouse parents child and now processing december 10th 2005 as of may 8th. and it has been december 10th for 2 months.

now i come here to these forums and see people who has noa1 of feb and march got their noa2 in the first or second week of may 2006. is this processing times list not accurate? or i am looking at a very wrong place?

and my wife was directed wrongly at the town hall near her place...the person said K3 was for fiance visa not already married...we found out it was also good for us last month...so filed the form pretty late....we were married on oct 20th 2006 ...filed I130 on feb 10th and may 1st for i129f. now its been 3 weeks we still havent received noa1 for i129f. we also never heard or recieved any anything about the i130 which we filed like 4 months ago.

and one more questions about whats next after recieving noa2 for I130 or I129f(whichever comes first)?

i know its difficult to estimate the wait time for noa2 but is there any estimation for whats after noa2?( when i can enter the US) my consulate will be ankara turkey. and they say things go pretty fast there. and not many people waiting on the list from turkey. well these are all positive i guess but being born in turkey will probably slow down the process.

well recieved noa1 on feb 10th 2006... still waiting ...havent heard anything yet. Our service center was Vermont. It was supposed to be faster than any other. There are people who got later noa1 dates than mine but recieved their noa2 a couple of weeks ago. I dont know what to do.

what does this" touched" means anyway?

well as a summary .....no emails... no mails ...no phones calls recieved...only have noa1 date of feb10th 2006 and still waiting.

I think they lost my file lol
otherwise if anything was missing or bad, they would have asked for rfe or something already.

any opinion on this is appriciated and also any advice.

thanks in advance

K-3 Spouse Visa Process & Proceduresjust wondered...
Your wife/husband can visit USA with their EU passport for 3 months without ever stopping by an embassy.

Just imagine other people from other countries which the US requires a visa. And when they apply for the visa, they hear " you must wait for your immigrant visa to be issued"

So pleasee people, dont cry too loud. If someone has to cry, those are the ones from poor countries which the INS does heavy research on them and much harder give them their visa. And definitely no visit during this wait.

Ohh especialy Canadians, pleaseee. You guys are only hours away from the US border. And most of the time, they wouldnt even ask you for a visa for the passage.

I know I am being rude but crying here in front of peole who are actualy in worst positions is mean as well.

US Embassy and Consulate DiscussionVISA CANCELLATION
I agree with morocco4ever. just canceling the petition is not the solution.

I have a conspracy theory in mind but i wonder if the US embassy would do that.

After you call and let the US embassy know about the situation. She would go on the interview and have a big denial stamp on her passport for 10 years. (that also goes into US immigration records) That will not only keep her away from US consulates for so long, it will also warn the other countries embassies if she ever try to get a visa from them. A denial stamp from USA is a big disadvantage, most embasies ask about the denial and it has a big negative impression in the officers mind (basicaly lowers her chance to 30%). Its also bad at the point of entry.

But these are only if the US embasy wants to give a her a lesson, not canceling the interview but giving a nice stamp on her passport.

well about the woman, she is nothing new, there are many greencard hunters out there. American citizens should pay extra attention to get to know foreigners if they have marriage in their mind. I dont mean to offend foreigners(i am one of them) but there is a lot of fraud going on and this is also why these processes take so long. I have seen a lot of people paying money to american citizens to marry them for the greencard.(more than real marriages actually) And I have seen a lof of people who got married to an american had greencard in their mind instead of love and the american person thought he/she loved him/her

IR-1 / CR-1 Spouse Visa Process & Proceduresinteresting question?
well my wife and i alredy filed for i130 and i129f some months ago. but it seems like its gonna take a while untill i will be able to enter the US( i am turkish, visa is required to enter the us)

my wife is currently going to college in the us and that is why she cant stay with me but she comes here in every break including short 1 week breaks(like spring break lol) And she is coming again on june 2nd for the whole summer.

well I dont think i will get my visa in late august when she has to return to the us ( we filed i130 on feb 10 and i129f on may 1st)

so i was thinking if my wife and i go to the embassy with all the paperwork we have done and ask for a tourist visa, what would the officer say ? lol

i mean its a real marriage , they are gonna give me my visa in sometime anyway lol just the officer how much we love each other and ask for a short term visa ?

would it be so stupid? i dont really want to work or stay on untill i get my greencard....i just want to be able to see her more often.

IR-1 / CR-1 Spouse Visa Process & Procedurestouched 3 days after noa1

we filed the form I130 in the first week of feb 2006. We recieved the recipt and date on it was Feb 13th 2006. When I check the latest update on my case on the online system the date is Feb 16th 2006, 3 days after they issued the Noa1. Since then no updates, no nothing.

is this a good thing or bad? I have seen people with later noa1 dates recieved their noa2 weeks ago. is it possible they just took a look at my case on the 3rd day and threw it down to the bottom of the other cases as they found it one of the least piority cases.

do you think they do this kind of organising and numbering files, which one first which later on?
I dont see any reason checking my case on the 3rd day and then silence for 4 months.

I wouldn't be too alarmed yet. Ours took aprox. 90 days to get through USCIS. I have heard of others sailing through and some that took longer.

it has been 100 days since the receipt date as of today. still waiting.

Relax...

According to the dates.. Vermont are still processing Dec 05 for I-130.. so you wont have recived your NOA2 yet... I believe (and could be wrong)... that the most of the petitions that have been approved faster will be people that DCF....

The NOA 1 just means that your case has been entered into the system and that they will be working on your case...

processing times explains why i am still waiting....ok i got that point.
what I dont get is , how come people with much later noa1 dates could get their case approved much before mine.

What should I do once I get my CR1 ? should I apply for a new SSN? or my SSN is still valid? will i be able to work?

if i have to apply to SS office for changing of status from "not valid for work" to valid for work SSN. how long will i wait?

IR-1 / CR-1 Spouse Visa Process & ProceduresIs it possible to be approved for a green card if my wife owerstayed her visa before?
My friend had a similar situation. I hate to say this but they mostlikely wont care about you situation why you had to overstay. Once INS (now homeland security) got you, they dont want to let you go easy. They are going to tell you why didnt you apply to INS and ask for an extention on your visa and stuff(thats what they said to my friend, and he was involved in a car accident, he was in hospital for 20 days while his visa expired and only overstayed 50 days) they said you should have send someone to notify us for your overstay.

well they have their reasons. Visa is given for a purpose , either travel or education or business and you simply state how long visa you want. any extra day you spend in the US, they want to know what you are doing.

It was only 50 days so they didnt give him any bar but he went back to his country and never be able to get a visa again. each time they gave him no reason but rejected the visa.

however you are planning on a marriage, so its a different story. you should be able to do this waiver thing. but i heard it takes some months.

maybe its better for you to go for CR1 through USA not embassy. i am not sure but if you do DCF and the embassy rejects you cant apeal, but when you go through one of the service centers and NVC then embassy, i think you have a right to apeal in 90 days after the rejection. but it will be much more than 4-5 weeks .

you need a family immigration lawyer i believe

IR-1 / CR-1 Spouse Visa Process & Procedures...denied
the denial is possible for everyone, there could be millions of explanations for a visa denial but a ban forever, there should be too many reasons for that. What could result in a ban for all life? I know that if you violate immigrations laws, such as overstaying , working under tourist , student visa etc.., gives you 3 or 10 years ban. but even in these you can file a waiver. Well the reason should be one of the sections on Ds 230 Part II. Most people doesnt have to answer those but I believe they apply to everyone. Some of the sections should get to file a waiver but some of them definitely would result in ban for all life.

I think police document and medical are good for 6 months. I remember i read a post of someone who didnt have papers for the interview but just went to the interview and he had no problems. his name was on the list there. but you should double check this.

It usually take 1 hour maybe little longer. but your embassy might be different.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat is the difference between IR-1 and CR-1?

IR1 = Marrired more than 2 years at time of interview and gets 10 years greencard....

CR1 = Married less than 2 years at time of interview and gets a 2 year conditional Greencard.... conditions have to be removed before the expiration date of the Greencard approx. 1 year and 9 months from the date of issue... if approved at removal of conditions a 10 year Greencard is then issued...

Both a CR1 and a IR1 have the same rights as all Greencard holders...

I have a question about this. its a bit confusing. My Cr1 interview is about 1 monht ahead. exactly 1 year 3 days from the day we got married. So i will be getting CR1 i understand that but will I have to get IR1 2 years after the interview or 1 year since it has already been 1 year from the marriage? I am guessing from your writing its 2 years after probably but it doesnt sound fair. one can apply fo K3 which takes about 6-8 months to get, then go to the US act slow and get the interview date about after second anniversary and directly get IR1 , on other hand people who first got CR1 should wait 2 more years. its 2 years vs 3 years total. you know what i mean?

I dont really care for IR1 as long as i have some sort of visa that i can stay with my wife is fine but i was just curious because it sounded unfair.

IR-1 / CR-1 Spouse Visa Process & ProceduresDoes all of this waiting make since??
Immigration people could pay less attention to DY (lottery) guys and give piority to family based visas. About 55 000 people get greencards through lottery, that means about over 100 000 people in immigration process each year. then the INS narrow that number down, eleminating half of them through the process. That is a big number. And guess what? they have the piority. I know many people who won the lottery and they got their interview in less than 1 year. I can tell you the numbers for my embassy. Last year about 5000 people got greencard from Ankara and 1200 of them were DV guys. If there was no lottery or at least they had the least piority, things would be faster by 30 % or so. I am not saying they should stop the DV. but they should reconsider who got to get the visa first.

well someone above said they deal with 100s of paperwork everyday...Ok we all know that... They can ask for higher fees and hire more people to get things going. and i am sure no one would mind high fees if they knew they could get the visa in matter of weeks , not months.

as someone else above states, for Uk it takes couple days. Yes it is correct. The Us immigration is the slowest, takes months . the second slowest country it takes weeks. My wifes brother works in administrative business. he says all this work takes about 1 hour. well the thread starter said the papers sit on the desk half the time.....she is wrong. they sit on the desk all the time......this complete process is no longer than half day of work, everything included. thats how UK guys handle immigrations matters in 2 days.

there was thread about this and there was some serious facts. It was announced that US goverment will not pay a penny for the immigration. So that the fees we pay should cover our expenses. and when you do the math......170 dollars for I 130......350 IV bill....70 dollars AOS bill.....total of 590 dollars. in this kind of business and their hourly wages.....how many hours do you think 590 dollars can buy? the answer is how much work they put in to your case in all this 10+ process... that simple!!!

its definitely discouraging US people from marrying foreign people. Longer it takes, less people will do it.
